Democrats Have A Mandate (For At least Two Years), but..

Well, Californians have spoken and it's the exact opposite message than the rest of the country delivered! While the majority of the county voted out the incumbents, California literally retained all of them on the state level and brought back Jerry (version 2.0). It seems that after seven years of "Arnold" the citizens had enough of the "non-politicians" and decided to bring back someone with over forty years of experience. Simply, Meg and her mega millions just didn't resonate as she and her fellow Republicans had hoped. So, on with the show! With the clear mandate that the Democrats now have in California (since they control both houses of the Legislature as well as the governorship) AND with the approval of Proposition 25 which eliminates the need for a two thirds vote on the budget, the "world's their oyster!" Indeed, just as the Democrats had a mandate (or so they thought) nationally two years ago, the Democrats here in California now have two years to show what they can do! Having said this, just remember that combined, Props 22, 25 and 26 may help or hinder the Democrats. Read on: Only time will tell whether voters made California's fiscal situation any better by passing three budget-related initiatives Tuesday. On the heels of a record 100-day budget delay, voters relaxed the vote threshold for passing a state budget, handing the reins to Democrats and potentially avoiding the annual gridlock between the two parties. But voters also restricted the majority party's ability to obtain more revenue and shift money away from local government accounts on its own, potentially adding new hurdles to the budget process. "Voters gave and they took away," observed Democratic Gov.-elect Jerry Brown during a Wednesday press conference in Oakland. Since 1962, the state has required a two-thirds vote for any appropriation. But under Proposition 25, majority Democrats now can approve a spending plan without relying on Republican support. "There is no reason – there is absolutely no reason – why the budget should be late," said Senate President Pro Tem Darrell Steinberg, D-Sacramento. "The budgets have been late in large part because of the two-thirds supermajority vote, and the fact that the Republicans have used that two-thirds (as) leverage." Republicans said that as a result of Proposition 25, Democrats would own the budget, warts and all. "That works for me," said Senate Republican leader Bob Dutton, R-Rancho Cucamonga. "Voters have made it clear they're tired of excuses for having a late budget, and Democrats have always blamed it on the two-thirds vote. Now they don't have that excuse." Voters also curtailed the majority party's powers to increase revenues. California likely will face a deficit next year well over $10 billion. The state will lose about $8 billion in annual revenues when temporary tax increases on sales, income and vehicles expire next year. The state already anticipated fewer federal dollars, and that likelihood has increased with Republicans taking control of the House.

GOP state lawmakers want the state to balance its budget mostly through spending cuts. Democrats say that would flout state and federal protections for the poor and would undermine the safety net. To avoid cuts and still balance the budget, Democrats say, they need to find billions in new revenues. Increasing taxes requires a two-thirds vote. But Republicans have blocked tax hikes since the Legislature approved a large package of taxes in February. In place of taxes, Democrats and Gov. Arnold Schwarzenegger proposed and passed fund shifts and fee hikes to generate new revenues. But by passing Propositions 22 and 26, voters closed off some of those options. Proposition 22 prevents the state from using gas tax money to repay bonds and relying on local government funds to balance the budget. Cities and counties say the new law will protect local transportation and redevelopment projects, as well as public safety services. The initiative's passage will cost the current state budget about $1 billion, according to Michael Cohen, deputy legislative analyst with the nonpartisan Legislative Analyst's Office. That's because the initiative blocks a gas tax maneuver Democrats employed this year to raise that money. Proposition 22 also will reduce the ability of lawmakers to patch future budgets with local redevelopment money or gas tax funds the way they have over the past two years. That means lawmakers will have to find money elsewhere for the general fund budget. "Nobody cares about protecting the solvency of the general fund budget," said Fred Silva, a former legislative budget aide and adviser with the think tank California Forward. "We have citizens to protect transportation and health care, but not the solvency of the general fund." Proposition 26 says the Legislature needs a two-thirds vote for policies that increase taxes for any taxpayer. The law previously allowed the Legislature to raise one form of tax and reduce another by a like amount on a majority vote, as long as the overall tax burden was unchanged. Based on that concept, Assembly Speaker John A. Pérez, D-Los Angeles, proposed a $1.2 billion tax on oil production that could be passed on a majority vote through a maneuver that relied on other tax shifts. That tax proposal never went anywhere. Under Proposition 26, that idea would need two-thirds approval. "The key phrase is that if a bill raises a tax on any taxpayer, it needs a two-thirds vote," Cohen said. "This makes it really, really tough. The rule we'd been using up until now was that we looked at the impact on all taxpayers combined." So, the next two years are going to be very interesting, to say the least!

