    Introduction

    This booklet presents a summary of key aspects of the new European

    Community (EC) Regulation No 2037/2000 on ozone depleting

    substances (ODS), that is applicable from 1st October 2000.

    O ver 170 countries have now ratified the M ontreal Protocol on

    substances that deplete the ozone layer, an international treaty for the

    protection of the stratospheric ozone layer. W ithin the EU , the protocol

    w as previously enforced by EC R egulation 3093/94. H ow ever, recent

    changes to the M ontreal Protocol have m ade it necessary to introduce

    tighter restrictions resulting in a new EC R egulation N o 2037/2000 on

    ozone depleting substances, applicable from 1st O ctober 2000.

    As the EC Legislation is in the form of a R egulation and not a D irective,

    it is directly applicable in U K law.

    The new EC Regulation will affect users, producers, suppliers,

    m aintenance and servicing engineers, and those involved in the

    disposal of all O D S. These include chlorofluorocarbons (CFCs),

    hydrochlorofluorocarbons (H CFCs), halons, 1,1,1 trichloroethane,

    carbon tetrachloride and brom ochlorom ethane (CBM ). These

    substances are m ainly used in refrigeration, air-conditioning, foam

    blow ing, as solvents and in fire fighting.

    The inform ation contained in this booklet is intended as a short guide

    explaining the im pact of the new EC Regulation. The new EC Regulation

    introduces bans on the supply and use of CFCs, halons,

    1,1,1 trichloroethane, carbon tetrachloride and CBM . These prohibitions

    take effect im m ediately on or shortly after 1st O ctober 2000 - users of

    these substances will need to take early action. The new EC Regulation

    also introduces a revised schedule for the phase out of H CFC s,

    accom panied by a num ber of im portant new use controls.

    To accom pany this sum m ary booklet, a series of three m ore detailed

    booklets has been published by the D TI and D ETR for the refrigeration

    and air-conditioning, solvent cleaning and fire fighting sectors.

    It should be noted that this booklet does not cover those aspects of the

    new EC Regulation related to m ethyl brom ide. Inform ation on this topic

    can be obtained from DETR or M AFF; contact details are provided at

    the end of this booklet.

    The new EC R egulation affects the supply and use of all ozone

    depleting substances (O D S). Som e of the key substances are listed

    below . N ote: this list is not intended to be fully com prehensive.

    a) Refrigerants

    H CFCs: 22, 123, 124

    Highlight s of t henew EC Regulation

    The new EC R egulation applies from 1st O ctober 2000, upon w hich

    date the previous R egulation, EC 3093/94, is repealed. This bookletsum m arises key aspects of the new EC R egulation - a full hard copy of

    the docum ent is available from the D ETR (contact details given at the

    H ighlights of the new EC Regulation include:

    N ew bans on the supply1 and use2 of CFCs, H alons,

    1,1,1 trichloroethane, carbon tetrachloride, hydrobrom ofluorocarbonsand CB M 3. These bans apply from 1st O ctober 2000 for m ost

    applications, although certain delays and exem ptions apply - these

    are described in this booklet. The bans on these substances apply to

    both virgin and recycled m aterial.

    Significant revisions to the controls on use2 of H CFC s. This adds a

    num ber of new controls to those specified in the previous EC

    R egulation. All the m ajor use sectors for HCFCs are subject to new

    use controls.

    Tougher requirem ents regarding the recovery of O D S from products

    and equipm ent and to prevent leakage from system s. A ban on

    supply of O D S in disposable containers, except for essential uses.

    A revised tim etable for the supply1 of H CFCs. The tim etable is

    designed to m atch the new H CFC use controls. Som e cuts com e into

    effect in 2001 and there w ill be a substantial cut by 2003. N o virgin

    H CFC s can be placed on the m arket after the end of 2009.

    A ban on the im port of products containing O D S. This is im m ediate

    for all O D S except H CFC s - the specific H CFC use control dates alsointroduce im port bans for those products and equipm ent which they

    cover.

    A ban on the export of virgin and recycled CFCs and halons and

    products containing them , although certain exem ptions apply.

    A new tim etable for the phase out of EU production of H CFCs.

    Refrigeration andair conditioning

    a) Supply and Use Control s for CFC4 Systems

    N ew controls on supply and use of CFCs will have im m ediate effect on

    the refrigeration and air-conditioning m arket. From O ctober 1st 2000

    there w ill be a ban on supply of CFCs. From 1st January 2001 there w ill

    be a ban on the use of these refrigerants for the m aintenance of

    existing equipm ent. Provision for exem ption to this ban is available, for

    use in certain existing m ilitary applications, until 31st D ecem ber 2008.

    b) HCFC Use Controls, New Equipment

    The previous EC R egulation (3093/94) already has a num ber of end

    use controls that are repeated in the new EC R egulation. This m eans

    there is already a ban on the use of H CFC s in the m anufacture of

    new equipm ent for the follow ing applications:

    non-confined direct evaporation system s

    dom estic refrigerators and freezers

    m otor vehicle, tractor and off-road vehicle or trailer air conditioning

    system s

    road public-transport air-conditioning

    rail transport air conditioning applications

    public and distribution cold stores and w arehouses

    equipm ent of 150 kW and over shaft input

    The new EC R egulation introduces further use controls.

