The subject property is a well-established industrial site containing six industrial buildings, associated parking and outdoor storage.

DISCUSSION

Official Community Plan

Fraser Highway and Industrial (zoned 12) beyond; Pinegrove Street and industrial (zoned 12) beyond; and Agriculture (zoned A 1 ).

1. The Official Community Plan (OCP) designates the subject property as "Industrial­Business" which is intended for industrial land uses, including the manufacture, processing, transportation, distribution, wholesale, warehousing and storage of material and equipment along with related activities. The existing microbrewery is consistent with the Industrial-Business designation.

Zoning

2. Under the Abbotsford Zoning Bylaw, 2014 the subject property is zoned General Industrial Zone (12) which permits Microbreweries and Restaurants with restrictions. A microbrewery is limited to the production of 15,000 barrels per year and can have accessory sampling, retail display and retail sales that do not exceed 33% of the gross floor area. Restaurants in the 12 zone are limited to 175m2

( 1,884 ft2). The

applicant is proposing a 95m2 (1,022 ft2) lounge which will sell and serve brewery products as well as food and non-alcoholic beverages which is considered a restaurant use under the Abbotsford Zoning Bylaw. The existing microbrewery and the proposed lounge are consistent with the 12 Zone, in that the retail area and lounge equate to 25% of the gross floor area of Old Abbey Ales, and therefore is in compliance with the Zoning Bylaw.

Business Licencing

3. The proposed brewery lounge hours of operation is from 2:00pm to 7:00pm Monday and Tuesday, from 12:00pm to 8:00pm Wednesday to Saturday and from 12:00pm to 6:00pm on Sundays. These proposed hours are consistent with the Business Licence Bylaw, 2006.

Staff recommends that Old Abbey Ales become members of the City's Bar Watch Program once the proposed brewery lounge is established. On April 14, 2014, Council adopted an amendment to the Business Licence Bylaw, 2006. Part of the amendment increased the Business Licence fee for a Liquor primary establishment which is not operating to the Bar Watch standard from $563 to $7,000. These fees would be applicable to Old Abbey Ales once they apply for the necessary licence for the proposed brewery lounge.

4. In British Columbia, a brewery must obtain a manufacturer's licence from the LCLB. Under a manufacturer's licence the operator may have an area for public sampling of their product and retail space for the sale of their product. The owner can also obtain 'endorsements' for a lounge, special event area, tour area and picnic areas.

A lounge is an indoor or outdoor area where customers can purchase and consume product that the brewery manufactures. Special event areas are indoor or outdoor areas where the public can purchase and consume liquor during special events such as weddings. Both the lounge and special event area endorsements require local government approval.

Old Abbey Ales is proposing a 95m2 (1,019 ft2) brewery lounge which requires a

Council Resolution of support in order for them to proceed.

5. The Liquor Control and Licencing Branch (LCLB) require that the City comment on the following issues:

1) The location of the establishment. Old Abbey Ales is located on the north side of Fraser Highway close to the Mt. Lehman and Highway 1 interchange. The establishment is located in a well-established industrial site. To the north and west of the subject site are agriculturally zoned properties. To the north east across Highway 1 is the High Street shopping centre. To the south are well­established industrial uses. It is anticipated that Old Abbey Ales will draw in workers in the surrounding area as well as travellers along Fraser Highway. Minimal impact on the surrounding businesses is anticipated by staff.

2) The proximity of the establishment to other social or recreational facilities and public buildings: The nearest school and park is located over 1,000m away; no other City owned public facilities are in proximity to the subject property. High Street shopping centre is located approximately 500m away and contains several restaurants including Milestones. It is anticipated that Old Abbey Ales will not impact other social or recreational facilities as none exist in the immediate area.

3) The person capacity and hours of liquor service of the establishment: The person capacity is 32 persons as per the Building Code. The proposed hours of operation for Old Abbey Ales is consistent with the permitted hours of operation set out in the Business Licence Bylaw, which limits Liquor service from 9:00am to 1 :OOam seven (7) days a week.

4) The impact of noise on the community in the immediate vicinity of the establishment. Noise from the establishment impacting residents within the area should be limited. The nearest residential neighbourhood is over 500m away. Single family dwellings within the agricultural land are located approximately 300m from the establishment.

5) The impact on the community if the application is approved. The operation of a brewery lounge at this site would provide a service that does not exist within the surrounding industrial lands and surrounding community.

COMMUNICATION PLAN

If supported by Council, the brewery lounge application under reference number 4320-60/LQ15-001 will proceed to an upcoming Council Hearing. The City will notify in writing the owners and occupiers of land within a 100 meter radius of the property. Staff will provide Council with copies of the feedback received.

SUMMARY

Staff are supportive of the proposed brewery lounge, as the proposed change is consistent with the Business Licence Bylaw, 2006, the Abbotsford Zoning Bylaw, 2400-2014 and the policies contained within the OCP.

Dear Christine and To Whom It May Concern;

As per our telephone conversation regarding Old Abbey Ales Brewery Lounge Application and our

intended hours of operation, I am submitting this addendum to our application.

Old Abbey Ales is a new craft brewery located at lA- 30321 Fraser hwy. Abbotsford, BC. We currently

operate a craft brewery with attached tasting room and retail area. We have applied to the province of

BC to add a brewery lounge to our operations. The tasting room allows for customers to come into our

facility and enjoy a hand-crafted beer whilst in the manufacturing facility. Out intedned hours of

operation will be as follows:

Monday-Tuesday: 2:00pm - 7:00pm

Wednesday-Saturday: 12:00pm - 8:00pm

Sunday: 12:00pm - 6:00pm