SMART train to stop at Terra Linda

Recently the SMART board of directors voted to eliminate the Downtown San Rafael and the Larkspur Ferry Terminal in the first phase of train route.

The board voted 10 to 1, with one abstention, to move forward with a rail line from the Marin Civic Center to Railroad Square in Santa Rosa at a cost of $395 million. The line would serve 57 percent of forecasted riders.

In November of 2008 voters passed a quarter-cent sales tax in Marin and Sonoma with the assumption a 69-mile rail line and adjacent bike and pedestrian path would be built from Larkspur to Cloverdale.

But with the bad economy which weakened sales tax revenue, the project now must be modified. There is an approximate $350 million shortfall. SMART anticipates once the first phase is built, fed-eral and other dollars will flow to the project to finish it. They are also hopeful the initial phase could be expanded if bids for the rail work come in lower than expected.

Under the plan approved Saturday, the Marin Civic Center stop would be completed by fall of 2014. Stops in downtown San Rafael and in Larkspur, as well as northern Sonoma, are scheduled to be done by 2018 at the latest, provided an additional $290 million is secured.

The total cost of the SMART rail and pathway project is now estimated at approximately $695 million, up from the $540 million projected when the train tax was passed in 2008.

To date SMART has secured $410 million. Cost to date are $60 million. This leaves about $350 mil-lion, limiting what can initially be built.

This year sales SMART sales tax revenue is expected to total $25 million. Originally $31 million was projected.

With less revenue, the agency will have a harder time borrowing money. The agency had planned to sell bonds for $300 million of the work, but a $200 million bond is likely to be the limit.

Get the Most Out of Your Blog Why you should sync your blog with your home page

A site filled with interesting, engaging information can only do so much if your audience cannot

find it. Getting high-placed rankings for specific keyword searches on Google can be the

difference between a successful website and an unsuccessful one. But by integrating your blog

into your company's homepage, you can optimize your presence on search engines. Google's

ranking algorithm puts significant emphasis on "keyword density," or the ratio between the

searched-for keyword and the rest of the content on your page. In other words, when your

potential customer searches for a keyword in your company's field, one factor determining

where your site places in the results list is the number of times that keyword appears on the

page. For example, if you own a glassblowing studio, example keywords could include

"glassblowing," "hand-blown vase," "glassblowing class," and "custom blown glass."

So, why integrate your blog with your homepage? Combining your blog and your company's

homepage will produce several positive results. First of all, you can organize your articles in an

easy-to-find way while still keeping them in the most visible places your customers see. They can

go to the same place online for the steady, necessary content featured on your home page, as

well as the exciting, constantly updated content of your blog. However, integrating can also have

the added benefit of optimizing your keyword density.

As far as where you should place keywords, you can only work in your keywords so many times

on your homepage copy without annoying your visitors and diluting your message. However,

blog posts allow you to repeat important keywords more "organically." For example, in an

integrated homepage and blog, you can work keywords into the following:

• Headlines and subheads of blog posts

• Content of blog posts

• Blog post categories

• Core home page content

• Your home page footer

See how this integration can spread keywords out nicely over the content of your website? And

by increasing your presence on Google this way, you should see your web traffic increase

significantly.

