lngevolge artikel 3JA(2) van die Ordonnansie op Dorpe en Grondverdeling J 963 (Ordonnansie J I van I963) word hierby beken~gemaak dat ek die voorwaardes uiteengesit in die Bylae by Prok lamasie 35 van J 973 kragtens genoemde ar­t ike I 31 A(2) verander het soos in die Bylae uiteengesit.

SCHEDULE

Paragraph 4 is hereby amended -

(a) by the insertion after subparagraph G, of the following subparagraphs:

"G I . ADDITIONAL CONDITIONS IN RESPECT OF ERF 2018:

(a) The erf may be used for residential pur­poses only.

(b) Only one building, designed and destin­ed for occupation by only one famil y, with the necessary outbuildings, sha ll be erected on the erf.

(c) There shal l not be more than three (3) garages erected on the erf.

(d) The building value of the main building, exc luding the outbuildings, sha ll be at least R60 000,00 (sixty thousand rand).

G 2. ADDITIONAL CONDITIONS IN RESP ECT OF ERF 2019:

(a) The erf may be used for residential pur ­poses on ly.

(b) The building value of the main building, exc luding the outbuildings, shall be at least R60 000,00 (sixty thousand rand) in the case of a sing le residence.

(c) The building value of the main bui lding, exc luding the outbuildings, shall be at least R100 000,00 (one hundred thou­sand rand) in the case of dup lex flats or blocks of flats."; and

(b) by the substitution in the heading of sub­paragraph H for the expression "G" of the ex­press ion "G 2. ".

DECLARATION OF HAKHASEB TO BE AN APPROVED TOWNSHIP

Under section 13 of the Townships and Divisions of Land Ordinance, 1963 (Ordinance 11 of 1963), I hereby declare the area represented by General Plan H. 50(A.205/83) to be an approved township.

Paragraaf 4 word hierby gewysig -

(a) deur die volgende subparagrawe na sub­paragraaf G in te voe~:

"Gl. BYKOM END E VOORWAARDES TEN OPSIGTE VAN ERF 20 18:

(a) Die erf mag slegs vir woondoeleindes gebruik word .

(b) Slegs een gebou, ontwerp en bestem vir bewoning deur s legs een ges in, met die nodige buitegeboue, mag op die erf opgerig word.

(c) Daar mag nie meer as drie (3) motor­huise op die erf opgerig word nie.

G2. BYKOMENDE VOOR WAARDES TEN OPSIGTE VAN ERF 2019:

The conditions subject to which the application for permission to establish the township concerned has been granted, are set forth in the Schedule in terms of the said section 13.

SCHEDULE

I. NAME OF TOWNSHIP

The township shall be called Hakhaseb.

2. COM POSITION OF TOWNSHIP

The township comprises 760 erven numbered 1 to 352, 372 to 496, 499 to 722, 728 to 784, 786, 787, one open space numbered 785 and streets as indicated on General Plan H. 50(A.205/83 ).

3. RESERVED ERVEN

The following erven are reserved as follows:

(a) For the Government of the Territory: ·

(i) erven 3 and 237 for ed ucational pur­poses

(ii) erf 732 for a clinic

(b) For purposes of the local authority:

(i) erven 707, 728, 730, 731 and 733 for general municipal use

(ii) erf 683 for a municipal creche (iii) erven 432 and 784 for municipal com-

munity halls (iv) erf 1 for municipal sports grounds (v) erven 2 and 388 for cemeteries (vi) erf 5 I 1 for an electrical sub-station for

municipal purposes

4. CONDITIONS OF TITLE

A. The following conditions shall be registered in favour of the local authority against the title deeds of all erven, other than those referred to in paragraph 3:

(1) It sha ll not be permissible to drill or excavate for water on the erf.

(2) No dairy, stable, cowshed, abattoir, piggery, bakery, sausage facotry or any offensive trade whatsoever shall be es­tab lished or conducted on the erf.

Die voorwaardes ingevolge waarvan die aan­soek om verlof tot stigting van die betrokke dorp toegestaan is, word ingevolge genoemde artikel 13 in die Bylae uiteengesit.

BYLAE

1. NAAM VAN DORP

Die dorp heet Hakhaseb.

2. SAMESTELLING VAN DORP

Die dorp bestaan uit 760 erwe genommer 1 tot 35~372tot496,499tot722,728tot784,786, 787, een oop ruimte genommer 785 en strate soos aangedui op Algemene Plan H. 50(A. 205/83).

3. GERESERVEERDE ERWE

Die volgende erwe word soos volg gereserveer:

(a) Vir die Goewerment van die Gebied:

(i) erwe 3 en 237 vir onderwy_sdoeleindes (ii) erf 732 vir ' n kliniek.

(b) Vir doeleindes van die plaaslike bestuur:

(i) erwe 707. 728, 730, 731 en 733 vtr algemene munisipale gebruik

(ii) erf 683 vir 'n munisipale creche (iii) erwe 432 en 784 vir munisipale ge-

meenskapsale (iv) erf 1 vir munisipale sportgronde (v) erwe 2 en 388 vir begraafplase (vi) erf 511 vir 'n elektriese distribusie­

stasie vir munisipa1e gebruik.

4. TITELVOORWAARDES

A. Die volgende voorwaardes moet ten gunste van die plaaslike bestuur geregistreer word teen die titelbewyse van aile erwe buiten die genoem in item 3 :

(1) Op die erf mag nie na water geboor of gegrawe word nie.

(2) Geen melkery, stat, koeistal, ·abattoir , varkhok, bakkery, worsfabriek of enige hinderlike bedryf hoegenaamd mag op die erf aangebring of bestuur word nie.

For the purposes of this paragraph "offensive trade" shall mean any of the trades, businesses, works or insti tu­tions mentioned in regulation 1(a) of the Reuglations promulgated under Government Notice 141 dated 10 November 1926, as amended.

(3) Except with the permission of the local authority no bricks, ti les, earthenware pipes or any other articles of a like nature shall be made on the erf for any purposes other than the erect ion of a building on the erf.

(4) No cattle, sheep, pigs, goats, baboons, monkeys, beasts of prey or draught anima ls sha ll be kept on the erf.

(5) No buildings or structures or any por­t ion thereof (except boundary walls, fences, fire walls and ra ilway lines), as the case may be sha ll be erected within 5 metres of any street boundary or within 3 metres of any latera l or rear boundary of the erf.

Fo r the puposes of this paragraph "street boundary" shall mean any boundary common to a street, " lateral boundary" sha ll mean any boundary with at least one end on a street boun­dary and "rear boundary" sha ll mean any boundary other than a lateral or street boundary.

