Notice Inviting Offers

Empanelment of Structural Engineers for consultancy services for

repairing cum waterproofing/painting etc., of buildings

State Bank of India has its staff residential colony at Sector 13, Nerul (East), Navi

Mumbai, spread in approx 25 acres. The existing Ground + 4 floors / Stilt + 4

floors, buildings were constructed about 20+ years ago and repairing work is to

be carried out to arrest leakage, seepage, deterioration of structural position and

for safety of buildings, in several buildings.

INSTRUCTIONS TO APPLICANTS

1. All the applicants intending to submit offers/applications have to submit

their proposal in closed envelope, wax closed/sealed properly. Applicants are

requested to read the contents of this document. The same shall be submitted

duly signed on every page along with application. Duly completed application

with enclosures shall be addressed to “The AGM (Estate), State Bank of India,

Estate Department, Ground Floor, ‘C’ Wing, GITC, Plot No.8, 9, 10, Sector 11,

CBD Belapur, Navi Mumbai – 400 614” super-scribing the cover “Empanelment

of Structural Engineers for consultancy services for repairing cum

waterproofing/painting etc., of buildings.”

2. The Bank reserves the right to reject any or all the applications without

assigning any reason thereof and no correspondence would be entertained in

this regard.

3. The bank shall pay fees to the structural engineer for the completed work

only and no part payment shall be made, expect for completed work in respect of

some buildings, out of total buildings, in respect of which work has been

assigned.

4. SBI will notify identified applicants in writing by a letter in duplicate that

their application for empanelment has been accepted. The Selected applicant/s

has to return the duplicate copy to the Bank within 07 working days duly

Accepted, Stamped and Signed by Authorized Signatory in token of acceptance.

5. All expenses, stamp duty and other charges/ expenses in connection with

the work to be allotted shall be borne by empanelled bidder/s.

6. Any effort on the part of bidder to influence empanelment process or award of work may result in the rejection of the bid.

7. Duly filled-in, completed applications along-with relevant papers,

documents to be submitted with supporting papers, documents, certificates,

statements etc.

8. Applicant Structural Engineer has to submit their bid/rates, on the basis of

per square foot of the built-up area, for the services mentioned under Scope of

work.

9 Site Visit The bidder should arrange for

3. Minimum Eligibility Criteria for pre-qualification

(A) Applicant Structural Engineer must be registered with NMMC.

(B) Applicant can be an individual or a proprietorship firm/ partnership

firm, with registration with NMMC as Structural Engineer.

(C) Average Annual financial turnover during the last 3 years, ending

31st Mar'17, should be at least Rs. 5 lacs.

(D) Experience of having successfully completed similar works during

last 5 years ended Mar'17 should be either of the following:

a) Three similar completed works costing not less than the

amount of Rs. 2.00 lacs (fees) each

or

b) Two similar completed works costing not less than the amount

of Rs. 2.50 lacs (fees) each

or

c) One similar completed work costing not less than the amount of

Rs. 4.00 lacs (fees).

*Similar work means preparing BoQ/ estimate/ detailed drawings

for repairing/waterproofing on the basis of their

observations/inspections etc.

(E) Structural Engineer should be having office/office cum residence/

address at Navi Mumbai/ Mumbai/Mumbai sub-urban

(F) The applicant should not have been banned in any Government

Department/ Public Sector undertaking during last three years. If

the ban was temporary nature, ban period should not be

continued.

(G) The applicant must be having PAN number.

4. Scope of Work : Scope of the work broadly include following:

i. Inspect, diagnose and identify the repairs/ damages/ defects/ cracks/ source of

leakage/ seepage in the building with respect to structural distress, non-structural

deterioration/ damages, other major repairs like plastering, waterproofing etc. as

required for the building.

ii. To prepare detailed drawings, flat wise/area wise & building wise, and BoQ,

with all the necessary details including material specifications, quality, quantity

etc.

iii. Prescribing method/s for using/applying material.

iv. Preparation of sub-head wise, item wise detailed estimates, based on

current market rate analysis, for all major items of materials and labour, taking

into consideration site condition, height of building, scaffolding required for

execution of work etc.

