Dear Sir,

Sealed offers are invited from reputed parties to enter into annual contract forCLEANING OF TANKS, VESSELS, PITS AND REMOVAL OF SLUDGE at ourWorks at Naya Nangal, Distt. Ropar (Punjab) as per details below:

1. Scope of work:- Scope of work will be as per annexure -I enclosed herewith.

2. Rates: - Kindly quote rates in annexure-II enclosed herewith: The rates willremain firm during the period of contract.

3. Last Date of Submission of offers: - Last date of submission of offers is12.09.2017.

4. Earnest Money: - Earnest money of Rs. 20000.00 by way of demand draftfavouring Punjab Alkalies & Chemicals Limited is to be enclosed with tender ina separate envelops marked Earnest Money.

5. Security deposit:- The successful contractor will have to deposit Security of Rs.50000.00. Security will be released after satisfactory completion of the contract.

6. All the tools & tackles including tractor trolley required for carrying out theabove jobs will be arranged by you.

7. Payment Terms: Within 30 days from the date of submission of bills on monthlybasis duly verified by the concerned department.

8. GST: GST as applicable will be paid extra. Kindly confirm HSN/ASC code andrate of GST in your offer.

9. Income Tax: Income Tax shall be deducted at source from your bills as perrules.

10.Work Contract Tax or any other tax as applicable from time to time will bededucted if applicable and shall be borne by you

11.Validity: The contract shall be valid for one year. PACL will have the right toextend the contract for one month on same rates and terms and conditions.

12. Penalty: - If contractor is failed to execute the work as per instructions of PACL,penalty of Rs. 500.00 may be levied each time.

13.The contractor will have to abide by the Govt labour laws as applicable fromtime to time as per annexure -A enclosed herewith.

14. Statutory Laws: You shall abide by and observe all the statutory requirementsof local and Central Govt. for employing contract workers while working at ourSite specially minimum wages, Provident Fund, ESI, Workman Compensationand shall further ensure that safety and security regulations of our Companyare strictly observed by all of your employees and contract workers working foryou at our Site. We however, reserve the right of asking any of your workers orstaff to leave our premises if he/she is found violating any of our safety andsecurity regulations within our premises.

15.Arbitration Clause: In all cases of dispute or disagreement between the partieshereto as to any matter arising out of or relating to this Work Order whethersuch dispute or disagreement shall arise during the continuance of this WorkOrder regarding interpretation of this Work Order or any clause or clausesthereof or upon or after the termination hereof and provided no understandingbetween the parties can be reached for the settlement of the difference suchdispute or difference shall be referred to the sole arbitration of the ManagingDirector of Punjab Alkalies & Chemicals Limited or any other officer appointedby him on his behalf, in accordance with the provisions of Arbitration andConciliation Act, 1996 or any Statutory modifications or substitute thereof andall the provisions of that Act, so far as are applicable or of any of them for thetime being in force shall apply to every reference hereunder. The award givenby such Arbitrator shall be final, conclusive and binding upon the parties to theWork Order/contract. The Arbitrator may from time to time, with the consent ofparties,. enlarge the time for making or publishing the award. The arbitrationproceedings shall be held at Chandigarh.

Notwithstanding any pending reference to arbitration both parties shall precedewith the execution of their commitments, under the Work Order/contractuntil the arbitration award is known unless the question of such continuance isa subject matter of such proceedings.

16. Law and Its Jurisdiction: The contract shall be governed by the laws of Govt. ofIndia in force from time to time and shall be deemed to have been concluded inthe Union Territory of Chandigarh. All suits and proceedings shall be subject tojurisdiction of the courts at Chandigarh only.

ANNEXURE -I

SCOPE OF WORK

A) Cleaning of Tanks, Vessels etc.:

To clean waste sludge, garbage and other foreign matter from various tanks,vessels & pits. You will use your own mean-power, tools and tackles, baskets handtrolley etc. for carrying out above said jobs. The sludge thus removed shall be keptnearby earmarked areas.

The description of the tanks, vessels and pits, number of units and rates for eachjob are mentioned in the enclosed Annexure-II. Removal of water will be done byPACL and for the removal of rest material i.e. sludge and residual Brine/Water isunder scope of Contractor. All tools and tackles shall be arranged by the Contractor.One cut out in the clarified for removal of sludge shall be done by PACL.

Some of the Pits particularly below the ground level may have to be de-wateredfrequently during cleaning operation. The de-watering Pump shall be arranged byyou at your cost. PACL will not provide any electricity connection for the same.

B) Removal of Sludge:

i. Sludge removal/Spreading:

To remove brine sludge/lie sludge from anywhere inside plant and dumping thesame in lagoon pits located within plant premises. The sludge shall be draggedup to 30-40 meters in length and will be spread uniformly to a level of double ofthe tractor trolley body. You will also collect the sludge manually which could notbe collected through tractor trolley during the operation. PACL shall not provideany labour assistance for this job. Rates for the same are mentioned in theenclosed Annexure-II.

ii. Filling of sludge in bags and dumping of the same in lagoon pits. To fill semisolid brine/lime in polythene/HDPE bags of 50/75 Kg or any other capacity. Bagsthus filled would be closed leak proof using nylon/plastic sutli. Sludge filled bagsare to be transported manually or through tractor trolley or any other transportmeans and finally to be dumped in sludge pit/lagoon pit in such manner so as toensure stacked height of the filled bags should remain below nearly road/groundlevel. Bags will be provided by PACL.

iii. In case spreading of sludge is not done properly only 50% payment shall bemade.

iv. Weighment:

Payment for above jobs will be made on actual wighment basis. You would haveto produce documentary evidence of actual weighment from our weighbridgealonwith the bills. In exceptional cases whenever weighbridge is out ofoperation, average net weight of sludge in each trolley will be considered for thepurpose of calculating weight. However, in case of semi-solid sludge, weight willbe calculated on the basis of volume and density of sludge in particular tank pit.The measurement shall be taken jointly I presence of PACL and yourrepresentative.

v. You shall clean roads and other walkways in case the areas become dirty duringthe transportation of sludge.

vi. The breakup rate of effluent pit Unit-II, item No. 15 will be as under:

Payment shall be released accordingly.

vii. It may be ensured that while shifting the sludge from plant to lagoon pits, thesludge is not spill over the roads. Accordingly, tractor trolleys etc. should be ingood condition.

MISCELLANEEOUS:

1. You will provide to your labour, all necessary safety equipment like hand gloves,gum boots, safety goggles, safety belts, safety helmets etc. as per statutoryrequirements.

2. All tools and tackles like nylong ropes, manila rope, kassi, belcha, baskets, tractortrolley and all type of labour required for the job shall be arranged by you at yourcost.

3. It must be expressly understood that you would be taking utmost care to protect theproperty of PACL from being damaged due to negligence of your workers. Alllosses incurred to PACL due to negligence on your part shall be debited to youraccount.

4. Time is essence for completion of said jobs in specified period. If you fail tocomplete the work in stipulated period, PACL can get work done from any otheragency and cost so incurred shall be recovered from you.