Kalb's Q&A for Contractors By David Kalb, President of Capitol Services, Inc. We take two directions with contractor’s questions this time. One is interested in ‘walking away’ from an unfortunate failed effort. Another contractor is seeking ‘direction’ before ‘walking into’ the unknown areas of a new growing industry… Q: I know from reading your columns that you deal with the Contractors Board. My question relates to the Franchise Tax Board (FTB) and I hope you can help. My corporation has ceased doing business, so do you know of a reason they would be requesting a tax return? What paperwork would you guess they want in addition to the return? A: Even if a corporation has ceased doing business, it must formally dissolve or withdraw with the Office of the Secretary of State (SOS) in order to formally terminate its legal existence. For more general rules on corporate contracting visit www.cutredtape.com for a ‘keyword’ search. In all likelihood in your individual case, the FTB computers generated this request because they received some income information from Federal tax returns, the Board of Equalization, or the Employment Development Department. It does not matter if the corporation is inactive, ceased doing business or operated at a loss, corporations are subject to an annual minimum $800 franchise tax. As with any tax issue, it is important to consult with a tax specialist. This being said, based on my experience in dealing with the FTB and SOS, you’ll likely be required to file a Tax Return (Form 100), pay all outstanding tax liabilities, penalties, interest due; Complete an Assumption of Tax Liability/Request For Tax Clearance Certificate (FTB Form 3555); and request a Tax Clearance Certificate (if the corporation is suspended).

Q: The solar construction industry is quite a booming opportunity and with this comes some uncertainty & confusion. We’ve encountered new "delivery methods" of contracting to install the solar systems. There are companies who are not Licensed Contractors in the market place who are selling and contracting for the delivery and installation of these new Systems. I call these folks “solar integrators”.

They hold the contract with the owner for the delivery of the solar system and then contract with a Licensed Contractor to install the system. This sounds like a Prime and Subcontract arrangement. MyQuestions: 1) Doesn't Contractor Licensing Law require these (Integrator) companies to be Licensed Contractors to enter into a contract to deliver and install a Solar System to an Owner? 2) Can we as a licensed General contractor legally enter into a contract with an integrator to install a solar system for an Owner (if the Integrator is not a licensed contractor)? 3) Do we have any Lien Rights if our contract is with the integrator, and the integrator is not a licensed contractor? Shouldn't we hold the installation contract directly with the Owner? Thank you for your response.

A: Based on the description above, you are correct. It would appear the “integrator” is acting as a contractor if his contract includes the “installation” of a solar system. In my opinion, as a licensed contractor it would not be proper to enter into a contract with an unlicensed entity. The CSLB would likely consider this in violation of B&P Section 7114 — “Aiding, abetting or conspiring with unlicensed person to evade law”. This being said, your question, “can we legally enter into a contract...” requires another expert opinion. I would consult with an attorney as to whether this is considered “legal”.

To avoid potential problems, I would suggest that you hold the installation contract directly with the property owner to protect your rights. For specific questions on Mechanic’s Liens, I would again direct you to contact an attorney that specializes in the construction field. WELDING

Welding joins metal or thermoplastic materials together by using heat and sometimes pressure to melt the material until it forms a strong joint. The many types of welding have common hazards such as fire, burns, electric shock, vision damage, and exposure to fumes.

Get training in the welding equipment and process you will use. Know the properties of the materials (and any coatings on them) that you are welding in order to take proper precautions. Weld only in designated areas that are screened, posted with warnings, and free from combustible and flammable materials.

Welding requires layers of PPE to prevent injuries. Don’t weld unless all of your body is covered with protective clothing to prevent burns from sparks, spattering materials, or radiation. Wear a fire-resistant welder’s cap that covers and protects your head and hair from burns. Wear insulated flame-resistant gloves. Don’t wear cuffed pants that could trap sparks. Wear leather aprons, leggings and/or gauntlets depending on your job task. Keep protective clothing dry and free from damage, tears, and holes and uncontaminated by grease, oil or solvents that could burn.