v. The work may also involve identifying various plumbing / civil defects or

damages etc. besides painting, plastering, waterproofing including necessary

repairs to electrical installations and other work, for the said building as per the

site conditions.

vi. The structural engineer may suggest one or more method/materials for

waterproofing / repairing, with estimated cost and durability period.

vii. While assessing repairing / waterproof requirement, it will be responsibility

of the Structural Engineer to inspect and carry out test/s wherever required (on

random or otherwise) or otherwise, as per his observations regarding position or

building.

viii) Before submitting the application, alongwith price bid, Structural Engineer

may visit the buildings for inspection/observation purpose. However, this visit will

be at his cost, risk & responsibility only.

ix. Structural Engineer to certify/ quantify the work, completed on the basis of

BoQ/ Estimates.

5. Criteria for Acceptance of Proposals and Procedure for Evaluation

a) The Structural Engineers shall submit their offers in sealed covers, duly

completed alongwith its enclosures/ supporting papers.

b) The bids will be examined by the Bank to determine whether they are

complete, as per eligibility criteria and terms of offer documents. A bid

determined as not substantially responsive will be rejected. The Bank may, at its

discretion waive any minor non-conformity or irregularity in a bid which does not

constitute a material deviation.

c) After opening of the technical bids and preliminary examinations, some or

all of the bidders may be asked to make presentation of the solution/services

offered by them.

5.1 Evaluation process:

Detailed technical evaluation will include, scrutiny of minimum eligibility criteria,

technical information submitted as per technical bid format (Annexure H),

supporting documents/ papers submitted and site visits.

i. Proposal shall be evaluated based on the scoring of marks against various

criteria, including undernoted:

a. Availability of in-house infrastructure along-with assistant/s, structural

engineers and other testing facilities.

b. Methodology offered

c. Technical feasibility, durability, serviceability, maintenance cost, eco-friendly

aspects and product life cycle cost

d. Time period for preparation of plan, item rate detailed estimate.

ii. Apart from fulfilling the PQ criteria (minimum eligibility criteria), applicant

should score minimum 70% marks in overall scoring parameters, in order to

become eligible for empanelment. However, minimum scoring criteria and

minimum eligibility criteria may be relaxed, if adequate numbers of eligible

applicants are not qualifies. However, no relaxation will be done on

prequalification (minimum eligibility criteria) pertaining to registration of SE with

NMMC.

iii. Proposal/s, meeting the eligibility criteria & having complied with the points

of Technical Bids and attain minimum technical score, shall be qualified for

empanelment.

iv. Structural Engineer has to quote rates per square foot of built-up area, in a

sealed envelope.

6. General Terms & Conditions:

a) The Structural Engineer (SE) shall carry out the work mentioned above under

'Structural Engineer's Services" in full or part, as assigned by the bank, according

to requirement & decision of the bank, in one go or in parts.

b) The Structural Engineer shall exercise all reasonable skills, care and diligence

and conduct all tests wherever required, while carrying out assigned work

hereby covenanted to be performed by them.

c) The Structural Engineer shall take the responsibility themselves. Bank

shall be authorized to write to the SE, if they find any discrepancy in the

submissions including drawings, BOQ, estimates.

d) For preparing the BOQ, Drawings, the Structural Engineer shall visit &

inspect/examine the site, collect all the relevant information/data, take site

particulars, prevailing prices for the repairing materials and labour wages etc.

e) While assessing the requirement of repairing, cost verses benefit to be kept

into account, in terms of safety of structure and expected increase in life of the

building.

f) While choosing/proposing methodology & material, modern available options to

be examined, ascertaining its reliability & success.

g) The Structural Engineer shall pay an amount limited to 10% of the total

payable fees for covering damages for losses caused to the Bank or delay on

their part in carrying out the terms of this RFP or penalty of similar amount may

be imposed. The decision of the Bank, will be final and binding on the Structural

Engineer.

