Minutes of the meeting of the Municipal Building Committeeheld at the Council Chamber Febuary 3rd,1940 at Eleven --0­clock A.M.

All members of the Committee were present,to-wit:C.J.Smith,C.W.Farmer.J.B.Fuller and A.H.Freeman.

Meeting was held for the purpose of recieving anopening bids for planting the grounds of theMunicipal Building.

C.W.Farmer,Mayor Pro Tem,presiding calling the meeting toorder.After which public announcement was made that allbidders who desiBed to submit bids should come into theCouncil Chamber. After this announcement those in atten­dance appeared and submitted bids which were opened,readand considered in public meeting.The result of the saidmeeting and the said bids follows;

\YHERAS,this body,has fullyconsidered said plans,specificationsand contract document,and finds that it is for~e best interestof City of Newnan,Georgia to proceed with the contemplated pro­ject,as therein provided;

NOW THEREFORE,BE IT RESOLVED;That the plans, specifications and contract documents referredto in the preamble hereof for the Grounds of the MunicipalBuilding of the City of Newnan,Ga • be, and the same are hereby,in all respects, approved and adopted as the Official plans,specifications and contract documents to be used in connectionwith the prosecution of the work. That for the purpose of iden­tification,there shall be indorsed on one set of such plans,specifications and contract document by the Mayor Pr~ Tem.ofthis City of Newnan, the following;

~~ereas,WilliamC.Pauley,LandscapeArchitect, pursuant to aresolution heretofore adopted, has. tabulated and consideredall bids heretofore recieved for Planting of the Groundsof the Mu~icipal Building and has dul~ made his recomen­dations to this body and it appearing from said recomen­dations and report that J.T.Kehely,Florist,by Paul Kehe-ly is the lowest and best bidder for the Planting of the@rounds of the Municipal Building, in the Sumof$975.00,and that this body, after considering said report and rec­omendations and all bids heretofore filed,finds that thebid of the above mentioned bidder is the lowest and bestbid;

NoW Therefore, be it resolvedjSeption IjThat the bid of J.T.Kehely Florist,By Paul M.Kehely,for the planting of the grounds of the MunicipalBUilding,Newnarr,Ga.is the sum of $975.00, is hereby acce­pted, determined and declared to be the lowest arid bestbid, and that acontract for said work,as heretorore pre­scribed by the plans,specifications and contract document,shall be forthwith executed for said work

Section 2jThat C.W.Farmer Mayor Pro Tern is hereby author­ized and directed to execute said contract for and in be­half of City of Newnan, this Febuary the 5th,1940.

Alderman Fuller read and moved the adoption of the follow­ing ~Kd1NaR~Kx resolution;It appearing that there is now available for financing theLandscape contract for the Municipal Building the sum of$593.44,and,

Whereas,the cost of the said Landscape Contractis $975.00 and the difference between the said amounts mustbe appropriated by the City of Newman,

Now therefore be it RresolvedjSectionl.That $381.56 be and the said amount is hereby appro­priated from the General Fund now in the Treasury of the Cityof Newnan for the purpose of financing the landscape contractand the said sum is hereby appropriated forthe said purpose.

Section 2. That the City Treasurer be and he is hereby direc­~ed out of the General Fund of the City of Newnan to depos­1t to the credit of the Municipal Building Fund of said Cityfor landscape contract the sum of$381.56.

Motion by Mr.Hubbard Seconded by Mr.Johnson that Dr.C.A.Moody be employed as Inspector of Milk and Meats for ueCity at the Salary ofc'$50.00 per month, and Salary to be­gin as of January the 1st 1940.

Motion by Mr.Johnson seconed. by Mr Parks that the Policeand purchasing committee be authorizes to pur~hase the nec­cessary bedding and covering for the New City Jail.

Motion by Mr.Fuller seconed by Mr.Farmer that that theing Committe be authorized to purchase the neccessary­itary supplies for the New Municipa~ Hall.