Protect your vision with a helmet that covers your face, forehead, ears and neck. It should be made of materials that will protect against radiant energy, flying sparks, and spatter. Use a filter lens with a shade designed for the welding type, electrode size, metal thickness, or welding current. Wear safety glasses with side shields or goggles underneath your helmet. Use filtered shades and barriers to protect yours and other’s vision. Never look at a flash, even for an instant.

Prevent hearing loss by wearing earplugs or muffs if there is loud shop noise or if the welding operation is loud. If you weld overhead or in other awkward positions, wear earplugs or muffs to prevent burns in your ear from sparks, spatter, and hot metal.

Avoid electric shock by wearing dry clothing for welding. Wear rubber soled shoes and use an insulating mat on surfaces that can conduct electricity. Don’t weld in wet areas or wet weather. Ground the welding equipment and metal being welded. Don’t change electrodes with your bare or wet hands.

Control your exposures to hazardous fumes. Welding smoke can irritate your eyes, nose, and respiratory system. Weld only in well-ventilated areas or near fume hoods. Keep your head away from fumes by staying back and to the side of the work. Don’t weld in confined spaces without ventilation. Use a respirator to control hazardous fumes.

Prevent fires and explosions. Clear your welding area of combustible and flammable materials. Check gas hoses for leaks. Don’t weld containers or materials that held or were contaminated with flammable materials. Designate a firewatch after welding work has occurred in a building or area to ensure there are no smoldering sparks. Dispose of waste metals and electrode butts in designated containers. Know the emergency evacuation plans and where fire fighting equipment is located.

SOLDADURA

La soldadura une entre sí metales o materiales termoplásticos mediante el uso de calor y algunas veces presión para fundir el material hasta formar una junta resistente. Los diversos tipos de soldadura tienen peligros comunes como incendios, quemaduras, electrocución, daño de la vista y exposición a vapores.

Obtenga capacitación para el uso del equipo de soldadura y para el proceso que utilizará. Conozca las propiedades de los materiales (y de cualquier recubrimiento en ellos) que esté soldando a fin de tomar las precauciones adecuadas. Si realiza soldaduras elevadas sobre la cabeza o en otras posiciones inusuales, use tapones para oídos u orejeras para prevenir quemaduras en sus oídos causadas por chispas, salpicaduras y metal caliente.

Evite los choques eléctricos mediante el uso de ropa seca para soldar. Use zapatos con suela de goma y use una estera de aislamiento en las superficies que puedan conducir electricidad. No suelde en áreas húmedas ni en clima húmedo. Conecte a tierra el equipo de soldadura y el metal a soldar. No cambie electrodos con sus manos descubiertas ni húmedas.

Controle sus exposiciones a los vapores peligrosos. El humo de la soldadura puede irritar sus ojos, nariz y sistema respiratorio. Suelde solamente en áreas bien ventiladas o cerca de campanas de extracción de vapores. Mantenga su cabeza lejos del paso de los vapores inclinándose hacia atrás y hacia un lado de la pieza de trabajo. No suelde en espacios confinados sin contar con ventilación. Use un respirador para controlar los vapores peligrosos.

Prevenga los incendios y las explosiones. Despeje su área de soldadura para que no haya materiales combustibles ni inflamables. Inspeccione las mangueras de gas para verificar que no tengan fugas. No suelde contenedores o materiales que contuvieron o estuvieron contaminados con materiales inflamables. Designe a un vigía contra incendios después de terminar el trabajo de soldadura en un edificio o área para asegurarse de que no haya brazas que ardan lentamente. Elimine los desechos metálicos y los trozos sobrantes de electrodos en contenedores designados. Conozca los planes de evacuación de emergencia y la ubicación del equipo de combate de incendios.
