2014OVERVIEW:REAFFIRMEDPRINCIPLES,NEWDIRECTIONSAstrategicplanningexercisein2014sawarestructuringofEMPOWER’sworkintothreeinterlinkedthematicareas:PoliticalParticipation,andEconomicEmpowerment,CivilLiberties.

Under Political Participation, the IKAT programmeended in 2014 with a number of regional-levelactivities. In the same year EMPOWER beganengaging with a new constituency: Orang Asliwomen leaders and activists. The organisation alsotookup the issueof sexistandmisogynisticattacksagainstwomenpoliticiansduringtheTelukIntanby-electionandtheSelangorpoliticalcrisis.BERSIH2.0saw three momentous occasions: theannouncement of the verdict of the People’sTribunalonGE13,thelaunchofDART,andamassivefundraisingeffort.

EconomicEmpowerment isanewareaofworkforEMPOWER.Thiswasundertakenbasedontheorganisation’s engagement with participants of its Women’s Political Participation programme,manyofwhomwere from low-income communities. Formanyof theparticipants, experiencesofgender discrimination, poverty, and economicmarginalisation are inseparable in their daily lives.EMPOWER plans to begin documenting women’s experiences of poverty and economicmarginalisationin2015.2014 saw several new developments in the area of Civil Liberties. EMPOWER begun the long-delayedAPC IMPACT (India,Malaysia, Pakistan Advocacy for Change through Technology) projectwith the Association of Progressive Communications, Bytes For All (Pakistan) and DigitalEmpowermentFoundation(India).Asaco-secreteriatofCOMANGO,EMPOWERcarriedoutlobbyingand follow-up activities aroundMalaysia’s 2nd UPR, in the shadow of a January statement by theSecretary-Generalof theHomeMinistrywhichdeclaredCOMANGOtobean“illegalorganisation”(“pertubuhanharam”).InJuly,EMPOWERbecameafoundingmemberofaloosecoalitionsetuptofightpunitivesanctionsbytheauthoritiesagainsthomelesspersonsandtocallfortheabolishmentoftheDestitutePersonsAct 1977. Later in the year, following a spate of crackdownsunder the SeditionAct, theGerakanHapus Akta Hasutan (GHAH) civil society coalition was formed. EMPOWER is a member of thiscoalition. In addition, EMPOWER was substantially involved in the ACSC/APF 2015 process asMalaysianCSOspreparetohosttheevent.The 2014 strategic plan alsomappedout a three-year communications strategywith the goals ofincreasingtheorganisation’svisibility,maintainingthevisibilityofwomen’shumanrightsasapublicissue, and establishing a conversation on women as an electoral interest group before the 14thGeneral Election in 2017-2018. The organisation’s primary audiences under this strategy includegrassrootscommunities;urbanandruralpublicinthestatesofSelangor,KualaLumpur,andPerak;elected representatives, political parties; local and state governments; and other civil societyorganisations.As part of the organisation’s communications work, EMPOWER’s website has been completelyoverhauledtoreflectitscurrentthematicareasandtobetterhighlightitsexistingresources.

1.POLITICALPARTICIPATIONEMPOWER’s political participation programme is aimed at creating a critical mass of womendecision-makerswhowill promote and implement gender-sensitive policies and laws alignedwiththe principles of equality and non-discrimination. Ultimately, this will ensure that women –especially women frommarginalised communities – participate fully in democratic and decision-makingprocessesatthelocalandnationallevel.The barriers towomen’s political participation long identified by EMPOWERwere evident in theeventsthattriggeredtheorganisation’sinterventionsintheTelukIntanby-electionandtheSelangorpoliticalcrisis.EMPOWERheldajointpressconferencewithPerakWomenforWomenSocietyon28May to denounce the barrage of sexism and sexualised language directed against a womancandidate, including from supporters of her political party. The necessity of moving forward thediscourse onwomen in politicswas further highlighted by the double standards andmisogynisticattacks facedbyawoman“MenteriBesar” (ChiefMinister)candidate inSelangor, includingclaimsthatshewasunsuitableforofficeduetomenstruationandthatshewouldbeunabletoaccompanythe Sultan of Selangor on official duties. EMPOWER released a number of statements to countertheseregressiveclaims.ThevisibilityofEMPOWER’spoliticalparticipationprogrammein2014wasaidedbymediaattentionaroundtheby-electionandpoliticalcrisis,aswellasaseriesofinterviewsbyDurianAsean.com,anonline radio station. EMPOWERcontinued in2014 theStrengthenCapacitiesandAdvocacyofOrangAsli (Indigenous)Women to Articulate Human Rights and Democracy programme, which commenced in 2013. Afocusgroupdiscussionwasheldwith12participantsfromMelaka,PahangandNegriSembilanon27ApriltomapoutissuesofconcernamongOrangAslicommunitiesanddeviseatrainingmoduletosuit their political, social, and economic environment. This was followed by a Women’s PoliticalParticipation training in Kuantan on 22-23 June with 31 participants, incorporating stories andexperiencesofOrangAsliwomen.Theworkshopdrewoutmorechallengesfacedbythecommunity,includingissuesoflandrights,autonomy,andthestatusofwomen.

