I. INTRODUCTION AND BASIC DATA A. Background 1. The project has been financed under the Asian Development Bank Loan No. 3631-PHI,

to improve national primary, secondary and tertiary roads and bridges in Mindanao, Philippines.

The project is intended to strengthen economic and physical linkages in Mindanao and support

regional co-operation and integration.

B. Purpose and Scope

B.1. Project Objectives

(i) Increased economic growth in Mindanao, by opening and improving its

infrastructure logistics road and bridges; (ii) Support the country’s priorities to improve the overall national Government’s

agenda for Mindanao as set out in the “Ambisyon Natin 2040”; (iii) Achieve high, inclusive, and sustainable growth (iv) Improve the delivery of infrastructure services as well as investing in physical

assets; (v) Support regional cooperation and integration by contributing to the implementation

of the ASEAN Highway and Brunei Indonesia Malaysia and the Philippines – East ASEAN Growth Area (BIMP-EAGA) Priority Infrastructure Projects;

(vi) Support sustainable transport initiative by addressing climate change and road safety;

(vii) Contribute to ensuring resilience in the road infrastructure development in Mindanao; and,

(viii) Improve the Department of Public Works and Highways’ (DPWH) capacity in procurement, construction supervision and implementation of social and environmental safeguards.

B.2. Scope of the Project

2. The project will improve an estimated 169 km total gross length of national primary,

secondary, and tertiary roads and bridges in Mindanao. The improvements will include paving

earth roads, replacing damaged road sections, widening existing roads, adding surface overlays,

and replacing and strengthening of existing bridges. The project roads will be designed with

features to strengthen resilience to climate change. Among the structural and non-structural

features included are elevated pavement levels, enhanced slope protection, and improved

maintenance of drainage structures. Road safety on these roads will be improved through road

safety community awareness campaigns. Three core roads located in the Zamboanga peninsula

in western Mindanao (Region IX), with a total gross length of 80 km, have been appraised for

inclusion in the project. Consultants for the ongoing ADB-funded project prepared the detailed

design for the core roads and will prepare the detailed design for the non-core roads. The

government will propose additional roads, which will have to meet the following criteria to be

included in the project: location in Mindanao, and thresholds of the government and ADB on

economic viability and environmental and social safeguards.

D. Social Monitoring Report: 4. This Semi-annual Social Monitoring Report has been prepared pursuant to the requirements of the loan agreement with ADB and monitoring reporting requirements set out in the respective RIPPs. The semi-annual monitoring timeframe covered in this report is from July to December 2019. This report was finalized in August 2020 from an earlier draft. Some of the targets and actions were revised in the interim to account for the impact on COVID-19 restrictions. 5. This is the second social monitoring report for this project and, it is noted that of the three (3) core subprojects, the Resettlement and Indigenous Peoples Plan (RIPPs) for PR-06 and PR-09 were yet to be approved and implemented and the approved RIPP for PR-07 was yet to be implemented. Hence, this monitoring report informs the general activities related to the RIPPs preparation and other advance actions undertaken along with issues encountered.

II. RESETTLEMENT AND INDIGENOUS PEOPLES PLANS

A. Status of RIPP Preparation 6. Resettlement and Indigenous Peoples Plans (RIPPs) are required to be prepared based on the Detailed Engineering Design (DED) for all core and non-core roads and bridges in the project in accordance with the approved Resettlement and Indigenous Peoples Framework (RIPF). As of this reporting period (July-December 2019), the RIPPs for two core roads (PR06, and PR09) were still under preparation following comments received from the ADB review of the initial submissions. For core project PR-07, the RIPP was approved and published on ADB’s website on 15 August 2019. The processing of payment to the affected persons will commence immediately following the processing requirements at the District Engineering Office (DEO). For the non-core roads and bridges, the DED based RIPPs were at various stages of

preparation and were expected to be finalized early in 2020. 7. In accordance with the national law (Indigenous Peoples Rights Act) and requirements of the project’s RIPPF, clearance from National Commission for Indigenous Peoples (NCIP) is required for subprojects, except for those located within the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM). NCIP clearances were issued for all core projects in April 2019. For the non-core projects, the clearance for Guicam Bridge was issued on 10 July 2020, while for PR 13, PR01a, PR 08, and PR12, the NCIP clearances were issued on 26 December 2019. For Nalil-Sikkiat Bridge, Tongsinah- Paniongan Bridge, and Malassa-Lupa Pula Bridge, NCIP clearance is not required because said bridges are located in BARMM. 8. A summary of the status of RIPP preparation and target dates for finalization is set out in the table below.