h) Extra charges/ halting allowance/ conveyance allowance or any such

allowance will not be paid, regarding visit of Structural Engineer or its

representative at the site or office/s of SBI, before submission of offer/ application

or at later stage.

i) Whenever the work is examined by the Chief Technical Examiner of the

Central Vigilance Commission or his representative, Structural Engineer will have

to extend necessary assistance & help, including providing requisite details /

papers.

j) The Structural Engineer shall provide to the Bank free of cost two copies of

1:100 (one hundredth) scale drawings, showing specific parts/details of damaged

portion or requiring repairing. He shall, if so required by the Bank, supply extra

copies of all such drawings and the cost of such extra copies shall be reimbursed

by the Bank to reasonable extent, subject to production of satisfactory evidence

of cost. In addition to this, the SE shall provide soft copies of drawings in pen

drive or CD/DVD.

k) This arrangement shall cease to be exist if either bank or applicant Structural

Engineer express their intention to this effect, in writing. However, applicant will

have the responsibility of completion of assigned work. Further, terms &

conditions of this document shall continue to be binding on the SE and he shall

remain liable & responsible for the services tendered by him, including

submissions made by him.

l) If the SE fail to adhere to the time schedule stipulated or the extended time

which may be granted by the Bank in his sole discretion, the Bank shall be

entitled to delist the SE without giving notice and entrust the work to some other

SE, after withdrawing from delinquent SE .

m) In case of termination of arrangements as mentioned above, the SE shall not

be entitled to fees or compensation except the fees payable to them for the work

actually done and as per the provisions in this document. In such cases, the

decision of the Bank regarding extent and actual completion work, including the

amount of fees due to the SE on the basis of actual work, shall be final and

binding on the SE.

n) The Structural Engineer shall not assign, sublet or transfer their interest

regarding arrangements made through this officer document, without the prior

written consent of the Bank.

p) Arbitration:

(i) If any dispute, difference, or question shall at any time arise between the SE

and the Bank as to the interpretation of this agreement or concerning anything

herein contained or arising out of this agreement or as to the rights, liabilities and

duties of the said parties hereunder, or as to the execution of the said works,

except in respect of the matters for which it is provided herein, that the decision

of the Bank is final and binding, the same shall be referred to the Arbitration and

final decision of the Navi Mumbai /Mumbai based arbitrator to be agreed upon

and appointed by both the parties or in case of disagreement as to the

appointment of a single arbitrator, to be appointment of two arbitrators shall,

before taking upon themselves the burden of reference, appoint and umpire.

(II)(i) For the purpose of appointing the Navi Mumbai/ Mumbai based sole

Arbitrator referred to above, the Appointing Authority i.e. the CGM of the Bank or

on his behalf the D.G.M. (F&OA), of this Office will send within thirty days of

receipt by him/her of the written notice aforesaid to the SE a panel of three

names of persons who shall be presently unconnected with the organization, for

which the works executed.

(ii) The SE shall on receipt by them of the names of aforesaid, select any one of

the persons named to be appointed as a sole Arbitrator and communicate his

name to the Appointing Authority who shall thereupon without any delay appoint

the said person as the sole Arbitrator. If the SE fail to communicate such

selective as provided above within the period Specified, the Appointing Authority

shall make the selection and appoint the selected person as the sole Arbitrator.

(iii) If the Appointing Authority fails to send to the SE the panel of three names as

aforesaid within the period specified, the SE shall send to the Appointing

Authority a panel of three names of Mumbai/Navi Mumbai based persons who

shall all be unconnected with either party. The Appointing Authority shall on

receipt of the names of the aforesaid persons appoint one as the sole Arbitrator

within 30 days of receipt by him of the panel and inform the SE accordingly. If the

Appointing Authority fails to do so, the SE shall be entitled to appoint one of the

three persons from the panel as the sole Arbitrator and communicate his name to

the Appointing Authority.

(iv) If the Arbitrator so appointed is unable or unwilling to act or resigns his

appointment or vacates his office due to any reason whatsoever another sole

Arbitrator shall be appointed as aforesaid.

