The licence shall be granted to the bidder who shall undertake to manufacture the highest quantity of liquor of 25% under proof or corresponding quantity of lesser strength after full payment of bid amount. 4. The amount of duty payable on the quantity of liquor undertaken to be produced by the bidder shall be paid by him in two equal installments. The first installment shall be paid by the bidder on the spot as soon as the bid is accepted and 2nd installment shall be paid by him within fifteen days from the date of acceptance of his bid. 5. The successful bidders shall withdraw the earnest money deposits in the same manner as above within 10 days after the payment of first installment of the bid amount. 1. No bidder shall be admitted to the auctionunless he/she makes a deposit of Rs. 100/- asan earnest money separately in respect ofeach zone. The earnest money can bedeposited in the Department between 04thFebruary, 2019 to 12th February, 2019 andthereafter deposits shall also be accepted atthe place of auction before commencement ofauctions of respective Talukas.

2. At the close of the auction the deposits ofearnest money made by the unsuccessfulbidders shall be refunded to them against theproduction of receipts of such deposits.

6. A bidder shall not be allowed to transfer thebid once the right to manufacture the highestquantity of liquor is adjudicated to him/her.

7. Attention to the bidders is drawn to theprovision of Rule 76 of the Excise Duty Rules,1964. In case the licensee refuses to pay forthe juice supplied by cashew extractors orfails to obtain such supply from the cashewjuice extractors for any reasons whatsoever,he shall not be entitled to claim for refund ofduties on these grounds and therefore, theresponsibility of getting the juice from zonesbidded shall fully rest upon him/her.

8. In event of failure to comply with the aboveconditions and the provisions of Rule 72 bid orfailure to pay the first installment of the bidamount as required by sub-rule (3) of Rule 71,the earnest money of Rs. 100/- depositedby the bidder with reference to sub-rule (4)of Rule 72 shall be forfeited. If secondinstallment of bid amount is not paid within theperiod of 15 days as prescribed above, the firstinstallment paid shall be forfeited in favour ofthe Government. Any loss in Excise Dutycaused to the Government by reason of freshauction being held as result of non-payment ofthe installment, shall be recoverable from thefirst bidder as an arrears of land revenue.

9. As per the Goa (Excise Duty) Rules, 1964 theaccepted bidding price shall be the amount ofExcise Duty for the zone put to auction and norefund shall be admissible if the dutyassessed on the production in such zones isless than the amount of the highest offer.

After the duty has been paid by successfulbidder he/she shall declare within 5 days therefromto the Excise Inspector of the respective Taluka thenumber of stills and the place where he/she shallwork them as required under Rule 73 of the GoaExcise Duty Rules, 1964.

The price of cashew juice for the purpose of Rule 76of the Goa Excise Duty Rules, 1964 shall beRs. 4.00 per litre and Rs. 3.00 per kilogram of ripe cashewapples without seeds conveyed vide letter bearing No.1/11-78-Fin (R&C)/Part/1930 dated 07-12-2018.

The licensee shall make use of proper vessels forstorage of cashew juice and distilled liquor anderect proper still apparatus for distillation. No coaltar barrels will be used at any stage. The licenseeshall maintain a register in terms of Rule 78.

The License shall be subject to the provisions ofGoa (Excise Duty) Act, 1964 and Rules madethereunder as amended from time to time.

2. Report No. SP/South Goa/06/2019 dated07-01-2019 from the Superintendent ofPolice (South), Margao-Goa.

Whereas, the Executive Engineer-II(S), JICA-ODALoan Project, PWD, H. No. 1970, Bh. Felicinta Bldg.,Gogal Circle, Margao-Goa vide letter dated18-12-2018 has informed that the sewer networkwork in Margao town constructed under JICA ODALoan project is 99.75% completed. Missing links haveto be completed so that entire project can becompleted and the public can avail the benefit ofthe scheme. It has been further informed that theselinks could not be completed although this officehad issued an order vide No. 37/128/2008/MAG//12632 dated 31-10-2018 because of high water tableand other hindrances such as electric cable(33KVA), service utilities, etc., and requested to issuepermission for road closure/diversion for a period of6-8 days at the following places:

a) At Rawanfond junction for laying sewer lineby HDD (70 mtrs.) from Navelim Church Roadto Davorlim Road.

b) Near ESI hospital for linking of sewer line(20 mtrs.).

c) Near Damodar Temple, Housing Board forshifting of water line in sewer manhole(15 mtrs.).

d) Excavation for testing/rectification on DistrictLibrary Road/Davorlim-Rawanfond-NavelimChurch/Konkan Railway Road.

And whereas, the Superintendent of Police,South Goa, Margao, vide letter dated 07-01-2019has submitted no objection for temporary closure ofroads at the above places.

