7.1 January 2019 Monthly Financial Report The Monthly Financial Report for January 2019 is designed to identify and explain any major variances to budget at an organisational level for the period ending 31 January 2019. Council’s favourable operating result against year to date budget of $97.61 million is $9.40 million or 11% above the September Amended Budget of $88.20 million primarily due to a number of factors which are outlined in Section 2 of Attachment 1 - Financial Overview. Capital works actual expenditure is $22.53 million which is $3.23 million below year to date budget phasing of $25.76 million. Priority projects expenditure of $8.24 million is $3.35 million below year to date budget phasing of $11.59 million.

Council's Balance Sheet and cash position are sound and depict a satisfactory result. At the end of January, Council's cash position stood at $112.97 million or $11.49 million above year to date budget. 7.2 Provision of Information and Wellbeing Support Services A report was presented at the Council meeting on 28 August 2017 regarding the funding deed Council had with Camcare (now merged with Access Health and Community) to deliver community services. One of the resolutions carried referred to future grant arrangements as follows: Conduct a competitive triennial grant process for the provision of required community services, specifically Information, Advice and Referral, Wellbeing and Support and In Home Parenting Support and Parenting Skills Groups as detailed in this report, from 1 July 2019 - 30 June 2022 and, following evaluation of submissions, present a report to Council with a recommended service provider for Council’s consideration. This report seeks Council endorsement for the award of Contract No. 2018/161, Provision of Information and Wellbeing Support Services which refers to the services listed above. This contract will provide Council with the provision of specified community services for a term of 3 years, from 1 July 2019 to 30 June 2022. An Expression of Interest process was undertaken to conduct a competitive triennial grant process. Since their merger with Camcare in July 2018, Access Health and Community has been the agency delivering community services as part of the triennial grant, which expires 30 June 2019. The fixed price submitted by Access Health and Community for 2019/20 is $583,300. Expenditure in years two and three will increase by CPI. Because of the value of the contract it was publicly advertised in accordance with the requirements of section 186 of the Local Government Act 1989. Confidential information is contained in Attachment 1, as circulated in the confidential section of the agenda attachments, in accordance with Section 89(2) of the Local Government Act 1989, as the information relates to contractual matters and premature disclosure of the information could be prejudicial to the interests of Council or other persons. This item has been included in the public agenda to facilitate transparency and accountability in Council’s decision making. If discussion of the confidential information in the attachments to this report is required in order for Council to make a decision, this item will be deferred to the confidential section of the agenda.

MOTION Moved Councillor Parke Seconded Councillor Hurd That Council resolve: 1. To award Contract No. 2018/161, Provision of Information and Wellbeing

Support Services to: Access Health and Community (ACN 136672681) at their submitted schedule of rates for a contract term of three (3) years. The estimated contract cost for the term is $1,973,414 (including GST). The cost to Council after the return of the GST Tax Input Credits is $1,794,013.

2. To authorise the Director Community Development to execute the contract agreement with the above provider.

3. To note expenditure under this contract will be in accordance with the

approved budget allocation in the following three financial years. CARRIED

7.3 Proposal to rename Burke Road South Reserve, Sinclair Avenue, Glen Iris

A request has been received from a resident, for the Burke Road South Reserve to be renamed. The basis of the request is that the applicant believes that the reserve should have a name that has a connection with the local community. The applicant suggested that the reserve be named after Mr John Lewin who was a Councillor at Hawthorn City Council from 1990 to 1994 and was passionate about protecting the reserve. The naming of places (including parks and reserves) is a local government responsibility under the Local Government Act 1989. However, all naming proposals must meet the requirements of the Geographic Place Names Act 1998 and associated Naming rules for places in Victoria 2016 (“the Rules”). The Rules set out the Principles that form the basis of whether or not a naming request is compliant. They are wide ranging and are intended to cover the naming of any place or feature in Victoria. (See Attachment 2 for complete list of Principles). A survey was undertaken seeking feedback from owners and occupiers in the vicinity of the reserve and other relevant stakeholders. A total of 356 surveys were posted on 1 June 2018. A total of 91 or 26% of the surveys were returned. Of these, 86 (95% of those returned) supported the proposal without qualification. A public notice was placed in the Progress Leader the week commencing 12 June 2018, inviting submissions on the proposal. The closing date for submissions was 11 July 2018. No submissions were received as a result of the public notice.

