Public Hearing Comments

One copy of a document containing responses to comments made at the public hearing must accompany the filing pursuant to TCA sect4-5-222 Agencies shall include only their responses to public hearing comments which can be summarized No letters of inquiry from parties questioning the rule will be accepted When no comments are received at the public hearing the agency need only draft a memorandum stating such and include it with the Rulemaking Hearing Rule filing Minutes of the meeting will not be accepted Transcripts are not acceptable

The foregoing amendment to 1200-03-18-01 is to comply with sect 110 of the federal Clean Air Act in order for the State to maintain its State Implementation Plan making this rule amendment federally mandated and exempt from the requirements of TCA sect 4-5-401 et seq

All agencies upon filing a rule must also submit the following pursuant to TCA 4-5-226(i)(1)

(A) A brief summary of the rule and a description of all relevant changes in previous regulations effectuated by such rule

This action revises the States definition of volatile organic compounds (VOCs) for purposes of preparing the state implementation plans (SIP) to attain the national ambient air quality standard for ozone under Title I of the Clean Air Act This revision adds the compounds propylene carbonate and dimethyl carbonate to the list of compounds which are excluded from the definition of VOC on the basis that these compounds make a negligible contribution to tropospheric ozone formation

(8) A citation to and brief description of any federal law or regulation or any state law or regulation mandating promulgation of such rule or establishing guidelines relevant thereto

The federal regulation this amendment is based was published in the Federal Register Volume 74 Number 12 Wednesday January 21 2009 Rules and Regulations Pages 3437 - 3441 and was adopted by the Air Pollution Control Board under the authority of TCA sect 68-201-105

(C) Identification of persons organizations corporations or governmental entities most directly affected by this rule and whether those persons organizations corporations or governmental entities urge adoption or rejection of this rule

Propylene carbonate has been used in cosmetics as and adhesive component in food packaging as a solvent for plasticizers and synthetic fibers and polymers and as a solvent for aerial pesticide application Dimethyl carbonate may be used as a solvent in paints and coatings The aforementioned entities urge adoption of this rule

(0) Identification of any opinions of the attorney general and reporter or any judicial ruling that directly relates to the rule

The Department in not aware of any

(E) An estimate of the probable increase or decrease in state and local government revenues and expenditures if any resulting from the promulgation of this rule and assumptions and reasoning upon which the estimate is based An agency shall not state that the fiscal impact is minimal if the fiscal impact is more than two percent (2) of the agencys annual budget or five hundred thousand dollars ($500000) whichever is less

This action revises the States definition of volatile organic compounds (VOCs) for purposes of preparing the state implementation plans (SIP) to attain the national ambient air quality standard for ozone under Title I of the Clean Air Act This revision adds the compounds propylene carbonate and dimethyl carbonate to the list of compounds which are excluded from the definition of VOC on the basis that these compounds make a negligible contribution to tropospheric ozone formation

(8) A citation to and brief description of any federal law or regulation or any state law or regulation mandating promulgation of such rule or establishing guidelines relevant thereto

The federal regulation this amendment is based was published in the Federal Register Volume 74 Number 12 Wednesday January 21 2009 Rules and Regulations Pages 3437 - 3441 and was adopted by the Air Pollution Control Board under the authority of TCA sect 68-201-105

(C) Identification of persons organizations corporations or governmental entities most directly affected by this rule and whether those persons organizations corporations or governmental entities urge adoption or rejection of this rule

Propylene carbonate has been used in cosmetics as and adhesive component in food packaging as a solvent for plasticizers and synthetic fibers and polymers and as a solvent for aerial pesticide application Dimethyl carbonate may be used as a solvent in paints and coatings The aforementioned entities urge adoption of this rule

This action revises the States definition of volatile organic compounds (VOCs) for purposes of preparing the state implementation plans (SIP) to attain the national ambient air quality standard for ozone under Title I of the Clean Air Act This revision adds the compounds propylene carbonate and dimethyl carbonate to the list of compounds which are excluded from the definition of VOC on the basis that these compounds make a negligible contribution to tropospheric ozone formation

(8) A citation to and brief description of any federal law or regulation or any state law or regulation mandating promulgation of such rule or establishing guidelines relevant thereto

The federal regulation this amendment is based was published in the Federal Register Volume 74 Number 12 Wednesday January 21 2009 Rules and Regulations Pages 3437 - 3441 and was adopted by the Air Pollution Control Board under the authority of TCA sect 68-201-105

Propylene carbonate has been used in cosmetics as and adhesive component in food packaging as a solvent for plasticizers and synthetic fibers and polymers and as a solvent for aerial pesticide application Dimethyl carbonate may be used as a solvent in paints and coatings The aforementioned entities urge adoption of this rule

This action revises the States definition of volatile organic compounds (VOCs) for purposes of preparing the state implementation plans (SIP) to attain the national ambient air quality standard for ozone under Title I of the Clean Air Act This revision adds the compounds propylene carbonate and dimethyl carbonate to the list of compounds which are excluded from the definition of VOC on the basis that these compounds make a negligible contribution to tropospheric ozone formation

(8) A citation to and brief description of any federal law or regulation or any state law or regulation mandating promulgation of such rule or establishing guidelines relevant thereto

The federal regulation this amendment is based was published in the Federal Register Volume 74 Number 12 Wednesday January 21 2009 Rules and Regulations Pages 3437 - 3441 and was adopted by the Air Pollution Control Board under the authority of TCA sect 68-201-105

(C) Identification of persons organizations corporations or governmental entities most directly affected by this rule and whether those persons organizations corporations or governmental entities urge adoption or rejection of this rule

Propylene carbonate has been used in cosmetics as and adhesive component in food packaging as a solvent for plasticizers and synthetic fibers and polymers and as a solvent for aerial pesticide application Dimethyl carbonate may be used as a solvent in paints and coatings The aforementioned entities urge adoption of this rule

(0) Identification of any opinions of the attorney general and reporter or any judicial ruling that directly relates to the rule
