Deputy Chief Minister Dr Nirmal Singh, Chairman of the Coordination Committee, will preside over nine-member Coordination Committee meet- ing. Dr Singh told the Excelsior that the Coordination Committee will meet here tomorrow at 5 pm and take up number of issues including PDP-BJP Alliance Government's floor strategy for both Houses of the Legislature for budget session, beginning January 2 and Panchayat elec- tions in the State, which are scheduled to start from February 15. The Coordination Committee members included Dr Nirmal Singh, Chairman, Jugal Kishore Sharma, Lok Sabha member from Jammu- Poonch seat, Thupstan Chewang, Lok Sabha member from Ladakh, Shamsher Singh Manhas, Rajya Sabha member and Narinder Singh, State gener- al secretary, all BJP, Revenue and Parliamentary Affairs Minister Abdul Rehman Veeri, Sartaj Madni, State vice presi- dent, Dillawar Mir, former Minister and Tarlok Singh Bajwa, former Rajya Sabha member, all from PDP. Sources said general situa- tion in Jammu and Kashmir, both on security and political fronts, yesterday's expansion of Council of Ministry and Centre Government's dialogue initiative on Jammu and Kashmir through Special Representative Dineshwar Sharma, were also likely to figure in the meeting. "Besides, all members can take up any issue of their choice in the Coordination Committee meeting for discus- sions,'' sources said, adding that the BJP members could rake up the issue of Mohinder Verma JAMMU, Dec 29: Harnessing solar energy is the least priority for all the con- cerned agencies in Jammu and Kashmir despite the fact that State has second highest potential in the country after Rajasthan. Moreover, due to absolute non-seriousness the fate of two Ultra Mega and a Solar City Projects is hanging in balance during the past sev- eral years. As per the study conducted by the National Institute of Solar Energy (NISE), Jammu and Kashmir has solar power poten- tial of 111.05 GWp (Gigawatt- peak), which is the second high- est in the country after Rajasthan where the potential is 142.32 GWp. None of the other States in the country have the potential even up to 65 GWp. “However, no serious attempts are being made to harness this potential to make the State self reliant in this sec- tor", sources said while dis- closing that during 2016-17 year merely 0.77 Million Units of electricity was generated from solar energy. Astonishingly, during the cur- rent year not even single unit of electricity has been generat- ed from renewable energy till date. Notwithstanding the fact that solar energy can play crucial role in meeting the electricity requirement of the State, the potential is being harnessed only for operating solar lanterns and lamps, street lights and pumps in certain parts of the State. However, majority of such lanterns and lamps remain defunct due to non-seriousness on the part of Jammu and Kashmir Energy Development Agencies (JAKEDA), sources informed. It is pertinent to mention here that the States which have far less potential as compared to Jammu and Kashmir have been able to generate several hun- dreds of million units of electric- ity from solar energy. Keeping in view solar ener- gy potential particularly in Ladakh region, some years back the Union Government had sanctioned two projects- one each for Leh and Kargil to generate 7500 Mega Watts of solar power and even a Memorandum of Understanding was signed between the Union Ministry of New and Renewable Energy and Science and Technology Ministry of Jammu and Kashmir. Thereafter, the State Cabinet accorded formal sanction for setting up of two Ultra Mega Solar Power Projects and even a high-level coordination commit- tee was constituted to give prac- tical shape to the projects. "However, there is no progress on these projects despite lapse of several years", sources said. The intensity of non-serious- ness can be gauged from the fact that even concerned authorities like Leh and Kargil Energy Development Agencies failed to give any satisfactory reply when approached by EXCELSIOR to ascertain the reasons behind dilly-dallying approach on both the projects. It is worthwhile to mention here that average solar energy at Leh is 5530 Whr/m2/day while the estimated average for Kargil and Nubra is 5390 Whr/m2/day Not even single unit generated during current year so far Excelsior Correspondent NEW DELHI, Dec 29: Union Home Minister Rajnath Singh today said that the secu- rity situation in Jammu and Kashmir has considerably improved with the efforts of the security forces and the development initiatives under- taken by both the Centre and the State. He made these remarks while chairing an inter-ministe- rial meeting, convened here today to discuss development issues in Jammu and Kashmir besides Left Wing Extremism- affected States and the Northeast region. The high-level meet dis- cussed improvement of commu- nication infrastructure in the J&K State, particularly Ladakh region, strengthening of educa- tion system in Jammu Kashmir and other