C. Issues Encountered on Payment of Compensation, Allowances, and Assistance 10. The following section provides a description of any challenges encountered in disbursing compensation and assistance, along with planned actions to address any issues. 11. Compensation for Land (PR07). Funds for compensation of Land was not yet released to the DEO pending approval of the Entitlement Matrix from the Legal Service. The Legal Service of DPWH gave direction to UPMO-RMC II that the land compensation rates should also be subjected to the appraisal from the Government Financial Institution (GFIs). UPMO-RMC II already sent a letter to Land Bank of the Philippines (LBP) on this matter. 12. Compensation for Structures (PR07). The implementation of the RIPP 07 is delayed due to the following reasons:

➢ Fund allocation for payment of the compensation package for the APs was already fully released to DEO. However, the request of the DEO for the Notice for Cash Allocation (NCA) will only be made available when all the required documents are submitted by the payee and their names will be included in the List of due and demandables as per the process set by the Department of Budget and Management.

➢ There are documentary requirements still being completed by the affected persons (APs);

➢ There are 163 APs that are considered eligible for compensation payment. However, only 94 APs were able to complete the required documents based on the checklist provided to them, and the remaining 69APs are still processing their documents; and

➢ Since only 94 APs were able to complete the said documents, they will be compensated first upon the release of the funds1 because of the accounting rules that the cash should be disbursed within one (1) month. The remaining APs will go through the same process upon submission of the required documents.

D. Resettlement Progress

13. This section provides information on progress of resettlement of households whose houses are fully affected and preparation of the resettlement sites for each respective RIPP. It not only covers those who are relocating to resettlement sites but also those who are self-relocating or reconstructing their houses on residual land outside the project right of way. 14. Two resettlement sites are being developed for AHs in PR07 eligible for resettlement site plots. These are planned to be completed in March 2021. None of those requiring resettlement site plots have yet been displaced. 15. The resettlement site requirements for the other subprojects will be determined as the RIPPs are prepared. 16. Appendix 1 provides progress status of resettlement site preparation.

1 The Department of Budget and Management (DBM) has allocated budget for compensation package. The District

Engineering Office (DEO) submits list of due and demandable accounts payable for DBM to release cash to the Development Bank of the Philippines (DBP). DEO will then issue DBM check payment to PAPs with complete documentary requirements within a month after cash release. PAPs that submit requirement beyond 1 month, will undergo another process of cash release from DBM.

21. To enable advancement of road works on PR06 and PR09, payments were made by the civil works contractor to APs with the following premise:

➢ The payments were selective and only involve trees and crops of particular

affected persons to advance civil works only after arrangement are made with DPWH DEO and RROW Team.

➢ Payments were to be based on the approved entitlement matrix included in the draft RIPPs of PR06 and PR 09.

➢ Payments made on trees and crops were to be paid in full to ensure that the affected persons allow the civil works contractor to cut/remove trees and crops to advance civil works.

➢ Payments were to be made directly by the civil works contractors who have sole responsibility for recovery of the amount paid to the APs in a Deed of Assignment Agreement.2

22. In PR 06, a privately-owned rice field in Barangay Lipacan, Alicia was acquired without full compensation for land but was compensated for crops. DPWH guaranteed that payment will be made in early 2020. The price of the crops was based on the valuation submitted by the Independent Land Appraiser in the Entitlement Matrix. The process of the payment of the land will commence upon the approval of the Entitlement Matrix submitted to the Legal Service to request for Fund Allocation. Once the name of the Lot Owner is included in the Entitlement Matrix, they will be included in the List of Due and Demandables for the request of Notice of Cash Allocation (NCA). Their names cannot be altered or else the DEO will request for a change of creditor to DBM or in no way can be assigned to another name of person as claimant/payee. 23. Due diligence and corrective actions, if needed, will be reported in the next SMR.

