Board Secretary LuGina Mendez-Harper asked that the following amendments be made: The pharmacist clinician meeting minutes for August 2015, reflect that Ms. Buesing was in attendance when in fact she was not in attendance; and that in the October 2015 board meeting minutes, under letter “g” of the executive directors report that no entry was made, the entry should read “the board authorizes Ben Kesner to send a letter to the Governor’s office”. Ms. Wilhite has made these amendments to the August 2015 and October 2015 minutes for approval. b) ACPE Invitation for on-site evaluation State Board observer – Cathleen Wingert: Ms. Wingert attended upon invitation from ACPE to observe the UNM on-site evaluation which consisted of a 22 month self-study. She stated that she was impressed with the honest and straightforwardness of the evaluation which consisted of 30 standards. Chairman Mazzoni wanted the board to recognize that Ms. Wingert attended the NMPhA meeting in its entirety.

c) The Inter-Governmental Working Meeting on Pharmacy Compounding and Drug Supply Chain Security November 16-17, 2015 – Lori Carlisle & Cheranne McCracken: Ms. McCracken & Ms. Lori Carlisle attended the Inter-Governmental meeting in Washington D.C. d) NMBOP Board Officers and Members 1983 to Present: Mr. Kesner presented a list that Inspector, Adela Padilla came upon that is comprised of NMBOP board members from 1983 to present. Mr. Kesner stated that he would like to continue the list for future reference. e) NABP Interactive Compliance Officer Forum – Richard Mazzoni & Shawn Avery: Inspector, Shawn Avery presented the following topics to the board: Compounding issues:

Multi Professional Inspections: Discussion on how different Boards of Pharmacy are organized around the US Some states are under an umbrella with other Boards such as Medical and Nursing. Some states

operate as individual agencies Some states conduct joint inspections with the other boards of hospitals and other locations where

multiple licensees may be. Multistate Pharmacy Inspection Blueprint:

NABP working with states to try and create a guideline for inspectors to use. This would allow the multiple Boards of Pharmacy to be looking for similar items during inspections. This would allow for some peace of mind when allowing for out of state pharmacies to ship into your state

link their licensing, investigations and inspections f) Unlicensed Activity – Contact Lens Distributors – Shawn Avery & Cheranne McCracken: Example Letter Response Received Att-1 Att-2 Att-3: The board was informed via email from the NM Optometry Association of online distributors of contact lenses. Inspectors Avery and McCracken identified the online contact lens distributors and sent out correspondence stating that licensure and prescription is required. The response from the Canadian federal corporation stated that they do not need licensure for the three online companies identified. Upon further discussion the board asked that counsel research the enforcement and applicability of a cease & desist order enforcing the protection, health and safety of the public. Inspector McCracken and board counsel will bring back to the April 2016 board meeting. g) LuGina Mendez-Harper: Ms. Mendez-Harper presented the following topics to the board: Appointment to ACPE Board of Directors - ACPE Board of Directors Meeting January 21-23, 2016 – Little Rock: Ms. Mendez-Harper attended the January 2016 ACPE meeting in Little Rock, MO and in informed the board that she has been appointed to the ACPE Board of Directors. She stated that she was excited about the appointment and can see that there will be a lot of work ahead. Sterile Products Training for Technicians Regulation – 16.19.22 NMAC citation amendment: Ms. Mendez-Harper informed the board that an incorrect citation 16.19.6.11.C is referenced in rule 16.19.22.9 NMAC. She stated that the correct citation of 16.19.36.13.C should be noticed.

Motion: Notice proposed citation amendment as presented in 16.19.22 NMAC at the April 2016 board meeting. Motion made by Mr. Cross, seconded by Mr. Woodul, board voted unanimously to pass the motion. American Society of Pharmacy Law Conference – November 2015: Ms. Mendez-Harper suggested that a board “Mission Statement” be written and referenced on the agenda and read at each board meeting. June 2016 NMBOP Meeting Dates: Ms. Mendez-Harper is requesting that the board meeting dates of 6/23/16 & 6/24/16 be changed to 6/27/16 & 6/28/16. Ms. Wilhite will request the date changes with the B&C calendar coordinator, if they are approved she will contact all board members via email and update the website to reflect the change.