(6) There sha ll be no obstruction or devia­tion of any natural course of stormwater over the ert: without the approval of the local authority.

B. The following conditions shall be registered in favour of the local authority against the title deeds of the following erven:

(I) Erven 4 to 131, 133 to 236,238 to 317, 322 to 325, 330, 336, 337, 345 to 35~ 372 to 387, 391 to 431, 447 to 466,468 to 482, 485 to 496,499 to 510,512 to 567, 569 to 682, 684 to 705, 709, 710, 7 13 to 71 6, 7 18 to 721,734 to 783,786 and 787:

(a) The erf shall be used for res idential purposes only.

(b) Only one building, designed and destined for occupation by only one family , with the necessary out­buildings, shall be erected on the erf.

Vir die doe leindes van hierdie paragraaf beteken "hinderlike bedryf' enigeen van d ie bes ighede, bedrywe, werke of inrigtings genoem in regulasie 1(a) van die Regu lasies afgekondig by Goewermentskennisgewing 141 van 10 November 1926, soos gewysig.

(3) Bu iten met die toestemming van die plaas like bestuur mag geen stene, tee ls, erdepype of enige ander artike ls van soortge lyke aard vir en ige ander doel as die oprigting van 'n gebou op die erf. op die erf gemaa k word nie.

(4) Geen beeste, skape, varke, bokke, bobbej ane, ape, roof- of trekdiere mag op die erf aangehou word nie.

(5) Geen geboue of strukture of enige deel daarv a n (b e hal we g r e ns mur e , omhe in in gs, bra ndmure en spoor­lyne), na gelang, mag binne 5 meter van enige straatgrens of binne 3 meter van enige sy- of agtergrens van die erf opgerig word nie.

Vir doeleindes van hierdie paragraaf be­teken "straatgrens" enige grens ge­meenskaplik met ' n straat, "sygrens" enige grens wat minstens een eindpunt op 'n straatgrens het, en "agtergrens" en ige ander grens as 'n sy- of straat­grens.

(6) Daar mag geen hindernis of verlegging van enige natuurlike stormwaterge­leiding oor die erf wees sonder goed­keuring van die plaaslike bestuur nie.

B. Die volgende voorwaardes moet ten gunste van die plaaslike bestuur geregistreer word teen die titelbewyse van die volgende erwe:

(a) Die erf mag slegs vir woondoel­eindes gebru ik word.

(b) Slegs een gebou, ontwerp en bestem vir bewoning deur slegs een gesin, met die nodige buitegeboue, mag op die erf opgerig word.

(c) Subject to the provtswns of paragraph (d), the buildings on the erf sha ll be occupied by one family only .

(d) Only one bona fide domestic ser­vant who actually and exclusively performs his services on the erf, sha ll be permitted to reside on the erf or any portion thereof or to oc­cupy it in any other manner.

(2) Erf 467:

(a) The erf shall be used for flat or group housing purposes only.

(b) Each separate residential unit shall be occ~pied by one family only.

(c) In respect of each residential unit which is occupied by a separate family not more than one bonafide domestic servant who actually and exclusively performs his services on the erf, shall be permitted to reside on the erf or any portion thereof or to occupy it in any other manner.

(3 ) Erven 319 to 321.326 to 328,331 to 335. 338 to 344, 35 I, 352, 389, 390. 708. 7 I I. 71 7 and 722:

(a) The erf shall be used for residential purposes only.

(b) Not more than two residences, designed and destined for occupa­tion by one fami ly per residence on­ly, with the necessary outbuildings, shall be erected on the erf.

(c) In respect of each residence not more than one bonafide domestic servant who actually and exclusive­ly performs his services on the erf, shall be permitted to reside on the erf or any portion thereof or to oc­cupy it in any other manner.

(4) Erven 318, 433 to 446, 483 and 484:

(a) The erf shall, subject to the provi­sions of the proviso to paragraph (b), be used for business purposes only.

(c) Behoudens die bepalings van paragraaf (d), mag slegs een gesin die geboue op die erf bewoon.

(d) Slegs een bona fide huisbediende wat sy dienste werklik en uitsluitlik op die erf lewer, mag toegelaat word om op die erf of enige gedeelte daar­van te woon of dit op enige ander wyse te okkupeer.

(2) Erf 467:

(a) D ie erf mag slegs vir woonstel- of groepbehuisingsdoeleindes gebruik word.

(b) Elke afsonderlike wooneenheid mag deur slegs een gesin bewoon word.

(c) Ten opsigte van elke wooneenheid wat deur 'n afsonderlike gesin be­woon word, mag hoogstens een bona fide huisbediende wat sy dienste werklik en uitsluitlik op die erf lewer, toegelaat word om op die erf of enige gedeelte daarvan te woon of dit op enige ander wyse te okkupeer.

(3) Erwe 319 tot 321, 326 tot 328, 331 tot 335, 338 tot 344, 351 , 352, 389, 390, 708, 711, 712, 717 en 722 :

(a) Die erf mag slegs vir woon ­doeleindes gebruik word.

(b) Hoogstens twee wonings, ontwerp en bestem vir bewoning deur slegs een gesin per woning, met die nodige buitegeboue, mag op die erf opgerig word.

(c) Ten opsigte van e lke woning mag hoogstens een bona fide huisbe­diende wat sy dienste werklik en uit­slu it lik op die erf lewer, toegelaat word om op die erf of enige ge­dee lte daarvan te woon of dit op en ige ander wyse te okkupeer.

(4) Erwe 318, 433 , tot 446, 483 en 484:

(a) D ie erf mag, behoudens die be­palings van die voorbehoud by paragraaf (b), slegs vir besigheids­doe leindes gebruik word.

(b) Only one building, destined for business purposes, shall be erected on the erf: Provided that any building destined for industrial or residential purposes or for purposes of entertainment or training or of a scrap yard may be erected on the erf with the written consent of the local authority and subject to such con­ditions as the local authority may impose, in which case the erf may be used for the said purposes.

(c) Outbuildings may be erected on the lateral or rear boundary of the erf, provided that the wall erected on such boundary is a fire wall.

(5) Erven 132, 329, 568 and 706:

(a) The erf shall be used for a church or church hall or both a church and a church hall only.

(b) Only one main building, with the necessary outbuildings, shall be erected on the erf.

(c) The building value of the main building, excluding the outbuildings, shall be at least RIO 000,00.

(d) No living quarters shall be erected on the erf.