The Office of Geographic Names was also consulted and advised the content of the survey and public notice was appropriate and provided “in principle” support for the proposed name “Lewin Reserve”. 7.4 Proposed naming of right of way at the rear of 235-241 Canterbury Road, adjoining 243 Canterbury Road and 2 Rochester Road, Canterbury

A request has been received from an adjoining property owner for the right of way located at the rear of 235-241 Canterbury Road, adjoining 243 Canterbury Road and 2 Rochester Road, Canterbury to be named. The basis of the request is that the applicant’s property is located on the first floor of the building and cannot be accessed from the front of the building (Canterbury Road). The property can only be accessed through the right of way at the rear of the building. As a result, the applicant experiences difficulties directing visitors, mail and emergency services to the property. The naming of the right of way will assist visitors, mail and emergency services to locate and access the property. The naming of roads and streets (including rights of way) is a local government responsibility under the Local Government Act 1989 (“the Act”). However, all naming proposals must meet the requirements of the Geographic Place Names Act 1998 and associated Naming rules for places in Victoria, Statutory requirements for naming roads, features and localities – 2016 (“the Rules”). The Rules set out the Principles that form the basis of whether or not a naming request is compliant. They are wide ranging and are intended to cover the naming of any road, feature or locality in Victoria. (See Attachment 2 for a complete list of the principles).

7.7 Toorak Road level crossing removal - Planning Scheme Amendment and community consultation submission

The Toorak Road level crossing is one of four on the Glen Waverley train line near the municipal border of Stonnington and Boroondara. The road, rail, footpath and shared path networks at and near the crossing are used by the Boroondara community every day. The congestion and road safety issues associated with the crossing are experienced by the Boroondara community daily. The level crossing is one of the original 50 nominated by the Victorian government for removal by 2022. The Victorian government’s preferred design option for the removal of the Toorak Road level crossing on the Glen Waverley train line in Kooyong, rail bridge over Toorak Road, was announced on 13 February 2019. The Toorak Road level crossing removal project team intends to amend the Boroondara and Stonnington planning schemes to aid the delivery of the project. The project team is seeking community and Council feedback on the planning scheme amendment (PSA) and the project in general. Feedback on the PSA and the project was due on 18 March 2019. Council has been granted an extension to 26 March 2019. Council officers have prepared a submission (Attachment 1) for presentation to the Level Crossing Removal Project (LXRP) (formally Level Crossing Removal Authority [LXRA]). The submission responds to the likely impacts of the project on Boroondara, including construction, visual amenity and vulnerable road user impacts. The PSA component of the submission provides feedback and suggested changes to the proposed Incorporated Document for consideration by the Minister for Planning. submission to the Level Crossing Removal Project on 26 March 2019. CARRIED 7.5 Amendment C303 - Corrections to the Heritage Overlay - Exhibition

outcomes and consideration to adopt the amendment

The purpose of this report is to inform Council on the outcomes of exhibition for Amendment C303 to the Boroondara Planning Scheme. The amendment proposes to: Extend the curtilage of the Heritage Overlay (HO171) pertaining to 19-21

Canterbury Road, Camberwell and activate the tree control in the Schedule to the Heritage Overlay

