Here is the guidance that your predecessor(s) provided to us with respect to immediate notifications to the ILTAB Duty Officer. The implication is that all other notifications to the duty officer will be during normal working hours. In our parlance, IMMEDIATELY NOTIFY means no matter the hour. Please feel free to provide us guidance on when, or if, we are ever to immediately notify the ILTAB duty officer of events. For instance, if only during emergencies, please specify what constitutes an emergency (Security EALs invoked by the licensee, armed response to the facility by LLEA, credible threat information, etc.)
1. IF notification involves activities which pose a potential direct or communicated threat to the site including, but not limited to: • Ongoing security events. {basis for the drone calls since they were loitering in the OCA) • Verbal/telephone/a-mail threats. • Bomb threats. • Threats to site employees. • Fence jumpers/intrusions. • Security barrier penetrations. • Discovery of weapons or explosives. • Event involving law enforcement response/investigation on the owner-controlled area (OCA) or
watercraft exclusion areas. • Event involving FBI investigation. • Security-related media attention at any level. • Sabotage/Tampering

Please place a note in the turnover log stating "Until further notice, do not call the IL TAB duty officer from 1 O pm until 6 am for drone flyovers of Palo Verde. Send an email to ILTAB in the morning. This is specific to Palo Verde only. For all other licensed facilities, continue to follow HOO procedures until changes are made."

Silas, can we temporarily halt calls to the ILTAB duty officer about drones flying over this NPP in the wee hours, before we are able to make a permanent change to the procedures? There is nothing ILTAB can do about it at night, and if my staff has to be woken up about it each night, it will start to cause other problems for us. We have a small staff and having people out or late because they are not getting adequate sleep will impact our ability to get work done.

Our folks got calls last night at 2am, which is correct per the procedure. However, I am wondering if there is a way to cut down on calls in the middle of the night for issues that ILTAB can't add value to. The call last night about drones is a good example-in the middle of the night, ILTAB can't really do anything about it anyway apart from say "ok thanks" and handle it in the morning. However, the call interrupts sleep, and then they are either groggy or come in late, so there's negative returns on it from an ,organizational perspective. We, are also understaffed in here, so I need all my folks to be able to come in and be alert. Can we change the procedure or reinterpret the procedure so that staff are only called in a true emergency? Thanks.

We have received two separate suspicious activity reports from Palo Verde Nuclear Power Plant regarding multiple UAVs flying over / around the facil ity overnight. The first report was from Sunday night, and the other report was from Monday night (see attached).
Site security was unable to observe any identifying markings on the UAVs themselves or locate the operator(s), so I do not know how much additional investigation can be undertaken. However, if you are able to get any additional information, please let me know so that I can update our records/ database accordingly.

The Licenaee notified one of the NRC resident inspector&.

Four (4) drones were observed flying beginning at 2051 MST and continuing through the time of this report (2113 MST). At the urging of John Dixon (thanks, John!), I just received a call from Sean Darnseif and Michael Casenza (?) from PVGS to update me on the activities their site is undertaking to attempt to identify the UAV operators from earlier this week.
According to our discussions just now, PVGS is working closely with their regulatory affairs staff, LLEA, DHS, FAA, and FBI to address the UAV overflights. Further, PVGS intends to deploy a counter-drone technology from Area Armor to attempt to identify the UAV operators. This technology apparently has a 13-mile radius and can determine the specific point from which the UAVs were launched so that LLEA / site security can locate the operator(s). I confirmed with the licensee that they have coordinated the use of this counter drone technology with FAA, and they informed me that this technology only locates the UAVs; it does not interfere with the flight pattern of those UAVs in any way. PVGS has also staffed an additional team on the backshift to help search for any potential operators should additional UAVs be observed later this week.
I have conveyed this information to my FBI counterpart with whom I have been coordinating this week for his awareness, and I have asked both PVGS and the FBI to keep me informed of any additional information they may receive during the course of this investigation. I will also share this information with ILTAB for their on-call duty officer's awareness.

Since drones are aircraft and they are not violating a law, what is the action that can be taken legally if they locate the operator?

Actually, the system they describe is not a counter-UAV technology. It is a detection system that could aid in the identification of the people flying the UAVs. However, at th is time, the pilots are not violating ay laws or regulations by flying over the plant.

