Instructions to Tenderers

1. Documents Provided for Tender Purpose

1.1 The documents specifically provided for the purpose of tendering (herein after called “the tender

documents”) comprise of the followings.

2. Submission of Tender Offer

2.1 The tenderer/bidder must adhere to the conditions stated in the tender documents and write the total

prices on the “Tender Form” and Form of Schedule of the Rates and Prices duly filled on their company„s

letter head in accordance with the provisions of these documents. Any tender offer that does not comply

with these provisions shall be considered null and void.

2.2 Should there be any comments, qualifications, reservations or amendments, alterations to specifications or

conditions they must be stated in a separate letter attached to this tender offer and indicated on the

enclosed tender offer.

2.3 Tender offer must be submitted in (3) three separate wax-sealed envelopes with the information fill out

on the provided sticker together with the tender documents for each envelope as mentioned in bellow:

a) Tender Bond Envelope

b) Technical Offer Envelope (submitted in original plus two additional copies)

c) Commercial Offer Envelope (submitted in original plus two additional copies)

The envelope (a) and (b) should have no bearing of prices anywhere. The three (3) separate

envelopes must be placed into an outer sealed envelope clearly marked on the cover the

Number of Tender, Name of Tenderer, Submission Date, Closing Date of tender and the Title of

Tender .

2.4 Alternate Options: The Tenderer may submit alternative tender offer in addition to the original

tender offer and should the tender documents so stipulate and if the tenderer deems it to be in

the interest of works to be executed or the projects financially or technically or with respect to

delivery or execution period or for any other consideration. These alternate tender offer(s) will

be presented in separate envelopes in the same manner as the original tender offer(s( enabling

a comprehensive evaluation of the Tender and should be clearly marked as alternate tender

offer A, alternate tender offer B etc.

2.5 The tenderer must include the following in duly filled in his tender offer:

a. The execution period of the works & supply to be executed in compliance with defined execution

period in these tender documents..

b. Each page of tender documents shall be initialed by the principal duly authorised to represent and

bind the tenderer/bidder and stamped by the tenderer/bidder as token of their acceptance.

c. The tenderer shall express that he has no objection to enter into a final contract/agreement based

substantially upon the content Contract of transport and tender general conditions described in

this tender documents.

d. Unit prices Schedule

e. The tenderer shall submit copy of annual accounts duly audited by professional certified

accountants for three years preceding.

f. The tenderer shall submit a current copy of his Commercail Register alongwith a current copy of

the tendere„s company Computer Card.

3. Filling of tender formats/Corrections & Adjustment of Errors

3.1 No erasures, alteration or additions shall be made by tenderer/bidder to the tender Document's formats

(other than filling in blanks where intended for that purpose), unless such alteration is made in accordance

with an addendum issued as hereinafter described.

3.2 Should there be any erasure or scratching out on the Tender Documents, it must be signed and stamped by

the tenderer.

3.3 Prices and their particulars must be typed written or written in ink and should not be written in pencil. All

pages of the tender documents especially those containing the total prices and their term must have the

stamp of the company/establishment affixed to them..

3.4 The tenderer shall submit his tender offer in Qatari Riyals. The related sehedule of rate and prices and all

other monetary statements in connection with the tender are to be in Qatari Riyals.

3.5 The name of the authorized person signing must be typed written or printed below the signature. The

official stamp of the tenderer must be fixed.

3.6 In case of any differences, ambiguity or discrepancy between the original and other copies of the tender

offer, the original documents shall prevail.

4. All questions/query or requests for clarifications pertaining to commercial, contractual or technical

matters of this tender prior to submission of duly completed tender offer shall be addressed as per Sub-

Section 4.3 below in writing, quoting tender number and title.

4.1 Tenderer„s query should reach in writing thru email adress of the Tenders & Procurement Committee

4.2 Query shall be considered if reached before Seven (7) days from the closing date of this tender, any query

reached therafter may be ignored.

General Conditions of the Offer:

1. Validity of Tender Offer

1.1 Tender offer must remain valid for the acceptance for a period of

90 days commencing the closing date of this tender.

1.2 The tenderer shall submit his tender offer in Qatari Riyals. The

related lump-sum price in the Form of Schedule of Rates & Prices

and in the form of tender and all other monetary statements in

connection with the tender as described in tender documents .