Delete the Heritage Overlay (HO225) from 21 Lesley Street, Camberwell; and Activate the internal alteration control for the reredos (ornamental screen covering

the wall at the back of an alter) at 2-2A Margaret Street, Canterbury (HO145). The amendment was initiated as a result of an anomalies review as reported to the Urban Planning Special Committee (UPSC) on 20 August 2018. Exhibition of Amendment C303 commenced on 6 December 2018 and concluded on 15 February 2019. Affected and adjoining land owners and occupiers were notified of the exhibition period. Council received one (1) supporting submission to the amendment, specifically in relation to the property at 19-21 Canterbury Road, Camberwell. No changes are proposed to the amendment as a result of the submission. In accordance with Section 23(1) of the Planning and Environment Act 1987, Council is required to review each submission and consider whether to: change the amendment in the manner requested; or refer the submission to a panel appointed under Part 8; or abandon the amendment or part of the amendment. Given only a supporting submission was received for this amendment, it does not require consideration by an independent Planning Panel. On this basis, officers recommend that Council resolve to adopt Amendment C303 to the Boroondara Planning Scheme in accordance with Section 29(1) of the Planning and Environment Act 1987. That Council resolve to:

1. Receive and note the submission to Amendment C303 to the Boroondara

Planning Scheme in accordance with Section 22 of the Planning and Environment Act 1987 as shown in Attachment 1.

2. Note the officers’ response to the submission as detailed in the report.

3. Note the Maling Road Shopping Centre and Residential Environs (HO145) citation which was adopted by the UPSC on 20 August 2018 as shown in Attachment 2.

4. Note the Schedule to the Heritage Overlay and maps as shown in

Attachment 3 and 4.

5. Adopt Amendment C303 to the Boroondara Planning Scheme in accordance with Section 29(1) of the Planning and Environment Act 1987.

6. Submit Amendment C303 to the Minister for Planning for approval in

accordance with Section 31(1) of the Planning and Environment Act 1987.

7. Authorise the Director City Planning to undertake administrative changes to Amendment C303 that do not change the intent of the amendment.

7.6 Proposal to amend the Order to establish Smart Street Reserve as a designated dog off-leash reserve

Council’s Order In Council No.1 (“Order”) sets out controls relating to dogs and designates specific reserves as ‘off-leash’ areas. In response to community interest, this report is brought to Council to consider the potential adoption of an amendment to the Order to designate Smart Street Reserve in Hawthorn as a dog ‘off-leash’ area either on a timeshare basis or without time restrictions. At the Services Special Committee meeting on 11 February 2019, the Committee resolved to refer the amendment proposal to Council for determination. The resolution followed the Committee’s consideration of the written submissions received through the public consultation process held between 1 and 21 October 2018, totalling two hundred and sixty-eight (268) responses to an online survey and one hundred and fifteen (115) responses to an Interactive Voice Response (IVR) telephone survey. Also taken into consideration by the Committee were twenty-five (25) unsolicited submissions received by Council prior to the public consultation period. Ten residents presented to the Committee reiterating their written submissions. The presentations demonstrated an equal split in favour of the proposal versus not in favour. This split is somewhat mirrored in the findings of the IVR survey, which demonstrated 48.7% of respondents being in support of the proposal (43.5% of which had a preference for timeshare) versus 44.3% not in support, with the remaining 7% indicating no preference.

The key themes raised by those in support of the proposal reflect:

The need for equitable access to open space and the sense of community and other health and wellbeing benefits to be gained;

A perception that dog owners are responsible for the most part; The possibility of the children’s playground and services co-existing with

dogs off-leash given other examples of this across the municipality and elsewhere;

The opportunity to socialise dogs and normalise the behaviour of dogs for children;

The unsuitability of other nearby off-leash dog reserves in terms of risks to safety posed by roads and snakes, as well as the frequency of organised sports and other events; and

A perception the reserve is under-utilised. In contrast, the following points were raised by those who spoke against the proposal:

Risks to safety, particularly for children and older people (in terms of dog aggression and attack and/or exposure to dog faeces);

Implications resulting from reduced access to open space should the reserve become off-leash;

A perception that dog owners were not always responsible and respectful; The high value placed on the reserve by families with children, afforded by

its on-leash status; The unsuitability of the reserve for conversion to off-leash in accordance

with the factors raised in Council’s Site Suitability Assessment report (ie. not enough space to enable concurrent use of the open grassed area for dogs off-leash alongside other uses; and risks to amenity);

Smart Street Reserve being the only park with a track that is on-leash in Hawthorn; and

Uncertainty around the need for another off-leash reserve given the availability of four other off-leash reserves within 500 metres of Smart Street Reserve.

