Summary of Recommendations of the Heritage Council of NSW to the Minister for Planning
The Heritage Council of NSW and its committees made the following recommendations to the Hon. Frank Sartor,Minister for Planning in 2006-07. The full minutes of HeritageCouncil meetings and recommendations are available onlineat www.heritage.nsw.gov.au.
Heritage Council of NSWBraidwood Exemption Review2 August 2006The Heritage Council: Resolve that the Heritage Council recommend to theMinister, in accordance with section 57(2) of the HeritageAct, that, by order to be published in the GovernmentGazette following exemption be granted:
HERITAGE ACT, 1977Order under Section 57(2) of the Heritage Act, 1977
I, the Minister for Planning, pursuant to section 57(2) of the Heritage Act 1977, on the recommendation of theHeritage Council of New South Wales, do by this Ordergrant exemptions from section 57(1) of the Heritage Act1977, described in Schedule B in relation to the landdescribed in Schedule A.

SCHEDULE AAll those pieces or parcels of land in the Parishes ofBraidwood, Coghill, Boule and Percy, County of SaintVincent shown to be within the State Heritage Registercurtilage on the plan catalogued HC 2008 in the Office of the Heritage Council of New South Wales.
SCHEDULE BEXEMPTIONS TO SUBSECTION 57(1) OF THE HERITAGEACT 1977
The following development does not require approval unders. 57(1) of the Act:
1. Integrated development for work to a private owner-occupied house for which consent has been granted by the consent authority which is consistent with thegeneral terms of proposed approval which have beenprovided to the consent authority by the Heritage Council.
The general terms of proposed approval issued by the Heritage Council may require the submission of an application under s. 60 of the Heritage Act which will prevail over this exemption.
2. Integrated development for which the consent has beenmodified by the consent authority pursuant to s. 96 of theEnvironmental Planning and Assessment Act 1979 in amanner which is consistent with any comments providedby the Heritage Council to the consent authority.
NOTE 1: ’Integrated development’ and ’consent authority’have the same meaning as in the Environmental Planningand Assessment Act 1979. ’General terms of approval’means the ’general terms of any approval proposed to be granted by the approval; body in relation to thedevelopment’, as used in Division 5 of Part 4 of theEnvironmental Planning and Assessment Act 1979.
NOTE 2: Integrated development which is exempt under 2 is not subject to the requirement in s. 65A of the Act in relation to modification of existing approvals.
Review of Standard Exemptions2 August 2006The Heritage Council:
1. recommend that the Minister for Planning, in accordance with section 57(2) of the Heritage Act, by order to be published in the Government Gazette, revoke the Schedule of Exemptions to section 57(1) of the Heritage Act 1977 published in the GovernmentGazette on 4 April 2006 and grant the replacementstandard exemptions described in Annexure A to the report.
2. revoke the exceptions to sections 139(1) and (2) of the Heritage Act published in the Government Gazette on 18 February 2000 and 4 April 2006 and create, inaccordance with section 139(4) of the Heritage Act, by Order to be published in the Government Gazette,exceptions to the requirement for an excavation permit as described in Annexure B to the report.
Review of Delegations to State Agencies2 August 2006The Heritage Council resolved to:
1. seek the consent of the Minister, in accordance withsection 169(3) of the Heritage Act, to delegate certain ofits functions to the Executive Director, Tenant and AssetManagement Services of the Sydney Harbour Foreshore

