JOSE LAWAG With reference to the memorandum dated 24 September 2013 of the OIC, CENRO, DENR-Olongapo City re incident report on the damages of the constructed gabion check dams caused by typhoon Odette and alleged inaction on the non-existent request for evaluation of the PO contractor, hence, requesting this office for evaluation/ validation and inspection as well as payment under 1 st billing collection of the corresponding accomplishments on the watershed rehabilitation contract (structural measures) for the construction of 87 cubic meter gabions within Caulaman Watershed contracted with Barangay Batiawan Upland Farmers Association (BBUFA). The team proceeded to the site on 04 October 2013 located at Barangay Batiawan, Subic, Zambales. Hereunder are the results of the inspection/evaluation conducted by the team: 1. Based on the contract, the PO contractor shall construct gabions with the following activities: stream bed/stream corridor soil excavation in preparation for the installation of gabion check dam, collection of rocks and boulders, setting up of cyclone wires/cyclone frames, stacking/piling of boulders and cross-fitting of ties and cross ties; 2. It was observed that the gabion/check dams constructed were already damaged during the time of inspection/evaluation and according to the PO contractor, the constructed gabions were damaged as it was caused by flash flood due to Typhoon Odette; 3. The team found out that there are 5 gabion check dams that were constructed by the PO contractor having its wings and spillway but there was no apron constructed; and 4. Since the constructed gabions were already dilapidated, the team therefore recommends terminating the project as a case of force majeure for unforeseen causes beyond the control of the DENR or the PO contractor. In view of the above findings and in as much as the contracting PO has religiously done the activities to be undertaken as specified in the approved contract, the team recommends the payment of 1 st billing collection in the amount of ______________________________________ only