(6) Erf 729:

(a) The erf shall be used for purposes of a bottle-store and bar only.

(b) Outbuildings may be erected on the lateral or rear boundary of the erf, provided that the wall erected on such boundary is a fire wall.

(b) Slegs een gebou bestem vir be­sigheidsdoeleindes mag op die erf opgerig word: Met dien verstan~e dat 'n gebou bestem vir nywerheids-. woon - or vermaaklikheids­doeleindes of vir doeleindes van onderrig of 'n rommelwerf met die skriftelike toestemming van die plaaslike bestuur en onderworpe aan sodanige voorwaardes soos die plaaslike bestuur mag ople, op die erf opgerig mag word, in welke ge­val die erf dan vir bedoelde doel­eindes gebruik mag word.

(c) Buitegeboue mag op die sy - of agtergrens van die erf opgerig word mits die muur wat op sodanige grens opgerig is. 'n brandmuur is.

(5) Erwe 132, 329, 568 en 706:

(a) Die erf mag slegs gebruik word vir 'n kerk of 'n kerksaal of beide 'n kerk en 'n kerksaal.

(b) Slegs een hoofgebou, met die nodige buitegeboue, mag op die erf opgerig word.

(c) Die bouwaarde van die hoofgebou, buitegeboue uitgesluit, moet minstens R 10 000,00 wees.

(d) Geen woonkwartiere mag op die erf opgerig word nie.

(6) Erf 729 :

(a) Die erf mag slegs vir doeleindes van 'n drankwinkel en kroeg gebruik word.

(b) Buitegeboue mag op die sy- of agtergrens van die erf opgerig word mits die muur wat op sodanige grens opgerig is, 'n brandmuur is.

PROVISIONS APPLICABLE IN RELATION TO THE PREVENTION AND TERMINA­TION OF UNLAWFULL SQUATTING AND

MATTERS INCIDENTAL THERETO

Under the powers vested in me by Proclamation 181 of 19 August 1977, I hereby make the laws set out in the Schedule.

SCHEDULE

Deflnit ions

I. In this Proclamation, unless the context otherwise indicates -

(i) "building or structure" includes any hut, shack , tent or similar structure; (ii)

(i i) "department" means any department as defined in section 1 of the Government Ser­vice Act, 1980 (Act 2 of 1980); (i)

(iii) "local authority" means, subject to the provisions of section 12, the council of any municipality, or any village management board, or the Peri-Urban Development Board established by section 2 of the Peri­Urban Development Board Ordinance, 1970 (Ordinance 19 of 1970); (iii)

(iv) "Secretary" means the Secretary for National Health and Welfare. (iv)

Prohibition of unlawful presence of persons on or in any land, building or structure, and provision for the removal of such persons and buildings or structures erected by or for them

2. (I) Any person other than a person acting on the authority of any law or in the performance of his functions or duties as an employee employed in any department or local authority, who -

(a) without lawful cause enters upon or enters any land, building or structure; or

BEPALINGS VAN TOEPASSING MET BE­TREKKING TOT DIE VOORKOMING EN BEEINDIGING VAN ONREGMATIGE PLAKKERY EN AANGELEENTHEDE WAT

DAARMEE IN VERBAND STAAN

Kragtens die bevoegdhede my verleen by Prok lamasie 181 van 19 Augustus 1977, maak ek hierby die wette in die Bylae vervat.

Woordomskrywing

I. In hierdie Proklamasie, tensy uit die same­hang anders blyk, beteken -

(i) "departement" ' n departement soos omskryf in artikel 1 van die Regerings­dienswet, 1980 (Wet 2 van 1980); (ii)

(i i) "gebou of bouwerk" ook 'n hut, pondok, tent of soortgelyke struktuur; (i)

(iii) "plaaslike owerheid" , behoudens die be­palings van artikel 12, die raad van 'n munisipaliteit, of 'n dorpsbestuur, of die by artikel 2 van die Ordonnansie op die Raad vir Buitestedelike Ontwikkeling, 1970 (Or­donnansie 19 van 1970), ingestelde raad vir Buitestedelike Ontwikkeling; (iii)

(iv) "Sekretaris" die Sekretaris van Nasionale Gesondheid en Welsyn. (iv)

Verbod op onregmatige aanwesigheid van persone op of in grond of 'n gebou of bouwerk en voor­siening vir die verwydering van sodanige persone en geboue of bou werke deur of vir hulle opgerig

2. ( 1) 'n Ander per soon as 'n persoon wat op­tree op gesag van die een of ander wet of by die verrigting van sy werksaamhede of pligte as 'n werk nemer in diens by 'n departement of plaaslike owerheid, wat -

(a) grond of 'n gebou of bouwerk sonder wet­tige rede betree of binnegaan; of

(b) without the consent of the owner or lawful occupier of any land, building or structure, is on or in such land, building or structure,

shall be guilty of an offence and liab le on convic­tion to a fine not exceeding five hundred rand or imprisonment for a period not exceeding six months or to both such fine and such imprison­men t.

(2) Crimina l proceed ings instituted against any person for contraven ing subsection (l)(b) by hav­ing been on or in any land, build ing or structure at any specified time or dur ing any specified period, shall not be a bar to such proceedings against such person for any such contravention by having been on or in such land, building or structure at any other time or during any other period.

(3) If any person is convicted of any offence referred to in subsection (I) on account of his presence on or in any land, building or structure, the court convicting him may -

. (a) in addition to any penalty imposed for such otTence. make an order for the summ~y ejectment of such person from such land, building or structure;

(b) make such further orders, issue such in­structions and confer such authority as may reasonably be necessary -

(i) to give effect to the order of ejectment;

(ii) to bring about the removal of the said person and his family and dependants to such other place within or outside the area of jurisdiction of such court as it may determine;

(iii) to ensure that any buildings or struc­tures erected or added by or for such person on, in or to land or any building are demolished and removed together with the contents thereof.

(4) If the magistrate of the district in which the place is situated to which persons have been removed under subsection (3), is satisfied on the ground of information furnished to him or on the ground of personal investigation, that such per­sons can be more suitably accommodated else­where or that they do not have suitable employ­ment within a reasonab le distance from the said place, the said magistrate may take such steps as he may deem to be reasonably necessary to remove the said persons to any other suitable

(2) Strafregtelike stappe gedoen teen 'n persoon weens oortreding van subartikel (l)(b) deurdat hy op 'n bepaalde tydstip of gedurende 'n bepaalde tydperk op of in grond of 'n gebou of bouwerk was. belet nie sodanige stappe teen bedoelde per­soon weens so 'n oortreding deurdat hy op 'n andcr tydstip of gedurende 'n ander tydperk op of in bedoelde grond, gebou of bouwerk was nie.

