The Board of Commissioners of Lorain County, Ohio met this day in a regular meeting, in the J. Grant Keys Administration Building,

226 Middle Avenue, Elyria, Ohio, at 9:30 a.m. with the following members present: Commissioner Ted Kalo, President, Commissioner Matt

Lundy, Vice President, Commissioner Lori Kokoski, Member and Theresa L. Upton, Clerk.

WHEREAS, the Lorain County Board of Commissioners adopted various resolutions to relating to previous fees schedules; Resolution No. 76-62, adopted on January 22, 1976 Resolution No. 88-112, adopted on February 17, 1988 Resolution No. 90-784, adopted on July 31, 1990 Resolution No. 90-883, adopted August 30, 1990 Resolution No. 05-371, adopted May 5, 2005 Resolution No. 09-710, adopted October 15, 2009 Resolution No. 17-349, adopted May 24, 2017 Resolution No. 17-409 , adopted June 21, 2017 Resolution No. 17-422, adopted June 28, 2017 Resolution No. 17-453, adopted July 12, 2017

And;

WHEREAS, Lorain County recognizes its responsibility under the laws of the State of Ohio and the United States of America to provide legal counsel for indigent individuals appointed by the Lorain County Courts. Lorain County Board of Commissioners hereby adopts the increased fee schedule which is set forth herein which the revised fee schedule shall be reviewed annually, along with all other general fund expenditures during appropriation proceedings.

WHEREAS, pursuant to Section 120.33(A)(3) of the Ohio Revised Code, in order for reimbursements said resolution must be adopted to pay counsel appointed by the Courts of Lorain County, Ohio as follows:

The following plan is adopted for use by the Courts of Lorain County including the Ohio District Court of Appeals and Supreme Court.1. Payment for representation in trial level cases not involving a death penalty specification will be made based on the maximum rate Effective July 1, 2017 will be $45.00 per hour for out-of-court services and $55.00 per hour for in-court services.Effective January 1, 2018 will be $50.00 per hour for out-of-court services and $60.00 per hour for in-court services.

Post-conviction and Habeas Corpus Proceedings6. 7. Payment for post-conviction and state habeas corpus proceedings involving a death sentence shall be made based on the maximum rate of $45.00 per hour for both out-of-court and in-court services to a maximum of $55.00 to be divided among services in the trial court, the Court of Appeals, and the Ohio Supreme Court.

Extraordinary Fees/Hourly Rates8. Cases eligible for Extraordinary fees or Extraordinary hourly rates are ones which, because of extraordinarily complex issues, multiple offenses, lengthy trials, or other reasons, warrant compensation at a rate which exceeds the maximums established by a county or the Ohio Public Defender. Payment for extraordinary fees/hourly rates are subject to the following requirements and are hereby enacted:

Lorain County hereby provides for extraordinary fees/hourly rates in this fee resolution adopted pursuant to R.C. 120.33(A)(3).

Extraordinary fees must be clearly documented in the appropriate sections on the Motion, Entry, and Certification form. Extraordinary hourly rates should be obtained at the beginning of representation by the assigned counsel.

The Judge hearing the case must indicate approval of the extraordinary fees and/or hourly rates by checking the “Extraordinary Fees Granted” box in the Judgment Entry section on the front of the form, and a copy of the journal entry/entries must be attached.

9. All Misdemeanors and felonies at Municipal Courts (statutory charge) are capped to be paid $250.00

Expenses10. Payment for reasonable expenses requiring Court approval, such as transcript or experts, associated with providing representation shall be made by motion and approved by the judge in advance of incurring the expense and the amount thereof is determined to be reasonable by the judge.

10.a All of the necessary forms are submitted to the trial judge in the General Division of the Lorain County Common Pleas Court no later than thirty (30) days after the attorney withdraws from the case, whichever date is earlier, or submitted to the Court in the Juvenile Division of the Common Pleas Court or the Appellate Court within thirty (30) days after the conclusion of the proceeding in that Court or within thirty (30) days after the attorney withdraws from the case, whichever date is earlier. Requests for payment of attorney fees and expenses which are submitted after the expiration of the thirty (30) day time limit will require approved for payment upon determination of good cause by the trial judge. However, any approval after the expiration of the thirty (30) day limit will be reduced by any amount no longer reimbursed through the Ohio Public Defender (OPD) commission. OPD will not reimburse the County after ninety (90) days. Therefore, requests for payment submitted after ninety (90) days will be reduced by the full amount of OPD reimbursement lost due to the delay in submission; but will receive the remainder of the fee.

Amendments to the Fee Schedule11. Lorain County Commissioners may amend this fee schedule at any time. Whenever the schedule is amended or revised, a copy of the resolution amending the fee schedule is directed to be sent to the Ohio Public Defender along with notice to all the courts and assigned counsel.

11a. A request for payment of court appointed counsel fees and reimbursement of expenses shall be approved for payment by the Lorain County Auditor only if the following conditions are met:

“We have reviewed the bids that were received for the West River Road Resurfacing Project in Carlisle Township and the City of Elyria, Ohio. The respondents to this bid were:

Karvo Paving agrees to complete all work by October 31, 2018. They have no substitutions but will be using American Roadway Logistics, Inc., Richfield, Ohio for the work zone items, maintaining traffic, signage and striping as subcontractor for this project.

We recommend that this bid be awarded to Karvo Paving, Stow, Ohio in the amount of $448,246.50. The OPWC will be contributing 89% of the construction costs or up to $497,510 as a grant. The City of Elyria will contribute 4.5% or up to $25,211.00 of the total project cost per the Cooperation Agreement. The balances of the construction funding will be provided by the Lorain County Engineer through the Engineer’s account for roadway projects.

