ONLINE BETTING - LEGALISATION & REGULATION-THE WAY FORWARD

Abstract
Purpose - The aim of this paper is to create awareness of the social ills and threats related to online
gaming which affect Malaysia and the International society such as money laundering via online
gaming and evasion of tax. It also includes suggestions of countermeasures and regulations that could
be implemented in Malaysia.
Design/methodology/approach - The paper achieves this by examining the accessibility of online
gambling in Malaysia and the law and regulations available in Malaysia to combat the existence of
online gambling. Initiatives taken by the Malaysian government will be scrutinised in this paper. In
addition, the paper will take a broad view of other jurisdictions like the United Kingdom, United States
and the available international law and regulations on online gambling such as the 'European
Commission Green Paper: Online Gambling in the Internal, 2011'. Further, the paper will also examine
the legislation of Australia such as the Interactive Gaming Act 2001. Also included are suggestions of
possible mechanisms to regulate online gambling activities in Malaysia.
Findings - Malaysia has legislation on gambling which does not specifically address online gambling.
Suggestions for revision of the laws to regulate online gambling have been included.