(3) lndien 'n persoon aan 'n in subartikel (I) bedoelde misdryf sk uldig bevind word weens sy aanwesigheid op of in grond of 'n gebou of bouwerk. kan die hof wat hom sku ldig bevind -

(a) benewens 'n straf weens daardie misdryf opgele, 'n bevel uitreik vir die summ iere uitsetting van daardie persoon van of uit be­doelde grond, gebou of bou werk :

(b) die bevele uitre ik, die instruk sies gee en die gesag verleen wat redelikerwys nodig is -

(i) om aan die uitsettingsbevel gevolg te gee;

(ii) om die verskuiwing van bedoelde per­soon en sy gesin en afhanklikes te be­werkstellig na die ander plek binne of buite die regsgebied van bedoelde hof wat die hof bepaal;

(iii) om te verseker dat geboue of bouwerke wat deur of vir bedoelde persoon op, in of aan grond of 'n gebou opgerig of toegevoeg is, gesloop en saam met die inhoud daarvan verwyder word.

(4) lndien die landdros van die d istrik waarin die plek gelee is waarheen persone kragtens sub­artikel (3) verskuif is, op grond van in ligting aan hom verstrek of op grond van persoon like onder­sock oortuig is dat daardie persone elders op meer gesk ikte wyse gehuisves kan word of dat bulle nie gesk ikte werk binne 'n redelike afstand van be­doelde plek het nie, kan bedoelde landdros die stappe doen wat hy redelikerwys nodig ag om be­doelde persone na 'n ander deur hom bepaalde ge-

place determined by him, within or outside his dis­trict and sha ll mutatis mutandis have the powers conferred upon a court by subsection (3).

Prohibition of erection or occupation of buildings or structures without the necessary approval, and provision for demolition and removal of buildings or structures so erected

3. ( 1) T he owner or lessee of land or any per­son exercising control over the land with the con­sent of the owner -

(a) who erects or causes or allows to be erected on such land any building or structure in­tended for human habitation, without the

- prior approval of the Secretary or any local authority of any plan or description of such building or structure required by law ; or

(b) who permits any person to occupy any building or structure so erected,

shall be guilty of an offence and liable on convic­tion to a fine not exceeding one thousand rand or to imprisonment for a period not exceeding twelve months or to both such fine and such im­prisonment.

(2) If in any prosecution for a contravention of subsection (I )(b) it is proved that any person oc­cupied the building or structure concerned, it shall be deemed until the contrary is proved, that the ac­cused permitted such person to occupy such building or structure.

(3) The court convicting any person of any offence referred to in subsection (1 ), may in addi­tion to any penalty imposed for such offence make an order that such person shall, at his own expense and within such period as the court may determine, demolish and remove the building or structure concerned.

(4) Any person who fails to comply with any order referred to in subsection (3), shall be guilty of an offence and liable on conviction to a fine not exceeding fifty rand or to imprisonment for a period not exceeding three months or to both such fine and such imprisonment.

(5) If any person ordered under subsection (3) to demolish and remove any building or structure fa ils to comply with the order, the local authority within whose area of jurisdiction that building or structure is situated, may cause it to be demolished and removed together with its contents and may recover the cost of demolition and removal from the said person.

Verbod op oprigting of bewoning van geboue of bouwerke sander nodige goedkeuring, en voor­siening vir sloping en verwydering van geboue of bou werke aldus opgerig.

3. (1) Die eienaar of huurder van grond of 'n persoon wat met die toestemming van die eienaar beheer oor die grond uitoefen -

(a) wat 'n vir menslike bewoning bedoelde gebou of bouwerk op daardie grond oprig, laat oprig of toelaat dat dit opgerig word, sonder die voorafverkree goedkeuring deur die Sekretaris of 'n plaaslike owerheid van 'n by wet vereiste plan of beskrywing van daardie gebou of bouwerk; of

(b) wat toe laat dat 'n persoon 'n aldus opgerigte gebou of bouwerk bewoon ,

is aan 'n misdryf skuldig en by skuldigbevinding stratbaar met 'n boete van hoogstens eenduisend rand of met gevangenisstraf vir 'n tydperk van hoogstens t waalf maande of met so wei daardie boete as daardie gevangenisstraf.

(2) Indien daar by 'n vervolging weens oor­treding van subartikel (l )(b) bewys word dat ' n persoon die bctrokke gebou of bouwerk bewoon bet. word dit geag, totdat die teendeel bewys word, dat die beskuldigde daardie persoon toegelaat bet om daard ie gebou of bouwerk te bewoon.

(3) Die hof wat 'n persoon aan 'n in subartikel (I) bedoe lde misdryf skuldig bevind, kan, benewens 'n straf weens daardie misdryf opgele, 'n bevel uitreik dat daardie persoon op eie koste en binne die tydperk wat die hof bepaal die betrokke gebou of bouwerk sloop en verwyder.

(4) 'n Persoon wat in gebreke bly om 'n in sub­art ike I (3) bedoelde bevel nate kom, is aan 'n mis­dryf sku ldig en by skuldigbevinding stratbaar met 'n boete van hoogstens vyftig rand of met gevangenisstraf vir 'n tydperk van hoogstens drie maande of met sowel daardie boete as daardie gev angen isstraf.

(5) Indien 'n persoon wat kragtens subartikel (3) beveel word om 'n gebou of bouwerk te sloop en te verwyder, in gebreke bly om die bevel na te kom, kan die p laaslike owerheid in wie se regsge­bied daardie gebou of bouwerk gelee is, dit laat s loop en saam met die inhoud daarvan verwyder en die koste van die sloping en verwydering op be­doelde persoon verhaal.

Demolition and removal of buildings or structures erected without consent of owner of land or con­trary to legal requirements.

4. (1) Notwithstanding anything to the con­trary in any law contained and without the authority of an order of court or prior notice of whatever nature to any person -

(a) the owner of land may demolish and remove together with its contents any building or structure intended for human habitation or occupied by human beings which has been erected or is occupied without his consent on such land;

(b) any building or structure intended for human habitation or occupied by human beings which has been erected on land within the area of jurisdiction of any local authority, without the prior approval of that or any former local authority of any plan or description of such building or structure required by law, may a t the expense of the owner of the land be demolished and removed together with its contents by the local authority or the Secretary or any of­ficer employed in his department and authorized thereto by him.

