Based on Point 3 of the Article 102 of the Constitution and on Point 1 of Article 12 of the Law No. 9000, dated January 30, 2003 “On the organization and functioning of the Council of Ministers”,
I ORDER:
1. The establishment and set to functioning of the multi stakeholder working group for supervising Albania’s membership procedures, as implementing country of the Extractive Industries Transparency Initiative, as well as ongoing fulfillment of duties deriving from being part of this initiative.
2. The Working Group is headed by the Deputy Minister of Economy, Trade and Energy and is composed by the following members:
a) One representative from the Ministry of Economy, Trade and Energy; b) One representative from the Ministry of Finances; c) One representative from the Ministry of Justice;

d) One representative from the General Tax Department; e) One representative from the National Agency of Natural Resources; f) One representative from the Albanian Geological Service; g) Five representatives from the business, selected by the National Network of Extractive

Society for EITI.
The representative level in this Group for State institutions will be not lower than that of a director of directorate in a ministry.
3. On invitation from the chairman of the Group, representatives from other institutions may take part in Group meetings.
4. The institutions mentioned in the point 2 of this Order shall send to the chairman of the group, within 15 (fifteen) days from the day of entrance into force of this Order, the names of their representatives.
5. The Secretariat of the Extractive Industries Transparency Initiative (EITI) shall prepare the draft Regulatory Act for the functioning of the Working Group of the Extractive Industries Transparency Initiative (EITI), which is approved by the Minister of Economy, Trade and Energy.
6. The Order No. 156 dated December 27, 2008 of the Prime Minister “For the establishment and set to functioning of the multi stakeholder working group for supervising Albania’s candidacy procedures in the Extractive Industries Transparency Initiative (EITI)” is abrogated.
This Order enters into force immediately.

GENERAL PROVISIONS
In implementing the Council of Ministers Decree No. 540 dated July 07, 2010 “For the establishment and set to functioning of the Secretariat to supervise Albania’s membership procedures in the Extractive Industries Transparency Initiative (EITI)”, later changed and the Prime Minister Order No. 71 dated July 21, 2011 “On the establishment and set to functioning of the multi stakeholder working group for supervising Albania’s membership procedures, as implementing country of the Extractive Industries Transparency Initiative”, the following Bill of Rules is prepared:
Article 1
Juridical Status
The establishment and set to functioning of the multi stakeholder working group for supervising Albania’s membership procedures, as implementing country of the Extractive Industries
Transparency Initiative (EITI), hereinafter called MSG is based on the Prime Minister Order No. 71 dated July 21, 2011.
Article 2
Object of the Bill.
The Bill of Rules determines the way of MSG organizing and functioning.

Article 3
Mission of the Multi Stakeholder Group (MSG)
1. MSG supervises Albania’s membership procedures, as implementing country of the Extractive Industries Transparency Initiative (EITI), for the ongoing completion and implementation of EITI procedures (Reference: Point 1 of the Prime Minister Order No. 71 dated July 21, 2011).
Article 4
MSG Competences
1. MSG approves short and long term plans of the activities needed to ensure Albania’s membership in EITI and on periodical bases analizes the implementation of due programs.
2. MSG supervises and assesses the work of ALBEITI Secretariat in a periodical way and reports to the Prime Minister and the respective Minister.
3. MSG informs on ALBEITI Secretariat performance during the period between its two meetings.
4. MSG approves all necessary acts to complete Albania’s membeship procedures in EITI, on proposal from ALBEITI Secretariat and in respect of EITI International Secretariat procedures.
Article 5
MSG Chairman and Members
1. The Working Group is headed by the Deputy Minister of Economy, Trade and Energy and is composed by the following members:
a) One representative from the Ministry of Economy, Trade and Energy; b) One representative from the Ministry of Finances; c) One representative from the Ministry of Justice; d) One representative from the General Tax Department; e) One representative from the National Agency of Natural Resources; f) One representative from the Albanian Geological Service; g) Five representatives from the business, selected by the National Network of Extractive

2. The representative level in this Group for State institutions will be not lower than that of a director of directorate in a Ministry.
3. MSG members that represent Government are appointed and released from duty by the director of the respective Government institution.
4. On invitation from MSG Chairman Group, representatives from other institutions and from the National Network of Extractive Industries and the National Network for the Civil Society for EITI may take part in Group meetings.
Article 6
MSG functioning
1. MSG holds its meetings, as a rule, in the headquarters of the Ministry of Economy, Trade and Energy, or in another location determined by MSG.
2. MSG develops its activity through the meetings of its Members and the decisions it takes. MSG meetings are considered valid when more than half of its Members participate.
3. MSG meetings are held not less than once in two months, or when they are required by its Chairman, by 1/3 of its Members, or by the Director of ALBEITI Secretariat. The Minister of Economy, Trade and Energy has the right to call an MSG meeting whenever he judges it opportune.
4. All MSG Members shall be informed in a written form and not less than 2(two) days ahead of the meeting, on the agenda of the meeting and shall be made available in an electronic way the preliminary materials for discussion.
5. MSG meetings are directed by MSG Chairman and in his absence, by an MSG Member authorized by him.
6. Every MSG Members present in an MSG meeting has the right of one vote. MSG decisions are considered as approved, when more than half of present MSG Members have voted for them. One the number of votes is equal, Chairman’s vote is decisive.
7. MSG meetings are documented by a Validation Note, prepared by a person assigned by MSG. The Note is signed by him/her and by all present MSG Members.
8. MSG decision are signed by MSG Chairman. 9. On invitation from MSG Chairman Group, representatives from other Government
institutions and/or from the National Network of Extractive Industries and the National Network for the Civil Society for EITI may take part in MSG meetings.

Rules of Ethics
MSG shall implement the Rules of Ethics approved in the Law “On Ethics in the Public Administration”.
Article 8
Information Administration
Classification of documentation and its safeguard ia made according the legislation in power, the methodology of documentation elaboration and its safeguard.
Article 9
Approval of the Bill
This Bill of Rules enters immediately into power and becomes obbligatory for implementation, immediately after its signing from the Minister of Economy, Trade and Energy.