    The use of HCFCs will be banned for the manufacture of new

    equipment in all refrigeration and air-conditioning applications

    from 1st January 2001 except for 2 tem porary exem ptions:

    the ban is delayed until 1st July 2002 for fixed air-conditioning

    equipm ent w ith a cooling capacity of less than 100 kW

    the ban is delayed until 1st January 2004 for reversible air-

    conditioning/heat pum p system s.

    c) HCFC Use Controls, Existi ng Equipment

    N ew controls are being introduced related to the use of H CFCs in the

    m aintenance of refrigeration and air conditioning system s m anufactured

    prior to the relevant m anufacture ban. There will be a ban on the use of

    virgin H CFC s from 1st January 2010 and a ban on the use of all

    H CFCs, including recycled m aterials, from 1st January 2015.

    d) Recovery & Destruction

    W ith im m ediate effect, all ODS used in refrigeration and air conditioningequipm ent m ust be recovered during servicing and m aintenance of

    equipm ent or prior to dism antling or disposal of equipm ent.

    After 1st January 2001 recovered CFC s m ust be destroyed by an

    environm entally acceptable technology. Recovered H CFCs can either

    be destroyed or can be re-used until 2015.

    This does not apply to dom estic refrigerators and freezers on disposal

    until 1st January 2002.

    e) Leakage Prevention

    The new EC R egulation strengthens requirem ents for the prevention of

    leakage of O D S refrigerants from system s. All precautionary m easures

    practicable m ust be taken in order to prevent and m inim ise leakage.

    An im portant new rule is that fixed equipm ent containing O D S, w hich

    has a refrigerating fluid charge greater than 3 kg m ust be checked

    annually for leakage.

    To ensure that recovery and leakage issues are properly dealt w ith byrefrigeration technicians the R egulation calls for each M em ber State to

    set a m inim um qualification level for all personnel servicing and

    m aintaining equipm ent and handling refrigerants. This m ust be done

    by the end of 2001.

    f) Trade Controls

    A num ber of trade controls w ill influence the im port and export of

    refrigeration and air-conditioning products that contain O D S.Details of im port and export controls are given on Page 10.

    Solvents

    a) Use Controls for CFCs, 1,1,1 t richloroethane,

    CBM and c arbon t etrachloride

    There w ill be a ban on the use of CFCs, 1,1,1 trichloroethane, CB M and

    carbon tetrachloride for any solvent application from 1st October 2000.

    b) Use Controls for HCFCs

    U se of H CFCs in non-contained solvent uses rem ains prohibited.

    From 1st January 2002 there is a ban on the use of H CFC s in all

    solvent applications. There is a tem porary exem ption for precision

    cleaning of electrical and other com ponents in aerospace and

    aeronautics applications where the use ban shall enter into force on

    31st D ecem ber 2008.

    c) Recovery & Destruction

    W ith im m ediate effect all ozone depleting solvents must be recovered

    during servicing and m aintenance of equipm ent or prior to dism antlingor disposal of equipm ent. W ith the exception of H CFCs, all recovered

    O D S solvents m ust be destroyed by an environm entally acceptable

    technology. H CFCs can be recovered for re-use in applications where

    this is perm itted by the new R egulation.

    Aerosols

    U se of CFCs in the production of aerosols is prohibited from

    1st October 2000. The U K non-m edical aerosol industry has not used

    CFC s since 1990. U se of H CFC s as an aerosol propellant has been

    banned since 1995.

    Fire prot ect ion systems

    a) Use Controls, Halons

    Virgin halons cannot be used for refilling existing fire protection system s.

    Recovered, recycled or reclaim ed halons m ay only be used in existing

    fire protection system s until 31st D ecem ber 2002. After this date

    system s cannot be refilled.

    M andatory decom m issioning of fire protection system s and fire

    extinguishers containing halons m ust be carried out and com pleted

    before 31st D ecem ber 2003.

    The only exem ption to the above is the use of halons in a lim itednum ber of “critical uses”, for exam ple, in certain m ilitary and aerospace

    applications. The critical uses are listed in Annex VII of the new EC

    Regulation.

    b) Recovery & Destruction

    All halons and other ODS contained in fire protection system s and fire

    extinguishers m ust be recovered during servicing and m aintenance of

    equipm ent or prior to dism antling or disposal of equipm ent. R ecovery

    m ust be for destruction by an environm entally acceptable technology.