AworkshoponDocumentation andMonitoringUsing Technology and Substantive Legislation andInternational Instrumentswasheldon19-21Septemberwith12participants fromNegriSembilan,PahangandMelaka.Thetrainingfocusedonthedocumentationandmonitoringofcasesandhumanrightsviolations,withsessionsontheAboriginalPeoplesAct1954,CEDAW,UNDRIPandUDHR.Aspart of the ongoing follow-up from the training, participants documented on video the strugglestheyfacedasOrangAsliactivists.Theresultshavebeenputtogetherintoadocumentarythatwaslaunched on 10 December, titled “Kami Wanita Orang Asli, Dengar Suara Kami!”:http://youtu.be/iJrVFXILZxMEMPOWERsaidgoodbyetothe IKAT-Kemitraanproject in2014,closingasignificantchapter in itshistorywithanumberofregionalactivitiesandmeetings.On27-28February,EMPOWERattendedthe IKAT Workshop for Building the Capacity of Elected Members of Parliament in Bali with itsinvitees:KasturiPatto(MPforBatuKawan),TiewWayKeng(StateAssemblypersonforTeratai),andNormawatibintiGhazali(AdministrationOfficeroftheOfficeoftheMPforSubang).TheworkshopfocusedontheroleofParliamentsandelectedrepresentatives.Asan IKAT-Kemitraanpartner, EMPOWER’sExecutiveDirectorMariaChinAbdullahwas invited toattend the Civil Society Experience Summit, co-hosted by Regional DevelopmentMission for Asia(RDMA)andtheUNDP’sRegionalCentreinBangkokon27-29May.Finally,tocloseouttheproject,the“WomeninPoliticalLeadershipinSoutheastAsia2014:Experiences,ChallengesandStrategies”Regional Conferencewas held in Bali on 24-26 August. EMPOWER attended the conferencewithFuziahSalleh (MemberofParliament forKuantan),Rodziah Ismail (StateAssemblyperson forBatuTiga),andDyanaSofyaMohdDaudoftheDemocraticActionParty,whoacceptedtheorganisation’sinvitationtotheevent.Allspokeonpanelsduringtheconference.The Coalition for Clean and Fair Elections (BERSIH 2.0) Secretariat – placed under the ElectoralReform programme – had a busy year. It started offwith the 9March launch of theDelineationActionandResearchTeam(DART)initiative,aimedatensuringfairandconstitutionaldelineationbytheElectionCommission.In2014,DARTcarriedouttwophases:PhaseIconsistingofanation-wideeducational roadshow,andPhase IIwhich consistedof thedrive to ‘recruit’ asmanyvoters tobeobjectors.PhaseIIIisexpectedtobeginin2015.The launch of DART was swiftly followed by the announcement of the verdict of the People’sTribunalonGE13,heldon25March.Itsreportwasreleasedlaterintheyearandisavailableonline.Anothersignificanteventwasamassivefundraisingcampaign,culminatinginadinneron8August.For a more detailed annual report for BERSIH 2.0, please refer to: http://www.bersih.org/bersih-annual-report-2014/

2.CIVILLIBERTIESEMPOWER focuses on three aspects of civil liberties: freedom of expression, freedom ofinformation, and freedom of association. Programmes and activities under this area of work areaimed at opening spaces for diverse voices in Malaysia and strengthening the protection offundamentalrightsandfreedoms.In 2014, the APC IMPACT (India, Malaysia, Pakistan Advocacy for Change through Technology)project began in earnest. Carried out in partnership with the Association of ProgressiveCommunications,BytesForAll(Pakistan)andDigitalEmpowermentFoundation(India),APCIMPACTaimstoaddressrestrictionsontheinternetbypromotingandprotectinginternetrights.Underthisproject,twomeetingswithprospectivenational-levelprojectpartnerswereheldon12thAugust and 25th November, leading to the setting up of a National Steering Committee. IssuesspecifictoMalaysiaidentifiedthroughthesemeetingsinclude:

• IncreasedsurveillancebytheStateoninternetusers;• Harassmentofinternetusersincludingraidingofofficesandconfiscationofcomputers;• Blockingorrestrictingaccesstowebsites;and• Prosecution of internet users over statements and/or remarks deemed seditious and

