Several training dates in this catalogue are fixed.

However, we offer the possibility to coordinate training dates and contents according to your requests. The minimum number of participants for special trainings is 3 people. All trainings take place in our seminar rooms in Ewattingen or in Bonndorf (Germany). If desired, trainings can be carried out at a place of your choice.

Our conditions for external trainings:

• Instructor: 840,-- Euro per day • Any per diem expenses as for example travel, hotel or meals must be borne by the

customer; will be charged against effort • Provision of seminar rooms, devices and tools • The number of participants of practice trainings should not exceed 6 people

Terms and conditions of attendance

General The following terms and conditions of attendance apply to all seminars organized by Hectronic GmbH (hereinafter referred to as "Hectronic") and the contracting partners or participants (hereinafter referred to as "customer"). Any divergent conditions of a customer, to which Hectronic has not expressly agreed in writing, are not part of this contract. Any changes of these terms and conditions of attendance must be written down and signed by both parties.

Registration Registrations must be sent to Hectronic in written form (post/fax/internet). Hectronic confirms every registration in writing. With this confirmation the contract becomes legally binding for both parties.

Cancellation by the customer

For written cancellations an obligatory contribution towards expenses of 50,00 EURO will be charged to the customer. There will be no further costs if Hectronic receives the cancellation at least 15 working days prior to the beginning of the training. Should Hectronic receive the cancellation later than the above-mentioned 15 working days or should the customer – even for important reasons – absent the training, the following charges apply:

Cancellation 14-10 working days prior to training: 35% of total training costs



No-show: 100% of total training costs

Alterations by Hectronic

For organizational reasons, e.g. too few registrations, illness of the instructor, Hectronic reserves the right to cancel trainings. In this case, Hectronic will refund any payments from the customer made in connection with the training, but will not accept any further claims. However, before cancelling a seminar, Hectronic will take any effort to postpone the date of the seminar.

Changes

Hectronic undertakes to carry out the trainings according to the descriptions in this catalogue; however, Hectronic reserves the right to change for example the trainer or location and date if reasonable.

Prices

The prices indicated in this catalogue apply to the respective seminars and do not include VAT.

Prices include training, documentation and, if planned, the use of systems and devices.

Warranty, liability

Our trainings and exercises are designed in a way that an attentive participant with respective basic knowledge can follow his instructor without any problems. However, Hectronic cannot be held responsible for the customer’s learning success. Hectronic shall be liable, for whatever legal reason, unless stipulated otherwise, solely for intent or gross negligence of legal representatives and executives. In case of gross negligence Hectronic’s liability is limited to foreseeable damage. For any consequential harm Hectronic cannot be held responsible. Hectronic can only be held responsible for data recovery if the use of data during training was confirmed by Hectronic in writing and if the customer has ensured that these data can be easily reconstructed from data which is available in a machine-readable form.

Copyright and data protection

All rights, as well for translations, making copies and reprints of training documents, even though in extracts, are reserved by Hectronic. Any kind of documentation reproduction without Hectronic’s prior written approval is illegal. For the duration of the seminar Hectronic grants the participant a non-exclusive usufructuary right to use the installed software for training and exercising purposes. The participant must not copy or make this software, any documentation or printouts available - neither completely nor partly - to third parties. The customer undertakes to inform and oblige all registered persons accordingly and is liable for all damages occurring from violations of these terms and conditions. By signing the registration form the customer agrees that his personal data will be processed as far as necessary for the completion of this contract.

Safety

Each participant is obliged to follow the safety rules at the training location.

Court of jurisdiction, other

Waldshut-Tiengen is the court of jurisdiction for all legal disputes, as well as for disputes over bills of exchange and cheques if the customer is a non-trader and if the dispute is not a judicial dunning procedure. Hectronic reserves the right to institute legal proceedings at the customer’s domicile.

These terms and conditions of attendance remain binding even if particular points become legally null and void.