Authority, as specified in column 1 of Schedule A, subjectto the conditions listed in column 2 of Schedule A andthe general conditions in Schedule B, as contained inAnnexure A, in relation to land for which Sydney HarbourForeshore Authority is the consent authority under theEnvironmental Planning and Assessment Act 1979 andto revoke the previous delegation to the Director BuiltEnvironment, Sydney Harbour Foreshore Authorityconsented to by the Minister on 30 April 2002;
2. seek the consent of the Minister, in accordance withsection 169(3) of the Heritage Act, to delegate certain of its functions to the Executive Director Cultural Heritageof the Department of Environment and Conservation, as specified in column 1 of Schedule A, subject to theconditions listed in column 2 of Schedule A and thegeneral conditions in Schedule B, as contained inAnnexure B, in relation to land which is managed by the Department of Environment and Conservation, and to revoke the previous delegation to the ManagerCultural Heritage Division of the National Parks andWildlife Service consented to by the Minister on5 September 2002; and
3. authorise the Chair of the Heritage Council to sign the instruments of delegation on behalf of the HeritageCouncil in accordance with the Minister’s consent.
Port Macquarie Government House Site4 October 2006
The Heritage Council recommended to the Minister theprovision of a $70,000 grant to Mr Peter Kuhn to assist withthe provision of an on-site interpretative centre within thenew ’FOCUS’ development at 2 Clarence Street, PortMacquarie.
Revised Section 57(1) Delegations to Historic Houses Trust of NSW 6 June 2007
The Heritage Council resolved to:
1. advise the Minister, in accordance with section 57(2) of the Heritage Act, to:
a. revoke the existing exemptions made to the HHT undersection 57(2) of the Heritage Act; and
b. under section 57(2) of the Heritage Act grant anexemption from all section 57(1) activities to propertiesowned or managed by HHT and listed on the State
Heritage Register as outlined in Annexure A with thefollowing conditions:
i. that the Historic Houses Trust provide an annualreport to the Heritage Council on future worksproposed for its properties;
ii. that the Historic Houses Trust advise the HeritageOffice archaeologists of any proposed worksrequiring major excavation at its properties toallow due consideration of the need for additionalarchaeological work;
iii. that the Director of the HHT must lodge allarchaeological monitoring or excavation reportsprepared with the Heritage Office library oncompletion after review by Heritage Officearchaeologists;
iv. that the HHT employ as required a consultanthistorical archaeologist with appropriatearchaeological qualifications, knowledge, skills and experience and the Director of the HHT mustobtain the advice of that person about the heritagesignificance of the archaeological resource and/orthe impact of the development proposal on theheritage significance of the archaeological resource,and take that advice into account;
v. that the Director of the HHT must take intoaccount as far as practicable the cumulative effectof approvals on the heritage significance of theitem and on the heritage resource of its area; and
vi. that the Director of the HHT must ensure thatapprovals are in accordance with any requirements,guidelines, regulations and general conditionsissued by the Heritage Council. The Director of theHHT may impose additional conditions which donot conflict with any Heritage Council conditions.
c. sign the instrument of delegation at in accordance withthe Minister’s consent; and
d. in addition to the above the Heritage Council requires a formal annual reporting mechanism to be establishedunder which the HHT would report to the HeritageOffice / Heritage Council on its works program for the previous year undertaken under the exemptions.The form this takes can be decided in discussionbetween the HHT and the Heritage Office.

Summary of Funding Programs 2006-07
The table below details 194 projects approved in the year to the end of June 2007, totalling $2,754,525 under the Heritage Incentives Program.
Funding totalling $5,123,557 was allocated in the 2005-06 financial year under the 2006-08 Heritage Incentives Program for work to be undertaken in 2006-07 and 2007-08. For full details of the 287 projects funded last year, see last year’s annualreport, pages 77-99.
Note that this is a two-year program. This year we administered the first year of the Heritage Incentives Program for 2006-08.

Program 10: Local Government Heritage Management Program167 new projects were approved in 2006-07 totalling $2,449,452 over two years.
Multiple year funding has been provided to local government since 2002-03 as follows:
• in 2005-06 one hundred and thirty-three projects were approved totalling $696,541
• in 2004-05 thirty-six projects were approved totalling $262,832. Top-up funding was also approved for 23 previously approvedprojects totalling $54,000.
• in 2003-04 thirty-one projects were approved totalling $281,242 over two years.
• in 2002-03 two hundred and fifteen projects were approved totalling $2,617,949 over three years.

Disability Action Plan
Meetings of the Heritage Council of NSW are held at thepremises of the Heritage Office, Department of Planning. The Heritage Office is fully accessible to disabled visitors and staff. Where possible, within the constraints of a historicbuilding, the design complies with the Design for Accessand Mobility Standard AS1428.1/2001. The Heritage Council’s Fire, Access and Services AdvisoryPanel have incorporated the provision of advice on disabledaccess to heritage buildings as part of its brief.