(v) The work awarded shall, however, continue during the arbitration

proceedings. No payment due or payable to the SE shall be with-held on account

of such proceedings except the disputed payment of fees on account of other

provisions in this agreement.

(vi) The Arbitrator shall be deemed to have entered on the reference on the date

he issues notice to both the parties fixing the date of the first hearing.

(vii) The Arbitrator may from time to time, with the consent of the parties, enlarge

the time for making and publishing the award.

(viii) The Arbitrator shall give a separate award in respect of each dispute or

difference referred to him. The Arbitrator shall decide each dispute in accordance

with the terms of the RFP and give a reasoned award. The venue of Arbitration

shall be such place as may be fixed by the Arbitrator in his sole discretion.

(ix) The fees, if any, of the Arbitrator shall, if required to be paid before the award

is made and published, be paid 50:50 basis by each of the parties. The costs of

the reference and of the award including the fees, if any of the Arbitrator, who

may direct to and by whom and in what manner, such costs or any part hereof

shall be paid, may fix or settle the amount of costs to be paid.

I/We have read, understood & examined the offer, alongwith terms &

conditions/ other details/formats, the receipt of which is hereby duly

acknowledged, including subsequent pre-bid clarifications/ modifications /

revisions, if any, furnished by the Bank and we submit our application for

rendering our services. The undersigned is authorized to sign the

documents/papers, on behalf of the bidding firm and the document

delegating this authority is enclosed with this letter.

2. We certify that we have not made any change in the contents of the

offer document, including its amendments/clarifications provided by the

Bank submitted by us. We shall abide by the terms & conditions spelt out in

the bank's notice/offer.

3. It is further certified that the contents of our proposal are factually

correct. We also accept that in the event of any information/ data /

particulars proving to be incorrect, the Bank will have the right to disqualify

us from the bidding or for awarding work.

4. I/We also understand if any false information is detected at a later

stage, including in any future contract made between ourselves and State

Bank of India, Estate Department, GITC on the basis of the information

given by me/us will be treated as invalid by the State Bank of India.

5. We confirm that we have not induced or attempted to induce any other

Bidder to submit or not to submit a proposal for restricting competition.

Also, we undertake that we will not resort to canvassing with any official of

the Bank, connected directly or indirectly with the empanelment process to

derive any undue advantage. We also understand that any violation in this

regard, will result in disqualification of applicant from further bidding

process.

6. We undertake that we will not offer, directly or through

intermediaries, any bribe, gift, consideration, reward, favour, any material or

immaterial benefit or other advantage, commission, fees, brokerage or

inducement to any official of the Bank, connected directly or indirectly with

the bidding process, or to any person,

organization or third party related to the contract in exchange for any

advantage in the Bidding, evaluation, contracting and implementation of the

contract. We shall abide by all the laws/rules/regulations pertaining to

prevention of corruption in force.

7. We understand that you are not bound to accept any particular or all

the offers, you may receive. You may reject all or any

offer/proposal/application without assigning any reason or giving any

explanation whatsoever. I/We agree that the decision of the State Bank of

India in selection of the contractors will be final and binding on me/us.

8. We hereby undertake that our name does not appear in any “Caution”

list of RBI / IBA or any other regulatory body.

9. We confirm that we do not have any litigation / case pending against

us in any Bank / PSU / State or Central Govt departments. We also confirm

that we have not been blacklisted by any Bank / PSU / State or Central Govt

Office/ departments for any reasons, except the undernoted (details should

be mentioned alongwith period and reasons thereof.

10. I/We hereby certify that none of our relatives as per Bank’s

Marks will be awarded on the basis of particulars submitted by the applicant

structural engineers and observations during site visit by the bank's official's

where the applicant has carried out or is carrying out the work.

Apart from fulfilling the PQ criteria (minimum eligibility criteria), applicant should

score minimum 70% marks in overall scoring parameters, in order to become

eligible for empanelment. However, minimum scoring criteria and minimum

eligibility criteria may be relaxed, if adequate numbers of eligible applicants are

not qualifies. However, no relaxation will be done on prequalification (minimum

eligibility criteria) pertaining to registration of SE with NMMC.