III. CONSULTATIONS AND KEY DISCLOSURE ACTIVITIES A. Consultations

24. Seven rounds of consultations involving a total of 31 sessions and 2,577 participants were

conducted with the affected persons during the reporting period. These were conducted to

prepare the RIPPs and covered status of the project, scope of land acquisition, entitlements, and

requirements to process compensation, resettlement arrangements and livelihood restoration

preferences. A summary of the consultations conducted is set out in the table below. Consultation

records of these meetings will be included in the respective RIPPs.

25. During the next reporting period, consultations activities will focus on:

(i) pending RIPP preparation requirements in PR06 covering relocation and livelihood

restoration; (ii) consultations to prepare the RIPPs in non-core subprojects, including project

description, implementation arrangements, survey and valuation activities, resettlement and livelihood restoration planning, entitlements and GRM; and

(iii) Compensation disbursement, RIPP implementation requirements in preparation for site clearance and civil works, works schedules, resettlement site finalization, and commencement of livelihood restoration activities. A consultation plan has been prepared for each of the RIPPs to guide consultation activities during RIPP implementation.

26. An approved information material in the local vernacular was given to the Contractor on

September 24, 2019 during the monthly progress meeting for production and distribution to the

Narrative Summary of Grievances

29. While no formal grievances were lodged during the reporting period, LGUs did express

concern over mobilization of the contractor, prior to RIPP implementation in PR06 and PR09 and

initial clearing and grubbing works in sections where the contactor had undertaken advanced

payments of crops (see related discussion above). (Subsequent to the reporting period, DPWH

was informed by ADB to cease such clearing of property in advance of DED based RIPP approval

and implementation. Requirements for due diligence reporting will be covered in the subsequent

SMR for period January to June 2020.)

Appendix 1: Resettlement Site Development Progress The following provides a description of resettlement site development and will be updated for each SMR.

PR 07 - Tampilisan-Sandayong Road Resettlement Site

A. Site description

1. Relocation sites for PR 07 are situated in Barangay Situbo, and Barangay New Dapitan.

The respective local government unit issued a Resolution designating the area as relocation site for 8 PAPs eligible for relocation.

(i) Barangay Situbo Resettlement Site

2. The relocation site is 20m away from the main road and located in the center of Barangay whereat the barangay health center is located. The site has access to electricity and power distribution lines provided by Zamboanga del Norte Electric Cooperative. A natural spring near the site provide water for domestic use.

(ii) Barangay Dapitan Resettlement Site

3. The resettlement site in Barangay New Dapitan has a total area of 10,000sq.m. The site is located near the barangay road, about 50m distance from the barangay road

B. Status of site preparation

4. Overall actions required to develop and complete infrastructure for resettlement site. The resettlement sites already have road access to the sites and main electricity distribution lines are provided by Zamboanga del Norte Cooperative (ZANECO). Assistance will be provided to APs to connect electricity to their houses. Both Barangays have their respective water systems. In the New Dapitan site, APs can connect to the barangay’s articulated water supply system. Water source is a deep well. In the Situbo site, APs can also connect to the existing water supply system being run by the barangay. The New Dapitan site will require some filling and levelling. The filling material is readily available from excavation works being undertaken at the barangay hall. The Situbo site, on the other hand, is a slightly elevated area and will just require clearing. Both sites will need construction (grading) of an access road into the sites from the main roads (50m for New Dapitan and 20m for Situbo).

5. Overall number of plots to be developed and households to relocate

• 3 plots (10x10m each plot) are designated for 8 Households in Sibuco

• 5 plots (124m2 each plot) are designated to 5 Households in New Dapitan