Ethnic Affairs Priority Statement
The Heritage Council of NSW is committed to the NSWPrinciples of Multiculturalism. We encourage all parts of thecommunity to identify and celebrate their heritage and provideprograms and incentives to assist community groups assessand manage their special heritage places and objects.
The NSW Government’s key objectives are outlined in theWhite Paper Cultural Harmony The Next Decade 2002 – 2012.They are: leadership to encourage and value a culturallydiverse society through the establishment of supportive policy;legal and planning frameworks; community harmony andaccess; equity within the framework of social justiceobligations and economic and cultural opportunities.

These principles are incorporated into the activities of theHeritage Council of NSW as defined by its Strategic Plan2005-10. A summary of progress in 2006–07 is set out below:
• the Heritage Council of NSW is committed to the use ofplain language in the preparation of all publications,including the quarterly newsletter Heritage NSW;
• one of the Heritage Council’s priorities under the HeritageIncentives Program is to offer funding to assist ethniccommunities to identify, assess and manages places,objects and collections they value;
• projects funded under the Heritage Incentives Program in 2006-07 included:
– To identify and record information about Chinesepersons who lived and worked in Murrumburrah and surrounding villages between 1860-1960
– To arrange, catalogue and conserve the photographicarchives of Mervyn Bishop over the past 40 years, fromAboriginal cadet at the Sydney Morning Herald toeducator, artist and commissioned photographer
– To publish a list of known families of Huguenot origin in Australia, complete with dates of arrival and sources
– To stabilise the well, fencing and other works to secure the Vineyard Haven, New Italy Settlementarchaeological site

Budgets and Financial Statements
The Heritage Council of NSW does not hold any assets or operate a budget. Under section 106 of the Heritage Act 1977 funding for loans or grants can be made by theMinister on the recommendation of the Heritage Council.This funding is managed by the Heritage Office, Departmentof Planning. The financial statements of the Department ofPlanning can be viewed in the NSW Department of PlanningAnnual Report 2006-07.

Risk Management and Insurance Activities
Members of the Heritage Council of NSW are coveredthrough the Heritage Office, Department of Planninginsurance arrangements for activities relating to HeritageCouncil meetings and workers’ compensation. The HeritageOffice, Department of Planning, carries a comprehensiverange of insurance through the Treasury Managed Fundcovering property, public liability, motor vehicle, workers’compensation and other contingencies. This cover has fewexclusions. The annual premium is paid for the current yearand this arrangement of self insurance is reviewedperiodically to ensure that it remains adequate.

Services relating to the Heritage Council of NSW areprovided to the public by the Heritage Office, Departmentof Planning. The Heritage Office has developed a Guaranteeof Service to guide its communications with the public andthe quality of services provided. Consumer Response
We receive letters and emails from the public on theactivities of the Heritage Council of NSW and theperformance of the Heritage Office, Department of Planning.We are committed to handling public feedback courteouslyand efficiently, and, in the case of formal complaints, toresponding to issues quickly and equitably.
In 2006-07 no complaints were received
We received 44 written compliments on a range of issues,including listings, the processing of applications to theHeritage Council, grants and funding, presentations andtraining, quality of service provided by Heritage Office staff,library service, Heritage NSW and Maritime Heritage Online.The community event held to commemorate the loss of theIron Knight generated a high level of positive feedback.

Freedom of Information
Under the Act the public has the right to apply for access to certain information relating to the Heritage Council ofNSW and its decisions. This information covers a wide range of areas and subjects that do not infringe personalprivacy policies. Requests are now processed through theFOI Unit of the Department of Planning. For information onapplications made under the provisions of the Freedom ofInformation Act 1989 to the Heritage Office, Department ofPlanning, see the NSW Department of Planning AnnualReport 2006-07.

Privacy Management Plan
The Heritage Council of NSW respects the privacy ofmembers of the public who deal with the council through its heritage activities and meetings. Correspondence,minutes and records of the Heritage Council are managedby the Heritage Office, Department of Planning, which as a government department complies with the Privacy andPersonal Information Protection Act 1998.
In accordance with the Act, the Department of Planning hasdeveloped a privacy management plan. The plan identifiespersonal information held by the Department of Planning,including the Heritage Office, and sets out obligations foremployees, guidelines for the storage and dissemination ofinformation and procedures for lodging complaints and/orinternal reviews.
The Heritage Office, Department of Planning, received noapplications to access personal information in terms of thislegislation during 2006-07.
