Novel food: New Regulatory Development on Novel Food in Asia

Novel food applies to food and ingredients used in foods which have not been used for human consumption toasignificantdegreewithinageographicalarea,suchastheeuorCanada.

In the EU Regulation, novel foods falls under several categories, including new or intentionally modified primary molecular structure, foods or food ingredients isolated from microorganisms, fungi or algae or consisting of or isolated from plants and food ingredients isolated from animals, or to which a new production process has been applied, where that process gives rise to significant changes in the composition or structure of the foods or food ingredients which affect their nutritional value, metabolism or level of undesirable substances.

The driving forces on food security, such as climate change, population growth, availability of arable land, water resources, availability and accessibility of food and food losses, has given novel foods a shot in the arm in recent times. The market has seen a healthy growth of innovations in novel food, ranging from juices made from the noni (Morinda citrifolia) to toppings, breakfast cereals, energy bars containing chia seeds (Salvia hispanica) to sweeteners made from stevia (Stevia rebaudiana) and inexpensive protein powder from khai-Nam (Wolffia arrihiza).

Regulations on the safety of novel food have been established in developed markets like the EU, Canada, Australia, and New Zealand. These regulations stipulate that foods and food ingredients falling within this scope must be safe for consumption, should not be misleading, as well as should not be nutritionally different from the foods and food ingredients which they are intended to replace which will disadvantage the consumer. Because of the proliferation of novel foods that is starting to be internationally traded in this era of globalisation, more countries are in the process of drafting regulations, particularly in the Asia and ASEAN regions, to regulate such products. The Asia Pacific functional foods market (excluding GCC) is anticipated to increase at a compound annual growth rate (CAGR) of over 12% to reach US$ 48.30 billion by 2020. Increasing awareness on the potential benefits of functional foods and dietary supplements among these two key consumer segments has played a major role in ramping up demand in the region. Decades of sustained economic growth has led to the emergence of a burgeoning middle class, with a sizeable disposable income to spend on health and wellness products. Whatdoyouthinkhaschanged the functional nutrition, nutraceutical, and dietary supplement industries the most?

a&r unanimously thinks that all these industries were most strongly impacted by the Nutrition and Health Claims Regulation. It has changed the European regulatory landscape completely and stagnated innovation in new product development, especially for botanicals and probiotics as well as prebiotics. Manufacturers instead sought out loopholes and detours for bringing their products to market, resulting in an increase of new FSMP and medical device products.

What is the biggest lesson you learnt in 2016?

Innovation shifted towards stronger exploitation of existing ingredients e.g. novel application formats, improved bioavailability and taste improvements through technology. Also there was a trend towards the development of more biotechnologically manufactured ingredients. Another trend was a shift towards more generic claims, again circumventing the NHCR.

Whatdoyouthinkwillbethebiggest challenge to the industry in 2017?

Sorting out the health claim situation for botanicals, but also for probiotics. This is not only the biggest challenge, but also the most pressing issue, since there is ample evidence for health benefits for botanicals and probiotics that consumers need to be informed about. This, however, currently is not possible due to regulatory constraints.

Whichareaoftheindustrydoyouthinkislargelyunexplored and still has room for innovation and product development?

Research around the gut microbiome as well as prebiotics, probiotics, and symbiotics is only beginning. This will undoubtedly evolve into a huge area for innovation and product development. Also, since the gut microbiome differs widely between individuals and ethnic groups, this will also tie into the development of personalized health products, another area that is still largely unexplored. Also deserving more exploration is healthy aging, especially in the area of cognition and delay of dementia. Last but not least the diagnostic possibilities through new technologies will enable consumers to identify their health needs in a more defined way what will also lead to dedicated and personalized treatment opportunities.

I think the combination of ageing and a more affluent population, more and easier exposure to health information on the internet, together with new development in formulation and ingredients have contributed to the drastic changes in the industry in past few years. We have probably witnessed more new products and faster evolution of personalised health trends in last decade than the last century.

What is the biggest lesson you learnt in 2016?

In 2016 we saw substantial changes in Asia markets in terms of regulation and my biggest learning is we need to always have a multiple channel strategy in place to capture and maximise the shifting consumers.

Whatdoyouthinkwillbethebiggest challenge to the industry in 2017?

Building trust and knowledge for consumers. We believe very strongly that people should understand the products they take and the health benefits that they can derive from our products. There is a lot of wrong and incorrect information in the market and as a company and an industry we really want to ensure our consumers really understand the products they are taking and the functional benefits they can provide.

Whichareaoftheindustrydoyouthinkislargelyunexplored and still has room for innovation and product development?

We believe there are interesting opportunities in the integration of western and TCM principles and products, and also products to support specific challenges in Asia such as anti-pollution products, especially anti-haze such as lung health products.

understanding the new regulatory frameworkinChinaChina Health Care AssociationIn 2015 and 2016 the Chinese government announced a series of new regulations and tax policy for governing food safety, health food registrations system and ecommerce restrictions with the aim of improving the governance for food and health food.

The new regulations meant the sales process is now being strictly governed, with more stringent requirements ranging from product formulas, production requirements, and product labels for international manufacturers and importers.

The outcome and impact of these new regulations meant that for some imported food products it has become much harder to be compliant with Chinese regulations and standards. The number of non-compliant products in China have increased, as have the number of products being rejected for sale in China.

Many small and medium Chinese importers are being hard hit by the new ecommerce restrictions; it has decreased the number of products online. Many international private label manufacturers have left the Chinese market, as their products cannot be properly registered. Despite this challenge many international companies still want to enter China and are still attracted by the rising purchasing power of China’s middle class, plus China is the world’s largest market for food.

despite the changes there is a positive side for companies selling vitamins and mineral products, under the new health food registration system it will bemuchquickerfortheseproductstoentertheChinesemarket.For well-established and reputable companies they are now able to rapidly expand their market share and brand.

Does this relation affect only the gut and the brain or does it also involve the microbiota residing inside the gut?

The gut microbiota plays various important roles for the functioning of the organism: it digests food, modulates the immune system and produces microbial factors acting on the brain, the adipose tissue etc...

The mitochondria and gut bacteria have a lot of similarities: they both share the same maternal origin and have same circular DNA structure. Dr Ideas will share, during his conference, the interactions between these two organisms and how the balance of one affects the balance of the other.