(2) If any owner of land in the area of jurisdic­tion of a local authority becomes aware that on such land any building or structure intended for human habitation or occupied by human beings has been erected or is being occupied without his consent, he shall forthwith notify such local authority or the Secretary thereof and if he fails to do so he sha ll be guilty of an offence and liable on conviction to a fine not exceeding five hundred rand or to imprisonment for a period not ex­ceeding six months or to both such fine and such imprisonment.

(3) Unless a person first satisfies the court on a preponderance of probabilities -

(a) that he is lawfully entitled to occupy the land on which any building or structure has been erected; and

(b) in the case of any person whose right of oc­cupation is based on the consent of any per­son other than the owner of such land, that such other person is lawfully entitled to allow other persons to occupy such land,

4. (I) Ondanks andersluidende wetsbepalings en sonder magtiging van 'n hotbevel of vooraf­gaande kennisgewing van watter aard ook al aan die een of ander persoon -

(a) kan die eienaar van grond 'n vir menslike bewoning bedoelde of deur mense be­woonde gebou of bouwerk wat sonder sy toestemming op daardie grond opgerig is of bewoon word, sloop en saam met die inhoud daarvan verwyder;

(b) kan 'n vir menslike bewoning bedoelde of deur mense bewoonde gebou of bouwerk wat op grond binne 'n plaaslike owerheid se regsgebied opgerig is sonder daardie of ' n vorige plaaslike owerheid se voorafverkree goedkeuring van 'n by wet vereiste plan of beskrywing van daardie gebou of bouwerk, op koste van die eienaar van die grond deur die plaaslike owerheid of die Sekretaris of 'n beampte in diens by sy departement deur hom daartoe gemagtig, gesloop en saam met die inhoud daarvan verwyder word.

(2) Indien 'n eienaar van grond in die regsge­bied van 'n plaaslike owerheid daarvan bewus word dat op daardie grond 'n vir menslike be­woning bedoelde of deur mense bewoonde gebou of bouwerk sonder sy toestemming opgerig is of bewoon word, stel hy onverwyld daardie plaaslike owerheid of die Sekretaris daarvan in kennis en in­dien hy in gebreke bly om dit te doen is hy aan 'n misdryf skuldig en by skuldigbevinding stratbaar met 'n boete van hoogstens vyfhonderd rand of met gevangenisstraf vir 'n tydperk van hoogstens ses maande of met sowel daardie boete as daardie gev angen isstraf.

(3) Tensy 'n persoon eers die hof op 'n oorwig van waarskynlikhede oortuig -

(a) dat hy wettiglik geregtig is om die grond te okkupeer waarop 'n gebou of bouwerk opgerig is; en

(b) in die geval van 'n persoon wie se reg van okkupasie gegrond is op die toestemming van 'n ander persoon as die eienaar van be­doelde grond, dat daardie ander persoon wettiglik geregtig is om ander persone toe te laat om die grond te okkupeer,

such first -mentioned person shall not have recourse to any court of law in any civil proceedings founded on the demolition or removal or intended demolition or removal of such building or structure under this section and it shall not be competent for any court of law to grant any relief in any such proceedings to such last-mentioned person.

Prohibition of dwelling or employing unless proper accommodation is available

5. (I) The Administrator-General may by notice in the Official Gazette and after consulta­tion with the local authority in whose area of jurisdiction any area defined in such notice is situated -

(a) prohibit any person of such category or class as may be mentioned in the notice from dwelling in any such area so defined unless -

(i) such person can deliver satisfactory proof to such local authority to the etrect that, while dwelling in the said defined area, he has suitable accommo­dation at his disposal; or

(i i) such person has obtained from such local authority written approval to dwell in the said defined area, for a period and in such a way and on the cona•tions, as may be prescribed;

(b) prohibit any person from employing in the area so defined any other person of such category or class as may be mentioned in the notice, as an employee of such category or class as may be so mentioned, unless such first -mentioned person has obtained from the said local authority a certificate to the effect that satisfactory arrangements have been made for proper accommodation in the said defined area or elsewhere for the said other person while employed as such an employee by such first-mentioned per­son.

(2) Any person performing any act in contra­vention of any prohibition under subsection (l) shall be guilty of an offence and liable on convic­tion to a fine not exceeding five hundred rand or to imprisonment for a period not exceeding six months or to both such fine and such imprison­ment.

Verbod op inwoning of indiensneming tensy ge­skikte huisvesting beskikbaar is

5. (l) Die Administrateur-generaal kan by ken­nisgewing in die Offisiele Koerant en na raad­pleging met die plaaslike owerheid in wie se regs­gebied 'n in die kennisgewing omskrewe gebied gelee is -

(a) 'n verbod plaas op 'n persoon van 'n in die kennisgewing vermelde kategorie ofklas om in 'n aldus omskrewe gebied te bly tensy -

(i) so 'n persoon bevred igende bewys aan sodanige plaaslike owerheid kan lewer dat hy oor geskikte huisvesting beskik terw}-1 hy in bedoelde omskrewe gebied bly; of .

(i i) so 'n per soon skriftelike goedkeuring van sodanige plaaslike owerheid verkry het om in die aldus omskrewe gebied, vir 'n tydperk en op die wyse en voor­waardes, soos voorgeskryf mag word, te bly;

(b) 'n verbod plaas op 'n persoon om in 'n aldus omskrewe gebied 'n ander persoon van 'n in die kennisgewing vermelde kategorie of klas ·in (Jiens te neem as werknemer van 'n aldus vermelde kategone of klas, tensy eersbe­doelde persoon van bedoelde plaaslike owerheid 'n sertifikaat verkry het dat be­vredigende reelings getref is vir geskikte huisvesting in bedoelde omskrewe gebied of elders vir bedoelde ander persoon terwyl hy by eersbedoelde persoon as 'n werknemer in diens is.

(2) 'n Persoon wat 'n handeling verrig in stryd met 'n verbod kragtens subartikel (1) is aan 'n misdryf skuldig en by skuldigbevinding strafbaar met 'n boete van hoogstens vyfhonderd rand of met gevangenisstraf vir 'n tydperk van hoogstens ses maande of met sowel daardie boete as daardie gev angen isstraf.

