That the Corporate and Community Service Committee recommends that Council provide sponsorship to the 2017 – 2019 Gawler Relay for Life events by providing hire of its facilities, including Princes Park and Gawler Sport and Community Centre free of charge. BACKGROUND The Gawler Relay for Life event has been held since 2009, with the inaugural event being held at Elder Riggs Reserve (South Gawler Oval). The event was moved to its current location at Princes Park for the 2010 event, where it has continued to grow and flourish. This culminated in the Gawler Relay for Life receiving the 2016 Australia Day Town of Gawler Event of the Year Award. The Relay for Life concept is a nationwide initiative of the Cancer Council that allows local communities an opportunity to recognise and celebrate those who have overcome cancer or are undergoing treatment, as well as those people who care for them. It also provides an opportunity to celebrate the memory of loved ones lost to cancer. Each Relay for Life event is organised by a local volunteer committee on behalf of the Cancer Council. Teams of 10–15, which are headed up by a team captain, get together and fundraise year-round. Everyone then meets at the Relay to celebrate the amazing fundraising achievements of the past year. Teams participate in a relay-style walk or run, challenging themselves to stay on the track overnight. The Gawler Relay for Life is one of over 200 relays held throughout Australia every year. The Gawler event is organised by a committee of 17 community volunteers from Gawler and the district with the aim of raising funds for the Cancer Council of South Australia. In the eight years of the event, the Gawler Relay for Life has raised in excess of $500,000 to help fund Cancer research, prevention and support services.

In 2013 the organising committee of the Gawler Relay for Life approached Council seeking sponsorship for the event – use of Princes Park and Gawler Sport and Community Centre at no charge. Council supported the sponsorship request and the following motion was adopted:

The above sponsorship provision concluded after the 2016 Relay for Life event held in April 2016. This report is presented in relation to Council providing sponsorship for future events. COMMENTS/DISCUSSION The purpose of this report is to introduce Mr. Richard Holt from the Gawler Relay for Life committee. The Gawler Relay for Life event has been successfully held at Princes Park, with use of the Youth Shak with Gawler Sport and Community Centre for the Survivors Afternoon Tea in recent years. The use of these facilities has been complimentary in nature to the existing uses of the Showgrounds precinct including Gawler Central Sporting Club and all existing users of Gawler Sport and Community Centre. The event continues to be a positive initiative that is strongly supported by the Gawler and broader regional communities. FINANCIAL/BUDGET IMPLICATIONS The value of sponsorship for the 2017 Relay for Life event, as per the Officers Recommendation would be a maximum of $1120, based on use of the Princes Park (Saturday and Sunday) and the Youth Shak (Saturday and Saturday evening). The value for subsequent years of sponsorship would be determined by the Fees and Charges adopted through the annual budget process. To provide an indicative cost of the three year sponsorship agreement – a 3% annual increase in Fees and Charges would result in a total three year sponsorship value of approximately $3462. It should be noted that the value of sponsorship for the Relay for Life event has been included in the 2016/17 budget for in-kind support of community events/organisations. OFFICER’S RECOMMENDATION Item 7.2 – Dry Areas (CC10/1674) That the Corporate and Community Services Committee request: 1. Staff to establish a key stake holder group seeking feedback on the impacts of dry

areas in Gawler and strategies needed to address ongoing community behaviour in this regard.

2. A report is presented back to this Committee on the outcomes of community engagement process.

BACKGROUND At the 26 April 2016 Full Council Meeting the following motion concerning extending dry areas was lost.

That Council supports the commencement of a community engagement process proposing variations to existing dry zone areas and as follows:

1. Extending the current dry zones in Gawler Areas 1 (Apex Park), 2 and 3 (Pioneer

Park) into a 24 Hour Dry Area. 2. Creating new dry areas within the Town of Gawler as per Attachment 1.

The recommendation as above, to introduce dry areas throughout Gawler came about as a result of incidences of anti-social behaviour and direct communication from the Community to Council.