Motion Mr.Fuller seconed by Mr.Farmer that Mr.Gilbert getneccessary m~terial for the makins of Street Markers and thathe make same when he had the time to spare from his otherwork.

Motion Adopted •..The Newnan Water and Light Commission delivered to CityCouncil Vou~hers to the amount of $189.680.19 f04 cash ad­vanced by them beginning Nov.7th 1925 and running throughJanuary lSth.1940.

Motion Mr.Farmer seconed by Mr.Hubbard that A.W.Powers CityClerk be authorised to sign receipt to the Newnan Water andLigllt Commission for the delivored Vouchers.

On motion the consideration of t~e application of A.W.Powers for a permit to build a filling station on thefront end of his lot at the intersection of Greenville

,Street and Salbidi Avenue was postponed by the Mayor andAldermen of the City of Newnan until the next regularmeeting of the Council.The said application was not con­

'sidered and action thereon postponed until next meetingof the Council because A.W.Powers requested its postpone­ment to enable him to confer with the Elders and Deacons

You will note fro~ th~ above estimated receipts of $145.202.00we haveapportioned $143.094.00 for expense, leaving unapportion­ed the sum of$2.108.00 which in our oppinion is the minimum ampuntthat couldbe set aside as a reserve for contingencies and emergen­cies.We have carefullycons'idered the request of the Fire Departmentfor an additional truck and certain improvements in the Fire A­larmsystem, and we feel that, while funds for their purchase arenot available, these items are needed for proper functioning ofdepartment.We have requested the Chief of the Fire Department toget prices on new light truck and cost of overhauling and recon­ditioning the old LaFrance Truc%.When this information is secured,we will give further consideration to the budget of ~~e Fire De­partment.Vle recomend th2,t the Water & Light Committee of this bodyconsult with the Newnan water & light Commission in reference tothe Commission making the improvements to the fier Alarm Systemas requested by the Chief of the Fire Dept.May we again stress the importance of living within the bugget byeach department and agency of the City.If additional appropriationsare made other than shown on this bUdget,or if the bUdget of anydepartment is not followed, 'itnwill beproper and neccessary for

. these additional Funds to be raised from increase in the City Rev­enue by Taxation or otherwise.

Call meeting of City Council held on above date 4 oclockP.M.with Mayor Smith Presiding.

Aldermen prebent,C.W.Farmer,F.W.Striplin,T.G.Ware,H.S.John­son,R.B.Hubbard Jr.R.P.Parks and J.B.Fuller, also City Atty.Freeman. Alderman absent,G.C.Polk.

On motion of Mr.Farmer Second by Mr.Stripling the followingResolution was unanimously adopted.

PROJECT NO.GA.1635-FMunicipal Building-Newnan,Ga.

Resolution of the Mayor and Aldermen of the City of Newnanaccepting the Municipal Building and its equipment,

Whereas,R.Kennon PerrY,Architect,has notified inwriting the City of Newnan that the Municipal Building erec­ted a project Docket Ga.No.-1635-F has been inspected andthat all work has been done in accordance with plans andspecifications therefor and that the contract with the New­man Oonstruction Company has been completed to his satisfac­tion, and,

Whereas, the said Perry has also inspected all equip­ment and finds that the same hes been delivered and installedcomplete in accordance with be specifications for the sameand to his satisfaction.

Now,therefore, be ~t res loved by the Mayor and Alder­men of the City of Newnan that the said Municipal Bui~ding

and its equipment be and the same is hereby accepted by thesaid City of Newnan.

Be it further resolved that a certified copy of thisResolution be forwarded to the P.W.A. authorities under theCertificate of the City Clerk andseal of said'City.

With no further busines~ motion was made and adoptedto adjourn.

Alderman Fuller moved that the consideration of the applicatio ofA.rr.Powers to erect a filling station on his residence property atthe intersection of Greenvile street and Salbidi avenue, which isnow up for consideration by the Mayor and Aldermen, be postpones un­til a later meeting.This motion was seconed by Alderman Farmer andwhen put to a vote was unanimously adopted.