developmental issues. The meeting was attended by Minister for Science and Technology, Earth Science and Environment, Forest and Climate Change, Dr Harsh Vardhan; Minister for Human Resource Development, Prakash Javadekar; Minister of State for Communications (Incharge) and Railways, Manoj Sinha, MoS Home Hansraj Gangaram Ahir, Secretaries and other senior offi- cers of the Ministries. According to an official spokesman, the Union Home Minister said that security sit- uation in the militancy infest Jammu Kashmir had shown considerable improvement and it was time to move for- ward with speed on the devel- opmental front. Maintaining that the overall situation in J&K was well con- trol, Rajnath Singh stressed that it was made possible due to the efforts of security forces and development initiatives under- taken by the incumbent Governments at Centre and the State. “Now it is time to move forward with speed on the devel- opment front,” he added. The project will store around 0.65 million acre-feet (MAF) of water of the river Ujh (a tributary of river Ravi) to irri- gate nearly 30,000 hectares of land and produce more than 200 MW of hydro-power, it said. The growth rate and massive increase in upcoming budget were possible due to series of reforms initiated by the Finance Ministry including clubbing of 29 Departments into four sec- tors, doing away with Plan, Non-Plan System, presentation of early budget and ending Treasury system in the State. The budget size for next Financial Year of 2018-19, which will be presented by Finance Minister Dr Haseeb Drabu in the Legislative Assembly on January 11, could be around the size of Rs 80,000 cr to Rs 85,000 crore. The com- bined revenue and expenditure budget could be around Rs 1.5 lakh crore. Meanwhile, Finance Minister Dr Haseeb Drabu, who will be presenting his fourth budget in a row, told the Excelsior that the Finance Ministry has decided to take back 25 per cent unspent amount if the expenditure by December 31 was below 50 per cent. “We had fixed the deadline of December 31 for 75 per cent expenditure and left only 25 per cent expenditure for last quarter i.e. between January 1 to March 31 with a view to avoid “finan- cial indiscipline’’ and ensure timely execution of works. If the expenditure is around 60 per cent, it’s alright but if it’s below 50 per cent, we are going to take back 25 per cent amount,’’ Dr Drabu said, adding this would serve as deterrent and ensure timely expenditure of amount next year. He said this was one of the major reforms initiated by the Finance Ministry to overcome “yearend rush’’ of utilization of funds, under the garb of which “misappropriation of funds’’ was also reported. When the PIL came up for hearing, Advocate Sheikh Shakeel Ahmed with Advocates Rahul Raina, Suraj Singh and Supriya Chouhan appearing for the petitioner submitted that vide Communication No. JMC/ RB/ 1516 dated September 21, 2017 the Jammu Municipal Corporation furnished the information to the petitioner under J&K RTI Act, 2009 and after perusing the RTI infor- mation it came to light that JMC has indulged in making illegal/arbitrary allotments of 10 prime Municipal Flats/ Quarters situated at Gandhi Nagar in favour of the officers who had served in JMC at sen- ior positions and later super- annuated. Hearing an appeal filed by one Hajra against the award passed for her land acquisition for public purpose, the Division Bench of Justice Ramalingam Sudhakar and Justice M K Hanjura dismissed the appeal with the finding that no writ petition can be filed to challenge the acquisition notice. "It is trite to say that after the award is passed, no writ petition can be filed to challenge the acquisition notice or against any proceedings there under. It is within the power and the author- ity of the Government to decide whether the acquisition is, or is not, required for public pur- pose", DB said. Upholding the judgment of the writ Court, DB said, it is clear and vivid and cannot be interfered with. "It is based on the sound foundations of the law and reason. The judg- ments and the law cited and relied upon by the writ Court to decide and determine the petition of the petitioner are suited to the purpose pro- pounded under it", DB said. Underscoring that smaller public interest has to give way to the larger public interest Court said, these are pertinent to the facts and the circumstances of the case. DB also said that the interest of justice and the public purpose grow together and these are the indispensable conditions embedded in the matter of the land acquisitions. To address her grievances, Court said, she has an alterna- tive remedy available to her under Section 18 of the Jammu & Kashmir Land Acquisition Act. "To this it may, however, be added that the appeal of the appellant is ineffective, incom- plete, incompetent and defec- tive", Court said. The Government todayextended by 10 days the lastdate for filing of final salesreturn GSTR-1 till January 10under the Goods and ServicesTax.