The objectives sought when originally introducing the dry areas were:

a) To reduce vandalism; b) Address behavioural offences in the town precincts; c) Raise awareness among youth and other community members that drinking to

excess in public is not socially acceptable; and d) To give a positive impression to the community and visitors that the Town of Gawler

is a proactive, socially responsible and family friendly community. The establishment of the current dry areas involved extensive public and stakeholder consultation. Dry areas give police an effective tool to combat anti-social behaviour in public places. (Attachment 1). In June 2014, South Australian Police (SAPOL) wrote to Council recommending a 24 hour dry zone for Clonlea Reserve. The area has BBQ facilities and other amenities which are aimed at attracting families with younger children. The major focus of the request is public safety and involves a proactive approach to reducing anti−social behaviour and alcohol related offending. Anti−social alcohol related behaviour can cause fear and reduce confidence in community safety. Council was advised at the 26 April 2016 meeting by SAPOL that in the past year or so Gawler Police have been more and more frequently attending incidents at Apex Park on Julian Terrace. Incidents involving intoxicated persons many of whom are persons gathering at the public shelters in Apex Park. SAPOL advise that they have had numerous incidents of grossly intoxicated persons in this area; some of them require conveyance by Police and many times these persons use public transport to return to their home addresses. Often there has been fighting that has resulted in assaults and a general disturbance to the enjoyment of the area for the regular public. The presence of liquor in this area is in general having a marked negative effect on all persons feeling safe to actually use this public area. SAPOL have requested that the 7am – 7pm Dry area be increased to 24 hours. COMMENTS/DISCUSSION Council is committed to working with the community of Gawler to create a vibrant, liveable town with neighbourhoods, streets and public places that are safe, welcoming and promote social interaction. Council is making great headway into becoming a town that is walkable and cycling friendly and is committed to building infrastructure giving priority to pedestrians and cyclists. This includes promoting physical activity as a core element in improving health and wellbeing, both physically and mentally. Providing the conditions to enable improved physical activity among Gawler’s residents and visitors is a strong focus of Council’s Regional Public Health and Wellbeing Plan. The philosophy and approach through which the Town of Gawler will implement the Regional Public Health and Wellbeing Plan means that the actions and projects in the Plan will be undertaken with a focus of people in their local place providing leadership, community ownership with a connection to place. The aim is to improve wellbeing and happiness, through feeling a greater sense of belonging and social connectedness. Council aims to help by making places and spaces healthier for all.

This Plan is developed with a number of broader social and environmental challenges in mind such as social inclusion and an ageing population. Working in partnership with the community is integral to Council achieving its goals. An important strategy in creating a safer Gawler is developing diverse areas with a range of entertainment, activities, events and attractions that promote responsible consumption of alcohol. Alcohol has adverse effects on our community including assaults, injuries, property damage and other forms of anti-social or illegal behaviour that have a negative impact on health and well-being. Intoxicated people can negatively affect the amenity of an area through increased litter, spilled bodily fluids and reduced perceptions of safety. The National Alliance for Action on Alcohol (NAAA) is a national coalition of health and community organisations from across Australia that has been formed with the goal of reducing alcohol-related harm. Currently comprising major organisations with an interest in alcohol and public health, the formation of the National Alliance for Action on Alcohol represents the first time such a broad-based alliance has come together to pool their collective expertise around what needs to be done to address Australia’s drinking problems. The National Alliance for Action on Alcohol aims to put forward evidence-based solutions with a strong emphasis on action. One of the NAAA’s first tasks has been to prioritise what needs to be done to achieve a cultural change that will reduce alcohol harms and improve the health of Australians. The purpose of dry area legislation is to curb alcohol-related problems in public places. The rationale for scheduling a dry area varies from addressing inappropriate use of public places and public nuisance, to more complex social issues such as alcohol abuse. A number of streets and reserves in the Town of Gawler are currently scheduled as dry areas. Council can apply for a variation to the scheduled areas at any time. While there some positive effects for the local community and the use of public space, there are negative effects on vulnerable people with drug and alcohol addictions that require work to be done to address their health and welfare needs. Consequently, the introduction/extension of dry zones alone is not sufficient to address drug and alcohol related behaviour. It has been recognised that there is a need for a “whole of Community” approach towards developing a more positive culture around drinking and improving safety. The following approach in regards to Apex Park and Clonlea Reserve is consistent with this holistic philosophy. Apex Park / Clonlea Reserve Users of Apex Park are particularly concerned with the impact of intoxicated persons in the mornings and at night creating a negative impact on day and night time activities. Council has received a number of complaints from residents and visitors who frequent Apex Park and feel unsafe and concerned about heavily intoxicated people in the Apex Park area. Complaints are about random acts of violence, self-harm, public urination, litter, intoxication and un-well people. This has an overall impact on perceptions of safety and amenity and the reputation of the Town of Gawler’s reserves and parks. As a result of this, Council staff will commence community engagement on the implementation of a 24 hour Dry Area for Apex Park and boundary realignment for Clonlea Reserve. It is anticipated that staff possibly with the assistance of specialised persons will facilitate communication amongst key stakeholders in relation to the current issues within these areas.