A bill from Water & Light Commission against Newmam Construction Co.of LaGrange was presented to Council for consideration with 'otterattached asking for a discount on account of other contractors beingbenefitted in the use of the Water & Lights.After some discussion of the above a motion was made by Mr.Fuller andseconded by Mr Parks that the Water & Light Com,be authorized to ac­cept of one half the bill in full settlement of the account.$54.72total.Motion Mr.Hubbard Second by Mr Polk that City donate $25.00 for thepurchase of Flags as requested by Mrs.T.B.Sanders.

Resolution of the Mayor and Aldermen of the City of Newnan ac­cepting the landscape work for the Municipal Building in the Cityof Newnan,

Vfuereas,R.Kennon Perry,Architect, has in writing notified the Cityof Newnan that he has inspected the landscape work for the Munic~

ipal Building which said landscape work was a part of ProjectDocket No.1635-F and that all the work has been done in accordancewith the plans and specifications therefor and completed to hissatisfaction.

Now,therefore be it resolved by the Mayor and Aldermen of the Cityof Newnan that the said .landscape work at said Municipal Building·be and the same is hereby accepted by the City of Newnan.

Beit further resolved that a certified copy of this Resolutionbe forwarded to the P.W.A. authorities under certificate of ~eCity Clerk and seal of the City.

A check for $849.13 from the Central of ~eorgia R.R.was pre­sented to Council in payment of their 1939 City Tax,providedCity would accept it in fUll payment without interest.

Consideration was given to the complaint that Fireman­Loyd Hurston was driving an Automobile in the City ofNewnan while intoxicated.The evidence of the said intox­ication was conclusive and Motion was made that FiremanLoyd Hurston be discharged as a Fireman for the City ofNewnan for conductcunbecoming to an office.This motionwas dUly seconded and when put to a vote was unanimouslyadopted.

Be it further ordained that it shall be the duty of theoccupant of any such building of which such complaint ismade to correct the conditions complained of within a rea­sonable time from the date of the notice from the Police,and it ahall be unlawful for any such occupant to fail tocorrect or refuse to correct the condition complained ofwithin a reasonable time after the said notice.

Be it further ordained that any person violating the termsof thms ordinace shall on conviction be punished as pre­scribed in section 245 of the City Code.

1.For ohe prtection of the investmentin the New Munici­palBuilding, the care and upkeep therof, it is thoughtto be very neccessary that a custodian for the buildingsand grounds be elected and held responsible for the careand upkkep of the buildings and grounds.This Custodianwill take care of these du~ies under the supervisionog the Public Building Committee,a~mll perform such dutiesin the care and upkeep of the buildings and grounds ,theheating, sanitary condition of all parts of the building,the opening and closing building, as are designated tohim by the Public Building Committee.

2.It is thought that the chief of Police can also serve asCustodian of the building and in this dual capacity serveboth the Police Department and the Public BUilding Commit­tee in a satisfactory manner and it is hereby recomendedthat the Chief Police be elected and desi~nated as Custo- ,dian of the Municipal Building.

3. In the performance of these duties the Custodian will attimes need laborers and it is recomended that Mr.Webb andhis force of both pai~ laborers and prisoners be assignedfor this work, under the supervision and control of theCustodian.

4. For the care and upkeep of the parks and the buildings ther­on,it is frequently neccessary,to have laborers and super­vision t"erof.It is very neccessary that thisfa~rt of theCitys,property be cared for and the recreation facilitieshave ou~ cooperation at all times.It is thssefore recomendedthat Mr Webb and his force of paid laborers and prisonersbe assigned for this work under the supervision and controlof the Parks Committee.