All of the submitters who spoke for the proposal were in favour of a timeshare arrangement (as proposed in the online petition - 5pm to 8am daily). In the previous report to the SSC meeting on 11 February 2019, officers proposed modified times (6.30pm to 7am) should designation eventuate. This was in order to enable a thirty (30) minute buffer around the operational times of the West Hawthorn Early Childhood Centre long day care program. However, officers maintain the view that Smart Street Reserve is not suitable for designation as dog off-leash due to the potential safety risks posed to children. The fencing abutting the pre-school consists of open panels and is therefore vulnerable to dogs’ mouths and heads penetrating the fence panels. Whilst the reserve has been used by dog owners and other recreational users without any major reported incidents, there is reference made in correspondence received by Council, to four (4) recent incidents of aggressive behaviour by off-leash dogs towards other dogs and people. There is also reference to four (4) separate incidents of off-leash dogs not being under effective control, resulting in unwanted and intimidatory interaction with adults and children.

The Site Suitability Assessment Report (Attachment 1) undertaken by Council’s Environment and Sustainable Living Department identifies a number of additional safety and amenity risks, including the potential for increased dog faecal matter, barking nuisance and parking demand. Concerns were raised regarding the reduced access to open space and opportunities for social connection and recreation for children and families, as well as older residents, resulting from conversion to off-leash. The qualitative data from the online survey revealed considerable concern by and for families with young children in relation to potential risks to their safety and access to open space. This concern was reflected in the comments of both those with a preference for the reserve remaining on-leash and those with a preference for off-leash on a timeshare basis. There were mixed views, however, in relation to the potential impact of the proposal on older residents. On the one hand, a common theme related to the opportunity afforded to older residents who lived locally to connect with the community with relative ease (in comparison to Pridmore Park which is perceived to be a fair distance to walk to). Conversely, there was concern expressed over older residents being jumped on and/or rushed at by dogs being exercised off-leash. Furthermore, the Boroondara Open Space Strategy 2013 does not typically support dog off-leash reserves in ‘neighbourhood’ open space areas, like Smart Street Reserve. Rather, it encourages pedestrian activity more broadly and thereby highlights the importance of access to open space for a wider variety of users. There is also uncertainty regarding the need for another off-leash reserve given the area is already well-serviced by four (4) off-leash reserves. Whilst officers do not support the proposal, it is nonetheless open to Council to consider adoption of Smart Street Reserve as a designated off-leash reserve with or without time restrictions. MOTION Moved Councillor Hurd Seconded Councillor Sinfield That Council resolve to: 1. Amend Council’s Order in Council No.1 to include Smart Street Reserve,

Hawthorn as a designated dog off-leash reserve between the hours of 6.00pm and 7.30am the following day, 7 days a week, for a twelve month trial period.

2. Complete the statutory process by publishing the Amended Order in the

Victorian Government Gazette and the Progress Leader. 3. Officers monitor Smart Street Reserve over the twelve month trial period

and review the suitability of the reserve for future use as a designated dog off-leash reserve and provide a report to Council.

8. General business 8.1 Leave of Absence - Councillor Hurd Councillor Hurd requested a leave of absence from Council for the period 31 March to 7 April 2019 inclusive. Councillor Hurd then declared a direct conflict of interest in accordance with Section 77B of the Local Government Act 1989. Councillor Hurd advised that nature of the interest was “I wish to apply for a leave of absence for the period 31 March to 7 April 2019 inclusive”. Councillor Hurd left the left the Chamber at 7.30pm prior to consideration and vote on this item. MOTION Moved Councillor Parke Seconded Councillor Sinfield That Council resolve to grant a leave of absence to Councillor Hurd for the period 31 March to 7 April 2019 (inclusive).
