AGENCY RE\rIEW AND COMPLIANCE PROCEDURE OFSTATEMENTS AND FINANCIAL DISCLOSURES FOR FY 2o2o

Republic Act No. 6713 was enacted on e9 Febmary 1989 to establish a Code of Conduct andEthical Standards for Public Officials and Employces, upholding the time-honored principleof public office being a public trust, granting incentives and rewards for exemplary service,enumerating prohibited acts and transactions and providing penalties for violation thereofand for other purposes.

The Rules Implementing the Code of Conduct and Ethical Standards for Public Officials andEmployees were promulgated on 07 May 1989. Rules VIII of the said rules provides for theReview and Compliance Procedure in the filing and submission of Statement of Assets,Liabilities and Networth (SALN) and Financial Disclosures which shall be strictly observed.

Ilowever, in light of the declaration of a state of public emergency, the Ciril SewiceCommission (CSC) issued Memorandum Circular (MC) Nos. o9 and r3, s. 2o2o, adoptingthe guidelines in the filing and submission of SALN for year zozo.

Section r. Filing and Submissrbn o/SAIN on Time and to the Proper Official

1.1 All HSAC officials and employees, except tlose who serve in an official honorarycapacity, without service credit or pay, contract of service, shall file under oath theirSALN and Financial Disclosures with their respectire Chief or Head ofAdministrative Division/Human Resource Development Division, to wit:

a. Within thirty (Bo) days after assumption of office, statement of which must bereckoned as of his/her first day of service;

b. On or before April 3o of every year thereafter, statement of which must bereckoned as of the end of the preceding year; and

c. Within thifty (3o) days after separatior) from the serwice, statemeuts of whichmust be reckoned as ofhis/her last day of office.

1.2 HSAC official and employees under temporary status are also required to file undertheir SALNs and Financial Disclosures in accordance with the guidelines providedunder these rules.

1.3 HSAC officials and employees are strictly required to fill in all applicable informationand/or make a true and detailed statement in their SALNs.

Section z. Duties of the Chief or Head of Adrntristrattue Diubion/Hurnan Resource

Upon receiving the SALN forms, the Chief or Head of Administrztive Division/HumanResource Development Division shall evaluate the same to determine whether the said

statements have been properly accomplished. A SALN is deemed properly accomplishedwhen all applicable information or details required therein are provided by the filer. Itemsnot applicable to the filer should be marked N/A (not applicable).

The Chief or Head of Administrative Division/Human Resource Development Division shallsubmit a list of employees in alphabetical order, who (a) filed their SALNs with completedata; O) filed their SALNs but with incomplete date; and (c) did not file their SALNs, to theHead of Office, copy furnished the CSC. on or before 31 August 2o2o pursuant to CSC MCNo. 13, s. 2o2o.

The proper tbrm to be used by all HSAC officials and employees for the annual filing andsubmission of the SALN for the year zozo shall be the Revised SAIN Form (Revised as ofJanuary 2or5) together with the Additional Sheets Form (Revised as ofJanuary 2o1S).

Section 3. In compliance to e:bting rul* and regulations a Reuiew and ComplianceCommittee uos created to monitor, eualuate and determine whether, SAI),1 haue beensubmitted on time, complete and in proper form.

Section 4. Minbterial Duty of the Head of Ofice to ksue Compliance Order.

Within five (S) days fiom receipt of the aforementioned list and recommendation, it shall bethe ministerial duty of the Head of Office to issue an order requiring tlose who haveincomplete data in their SALN to con€ct/supply the desired information and those who didnot file/submit their SALN to comply within a non-extendible period of thirty (3o) days fromreceipt of the said Order.

Section 5. Sanctionsfor Failure to Complg/Issuance of a Show Cause Order.

Failurc of an official or employee to correct/submit his/her SALN in accordance with theprocedure and within the given period pursuant to the directive in Section 4 hereof shall beground for disciplinary action. the Head of Office shall issue a Show Cause Order directingthe official or employee concerned to submit his/her comment or counter affidavit; and if theevidence so warrants, proceed with tie conduct of the administrative proceedings pursuantto the existing Rules on Administrative Cases in the Civil Service. The offense of failurc tofile SALN is punishable with the following penalties:

First Offense Suspension of one (r) month and one (r) day tosix (6) months

Second Offense Dismissal from the service

"Public offrcials and employees who fail to comply within the thirty (3o) day period requiredunder Section 3 hereof or who submit their SALNs beyond the said period shall beconsidered as not having filed their SALNs, and shall be made liable for the offense of Failurcto File SALN with a penalty of suspension of one (r) month and one (r) day to six (6) monthsfor the first offense, and dismissal from the service for the second offense.

"Heads of agencies/offices to fail to comply with the provisions of CSC ResolutionNo. 06231, dated or February zoo6, as amended, shall be liable for Simple Neglect of Duty,which shall be punishable by suspension of one (r) month and one (r) to six (6) months forthe first offense, and dismissal from the service for the second offense."

Section 6. Transmittal of all submitted SALNs to the concemed agencies on orSr October 2o2o.

SectionT. Penalty.

The Head of Office and/or Chief or Head of Administrative Division/Human ResourceDwelopment Division who failed to perform their duties may be held liable for neglect ofduty under Section 46, Chapter 7, Subtitle A, Title r, Book V of the Administrative Codeof 1987 (Executive Order No. z9z).