The application of the Imperial Oil Company for a permitto build a filling station in the City ofmNewnan on theEast side of Green]Jlle,street at thejunction of Savan­nah street was nexu taken up by the Mayor and Aldermen.Notice of the hearing of the application had been pub-lished as required by law. ,All persons who were present and who appeared for andagainst the granting of the permit were heard from.Al­derman Ware then moved that the Imperial Oil Companybe granted a perm&t to build a filling station on thelot of land facing the East side of Greenville streetand at the Junction of Savannah street with said Green-ville street on conditims that the building to be erect­ed shall conform tofue Fire building regUlations of theCity of Newnan and the storage of gas in tanks or otherwise on the premises shall comply with the regualtionsgoverning the same prescribed by the South Eastern Under­writers Association,and that the Fire Chief be directedto issue such a permit.This motion was seconded by Alderman Polk and when putto a vote the motion was unanimously adopted.

Be it further ordained that the owners of the abutting propertyon the said streets ordered to be improved as aforesaid shallnot have the right to have the improvements done in front ofthe property owned by him on the said streets by himself orby contract at his instance.

~hen the said cost of thesaid work shall have been ascertainedthe City Clerk shall notify by registered mail each abuttingproperty owner,agent in charge or tenant in possession threofand in caSe of abutting public property the authorities incharge of the same of the amount asssessed against each pieceof parcel of property as aforesaid,for~ said improvements ,itshall then be the duty ofeach o~ner,agent in charge or tenantin possession,and in case of public property,the authoritieshaving charge of the same to pay the amount of the assessmentwithin ten days fromfue receipt of said notice;provided,how­ever,should any owner, agent in charge or tenant in possessionthereof fail or refuse to pay the amount of said assessmentwithin ten days after receipt of the notice herein providedfor then it shall be the duty of the City clerk to issue anexecution for tae amount of the assessment against the realestate assessed and against the owners of the real estate soassessed,which said executuion shall be levied by the Marshallof said City on such real estate and after advertisement andother proceedings as in cases of sale of realty for City Taxes,as prescribed in 428 of t he code :of the City of Newnan, thesame may be sold at public outcry,to satisfy the said execu­tion;provided further,that the defendaht shall have the rightto file an affidavit of illegality denying that the whole orany part of amount for which the execution is isssue,is dueand stating what amount headmits to be due,if any,which amountso admitted to be due,shall be paid before the affidavit shallbe recieved,which affidavit when recieved shall be returnedto the Superior Court of Coweta County, and there tried andtheissue determined as in cases of illegality,subject,howeverto all the penalties, provided by law in cases of illegalitiesfiled for delay only.

Be it further ordainedthat the owners of the property abuttingon the stree~s ordered improved as aforesaid shall be givennoticeof said contemplated improvements and the manner ofassessing the cost thereof by publishing this ordinance inthe issue The Newnan Herald to appear July 25th 1940,and thatat the next regular meeting of the Mayor and Aldermen of the

Be it. ordained by the Mayor and Aldermen of the City ofNe.wnan and it~ is hereby' ordained by 'authori t.y of thesame that under the terms of an Act of the GeneralAssembly of Georgia approved August 15" 1910 the roadway or street proper of DUncan Street from TempleAvenue. t.o and inclUding its intersection with WealeyStreet. and Wesley Street from its intersextion withDUncan Street to the. present paving on Wesley Street.be and the said streets herein described are herebyordered improved by having the road way or streetproper as above described paved with double surfaceasphalt treatment.

Motion Mr. Ware second by Mr. Farmer that this be done, thefollowing resolution was unanimously adopted:

Whereas Peter Pirsch & Sons Company, Kenosha, Wis.,is const­ructing for the City of Newnan, Georgia a triple Combinationfive hundred gallon Booster Pump and Hose Car, and,

W~ereas, the Federal War Department has requested the saidCompany to get permission from the City of Newnan to turn thesaid car over to the United States Government in the event thewar Department desires it, and,

Whereas, the Mayor and Aldermen of the City of Newnan desireto cooperate fully with the War Department,

NOW, therefore, be it resolved by the Mayor and Aldermen of theCity of Newnan that C.J.Smith, Mayor of said City be and ishereby authorized and directed to inform the Peter Pirsch & sonsCompany that permission is granted to the said Company to turnthe saidfire apparatus over to the Uni tedc.States Government inthe event the War Department desires it.