This engagement will include the establishment of a key stakeholder group that would seek feedback on the impacts of the Dry Area time extension. Such a group would look at options for broader consultation, longer term strategies and investigate options for adopting a harm minimisation approach to reduce the impact of alcohol and drug usage on the community. A similar approach has been taken in regard to Domestic and Family Violence within the community. July 2015 saw the establishment of the Gawler Domestic and Family Violence Network that takes a holistic and community focused approach to addressing domestic and family violence issues in Gawler. A key stakeholder group can work to reduce the harmful effects of alcohol and drug usage within the community by:

a) Promoting awareness and understanding of alcohol and other drug issues and substances affecting people and communities.

b) Promoting positive alternate life ways to harmful alcohol and other drug use. c) Enhancing the capacity of the community to identify and respond to increasing trends

in substance misuse. d) Developing policy and plans to address identified community service needs in

relation to alcohol and other drugs. e) Represent and advocate community needs and interests to key stakeholders at local,

regional, state and national level. Key stakeholders to form the group can include, but is not limited to:

a) SAPOL. b) Gawler Health Service. c) Social service organisations. d) Office of the Liquor and Gambling Commissioner. e) Gawler Business Development Group. f) Local alcohol licensees. g) Local businesses. h) Users of parks and facilities impacted by Dry Area implementation.

The Gawler Community Plan 2014 - 2024 identifies that the Gawler Council is committed to building community capacity and increasing social inclusion for a strong and integrated community. As stated earlier the Regional Health and Well-being Plan that health and social well-being will be fundamental issues that will need to be addressed. The aim is to create a vibrant town centre, pedestrian connectivity, child and youth friendly neighbourhoods and new and improved recreational facilities.

That the Corporate and Community Services Committee recommends to Council that Council:- 1. Adopt the Library Review and Strategic Report comprising of Part 1 – Library

Review and Strategic Context, and Part 2 – Library Connect: an Integral Part of Gawler Connect (Civic Centre redevelopment).

2. Acknowledges that the Library Review and Strategic Report is a strategic document that will inform future Council deliberations on specific matters related to Library and Customer Service delivery within Gawler.

1. Council approves the release of the Library Review and Strategic Report including the ‘Planning for Gawler Connect – Library Review Strategic Report and other initiatives’ for public consultation.

The Library Review and Strategic Report, with the additional information as noted (Attachment 4) in the above motion, was released for public consultation throughout August 2016. Feedback received has been collated, and is presented in an attachment (Attachment 3) to this report. COMMENTS/DISCUSSION The first report – Library Review and Strategic Background (Attachment 1) provides background information about the public library sector, current trends and their impact on libraries, as well as a comparative overview of how the Gawler Library compares against Australian Public Library Standards. The second report – Library Connect: an Integral Part of Gawler Connect (Attachment 2) focuses on the Library within the context of Gawler Connect, and how it can integrate with the greater Gawler Connect project to create strong links with the youth space, digital hub, youth space, multi-function spaces and heritage spaces. Together with the library, these spaces will create an exciting community hub with opportunities for business incubation, learning and leisure. The current studies underway related to the business management of both the Multi-Function and Digital Hub spaces will assist in creating this truly connected centre. A key part of the Library Connect report (Attachment 2) is a shared service delivery model, comprising of the Library and Customer Service teams. This shared model would create efficiencies, streamline ‘front-of-house’ service delivery, and broaden the range of services available at each library service point (Gawler and Evanston Gardens). Feedback received during the public consultation period has been varied, and is has been collated (Attachment 3). Topics raised include the desire for a makerspace within the Library or greater Gawler Connect facility, the desire for increased technologies and business incubation within the facility, and the need for the heritage aspects of the building to be valued and preserved.