(3) For the purposes of subsection ( 1) "suitable accommodation" means accommodation which is not in contravention of any law, approved either generally or specifically, by a local authority and provided with the expressed or implied authority of the owner thereof, and "sutiable accommoda­tion" also includes -

(a) accommodation provided for a guest in an accommodation establishment, registered as such in accordance with the Accommo­dation Establishments and Tourism Or­dinance, 1973 (Ordinance 20 of 1973);

(b) accommodation supplied for patients in a hospital or similar institution as contem­p lated in the Hospitals Ordinance, 1972 (Ordinance 14 of 1972);

(c) accommodation lawfully provided by an educationa l institution, recognised as such by the Administrator-General, for a student or scho lar attending such institution;

(d) accommodation provided subject to the prescribed conditions in a township, hostel or in single or in married quarters or any other accommodation, recognised as ap­proved accommodation, under this or any other law;

(e) such other accommodation as may be deter­mined by the Administrator-General to be approved accommodation, by notice in the Official Gazette.

Prohibition of collection of certain funds

6. Any person who receives or solicits payment of anything by way of contribution or otherwise from any other person to be used directly or in­directly for any purpose relating to the organiza­tion of the presence of persons in or upon any land. building or structure contrary to the provi­sions of section 2 or to any order given or instruc­tion issued under that section or section 7, shall be gui lty of an offence and liable on conviction to a fine not exceeding one thousand rand or to im­prisonment for a period not exceeding twelve months or to both ~uch fine and such imprison­ment and -

(a) if the court trying the case is satisfied that anything serving as an exhibit in the case has been received by any person in contra­vention of the provisions of this section, the court shall declare any such thing to be forfeited for the benefit of the Central Revenue Fund;

' (3) Vir doeleindes van subartikel (l) sluit "ge­skikte huisvesting" in huisvesting wat nie strydig met enige wetsbepaling is nie, en in die algemeen of spesifiek deur 'n plaaslike owerheid goedgekeur is en wat met die uitdruklike goedkeuring van die eienaar daarvan, voorsien is, en "geskikte huisves­ting" sluit voorts ook in -

(a) huisvesting wat vir 'n gas in 'n huisves­tingsinrigting, wat as sodanig ingevolge die Ordonnansie op Huisvestingsinrigtings en Toerisme 1973 (Ordonnansie 20 van 1973), geregistreer is, voorsien word;

(b) huisvesting wat vir 'n pasient in 'n hospitaal of soortgelyke inrigting soos beoog in die Ordonnansie op Hospitale, 1972 (Ordon­nansie 14 van 1972), voorsien word;

(c) hu isvesting wat wettiglik deur 'n onderwys­inrigting wat deur die Administrateur-gene­raal as sodan ig erken word, en aan studente of skoliere wat sodanige inrigting bywoon, voorsien word;

(d) huisvesting wat onderworpe aan die voor­geskrewe voorwaardes van 'n dorpsgebied, hostel of enkel- of getroude kwartiere of enige ander huisvesting, wat as geskikte huisvesting ingevolge hierdie of enige ander wet goedgekeur is, voorsien word;

(e) sodan ige ander huisvesting wat ingevolge 'n kennisgewing in die Offisii/le Koerant deur die Administrateur-generaal as geskikte huisvesting bepaal en goedgekeur is .

. Verbod op insameling van sekere fondse

6. 'n Persoon wat enigiets by wyse van 'n bydrae of andersins ontvang of van 'n ander per­soon vra om regstreeks of onregstreeks gebruik te word vir die een of ander doel wat in verband staan met die organisasie van die aanwesigheid van persone op of in grond of 'n gebou ofbouwerk in stryd met die bepalings van artikel 2 of met 'n bevel of instruksie kragtens daardie artikel of ar­tikel 7 uitgereik of gegee, is aan 'n misdryf skuldig en by skuldigbevinding strafbaar met 'n boete van hoogstens eendu isend rand of gevangenisstraf vir 'n tydperk van hoogstens twaalf maande of met sowel daardie boete as daardie gevangenisstraf en

(a) indien die hof wat die saak verhoor oortuig is dat enigiets wat as bewysstuk daarin dien deur die een of ander persoon in stryd met die bepalings van hierdie artikel ontvang is, moet die hof so-iets ten voordele van die Sentrale lnkomstefonds verbeurd verklaar;

(b) if the said court is satisfied that the person conv icted has received any money other than money declared to be forfeited as aforesa id, in contravention of the said provisions, the court may make an order that he shall pay to the Secretary for Finance an amount equal to the amount of such other money and thereupon such order shal l be executed against him as if it were an order in a c ivil suit and any amount of money recovered thereunder s ha ll be deposited in the Central Revenue F und.

Applications for removal of persons from land or buildings. and ejectment orders

7. ( 1) The magistrate of the district in which any land or bui !dings are situated, may hear an application for an order for the removal of persons from such land or building -

(a) if the application is made by the owner or lawfu l occupier of such land or building or by the head of any department or any of­ficer employed in any department authoriz­ed by the head thereof or the local authority in whose area of jurisdiction such land or building is situated; and

(b) if at the same time there are submitted to the magistrate affidavits on oath in support of the application and an affidavit stating that copies or translations of the first-mentioned affidavits in the Afrikaans and the English lang uages, have been posted in a prominent place on the said land or on or near the said building together with a notice in the said lang uages of the date of the contemplated app lication, which shall be a date not less than three days after the date of posting of the said copies or translations.

(2) If the magistrate, after consideration of the affidavits referred to in subsection (1) and of affi ­davits submitted to him by persons affected by the application in rep ly to the first-mentioned affida­vits and of representat ions by their legal represen­tatives is satisfied -

(a) in the case of any application by the owner or lawfu l occupier of the land or building concerned, that the persons concerned entered upon or entered the said land or bui lding without leave of the said owner or occupier of the said land or bui lding a~d that they are remaining thereon or therem

(b) indien bedoelde hof oortuig is dat die veroordee lde persoori ander ge ld as geld wat kragtens paragraaf (a) verbeurd verklaar is, in stryd met bedoelde bepalings ontvang het, kan die hof 'n bevel uitreik dat hy 'n be­drag gelykstaande aan die bedrag van daar­die ander geld aan die Sekretaris van Finan­sies betaal en daarna word daardie bevel teen hom ten uitvoer gele as of dit 'n bevel in 'n sivie le geding was en word enige be­drag ge ld daarkragtens verhaa l, in die Sen­trale Inkomstefondsgestorrt.