And whereas, it is revealed that the workmentioned above is of urgent nature and it requires

to divert the traffic;

And whereas, I am satisfied that the diversion oftraffic is essential during execution of the abovework;

conferred under Sections 115 and 116 of the MotorVehicles Act, 1988 (Central Act 59 of 1988) readwith Government Notification No. 5/28/88/TPT (part)dated 26th September, 1989 being satisfied that itis necessary in the interest of public safety andconvenience do hereby permit for temporary closureof the roads and to also temporarily divert thevehicular traffic for a period of 6-8 days at eachlocation as mentioned above till 28-02-2019 to carryout the pending sewer network in Margao anderect the signages accordingly subject tocompliance with the conditions mentioned below:-

Conditions:

1. The applicant/contractor is directed to ensurethat no annoyance is caused to the generalpublic and nearby residents.

2. Should adhere to all the rules and regulationsin force.

3. The applicant/contractor is directed to obtainnecessary permission from other competentauthorities.

4. The applicant/contractor is directed to takenecessary precautions and engage all safetymeasures during execution of the work.

5. The applicant/contractor is directed to deputesufficient number of traffic volunteers for trafficcontrol and regulation.

6. The applicant/contractor is directed to display

proper signages of “Road Closed”, “No Entry”,

“Take Diversion/work in progress” etc. on both

the sides of road closure, flash light for

guidance of the motorists, pedestrians and

other road users.

7. If any untoward incident arises due to poor

barricading/non-applying of glowing/

reflective tapes then the concerned

contractor/PWD authorities shall be held

responsible for the same and be liable for

criminal proceedings.

8. The applicant/contractor is directed to ensure

that there are no loose gravels of soil/stones,

leftovers on the road/shoulder of the road after

the completion of work.

9. All safety measures shall be adopted by theapplicant/contractor for ensuring safety of theworkers engaged for the construction workand of the motorists, pedestrians, etc.

10. The area around the work should be properly//strongly barricaded and illuminated with redlight, glowing/reflective tapes to preventaccidental falling of pedestrians, motorists,cattle and other road users.

11. The applicant/contractor is directed to informin advance the exact date of commencement

of the said work to the Traffic Cell, Margaoand local police.

12. The applicant/contractor is directed toapproach IC Traffic Cell, Margao with a formalrequest for deployment of Traffic Police, ifrequired for traffic regulation, on advancepayment basis as per prevailing Govt. rates//service tax, etc. The same shall be providedas per availability.

13. The equipments/material if any kept on theproposed road shall be covered withilluminating warning sign during night time,so as to avoid from any untoward incident.

14. The applicant/contractor is directed to restorethe original condition of the road soon afterthe completion of the work by all means.

15. The applicant/contractor is directed to ensurethat alternate road made available for diversionis left free for vehicular traffic without anyobstruction.

16. The applicant is directed to ensure that oneofficer is present to oversee the entire worktill its completion.

17. The applicant/contractor is directed to givewide publicity of the road closure anddiversion through print media and electronicmedia for 03 days in advance and continuouslybefore staring the work.

18. For any mishap during the conduct of sewernetwork the applicant shall be heldresponsible.

19. If the applicant/contractor fails to abide bythe conditions laid above or if the NOC issuingauthority feels so, the NOC is subject tocancellation/revocation at any given time.

said shops/stalls/areas in old market for constructionof the New Market Complex premises on the landowned by the Corporation.

And whereas, from August, 2003 and January,2007 till date, the said individuals/occupants areoccupying the said shop/stall/area in the NewMarket Complex without payment of any fees,annual maintenance charges, Trade and Occupationlicense etc., due and payable to the Corporation.

And whereas, by resolution passed at the SpecialMeeting of the Corporation held on 21-01-2019, saidshops/stalls/areas in the New Market Complex needto be regularized in the interest of both theindividuals/occupants and the Corporation, byexecuting Agreement of Leave and Licence for aperiod of 30 years, between the individuals//occupants and Corporation, as per terms andconditions set out in said Agreement.

And whereas, at said meeting of the Corporationit was resolved to execute the Leave and LicenceAgreement with the Occupants as stated in theoriginal GSIDC list who are still in possession or inthe event where the original occupants aredeceased with their legal heirs as the case may be,subject to payment of arrears of various fees asstated above from the year 2003 and 2007respectively. It was further resolved that the shops//stalls/areas, for which leave and license Agreementare not executed by the original occupants/legalheirs, will be auctioned as per provisions of theGoa Municipalities (Transfer of Immovable Property)Rules, 1970 read with Section 3(2) of the City ofPanaji Corporation Act, 2002. It was also resolvedthat any allotment letters/orders issued in the pastby any officers/elected members of this Corporationare without the sanction of the Council andtherefore are illegal, null and void and the samestands cancelled immediately.