threateningtonationalsecurity.EMPOWERalsobegunworkonacountryreportforMalaysiabasedontheLaRueFrameworkaspartofthisproject,tobelaunchedatanationalconsultationin2015.EMPOWERwasoneoftheorganisersoftheRegionalConferenceonMediaandInternetFreedom2014 (MediaNetAsia2014),with theAPC,Centre for Independent Journalism (CIJ),Centre for theStudy of Communications and Culture of the University of Nottingham Malaysia, and SoutheastAsianPressAlliance(SEAPA).Theeventwasheldfrom15-17October.Organisingandparticipatinginthe event created an opportunity for EMPOWER to network with diverse groups and individualsworkingwithin the largerambitofmediaand internet rightsand freedoms in theSoutheastAsianregion.Asoneoftheco-secretariatsoftheCoalitionofMalaysianNGOsintheUPRProcess(COMANGO),EMPOWERhadabusyandchallengingfirsthalfoftheyear.InamediastatementreleasedinJanuary2014, the Secretary-General of the Home Ministry declared COMANGO to be an “illegalorganisation.”InFebruary,however,itappearedthatthestatementontheHomeMinistry’swebsitehas been quietly amended to remove the phrase “COMANGO dengan itu merupakan sebuahpertubuhanharam”(“COMANGOisthereforeanillegalorganisation”).The serious backlash against human rights faced by COMANGO in 2013 from fundamentalist andethno-nationalistgroupscontinuedin2014,particularlyaroundtheadoptionoftheoutcomereportonMalaysia’s2nduniversalperiodicreview(UPR)bytheHumanRightsCouncilinMarch.COMANGOmadeaconcertedefforttoengagewithembassiesinMalaysiaandtoconnectwiththeUNhumanrightssystemattheHRCsession.EMPOWERwasrepresentedbyamemberandastafffortheCSOlobbying in Geneva, where Communications Officer Yasmin Masidi delivered a statement onindigenousrightsandtherightsofnon-citizens.EMPOWERorganiseda follow-upeventafter theadoptionof theoutcomereport: theCoalitionofMalaysian NGOs in the UPR Process (COMANGO) Consultation on Monitoring UPR

Recommendations on 4-5 August. Malaysia’s acceptance of UPR recommendations wasdisappointing in some areas, particularly recommendations that required concrete timelines andactions.Attheconsultation,COMANGOendorseesagreedtosubmitamid-termreportin2016andtomonitorMalaysia’simplementationofUPRrecommendationsinfivethematicareas:

• CivilandPoliticalRights• Economic,Social,andCulturalRights• Groupingsofpeople(Women,Indigenous,Disabilities,Asylumseekers,Refugees)• Institutionsandmechanisms• FreedomofReligionandRacism

2014alsosawtheformationofnewcivilsocietycoalitionstoaddressspecifichumanrightsissuesinMalaysia.InJuly,followingreportsofsanctionsagainsthomelesspersonsandsoupkitchensinKualaLumpur, a loose coalition of NGOs and other groups working on issues of homelessness wasformed.Itsoonbecameobviousthattheproblemwasmuchbiggerthanasimplebanagainstsoupkitchens operating in certain areas. The authorities had been carrying out operations against thehomelessundertheheDestitutePersonsAct1977,whichallowstheGovernmenttoround-upandforcefullydetainthehomelessinrehabilitationcentres.EMPOWERwasafoundingmemberofthiscoalition,latercalledtheCoalitionoftheUrbanPoor.Thecoalition called for the abolishment of theDestitute Persons Act and formeaningful consultationwith the homeless community before enacting relevant laws and policies. The coalition alsosubmitted informationtotheUNSpecialRapporteurontherightofeveryonetotheenjoymentofthe highest attainable standardof physical andmental health during his country visit toMalaysiafrom19Novemberto2December.EMPOWERalsobecamepartofanewly-establishedcivilsocietyinitiativetoabolishtheSeditionAct1948,theGerakanHapusAktaHasutan(GHAH,AbolishtheSeditionActMovement),launchedon15September.TherewasadramaticincreaseininvestigationsandprosecutionsundertheSeditionAct,with44personschargedor investigatedin2014comparedto15cases in2013and7 in2012,necessitatinga strong civil society response.On16October,GHAHmembers includingEMPOWERparticipatedintheBarCouncil’sWalkforPeaceandFreedom,callingfortheabolitionoftheSeditionAct.

Organisationswhoattendedthemeetingrepresentedawiderangeofhealthconcerns,frompersonsindetentiontoenvironmentaldegradation.Finally,EMPOWERlooksforwardtotheASEANCivilSocietyConference/ASEANPeopleForum2015to be held in Malaysia, and seeing the results of its engagement with ASEAN process in 2014.EMPOWER is part of the thematic groups for elections and democracy as well as FOE/FOI/FOA,drawingonitsengagementwiththeissuesandotherCSOsthroughBERSIH2.0andAPCIMPACT.Theorganisation participated in the two regional consultations for ACSC/APF 2015 that were held in2014,anditsExecutiveDirectoralsotookpartintheDialoguebetweenCSOsandASEANSecretary-General and ASEAN Secretariat on Human Rights, Jakarta, in October. Unfortunately, Maria ChinAbdullahwasrejectedastheMalaysianCSOrepresentativefortheInterfaceMeetingbetweenCivilSocietyandtheASEANHeadsofState inMay,whichdrewcriticismfromtheMalaysianACSC/APFnationalorganisingcommittee.