Thank you for your cooperation with this project.”;

NOW, THEREFORE, BE IT RESOLVED by the Board of Lorain County Commissioners, that based upon bids received, reviewed and recommendation by the Lorain County Engineer in letter dated May 4, 2018 we do hereby award contract to Karvo Paving, Stow, Ohio in the amount of $448,246.50 for the West River Road Resurfacing Project in Carlisle Township and the City of Elyria, Ohio.

This was the lowest and most responsive bid received and complied with all specifications.

BE IT FURTHER RESOLVED that we hereby issue a Notice to Proceed letter effective on or about July 15, 2018 and work will be completed on or before October 31, 2018 for the above noted project. In the matter of authorizing participation in)ODOT Winter contract (2018-2019 road salt) May 9, 2018

WHEREAS, the Lorain County Engineer, Lorain County (hereinafter referred to as the “Political Subdivision”) hereby submits this written agreement to participate in the Ohio Department of Transportation’s (ODOT) annual winter road salt bid (018-19) in accordance with Ohio Revised Code 5513.01(B) and hereby agrees to all of the following terms and conditions in its participation of the ODOT winter road salt contract:

a. The Political Subdivision hereby agrees to be bound by all terms and conditions established by ODOT in the winter road salt contract and acknowledges that upon of award of the contract by the Director of ODOT it shall be bound by all such terms and conditions included in the contract; and

b. The Political Subdivision hereby acknowledges that upon the Director of ODOT’s signing of the winter road salt contract, it shall effectively form a contract between the awarded salt supplier and the Political Subdivision; and

c. The Political Subdivision agrees to be solely responsible for resolving all claims or disputes arising out of its participation in the ODOT winter road salt contract and agrees to hold the Department of Transportation harmless for any claims, actions, expenses, or other damages arising out of the Political Subdivision’s participation in the winter road salt contract; and

d. The Political Subdivision hereby requests through this participation agreement a total of 12,000 tons of Sodium Chloride (Road Salt) of which the Political Subdivision agrees to purchase from its awarded salt supplier at the delivered bid price per ton awarded by the Director of ODOT; and

e. The Political Subdivision hereby agrees to purchase a minimum of 90% of its above-requested salt quantities from its awarded salt supplier during the contract’s effective period of September 1, 2018 through April 30, 2019; and

f. The Political Subdivision hereby agrees to place orders with and directly pay the awarded salt supplier on a net 30 basis for all road salt it receives pursuant to ODOT winter salt contract; and

g. The Political Subdivision acknowledges that should it wish to rescind this participation agreement it will do so by written, emailed request by no later than Thursday, June 1, 2018. The written, emailed request to rescind this participation agreement must be received by the ODOT Office of Contract Sales, Purchasing Section email: [email protected] by the deadline. The Department, upon receipt, will respond that it has received the request and that it has effectively removed the Political Subdivision’s participation request. Furthermore, it is the sole responsibility of the Political Subdivision to ensure ODOT has received this participation agreement as well as the receipt of any request to rescind this participation agreement. The Department shall not be held responsible or liable for failure to receive a Political Subdivision’s participation agreement and/or a Political Subdivision’s request to rescind its participation agreement.

“We have reviewed the bids that were received for the 2018 Countywide Chip and Seal Program. The respondents to this bid were:

Henry Bergman $552,222.72Melway Paving $601,840.80Erie Blacktop $607,318.00Cross Roads Asphalt $676,250.00

Henry Bergman proposes to begin work on or before June 15, 2018 and complete all work on or before September 1, 2018. Henry Bergman does not propose using any subcontractors or substitutions on this project.

We recommend that the contract for the 2018 Countywide Chip and Seal Program be awarded to Henry Bergman, Genoa, Ohio in the amount of $552,222.72. The Engineer’s estimate on the project was $615,000.00.

This project is being funded 100% with MVGT funds. Thank you for your cooperation with this project.”;

NOW, THEREFORE, BE IT RESOLVED by the Board of Lorain County Commissioners, that based upon the bids received and the review and recommendation by the Lorain County Engineer in letter dated May 3, 2018 we do hereby award contract to Henry Bergman, Genoa, Ohio in the amount of $552,222.72 for the 2018 Countywide Chip and Seal Program.

BE IT FURTHER RESOLVED, we will Issue a Notice to Proceed letter on or about May 21, 2018, and the work will be completed on or before September 1, 2018. Commissioner Kalo attended Solid Waste meeting yesterday and still reviewing plan and we have received 2 grants; $25,000 for ag tire and $200,000 for a new bailer. Mr. Bailey, Director – Solid Waste stated that the center is collecting a lot of cardboard and they had a smaller bailer but due to the overwhelming collection they need to get a bigger bailer. Commissioner Kalo said republic will no longer take Styrofoam as a recyclable.

Commissioner Kalo attended Cinco de Mayo parade and event at Mexican Mutual also Prosecutor Will’s steak fry and Richard Cordray and Betty Sutton event at Black River landing.

Commissioner Kalo said the election turnout was low and people can should not complain if they do not go to the polls and thanked everyone that supported the county levies and congrats to all that won and ran in the election.

Commissioner Lundy said June 23 will be the unveiling of the old courthouse as well as the memorial for fire police sometime after 7 pm with tours and lighting of the courthouse. He said he is excited to see this building being renovated and used for government purposes

Jeff Baxter, Elyria said he worked as a poll worker yesterday at a Church on SR113 and there was low turnout 19%. Lorain County in 2014 had more voted then around 48,000, which is around 6,000 more voted and we have 6,000 more voters registered now. He heard a lot of complaints about the sales tax and why should people vote, it does not count, it gets over ridden. So the Board of Commissioners has a burden to bear as to why the voters feel this way _____________________