Library Staff feedback has also been varied. A recent staff workshop identified the importance of the Library and the Gawler Connect facility being a valued and relevant resource for the community, where the community engages, collaborates, and has a sense of ownership over the facility and its services. This will require successful and ongoing collaboration with the community, other divisions of Council and Elected Members, as well as the ability to identify and respond to changing community needs, and the ability to continually train staff in emerging technologies. COMMUNICATION (INTERNAL TO COUNCIL) Manager, Library and Community Services Acting Manager, Economic Development, Regulatory Services Team Leader, Customer Service/Office Support CONSULTATION (EXTERNAL TO COUNCIL) Community consultation for the Library Review and Strategic Report was gathered via written feedback in August 2016. Notification of the consultation process was advertised via Council’s website and social media accounts, in The Bunyip and by direct contact with specific stakeholder groups (including Library staff). Promotional material was also displayed in Council sites. Previous consultation for the preparation of the Library Review and Strategic Report was undertaken by Roger Henshaw Consultancy Services (RHCS). Workshops were held with Library staff; and a presentation and workshop-style discussion with Elected Members took place at the May 2015 Corporate and Community Services meeting. Scheduled consultation sessions were held with specific user groups (such as the Friends of Gawler Library, Youth Advisory Committee, Storytime attendees, and at the Elderly Centre). Open consultation sessions occurred within the Library, where the consultants engaged with many customers. A confidential online survey was emailed to all Library customers who had registered an email address with the Library. The consultation process was used to assess how the Library is currently used, viewed and valued by the community, and to help predict future areas of growth and demand upon the service. RHCS have used this information to detail how future growth and trends may impact upon the Library, and to develop specific areas of focus for the Library within the context of the Gawler Connect Project. POLICY IMPLICATIONS Council Policy 9.2 Library Service will be further reviewed and amended at the completion of this project. STATUTORY REQUIREMENTS All relevant legislative requirements have been adhered to in the development of the Library Review and Strategic Report. FINANCIAL/BUDGET IMPLICATIONS This project has been undertaken within the $30,000 budget to perform a Library Review and Strategic Report.

That the Corporate and Community Services Committee: 1. Adopts in principle the Gawler Amateur Swimming Club Licence Agreement and

authorise staff to seek legal review of the Agreement. 2. Request a report be presented to Council following the legal review, seeking the

application of the Common Seal of Council. BACKGROUND The Gawler Amateur Swimming Club has previously had a licence agreement with Council for the use of Gawler Aquatic Centre. In summary the agreement identified a licence fee and permitted use for the club during the operation of the Gawler Aquatic Centre. The club has been provided exclusive use of up to seven (7) lanes Tuesday, Thursday and Friday; and five (5) lanes Monday and Wednesday between 6:00pm and 7:30pm. The club would relinquish the use of up to three (3) lanes when the temperature was 32 degrees Celsius or above. The club was charged $5.50 per lane per hour plus GST for this use. There were a number of other conditions in the agreement in regards to carnivals, events, clubrooms and storage. The previous Gawler Amateur Swimming Club Licence Agreement with Council expired on 1 April 2016. This agreement was presented to Council on 28 January 2014 with the following resolved:

At the conclusion of the 2015/16 Gawler Aquatic Centre Season, Council staff consulted with both the Gawler Amateur Swimming Club and STARplex Swim Club. It was identified that the two clubs currently utilise the Gawler Aquatic Centre for lap swimming/training under different fee structure agreements. Council staff undertook a benchmarking comparison with other Council owned community swimming facilities within Adelaide. The best practice model utilised for the hire of Council owned aquatic facilities by Swimming Clubs in Adelaide is a discounted lane hire rate and discounted entry charge for swimmers. At the same time Council Policy 5.10 – Hire of Council Owned Facilities, included in this report as (Attachment 1) was scheduled for standard biennial review. The introduction of a new Gawler based Swim Clubs category within Council Policy 5.10 has ensured the Gawler Aquatic Centre swim club facility hire is consistent with industry best practice and will provide the following positive outcomes for users of the Gawler Aquatic Centre:

a) Ensure consistency with all Swim Clubs requiring the hire of lane space. b) Ensure consistency with Council Policy 5.10 Hire of Council Owned Facilities. c) Ensure a balance is kept between publicly available and privately hired lane

spaces. This is particularly important during peak times: 6:00am-8:30am and 4:00pm-6:00pm weekdays.

d) Remain consistent with industry standards (best practice) by placing a suitable value on privately hired lane space.

e) Ensure accurate reporting of the in-kind support provided to Gawler based Swim Clubs.

f) Ensure Council has flexibility to allow a fair distribution of water space between Swim Clubs, Lap Swimming, Recreational Swimming, and Internal Programs.