At the urging of John Dixon (thanks, John!), I just received a call from Sean Darnseif and Michael Casenza (?) from PVGS to update me on the activities their site is undertaking to attempt to identify the UAV operators from earlier this week.
According to our discussions just now, PVGS is working closely with their regulatory affairs staff, LLEA, DHS, FAA, and FBI to address the UAVoverflights. Further, PVGS intends to deploy a counter-drone technology from Area Armor to attempt to identify the UAV operators. This technology apparently has a 13-mile radius and can determine the specific· point from which the UAVs were launched so that LLEA / site security can locate the operator(s). I confirmed with the licensee that they have coordinated the use of this counter drone technology with FAA, and they informed me that this technology only locates the UAVs; it does not interfere with the flight pattern of those UAVs in any way. PVGS has also staffed an additional team on the backshift to help search for any potential operators should additional UAVs be observed later this week.
I have ,conveyed this information to my FBI counterpart with whom I have been coordinating this week for his awareness, and I have asked both PVGS and the FBI to keep me informed of any additional information they may receive during the course of this investigation. I will also share this information with ILTAB for their on-call duty officer's awareness.

As you may have already seen, there was a second overnight overflight incident last night, also involving multiple drones. I am contacting the FBl's WMD Coordinator to follow up with him on this second overflight incident, having already contacted them yesterday about the Sunday night incident.
And yes, I agree that both of these overflight incidents at Palo Verde meet several criteria that we have historically used in triaging UAV overflights as particularly worthy of follow-up(# of UAVs involved, time of day, length of overflight, maneuvers, etc.).

We have received two separate suspicious activity reports from Palo Verde Nuclear Power Plant regarding multiple UAVs flying over / around the facility overnight. The first report was from Sunday night, and the other report was from Monday night (see attached).
Site security was unable to observe any identifying markings on the UAVs themselves or locate the operator(s), so I do not know how much additional investigation can be undertaken. However, if you are able to get any additional information, please let me know so that I can update our records I database accordingly.

One more update for general awareness:
The FBl's WMD Coordinator wrote back this morning and indicated that PVGS has begun the process of designating their airspace as restricted through the FAA, and that the effort was being led by DOE. He indicated that the FBI is working to "assist the DOE in this process."

Actually, the system they describe is not a counter-UAV technology. It is a detection system
that could aid in the identification of the people flying the UAVs. However, at this time, the
pi lots are not violating ay laws or regulations by flying over the plant.

At the urging of John Dixon (thanks, John!), I just received a call from Sean Damseif and Michael Casenza (?) from PVGS to update me on the activities their site is undertaking to attempt to identify the UAV operators from earlier this week.
According to our discussions just now, PVGS is working closely with their regulatory affairs staff, LLEA, OHS, FAA, and FBI to address the UAV overflights. Further, PVGS Intends to deploy a counter-drone technology from Area Armor to attempt to identify the UAV operators. This technology apparently has a 13-mile radius and can determine the specific point from which the UAVs were launched so that LLEA / site security can locate the operator(s). I confirmed with the licensee that they have coordinated the use of this counter drone technology with FAA, and they informed me that this technology only locates the UAVs; it does not interfere with the flight pattern of those UAVs in any way. PVGS has also staffed an additional team on the backshift to help search for any potential operators should additional UAVs be observed later this week.
I have conveyed this information to my FBI counterpart with whom I have been coordinating this week for his awareness, and I have asked both PVGS and the FBI to keep me informed of any additional information they may receive during the course of this investigation. I will also share this information with IL TAB for their on-call duty officer's awareness.