1.3 The tender must include fixed lump sum prices and also must be

including all expenses such as Taxes and other expenses incurred.

1.4 Unit rate shall be indicated, the total prices quoted in )tender form)

attached herein shall only be considered, no attention shall be given to

any other figures or errors committed by the Tenderer in calculating

his total price. The Tenderer shall not be allowed to make any

amendments to his price after submitting his tender offer. Should the

arithmetic error exceed 5% of total price. The tender offer shall be

excluded unless QNCC decides to accept it for reasons of public

interest. Should the amount stated in words differ from the amount

stated in figures, the lesser amount will be endorsed. Without

prejudice to the principle of accepting the lump-sum price, and if it was

ascertained after examining the Tender Offer that the individual prices

and their items did not correspond to the lump-sum price, the lump-

sum price would be endorsed, unless the error therein involved an

increase over the total of the individual prices and their items, in which

case the corrections would be endorsed.

1.5 The tenderer may not withdraw his tender offer or amend his tender offer after the closing

date of tender and he shall be committed to the prices and conditions stated in his

tender offer before the amendment. In the event of withdrawal of the tender offer,

he shall be subject to the application of the following provision;

1.6 The tenderer should undertakes in wrting in case the tender awarded to him

that he accepts signing the final contract according to the terms & conditions

defined in the Contract given in the tender documents of this tender.

1.7 The tenderer undertakes to excutes and complete all works, supply and

delivery of the contractual quantities of the required imported gyspum

and clinker material as per the daily and monthly quantity rates

defined in the Contract.

the Contractor shall guarantee the proper execution of the contractual

obligations by the assignee. The Contractor and the assignee shall be

jointly responsible on sub-letting.

1.9 The tender offer must be accompanied with an updating statement

letter certified and attested by the Traffic Department of the Ministry of

Interior, indicating clearly the brand/model, numbers and year of all

tenderer„s owned heavy vehicles, machinery and any other

equipments required for execution of this contract works subject of this

tender, knowing that this certified statement letter is considered as the

most important technical criteria tack a place at the time of

technical study and evaluation of the tender offer.

1.10 Each tenderer, to prove that he and his staff, carried out earlier, a similar

contracting accompanied by evidence that, they accomplished

successfully according to the requirements of its customers.

1.11 The tenderer must adhere to the conditions stated in these tender documents &

write the prices and its individuals in details on the form of tender and schedule

of the Rates and prices attached herein the tender documents. Any tender offer

that does not comply with these provisions shall be considered null & void.

2. TENDER BOND:

2.1 The tenderer shall presents a Tender Bond/bank letter of guarantee on

his account within limited amount of QAR 220.000.00 (Qatari Riyals

Two Hunderd twenty Thousand) issued by one of first class reputable bank

operating in Qatar acceptable to the Company, and It must be unconditional

and valid for (120) days commencing from the closing date and it must be valid

for the entire performance and subject to renew its validity period at the first

demand from QNCC/Company. The Tender and Procurement Committee

reserves the right to exclude any tender offer which does not include the

required tender bond and without the slightest objection by the tenderer.

2.2 In case of awarding the tender, the successful tenderer will be required to submit

bank guarantee/performance bond as per the format provided in the tender

documents amounting to 10% (ten percent) of the tender offer total lump sum

price, issued by one of a first class reputable bank operating in Qatar acceptable to

Company. And the validity period of this bank guarantee/performance bond

should cover execution period of the Contracting works of transport & supply,

plus sixty (60) days following completion of extecution period of contracting

works, and this guaranttee to bond the Contractor until fufill of all his contracted

obligations under the Contract, in case not not fulfill any of one of contractual

obligations under the Contract extension required by the company should

guarantee validity be extended to cover the new extension period. In case of the contractor

fails in execution partially or completely of this contract works subject to this tender, the

company has the right to confiscate the guarantee value.

the works & quantity subject to tender at the same prices given

in his tender offer in this tender.

3.2 QNCC is not committed to accept any Tender Offer(s) with the

least price.

3.3 QNCC has the right to exclude tender offer(s) who are not

conforming to conditions of this tender and/or tender offer(s) that

are submitted after the closing date and/or submitted without tender

bond.

