    1. Performance Measure Targets. The following is a listing of the key performance target levelsfor the Animal Health Commission. It is the intent of the Legislature that appropriations made bythis Act be utilized in the most efficient and effective manner possible to achieve the intendedmission of the Animal Health Commission. In order to achieve the objectives and servicestandards established by this Act, the Animal Health Commission shall make every effort toattain the following designated key performance target levels associated with each item of

    appropriation.

    3. Unexpended Balance Authority: Within the Biennium. The Texas Animal Health Commissionis hereby authorized to carry forward and is hereby appropriated any unexpended balances fromfiscal year 2012 to fiscal year 2013.

    4. Laboratory Testing. It is the intent of the Legislature that laboratory testing for animal diseasesbe performed at the Texas Veterinary Medical Diagnostic Lab (TVMDL) to the extent of its

    capabilities, unless the Texas Animal Health Commission (TAHC) State-Federal Laboratory canperform the testing for TAHC programs more cost effectively. Furthermore, the TAHC will usefunds appropriated by this Act to enter into an interagency memorandum of understanding to workwith TVMDL to reduce duplication and ensure that all testing is performed in Texas to the extentpossible.

    5. Testing and Immunization of Employees. Funds appropriated above may be expended for anyimmunization or testing, which is required of employees at risk in the performance of their duties.

    6. Fee Revenue: Poultry Registration. Included in the amounts appropriated above out of theGeneral Revenue Fund is $37,705 each fiscal year in Strategy A.1.1, Field Operations, from feescollected pursuant to Agriculture Code 161.0411 for the purpose of administering the poultryregistration program.

    7. Contingency to Increase the Full-Time-Equivalents (FTE) Cap for Federally FundedPrograms. Contingent upon the receipt of federal funds above those appropriated in this Act forprograms related to animal identification or surveillance, control, or eradication of animal healthpests or diseases, the Texas Animal Health Commission is hereby authorized to increase itsnumber of FTEs to the extent that federal funds are allocated for salary costs. These FTEs shallnot be counted against the agency's "Number of Full-Time-Equivalents (FTE)" cap.

    The Texas Animal Health Commission shall report all additional FTEs authorized by thisprovision to the Comptroller of Public Accounts, the Legislative Budget Board, and the Governorprior to filling a position described by this rider.

    8. Allowance for Personally-Owned Horses. Funds appropriated above may be expended toprovide an allowance not to exceed fifty dollars ($50) per employee per day for each Commissionemployee whose duties require the use of a personally-owned horse.

    9. Collection of Revenue from Laboratory Testing Fees Applied to Out-of-State Clients. Anyfees collected by the Texas Animal Health Commission for the purpose of reimbursing the state-federal laboratory system for laboratory tests performed on samples from other states are herebyappropriated to the Texas Animal Health Commission for the biennium beginning September 1,2011 and ending August 31, 2013 (estimated to be $0).

    10. Contingency Appropriation: Cost Recovery for Animal Health Programs.3 In addition toamounts appropriated above to the Texas Animal Health Commission (TAHC), there is herebyappropriated out of the General Revenue Fund to Strategy A.1.1, Field Operations $4,963,653 and57.5 Full-time Equivalent Positions (FTEs) in fiscal year 2012 and $4,963,653 out of the GeneralRevenue Fund and 57.5 FTEs in fiscal year 2013. These additional funds and related FTEs areappropriated contingent upon the Texas Animal Health Commission assessing fees sufficient togenerate, during the 2012-13 biennium, revenue to cover, at a minimum the General Revenueappropriations for these programs as well as the estimated "Other direct and indirect costs" forthese programs, appropriated elsewhere in this Act, and as required, the passage of legislationauthorizing the Commission to charge or assess additional fees. "Other direct and indirect costs"(ODIC) are estimated to be $1,017,908 for fiscal year 2012 and $1,135,929 for fiscal year 2013.

    In addition, the following performance measure target is increased by the following amounts,contingent upon the Texas Animal Health Commission assessing fees sufficient to recover theappropriations and estimated "Other direct and indirect costs" identified by this provision and the

    passage of legislation authorizing the Commission to charge or assess additional fees:

    In the event that actual and/or projected revenue collections are insufficient to offset the costsidentified by this provision, the Legislative Budget Board may direct the Comptroller of PublicAccounts to reduce the appropriation authority provided above to be within the amount of revenueexpected to be available. Further, in the event that actual receipts or revenue collections are in