Aansoeke om verwydering van persone van grond of geboue, en uitsellingsbevele

7. (1) Die landdros van die distrik waarin grand of 'n gebou gelee is, kan ' n aansoek om 'n bevel vir die verwydering van persone van daardie grand of gebou aanhoor -

(a) indien die aansoek gedoen word deur die eienaar of wettige okkupeerder van daardie grand of gebou of deur die hoof van ' n departement of 'n beampte in diens by ' n departement deur die hoof daarvan daartoe gemagtig of die plaaslike owerheid in wie se regsgebied daardie grand of gebou gelee is; en

(b) indieri daar terselfdertyd aan die landdros verstrek word beedigde verklarings ter staw­ing van die aansoek en ' n beed igde ver­klaring dat afskrifte of vertalings van eers­bedoelde beedigde verklarings in die Afrikaanse en die Engelse tale, op ' n in die ooglopende plek op bedoelde grand of op of naby bedoelde gebou opgeplak is tesame met 'n kennisgewing in bedoelde tale van die datum van die beoogde aansoek, wat 'n datum is minstens drie dae na die datum w aarop bedoelde afskrifte of vertalings opgeplak word.

(2) Indien die landdros, na oorweging van die in subartikel (1) bedoelde beedigde verklarings en van beedigde verklarings aan hom verstrek deur persone wat deur die aansoek geraak word in antwoord op eersbedoelde beedigde verklarings, en van vertoe deur hul regsverteenwoordigers oortuig is -

(a) in die geval van 'n aansoek deur die eienaar of wettige okkupeerder van die betrokke grand of gebou, dat die betrokke persone sander die verlof van bedoelde eienaar of okkupeerder bedoelde grand of gebou be­tree het of binnegegaan het en dat hulle daarop of daarbinne sander sy toe-

(b)

without his consent and refuse, despite war­ning, to depart therefrom; or

in the case of all other applications that the persons concerned entered upon or entered the land or building and are congregating thereon or therein, whether with the consent of the owner or lawful occupier or not; and

(c) in the case of all applications that the con­ditions under which the persons concerned are living on or in the said land or building a re such that unless removed therefrom, the hea lth or the safety of the public in general or of any class of persons, including the per­sons aforesaid, may be endangered,

the magistrate, after consultation with the local authority within whose area of jurisdiction the land or building is situated; may make an order for the summary ejectment of the said persons from the said land or building and shall mutatis mutandis have the powers conferred upon a court by section 2(3Xb).

(3) The provisions of sect ion 2(4) shall mutatis mutandis apply in respect of persons removed un­der subsection (2) of this section.

Establishment of an emergency camp by local authority

8. (I) Any local authority may, and if so directed. after consultation by the Administrator­Genera l or the Secretary, shall estab li sh within the area over which it has jurisdiction, an emergency camp for the purpose of the accomodation of homeless persons, and the Administrator-General may make regulations, providing for the ad­ministration. maintenance, sanitation and health of the said emergency camp, and the control thereof. including particularly the control of trading.

(2) Without prejudice to the generality of the powers conferred under subsection (I), the said regulations may in particular -

(a) provide for fees or charges to be levied in respect of any accommodation or service supplied;

(b) contain different provisions in respect of different areas, categories or classes of per­sons;

(c) in die geval van aile aansoeke, dat die toestande waarin en die omstandighede waaronder die betrokke persone op of in be­doelde grond of gebou lewe sodanig is dat, tensy hulle daarvan verwyder word, die gesondheid of die veiligheid van die publiek in die algemeen of van die een of ander klas van persone, met inbegrip van voormelde persone, in gevaar gestel kan word,

kan die landdros na oorlegpleging met die plaas­like owerheid binne wie se regsgebied die grond of gebou gelee is, 'n bevel uitreik vir die summiere u itsetting van bedoelde persone van of uit bedoelde grond of bouwerk en het hy mutatis mutandis die bevoegdhede aan 'n hof by artikel 2(3)(b) verleen.

(3) Die bepalings van artikel 2(4) is mutatis mutandis van toepassing ten opsigte van persone wat kragtens subartikel (2) van hierdie artikel versk u if is.

Oprigting van 'n noodkamp deur 'n plaaslike owerheid

8. (I) 'n Plaaslike owerheid kan, en indien daartoe gelas, na raadpleging deur die Administra­teur-generaal of die Sekretaris, moet binne sy regs­gebied 'n noodkamp oprig ten einde daklose per­sone te huisves, en die Administrateur-generaal kan regulasies uitvaardig wat voorsiening maak vir die administrasie, instandhouding, sanitasie en gesondheid van bedoelde noodkamp en vir beheer daaroor. met inbegrip in die besonder van die beheer oor die dryf van handel.

(2) Sonder afbreuk te doen aan die algemeen­heid van die bevoegdhede wat kragtens subartikel (I) verleen is, kan bedoelde regulasies in die be­sonder -

(a) voorsiening maak vir die heffing van fooie of gelde wat ten opsigte van huisvesting of diens verskaf word;

(b) verskillende bepalings bevat ten opsigte van verskillende gebiede, kategoriee of klasse persone;

(c) provide for penalties in respect of the cont­ravention of such regulations, on a first con­v iction, of a fine not exceeding five hundred rand or imprisonment for a period not ex­ceeding six months, or both such fine and such impr isonment, and on a subsequent convict ion, of a fine not exceeding one thou­sand rand or imprisonment for a period not exceeding twelve months or both such fine and such imprisonment.

(3) The said regulations shall be published in the Ojficia / Gazelle, and shall in addition be ex­hibited in both the Engli sh and Afrikaans lang uages, in a prominent p.lace in or in the vicini­ty of the said emergency camp for the purposes of this section.

(4) The Administrator-General may at any time. by notice in the Official Gazette, declare that as from a date to be stated in such notice, an emergency camp estab lished in terms of this sec­tion sha ll no longer be an emergency camp for the purposes of this section.

Prohib ition of hindering, obstructing or delaying certain authorized persons

9. Any person who hinders, obstructs or de lays any other person in the execution or exer­c ise by such other person of any order, instruc­tion, authority or power made, given or conferred by or under section 2(3) or (4), 3(5), 4{1), 5(1) or 7(2) or (3), sha ll be gui lty of an offence and liable on conviction to a fine not exceeding one thousand rand or to impri sonment for a period not ex­ceeding twelve months or to both such fine and such impri sonment.

Jurisdiction of magistrate's court

10. Any magistrate's court shall, notwith­standing anything to the contrary in any law con­ta ined, have jurisdiction to make any order, give any instruction, confer any power or impose any pena lty provided for by this Proc lamation.

Extension of area of jursidiction of local authority for purposes of this Proclamation

II. The Administrator-General may from time to time, after consu ltation with any local authori­ty, by notice in the Official Gazette -

(c) voorsien ing maak vir strawwe ten opsigte van die oortreding van sodanige regulasies, by 'n eerste sk uldigbevinding, van 'n boete van hoogstens vyfhonderd rand of gevangen isstraf vir 'n tydperk van hoog­stens ses maande of so 'n boete sowel as sodanige gevangen isstraf, en, by 'n daarop­volgende sku ldigbevinding, van 'n boete van hoogstens een duisend rand of gevangenis­straf vir 'n tydperk van hoogstens twaalf maande of so 'n boete sowel as sodanige gev angen isstraf.