The report identified pool usage and the responsibilities related to the management of the pool after 6:00pm. Within the previous Gawler Based Swim Club report it was identified that Council were spending $9,674 in labour to stay open exclusively for the Gawler Amateur Swim Club. Staff through consultation with the Gawler Amateur Swimming Club identified the possibility of shared use of the facility after 6:00pm. This was also in response to community feedback relating to the use of the centre for lap swimming and hire on weekdays in the late afternoon and early evening. The extension of the weekday opening hours to 7:30pm will allow facility management to respond to the following community aspirations and identified opportunities:

a) Lap swimming after work (later afternoon/evening) b) Better community understanding of closing time due to consistency c) Aqua aerobics classes held at later times d) Increased opportunities for hire by community and sporting organisations

(e.g. Scouts and Football/Netball clubs during pre-season) e) Learn to Swim classes – in particular private classes f) Flexibility for existing afternoon bookings (e.g. STARplex Swim Club)

COMMENTS/DISCUSSION

The Gawler Amateur Swimming Club has been based at the Gawler Aquatic Centre since the clubs inception in 1962. The Club continues to provide coaching from beginners to senior levels and competes throughout the season at numerous swimming carnivals culminating in the South Australian Country Championships.

In recent years a multi-year Licence Agreement between the Gawler Amateur Swimming Club and Council has governed the use of the facility including clubrooms and storage areas by the Club. The multiple year agreement has provided the Club with a level of security regarding a stable and ongoing home base. The previous agreement was delayed in its implementation due to a number of significant alteration being proposed to the nature of the agreement including, afterhours access and fee structure, with agreement only finalised in January 2014. The implementation of this agreement over the past 18 months has proved to be positive for both the Club and Gawler Aquatic Centre management, with strengthening of existing working relationships between parties.

The Gawler Amateur Swimming Club Licence Agreement – updated August 2016 is included in this report with tracked changes as (Attachment 2). The updated agreement includes relevant elements of the following documents:

a) Policy 5.10 – Hire of Council Owned Facilities b) Council Report on Gawler Aquatic Centre Use After 6pm (presented 23 August 2016)

The changes to the Gawler Amateur Swimming Club Agreement are focused on two main areas:

1. Financial Arrangement a) Gawler Amateur Swimming Club Licence fee is determined by the Council

Fees and Charges adopted as a part of the annual budget process. b) Gawler Amateur Swimming Club is entitled to apply for a concession on

hire fees as stated in Council Policy 5.10 – Hire of Council Owned Facilities.

c) Bookings made outside of training times to be made with regard to the Gawler Aquatic Centre conditions of hire.

2. Shared Use a) Changes to the public opening hours of Gawler Aquatic Centre (close

7:30pm weekdays) will result in a fully shared model with the Gawler Amateur Swimming Club. The club will be entitled to exclusive use of a minimum of four (4) lanes between 6:00pm and 7:30pm

The changes to the first and second schedules within the Agreement may appear significant, however, these changes are aligned with the adopted motions.

The Gawler Amateur Swimming Club is still entitled to the other conditions previously outlined in the agreement. The Club has been consulted throughout the offseason in relation to the changes that have occurred relative to the impact of these upon the club:

1. Introduction of Gawler Based Swim Club concession category into Council Policy 5.10 – Hire of Council Owned Facilities

STATUTORY REQUIREMENTS All relevant statutory requirements are adhered to in the operation of the Gawler Aquatic Centre. FINANCIAL/BUDGET IMPLICATIONS The recommendation presented in this report will result in approximately $5,243 income, with an in-kind contribution of $15,727 for the use of Gawler Aquatic Centre for training by Gawler Amateur Swimming Club for the 2016/17 financial year. There will also be additional income and in-kind support for the use of the facility for the hosting of carnivals, although it is currently unknown the number of carnivals scheduled for the 2016/17 season. The value of hire per carnival is difficult to estimate, as it is heavily influenced by the numbers of carnival entrants, directly impacting carnival lengths and centre staffing requirements. The legal fees associated with the development of the Licence Agreement with the Gawler Amateur Swimming Club will be borne by Council and is allowed for within the 2016/17 Gawler Aquatic Centre budget. BACKGROUND