    The only exem ption to this rule is for reuse in the “critical uses”listed

    in Annex VII of the new EC R egulation.

    c) CBM (or Halon 1011)

    CB M is used as an explosion suppression agent and its supply and use

    are prohibited from 1st O ctober 2000. System s containing CB M can,

    how ever, continue to be used until they require refilling or topping up

    for any reason as the controls described in paragraph (a) above do not

    apply to this substance.

    Foams

    a) Use Controls - HCFCs

    The only OD S now used in the foam blow ing industry are H CFC s.

    The new EC R egulation prohibits the use of H CFC s for the production

    of all foam s except rigid insulating foam s and integral skin foam s for

    use in safety applications. O n top of this it introduces a series of

    product related bans that w illcompletely phase out the use of HCFCs

    in foam blowing by 1st January 2004 . The key steps in the phase out

    schedule are:

    From 1st October 2000 a ban on H CFC s for production of polyethylene

    rigid insulating foam s and all integral skin foam s for use in safetyapplications.

    From 1st January 2002 a ban on H CFC s for production of extruded

    polystyrene rigid insulating foam s (except w here used for insulated

    transport).

    From 1st January 2003 a ban on H CFCs for production of

    polyurethane foam s for appliances, polyurethane flexible faced

    lam inate foam s and polyurethane sandwich panels (except w here the

    latter tw o are used for insulated transport).

    From 1st January 2004 no foam s can be m anufactured using

    H CFCs. H ence at this date it w ill no longer be possible to use H CFCs

    for production of polyurethane spray or block foam , foam for insulated

    transport, rem aining polyisocyanurate foam s or phenolic foam .

    b) Recovery & Destruction

    The new EC Regulation calls for recovery of OD S from foam s “if

    practicable”.The recovered fluid m ust be destroyed or re-used

    (although, in m ost situations other aspects of the new EC R egulation

    w ould prevent re-use).

    Waste ODS

    W aste O DS m ust be disposed of in a m anner which does not harm

    hum an health or dam age the environm ent. It is possible that som ewaste O D S m ay be “special waste”and so subject to m ore stringent

    disposal arrangem ents than m ost other wastes. Special rules also apply

    to their im port and export. You should contact your local Environm ent

    Agency office for further inform ation.

    Trade cont rols

    The new EC R egulation includes a num ber of controls that apply to

    international trade outside of the EU . The trade controls apply to m ost

    OD S and all types of product and equipm ent containing them and are

    sum m arised below.

    a) Import of Most Controlled Substances

    The im port of CFCs, halons, carbon tetrachloride, and

    1,1,1 trichloroethane is prohibited except in three specific circum stances.

    These are (i) for essential uses, (ii) as a feedstock or processing agent

    and (iii) when the controlled substance is being im ported to be destroyed.

    The im port and placing on the m arket of products and equipm ent

    containing CFCs, halons, carbon tetrachloride, and

    1,1,1 trichloroethane is prohibited except in three specific

    circum stances. These are (i) the im port of products and equipm ent for

    essential uses, (ii) the im port of products and equipm ent for critical

    uses of halons and (iii) the im port of products and equipm ent that w ere

    m anufactured before 30th Septem ber 2000.

    b) Import of HCFCs

    H CFCs can be im ported w ithin the strict quantitative lim its defined

    in the EC Regulation, but only after an im port licence has been granted

    by the European Com m ission.

    Products and equipm ent containing H CFC s can be im ported until the

    relevant use control dates described in this booklet take effect. Afterthose dates im ports of products and equipm ent containing H CFCs are

    prohibited, unless the products were m anufactured before the relevant

    use control date.

    c) Export of Most Controlled Substances

    Export of controlled substances

    The export of CFCs, carbon tetrachloride, and 1,1,1 trichloroethane isprohibited from 1st October 2000 except those produced for (a) basic

    dom estic needs of developing countries, (b) essential uses, or those

    used for feedstock or process agent applications. Export of bulk halons

    is also prohibited from that date.

    Export of products containing controlled substances

    The export of products and equipm ent containing or using CFC s,

    carbon tetrachloride and 1,1,1 trichloroethane, is prohibited from

    1st October 2000 except for essential uses. Products and equipm ent

    containing halon, how ever, m ay be exported to satisfy any of the critical

    uses listed in Annex VII of the new EC R egulation.

    d) Export of HCFCs

    The H CFC use controls described in this booklet do not apply to the use

    of H CFCs for the production of products for export to States P arty to the

    M ontreal Protocol where the use of H CFCs is still perm itted, until 31st

    D ecem ber 2009. After that date the export of products and equipm ent

    containing H CFCs is prohibited. Export of H CFCs to any State not party

    to the M ontreal Protocol shall be prohibited from 1st January 2004.

    e) Export Authorisation

    Exporters of O DS will require an export authorisation from the European

    Com m ission for all exports from 1st January 2001.