3.4 QNCC reserves the right to exclude any Tenderer„s offer not

having commercial register as the conditions of the Qatari

Commercial Law.

The Tenderer has to submit a photocopy of his income tax card

along-with his tender offer, in case of tenderer fails to submitted then

QNCC/Company has the right to deduct from Contract value the

Income Tax amount due under contract as per Income Tax Law

No. 21/2009.

3.5 QNCC has the right to increase or decrease the quantities by 20% of

the Contract total quantities according to its same prices and

conditions.

4. PAYMENT CONDITIONS:

4-1 The Company shall pay to the Contractor on monthly basis based on

an invoice submitted by the Contractor for the delivered quantity in

the company„s cement plants @ ummbab within fifteen (15) days

of submission of the invoice.

4-2 The “Company” may suspend payment in case of suspension of the Contractor

for the execution of the Contract or failure to do so, and the Company” has the

right to deduct any amounts due from the Contractor on the occasion of the

execution of the Contract.

5- LANGUAGE OF OFFERS:

5.1 The first Language of the tender offer is the Arabic Language, if

necessary the English Language will consider as second

language of tender offer and in case of a conflict found between

the Arabic text and English Text, the Arabic text shall prevail.

Qatar, that we are committed to transporting & supplying of each shipment quantity to

accumlating yard in mesaieed industrieal city then transporting & supplying of complete shipment

quatntiy to cement plants and discharing , as per the particular technical terms and conditions

Scope of Supply & Works, Particular Technical Terms.

1. Scope of Supply.

Supply of total quantities 500.000 (Five Hundred Thousand) tons of Imported

Clinker and Gypsum Material +20% will arrive on several shipments to Mesaieed

seaport and to be suplied from Mesaieed to the stock yards & unloading in the

Cement Plants at Umm-Bab, this contracting execution perios is for twelve(12)

months.

2. Scope the Works

The execution includes the following two stages: -

a. 1st

Stage: load & transport the quantity below the discharging

hopper of the vessel from Unloading berth at once to accumulating

land in mesaieed industrial city.

At this stage, should the contractor to be ready to deploy its dump trucks in

Mesaieed port, 72 hours before the arrival of the Vessel, immediately after receiving the

letter from the company notice of which this, that provides a suffient numbers of trucks

with suitable capacity, so being able to start the implementation of loading and

transportation operation and continuity during limited specified hours for

discharging the ship„s shipment quantity by the port authorities, without stopage

along 24 hours to accumulating land for unloading the complete each shipment

quantity in mesaieed Industrial City. within a maximum for(4)days..

b. 2nd

Stage: load each shipped quantity of material from accumulated land in

Messaied for transportation & unloading in stock yards in C. Plants @

Ummbab.

The contractor is commitment load and transport the quantity of each shipment

of arrived & accumulated material in the respective specfice land for discharging

provied by the company at Mesaieed industrial city, then load & transport

complete each shipment quantity form Mesaieed city to the cement plants @

Ummbab and unloading in stock yards or else transport it directly to ummbab

during execution of discharging operation of of the vessel„s sipment quantity, the

Contractor is also commitment to deliver each shippment quantity at ummmbab

within a maxiemum oeriod of sixty(60) and performs the previous its

commitments, without failure or shorten it.

3. Particular conditions of this contracting works.

3.1. The contractor is commitment to carry out the deployment of adequate number of dump

trucks with a sufficient loading capacity, before the arrival of the ship 72 hours of unloading

berth which will be dedicated to unload its cargo of materials in Mesaieed port, to proceed

directly for the execution of loading operation on his dump trucks beside the vessel along

24 hours during the specified discharging days given by port authorities to unload complete

each shipment quantity from discharging berth of vessel, the contractor should execute

loading, transport operations of on their dump trucks dump firsthand to the accumulating

land located in the industrial city of Mesaieed provided by the company to unload and

accumultate each complete shipped quantity of the material arrived to Mesaieed port.

3.2. In the event the Contractor fails to fulfill his commitment contained paragraph

No. (3-1) mentioned above, be subject to impose a penalty by the port

authorities, due to his delay in completion loading, transporting & unloading

operations of shipped quantity within the alloawd discharging days of the ship„s quantity

of the material .