Alderman Farmer; ,moved that superintendent Gilbert will representand look after the City of Newnan on all local Federal WPA pro­jects. That in the interest of economy Superintendent Gilber~ isinstructed to remove from all local Fedetal WPA projects in theCity of Newnan all City employees excepy Muller Copeland, con­crete mixer, provided that when the services of Muller Copelandis not needed on WPA projects Superintendent Gilbert shall assignthe said Copeland to other work in the City. SuperintendentGilbert is also directed to deliver to Mr. Patterson, his suc­cessor or successors, in charge of the WPA projects in the Cityof Nevman, one City of Newnan truck and such other equipment asis requested by the said Mr. Patterson, his successor or suc­cessors, for use on local WPA projects, which said truck is tobe operated by some WPA employee. Superintendent Gilbert is alsodirected on request of the said patterson, his successor or suc­cessors, to make available for temporpry use on local WPA projectsan additional City of Newnan truck when it shall be called for bythe WPA Agents for such use.The foregoing is to remain ifi force until revoked by the Mayorand Aldermen.

STATE OF GEORGIACOUNTY OF COWETACITY OF NEWNAN:

WHEREAS, THE SOUTHEASTERN PIPE LINE COMPANY HAS under­taken to construct a gasoline pipe,line from Port st. Joe"Fla., to Chattanooga, Tenn.,. through the State of Georgia forthe purpose of transporting gasoline into the States of Georgiaand Tennessee; and

WHEREAS. many people in the State of Georgia are en­gaged in transporting petroleum products and derive a liveli­hood therefrom, and the state as well as the counties andcities through Which the railroads operate derive large amountsof tax money from these railroads, a large part of which isused for the support of schools; and

WHEREAS. the construction of the pipe line will be ofno benefit to the general public, being according to theInterstate Commerfe Commission merely a plant facility forthe oil corporations" and would employ very few people; buton the other hand would cause the loss of many jobs by rail­road employes, and a reduction in the tax income of the State,Counties, and Cities; and

WHEREAS" this pipe line would cause additional hazardunder railroads and highways of the State,.

THEREFORE, BE IT RESOL~ED that the Mayor and Aldermenof the City of Newnan respectfully request the HonorableGovernor and General Assembly of the Stat of Georgia to re­fuse permission for such a pipe line in the state of Georgia.

BE IT FURTHER RESOLVED,. that a copy of this resolutionbe furnished to the Governor of this State and a copy to thePresident of the Senate and Speaker of the House •.

Be it further ordained that from and after the passage of thisordinance it shall be unlawful for any perso~~ firm or corporationto repair or rebuild any surface privy in said City. When asurface privy in said city shall be in need of repalr or re­building, it shall then be the duty of the owner or occupantof the premises on Which such surface pri~y is located to buildthereon a pit privy, if his-lot is not accessible to sewerage,but if any such lot is accessible to pUblic sewerage then toinstall a-sanitary water closet.

Be it further ordained that nothing herein contained shall beconstrued to relieve the owner or occupant of any residence,place of business or other building or other place where personsreside, are employed or congregate Which is provided with a pitprivy, as required by this ordinance" from the necess i ty of install­ing a sanitary water closet when pUblic sewerage is available tothepremises.

Be it further ordained that any surface or pit privy in the saidCity shall be kept in a clean condition at all times and thesanitry condition shall be judged by Sanitary Inspector represent­tive of the said City whose decision shall be final.

Be it further ordained that it shall be unlawful for any person,firm or corporation in said City to violate any of the terms of thisordinance and that any person,. firm or corporation violating anyof the terms of this ordinance shall on conviction be punished aspresctibed in Section 245 of the City Code.

The waterials to beused for said improvements shall be: curbs, concrete;gutters, concrete; catch basins, brick with cast ironcastings, with necessary drainage to service ~he saidStreet. The paving for the said side. walks shall becement four inches thick laid on a clay foundation. Thesaid paving on the side walks shall be five feet in width.The cost of the said improvements on said Jackson Streetside walk is hereby levied and assessed as hereinafterprovided.