h) APRx Council to lift Independent Advocacy – Danny Cross: Mr. Cross stated that he is now a member of the newly developed group, APRx-backed New Mexico Pharmacy Business Council which was formed to give a strong advocacy voice to the state's independents, working cooperatively with other pharmacy groups that share its goals, which have developed clear goals and objectives and now have the resources to make a big difference for community pharmacies in New Mexico. i) Meeting for AHSP serving on BOP December 7, 2015 – Amy Buesing: Mr. Kesner stated that Ms. Buesing attended the AHSP meeting held in New Orleans, LA. Topics on the agenda were; sterile compounding laws & regulations, licensing of residents, medical marijuana dispensing, PDMP programs and opioid guidelines, USP 800 hazardous drugs, and electronic prescribing.

k) Dale Tinker: Mr. Tinker presented the following topics to the board: 2016 NMPhA Mid-Winter Meeting held January 23-24, 2016: Mr. Tinker stated that a law update was presented at the NMPhA meeting by Director, Ben Kesner and Inspector McCracken. He stated that the NMPhA appreciates the relationship with the NMBOP and is the best of any states. 2016 NM Legislative Update: Tax credits to pharmacists in rural areas due to shortage of pharmacists in the state; memorial to create a committee to evaluate drug pricing; osteopathic rules to include supervisory pharmacists clinicians; addition of dental therapist as a new class of practitioner with limited prescriptive authority.

l) NABP 112th Annual Meeting - May 14-17, 2016 - Hilton San Diego Bayfront Hotel: Mr. Mazzoni stated that he will be in attendance as he is on the executive board for the NABP and Ms. Buesing has expressed her interest in attending as the voting delegate using a travel grant, and Ms. Mendez-Harper will attend as alternate delegate. m) Naloxone Regulation Update and Issues - Michael Landen: Mr. Landen was unable to attend. Mr. Dominic Zurlo from the Department of Health was present to discuss HB 277 introduced by the department regarding an amendment to the Public Health Act and Pharmacy Act that authorizes possession, storage, distribution, prescribing and administration of opioid antagonists (naloxone), providing for immunity from civil and criminal liability. This would enable the DOH to allow prescribers to have standing orders, third party prescriptions, train and distribute to families of opioid use (Rx or illicit) members and access to rural areas. Motion made by Ms. Mendez-Harper, seconded by Ms. Wingert to approve support of HB 277, board voted unanimously to pass the motion. n) New Mexico Osteopathic Opioid Summit – Las Cruces – Lori Carlisle & Amy Buesing: Inspector, Lori Carlisle and board member Amy Buesing were in attendance of the summit. Inspector, Lori Carlisle presented the following topics:

• Pilot project with the Isleta Pueblo • Education on use and storage of medications • How opioid use can turn to heroin use • Educate that opioid overuse and abuse has no boundaries and does not discriminate.

o) 16.19.26 NMAC Pharmacist Prescriptive Authority – Pharmacist’s Letter: Mr. Kesner, Executive Director for the board presented the two versions of proposed language both requesting deletion of the “live” CE requirement for immunizations and naloxone. p) NABP Resolution re the Sale of Drugs from Pharmacy to Wholesaler: Mr. Woodul discussed a proposed language amendment to16.19.8.7.Y NMAC, addition of #6. 16.19.8.7 DEFINITIONS: Y. “Normal distribution channel” means a chain of custody, including intracompany sales, transactions or transfers, for a prescription drug that goes directly or by drop shipment from the manufacturer, its affiliated group as defined in Section 1504 of the Internal Revenue Code, manufacturer’s co-licensed partner or its affiliated group or from any of these entities to their third party logistics provider or exclusive distributor without respect to whether title is transferred to: (1) either a pharmacy or to other designated persons authorized by law to dispense or administer such drug to a patient; or (2) an authorized distributor of record and then to either a pharmacy or to other designated persons authorized by law to dispense or administer such drug to a patient; or (3) an authorized distributor of record to one other authorized distributor of record to an office-based healthcare practitioner or pharmacy or to other designated persons authorized by law to dispense or administer such drug to a patient; or (4) a pharmacy warehouse to the pharmacy warehouse’s intracompany pharmacy to either a patient or other designated persons authorized by law to dispense or administer such drug to a patient; or (5) an authorized distributor of record to a pharmacy warehouse to the pharmacy warehouse’s intracompany pharmacy to either a patient or other designated persons authorized by law to dispense or administer such drug to a patient. (6) Sale of drugs from pharmacies to wholesaler for resale is prohibited. Motion: Notice proposed language as presented in 16.19.8 NMAC at the April board meeting.