At its meeting held on 26 June 2012 Council resolved the following Motion:

COMMENTS/DISCUSSION The Town of Gawler receives funding from both the State (HACC – Home and Community Care) and Commonwealth (CHSP – Commonwealth Home Support Program) Governments to support the ongoing delivery of the Gawler Home Assist and Commonwealth Home Support Program. State funding supports the delivery of a broad range of flexible, low level Home Care services that are aimed to promote independence for younger people with disabilities living in the Gawler Council area, while Commonwealth funds supports those aged over 65 years. As the 2016 Service Agreement between the Minister for Communities and Social Inclusion (for the HACC program) and the Town of Gawler is made under the same terms of the 2012 Funding Agreement, it provides for the continuation of service provision in its existing format until 30 June 2017 (Attachment 1). Despite this roll over in funding, both the Aged Care and Disability sectors are currently in the process of implementing major reforms. This will impact how the Gawler Home Assist and Commonwealth Home Support Programs are funded in the future. From 1 July 2017 the disability sector will undergo major reform. Adults aged 18 to 64 years who meet disability access requirements will begin to enter the National Disability Insurance Scheme (NDIS). The NDIS is a new way of providing individualised support for people with an impairment or condition likely to be permanent, or a developmental delay which affects their ability to take part in everyday activities. The NDIS is being implemented by the National Disability Insurance Agency (NDIA). The Local Government area of Gawler will be one of the first areas to commence transitioning to the NDIS from the current scheme. The Aged Care Sector has begun to undergo similar reforms. In 2015 the Commonwealth Governments Living Longer Living Better reforms to aged care saw the establishment of the Commonwealth Home Support Program. This program brought together four previously separately funded programs, being the Commonwealth Home and Community Care Program (HACC), the National Respite for Carers Program (NRCP), Day Therapies Centre (DTC) Program and Assistance with Care with Housing for the Aged (ACHA) Program. From 1 July 2018, the Commonwealth Home Support Program will be integrated with the Home Care Packages Program. These two new models will represent a significant change in funding arrangements as the traditional block funding that has been available to Service Providers (ie Local Government) will cease in most cases and funding will follow the consumer. A more detailed report outlining the proposed reforms and the potential impact on the delivery of services will be made available to the Corporate and Community Services Committee in November 2016. POLICY IMPLICATIONS NIL STATUTORY REQUIREMENTS The 2016 Agreement is made under the terms of the Funding Agreements between the Minister for Communities and Social Inclusions and the Service Provider (2012).

The 2012 Funding Agreement includes the following references: (Clause) 21.3 the Service Provider must comply with the provisions of any relevant legislation, including the: 21.3.1 Equal Opportunity Act, 1984 (SA): 21.3.2 Occupational Health, Safety and Welfare Act, 1986 (SA): 21.3.3 Workers Rehabilitation and Compensation Act, 1986 (SA); 21.3.4 Superannuation Guarantee (Administration) Act, 1982 (Cth); 21.3.5 Payroll Tax Act, 1971 (SA) and 21.3.6 Income Tax Assessment Act, 1936 (Cth):

Insofar as all legislation relates to the Service Provider’s Staff arising out of or in connection with this Funding Agreement and the Service Agreement.

(Clause) 29.1 The Service Provider is required to endorse and promote the principles and practices in accordance with the objectives of the Disability Discrimination Act 1992 (Cth).

FINANCIAL/BUDGET IMPLICATIONS The 2016/17 budget for the Home Assist and Commonwealth Home Support Program has been developed with projections including receipt of funding from both the State and Federal Government. The 2016/17 budget, consistent with previous years, is predicated on the service being cost-neutral, outside of in-kind administrative support provided by Council administration staff. The State Government has allocated $43,489 in funding for the 2016/17 period, which accounts for approximately 8% of the total funding received. The Commonwealth Government provides $514,864.83 per year in funding. The initial scheduled grant funding payment from the State Government will not be made until the 2 signed Agreements are returned to the Department.