Be it further ordained that the total cost of the pavingthe said side walks on the East and West side of " the saidJackson Street be and the said cost is hereby assessedagainst the real estate abutting on the said side walksand against the owners of real estate abutting on the saidside walkS according to frontage and the width of the pave­ment on the said side walks paved. The purpose of thisordinance being that no property nor the owner o~ anyproperty shall be required to pay for any paving except thecost of said improvement abutting his property.

Be it further ordained, that the work of making the saidimprovements shall be done by the City of Newnan, underthe supervision Cf the Street Committee of said City, andthe owners of the property abutting on the said side walksordered paved as aforesaid shall not have the right to havethe pavement laid on the said side walk abutting his pro­perty by himself or by contract at his instance.

Be it further ordained that when the cost of said improve­ments has been ascertained, the City Clerk shall notifyby registered mail, each abutting property owner, oragent in charse, or tenant in possession thereof, theamount assessed against the real estate, and assessed

given through the pUblication of an ordinance of said Cityadopted by the Mayor and Aldermen on the 21st day of October1940 of the intent and purpose of the Mayor and Aldermen ofsaid City to improve the South side of the said walk ofBuchanan-Street fro@ LaGrange Street to-First Avenue bypaving the same and the manner of assessing-the cost of saidimprovements-against the abutting property, and carrying­notice of the manner of assessing the cost of said umprove­ment and when the said assessed cost shall be paid, andordaining that all owners of property on said street orderedimproved, should have the right to be and appear at themeeting of the Mayor and Aldermen of said City to be held-on the 4th day of November, 1940, at the Council Chamberat seven thirty o'clock in person or by attorney and be

- heard on any question relating to said improvements andthe manner of assessing the cost thereof. And after hear­ing from all citizens who appeared at this said meetingof the Mayor and Aldermen held on the 4th day of November,1940, and after further considering the improvement of saidside walk ~f said street as prescribed in said ordinanceadopted October 21, 1940, it is ordained that under theterms of an Act of the General Assembly of Georgia approvedAugust 15,- 1910, and of the s aid ordinance of October 21,1940, that- the South side of the said walk on BuchananStreet from LaGrange Street to First Avenue be improvedbetween the points above named by paving the said Southside of the side walk on Buchanan Street.

Be it further ordained that the cost of-said improvementbe and the- same is hereby assessed against the abuttingproperty in the manner as prescribed in said Act of theGeneral Assembly of Georgia approved August 15,' 1910, andas provided in the ordinance of October 21, 1940 Which said

. assessment cost shall be paid as prescribed in said ordinanceof October 21, 1940.

Be it further ordained that all ordinances or parts ofordinances in conflict with this ordinance be and the sameare hereby repealed.

Aldermen present, C.W. Farmer, F.W. Strip1ing, G.C. polk, T.G.Ware, H.S. Johnson, R.B. Hubbard Jr., R.P. Parks, and J.B. Fuller.

City Attorney Freeman absent due to sickness.

Minutes of regualr meeting of December 2, were read and onmotion were adopted.

Motion Mr. Hubbard second by Mr. Johnson the followingoddinance was adopted.

Whereas, the raturn of the managers of the election held in theCity of Newnan on the 7th. day of December, 1940, for-theelection of Aldermen and the menbers of the Board of Educationof said City shows that C.W. Farmer, G.C. polk, R.P. Parks andA.P. Mann, candidates for aldermen each received 27 votes andthere were no opposition candidates, and Walter D. Sandersand W.B. Davis candidates for members of the Board of Educationeach received 27 votes and theee were no opposition candidates.

Be it resolved by the Mayor and Aldermen of the City ofNewnan that C.W. Farmer, G.C. Polk, R.P. Parks, and A.P. Mannbe and are hereby declared elected as aldermen of the City ofNewnan for the term of next ensutn, and that Walter D. Sandersand W.B. Davis be and they are hereby declared elected members ofthe Board of Education for the term next ensuing.,---