The licensee has not changed their security posture. The licensee continues to monitor the drones.
As of 0355 EDT. no drones have been observed at the site since before 0020 MST. LLEA surveyed the area and were unable to locate drones on the ground or anyone controlling the drones.
The licensee notified FAA (both Phoenix and Albuquerque), FBI, OHS, and the Maricopa Sheriffs Office. The licensee notified the NRG Resident Inspector.

that could aid in the identification of the people flying the UAVs. However, at this t ime, the

Scott, At the urging of John Dixon (thanks, John!), I just received a call from Sean Darnseif and Michael Casenza (?) from PVGS to update me on the activities their site is undertaking to attempt to identify the UAV operators from earlier this week.
According to our discussions just now, PVGS is working closely with their regulatory affairs staff, LLEA, DHS, FAA, and FBI to address the UAV overfl ights. Further, PVGS intends to deploy a counter-drone technology from Area Armor to attempt to identify the UAV operators. This technology apparently has a 13-mile radius and can determine the specific point from which the UAVs were launched so that LLEA / site security can locate the operator(s). I confirmed with the licensee that they have coordinated the use of this counter drone technology with FAA, and they informed me that this technology only locates the UAVs; it does not interfere with the flight pattern of those UAVs in any way. PVGS has also staffed an additional team on the backshift to help search for any potential operators should additional UAVs be observed later th is week. I have conveyed this information to my FBI counterpart with whom I have been coordinating this week for his awareness, and I have asked both PVGS and the FBI to keep me informed of any additional information they may receive during the course of this investigation. Drones were first noticed at 2050 MST and are still over the site as of 2147 MST. Security Posture was normal, which was changed to elevated when the drones were noticed. The Licensee notified one of the NRC rnsident inspectors.
As of 0237 EST, no drones have been observed at the site since 2230 MST. Officers believe drones were over 2 feet in diameter.

Four (4) drones were observed flying beginning at 2051 MST and continuing through the time of this report (211 3 MST). As occurred last night, the drones are flying in, through, and around the owner controllled area, the security owner controlled area, and the protected area. Also, as last night, the drones are described as large with red and white f lashing lights. Spotlights have not been noted tonight.
The licensee has not changed their security posture. The licensee continues to monitor the drones.
As of 0355 EDT, no drones have been observed at the site since before 0020 MST. LLEA surveyed the area and were unable to locate drones on the ground or anyone controlling the drones.
The licensee notified FAA (both Phoenix and Albuquerque}, FBI, OHS, and the Maricopa Sheriff's Office. The licensee notified the NRC Resident Inspector.

I would point out that restricted airspace will do nothing to stop an adversarial attack and even the detection systems identified earlier in this email chain have limited success rates, and there is even lower likelihood that law enforcement will arrive quickly enough to actually engage with the pilots. We should be focusing our attention on getting Federal regulations and laws changed to allow sites to be defended and to identify engineering fixes that would mitigate an adversarial attack before there our licensed facilities become vulnerable.

The last time I looked at the state laws on drones was about a year ago, and that that t ime the
number of states w ith similar laws was in the high teens with more pend ing. There has been a big
push for states to enact these laws because the federa l government has limited authority to enact
similar laws, since most drone activity t hat is worrisome occurs close to the ground/structures- and
the federa l government's authority starts higher than that, if I recal l, over 500 feet. (Th is is why FAA's
drone regu lations get shot down in court constantly- lack of authority to create the regulations.) By
contrast the states have vast power over t his, and a lot (if not most at this point) have laws
perta ining to drone activity at power plants.

Mark, to answer your question, Arizona law prohibits flying a drone within 500 feet horizonta lly or
250 feet vertically of any critica l faci lity, wh ich includes power plants of any type.

Actually, the system they describe is not a counter-UAV technology. It is a detection system
that could aid in the identification of the people flying the UAVs. However, at this t ime, the
pilots are not violating ay laws or regulations by flying over the plant.

According to our discussions just now, PVGS is working closely with their regulatory affairs staff, LLEA, DHS, FAA, and FBI to address the UAV overflights. Further, PVGS intends to deploy a counter-drone technology from Area Armor to attempt to identify the UAV operators. This technology apparently has a 13-mile radius and can determine the specific point from which the UAVs were launched so that LLEA / site security can locate the operator(s). I confirmed with the licensee that they have coordinated the use of this counter drone technology with FAA, and they informed me that this technology only locates the UAVs; it does not interfere with the fl ight pattern of those UAVs in any way. PVGS has also
staffed an additional team on the backshift to help search for any potential operators should additional UAVs be observed later this week. I have conveyed this information to my FBI counterpart with whom I have been coordinating this week for his awareness, and I have asked both PVGS and the FBI to keep me informed of any additional information they may receive during the course of this investigation .