(3) Bedoelde regulasies word in die 0./fisiiile Koerant gepub liseer en word daarbenewe ns in 'n in die ooglopende plek in of in die nabyheid van bedoelde noodkamp in beide die Afrikaanse en die Engelse ta le vir die doeleindes van hierdie artikel vertoon.

(4) Die Administrateur-generaal kan te eniger tyd by kennisgewing in die 0./fisiifle Koerant verk laar dat vanaf 'n datum in so 'n kennisgewing bepaal, 'n noodkamp wat ingevolge hierdie artikel opgerig is , nie meer 'n noodkamp vir die doe leindes van hierdie artikel sal wees nie.

Verbod op die hinder, dwarsboming of vertraging van sekere gemagtigde persone

9. 'n Persoon wat 'n ander persoon hinder, dwarsboom of vertraag by die uitvoering of uit­oefening deur daardie ander persoon van 'n bevel, instruksie, gesag of bevoegdheid uitgereik, gegee of verleen by of kragtens artikel 2(3) of (4 ), 3(5), 4( I), 5(1) of 7(2) of (3) is aan 'n misdryf skuldig en by sk uldigbevinding strafbaar met 'n boete van hoog­stens eendu isend rand of met gevangen isstraf vir 'n tydperk van hoogstens twaalf maande of met sowel daardie boete as daardie gevangenisstraf.

Jurisdiksie van landdroshof

I 0. 'n Landdroshof is, ondanks anderslu idende wetsbepalings, bevoeg om enige bevel uit te reik, instruksie te gee, gesag te verleen of straf op te le waarvoor hierdie Proklamasie voorsiening maak.

Uitbreiding van regsgebied van plaaslike owerheid by toepassing van hierdie Proklamasie

II. Die Administrateur-generaal kan van tyd tot tyd, na oorlegp leging met 'n plaaslike owerheid, by kennisgewing in die 0./fisii!le Koerant -

(a) declare that any area described in the notice, situated outside the area of juris­diction of such I ocal authority, shall, for the purposes of such provisions of this Proc tarnation as may be mentioned in the notice and to the extent indicated in the notice, be deemed to be part of the said area of jurisdiction;

(b) amend or repea l any such notice.

Designation of holders of certain offices as local authority for purposes of this Proclamation

12. The Administrator-General may from time to time by notice in the Official Gazette -

(a) declare the holder of any office mentioned in the notice in any department so men­tioned, to be for the purposes of such provi­sions of this Proclamation as may be so mentioned, the local authority for any area described in the notice, situated outside the area of jurisdiction of any local authority;

(b) amend or repea l any such notice.

Limitation of liability

13. No person, including any governmental authority, shall be liable in respect of anything done in good faith in the excercise of any power or the performance of any function or duty under or by virtue of the provisions of this Proc lamation.

Certa in fines and fees or charges to go to local authority

14. (1) Any fine collected for any contraven­tion of any provision of this Proclamation in any proceedings instituted as a resu It of action taken by any officer of any local authority shall be paid over to such local authority.

(2) The fees or charges which arise in respect of any accommodation or services rendered by a local author ity in terms of the provisions of this Proc lamat ion, shall be paid to such local authori­ty.

Expenditure by local authority

15. (1) Any loca l authority may, in connec­t ion with the performance in its area of jurisdic­tion, of the functions and the duties assigned to it in terms of the provisions of this Proclamation, in­cur such expenditure as may be approved by the Administrator-Genera l.

(a) verklaar dat 'n in die kennisgewing omskrewe gebied wat buite die regsgebied van daardie plaaslike owerheid gelee is, by die toepassing van die in die kennisgewing vermelde bepalings van hierdie Prok lamasie en in die mate in die kennisgewing aangedui, geag word deel van bedoelde regsgebied te wees;

(b) so 'n kennisgewing wysig of herroep.

Aanwysing van sekere amspbekleders as plaaslike owerheid by toepassing van hierdie Proklamasie

12. Die Administrateur-generaal kan van tyd tot tyd by kennisgewing in die Offisiele K oerant -

(a) verklaar dat die bekleder van 'n in die ken­o isgewing vermelde amp by 'n aldus vermelde departement by die toepassing van die aldus vermelde bepalings van hierdie Proklamas ie geag word die plaaslike owerheid te wees van 'n in die kennisge­wing omskrewe gebied wat buite die regsge­bied van 'n plaaslike owerheid gelee is ;

(b) so 'n kennisgewing wysig of herroep.

Beperking van aanspreeklikheid

13. Geen persoon, met inbegrip van enige regeringsgesag, is regtens aanspreeklik ten opsigte van enigiets te goedertrou gedoen by die uit­oefening van 'n bevoegdheid of die verrigting van 'n werksaamheid of plig kragtens of uit hoofde van die bepalings van hierdie Proklamasie nie.

Sekere boetes en fooie of gelde gaan na plaaslike owerheid

14. (1) 'n Boete gevorder weens 'n oortreding van 'n bepaling van hierdie Prok lamasie in 'n saak wat weens die optrede van 'n beampte van 'n plaas like owerheid aanhanging gemaak is, word aan daardie plaaslike owerheid oorbetaal.

(2) Die fooie of gelde wat voortspruit ten op­sigte van huisvesting of dienste wat deur 'n plaaslike owerheid ingevolge die bepalings van hierd ie Proklamasie verskaf word, word aan sodanige plaas like owerheid betaal.

Uitgawes deur plaaslike owerheid

15 . (1) 'n Plaaslike owerheid kan in verband met die verrigting in sy regsgebied, van die funksies en die pligte wat aan hom ingevolge die bepa lings van hierdie Proklamasie opgedra is, d ie uitgawes aangaan wat die Administrateur-gene­raal goedkeur.

(2) Expenditure so approved may be refunded to such local authority by the Administrator­General either in part or in full.

Application oj' Proclamation

16. This Proclamation, except section I. 5, 8, 14. 15. 16 and 17, shall apply only in such area and to such extent and with effect from such date as the Administrator-General may from time to time by proclamation in the Official Gazette determine and shall cease to apply in the said area with effect from a date so determined.

Short title

17. This Proclamation shall be called the Squatters Proclamation, 1985 .

16.