Businesses with a turnoverof up to Rs 1.5 crore will haveto file GSTR-1 for July-September by January 10, 2018,as against December 31, 2017earlier, as per a Governmentnotification.

and Kashmir’s general budgetfor 2018-19 could, for the firsttime, touch around Rs 85,000crores and Rs 1.5 lakh crore ifcollective revenue plus expen-diture were taken, whichwould lead to massive infra-structure development in theState, giving further push togrowth rate, which was closeto 7 per cent, better than thecountry.

The growth rate and massiveincrease in upcoming budgetwere possible due to series ofreforms initiated by the FinanceMinistry including clubbing of

29 Departments into four sec-tors, doing away with Plan,Non-Plan System, presentationof early budget and endingTreasury system in the State.

The budget size for nextFinancial Year of 2018-19,which will be presented byFinance Minister Dr HaseebDrabu in the LegislativeAssembly on January 11, couldbe around the size of Rs 80,000cr to Rs 85,000 crore. The com-bined revenue and expenditurebudget could be around Rs 1.5lakh crore.

Meanwhile, FinanceMinister Dr Haseeb Drabu,

who will be presenting hisfourth budget in a row, toldthe Excelsior that the FinanceMinistry has decided to takeback 25 per cent unspentamount if the expenditure byDecember 31 was below 50 percent.

“We had fixed the deadlineof December 31 for 75 per centexpenditure and left only 25 percent expenditure for last quarteri.e. between January 1 to March31 with a view to avoid “finan-cial indiscipline’’ and ensuretimely execution of works. If theexpenditure is around 60 percent, it’s alright but if it’s below

50 per cent, we are going to takeback 25 per cent amount,’’ DrDrabu said, adding this wouldserve as deterrent and ensuretimely expenditure of amountnext year.

He said this was one of themajor reforms initiated by theFinance Ministry to overcome“yearend rush’’ of utilization offunds, under the garb of which“misappropriation of funds’’was also reported. landmark judgment, HighCourt today held that landacquisition notice cannot bechallenged by way of writ peti-tion before High Court as it isin the larger public interest.

Hearing an appeal filed byone Hajra against the awardpassed for her land acquisitionfor public purpose, the DivisionBench of Justice RamalingamSudhakar and Justice M KHanjura dismissed the appealwith the finding that no writpetition can be filed to challengethe acquisition notice.

"It is trite to say that after theaward is passed, no writ petitioncan be filed to challenge theacquisition notice or against any

proceedings there under. It iswithin the power and the author-ity of the Government to decidewhether the acquisition is, or isnot, required for public pur-pose", DB said.

Upholding the judgment ofthe writ Court, DB said, it isclear and vivid and cannot beinterfered with. "It is based onthe sound foundations of thelaw and reason. The judg-ments and the law cited andrelied upon by the writ Courtto decide and determine thepetition of the petitioner aresuited to the purpose pro-pounded under it", DB said.

Underscoring that smallerpublic interest has to give way tothe larger public interest Courtsaid, these are pertinent to thefacts and the circumstances of

the case.DB also said that the interest

of justice and the public purposegrow together and these are theindispensable conditionsembedded in the matter of theland acquisitions.

To address her grievances,Court said, she has an alterna-tive remedy available to herunder Section 18 of the Jammu& Kashmir Land AcquisitionAct. "To this it may, however, beadded that the appeal of theappellant is ineffective, incom-plete, incompetent and defec-tive", Court said.

It is pertinent to mentionhere, Court said, that it is for theGovernment to decide that a par-ticular acquisition was required
