C.S.R. 81(E).-ln exercise of the powers conferred by the proviso to article~()l) of the Constitution and in supcrscssion of the Department of Electronics (SectionOfficer Grade Departmental Competitive Examination) Regulations, 1986, except asrespects things done or omitted to be done before such supcrsession, the President herebymakes the following rules for regulating the Departmental Competitive Examination forpromotion to the post of Section Officer in the Ministry of Information Technology,namelv:-

1. Short title and commencement .- (1) These rules may be called theMinistry of Information Technology, Section Officer DepartmentalCompetitive Examination Rules, 2000.

(2) They shall come into force on the date of their publication in theOfficial Gazette.

2. Definition .- In these rules unless the context otherwise requires, -

(a) " appointing authority" means the Secretary to the Government ofIndia, Ministry of Information Technology;

(b) " approved service" means five years regular and continuous service inthe grades of Assistant, Personal Assistant, Security Supervisor andStore Assistant in the pay scale of Rs. 5500 - 175 - 9000 and PrivateSecretary with not less than 2 years regular and continuous service inthe pay scale of Rs. 6500 - 200 - 10500 on the crucial date;

(c) "available vacancy" means a vacancy in the post of Section Officer'sGrade in the Ministry of Information Technology which is required tobe filled up on the basis of the results of the examination;

(d) "crucial date" means the 1st day of January preceding the date ofnotification conveying the decision to hold the examination; .

~t;)'exammatlon" means the limited Departmental CompetitiveExamination for promotion to the post of Section Officer held in themanner specified in the Schedule;

(f) "recruitment year" means the period commencing from the I" day ofJanuary and ending on the 31st day of December of the same year;

(g) "Schedule" means the Schedule annexed to these rules;

(h) "Scheduled Castes" and "Scheduled Tribes" shall have the samemeanings respectively assigned to them in clauses (24) and (25) ofarticle 366 of the Constitution of India.

3. Conditions of eligibility .- A person appointed on regular basis asAssistant, Personal Assistant, Security Supervisor and Store Assistant in thepay scale of Rs. 5500 - 175 - 9000 and having 5 years regular and continuousservice and Private Secretary with not less than 2 years regular and continuousservice in the pay scale of Rs. 6500 - 200 - 10500 on the crucial date shall beeligible to appear in the examination:

Provided that in the case of a candidate who had been appointed asAssistant, or Personal Assistant on the results of a competitiveexamination including a Departmental Competitive Examination, suchan examination should have been held not less than five years beforethe crucial date and he should have rendered not less than fout yearsapproved and continued service in that grade, on the crucial date.

4. Holding of the examination .- (11The appointing authori~v shall noli fy.!.b..edates and place of the examination and number of availahle andanticipated vacancies assessed at the tIme of announclI1g theexamination, The examinatIon shall be conducted after the expiry ofThIrty days from the date of notification in the manner specified in theSchedule which may be held before the 31st March of the recruitmentyear.

(2) The number of vacancies reserved for the Scheduled Castes, theScheduled Tribes, Other Backward Classes and other specialcategories of persons shall be clearly indicated in the notification.

5. Results .- (1) On the basis of the aggregate marks secured by thecandidate in the examination, a merit list containing the names of thesuccessful candidates in order of merit shall be notified, keeping in viewthe number of vacancies and anticipated vacancies, if any, falling in therecruitment year.

. '(2) The candidates, for appointment against-the availablevacancies shall be considered in the order in which their names appearin the merit list prepared under sub-rule (1).

(3). The merit list shall remain in operation till the notified_vacancies are filled lip or npto a period of 18 months from the date of

its approval by the appointing authority or till the ne}{t merit list isapproved by the appointing authority, whichever is earlier._

Appointment .- The inclusion of the name of any candidate in themerit list shall not confer a righ; to appointment and he shall beappointed by the appointing authority only after satisfying itself thatno vigilance or disciplinary case is either pending or contemplateclagainst the candidate and after taking into account his placement in therrierit list, the reservation of posts or such other requirements as maybe laid down by statutory orders or rules issued by the CentralGovernment, from time to time, in this regard.

7. Removal of name from merit list on resignation, etc. -

(1) In case a candidate after appearing at the examination resignsfrom the service or whose services are terminated or who is appointed to anex-cadre post or to any other service and does not have a lien on any of theposts mentioned in rule 3, his name shall not be included in the merit list, or ifincluded in the said merit list shall be struck off therefrom.

(2) Where a candidate, whose name is included in the said merit list,is appointed to an ex-cadre post or is transferred to another Department of theCentral Government with the permission of the appointing authority andcontinue to have a lien on any of the posts mentioned in rule 3, shall not beappointed as Section Officer till he resumes the duties in the Ministry ofInformation Technology on his initial post during the period the merit listremains in force :

Provided that his claim fot proforma promotion maybe considered bythe appointing authority in accordance with the orders and rules of theCentral Government, issued' in this behalf from time to time.

8. Penalty for impersonation or other tnisconduct .- A candidate, who isor has been declared by the appointing authority to be guilty of-

obtaining support for his candidature by any means; orimpersonation; orprocuring impersonation by any person; orsubmitting fabricated documents or documents which have beentampered with; ormaking statements which are incorrect or false or suppressing materialinformation; orresorting to any other irregular or improper means in connection withhis candidature for the examination; orusing unfair means in the examination hall; ormisbehaving in the examination hall; orattempting to commit or, as the case may be, abetting the commissionof all or any of the acts specified in clauses (i) to (ix);

may, in addition to the criminal proceedings, liable-

(a) to be disqualified by the appointing authority from the examination; or(b) to disciplinary action, under the appropriate rules.

9. Power to relax .- Where the appointing authority is of the opinion thatit is necessary or expedient to do so, it may, by order and for reasonsto be recorded in writing, relax any of the provisions of these ruleswith respect to any class or category of persons.

2. Subjectwise syllabus for the examination shall be as follows, namely :-

(i) Noting, Drafting and Precis Writing .- In addition to questionsrequiring candidates to prepare notes and drafts on specific problems,a passage may also be set for making out a precis or Summary.

(ii) Procedure and Practice in the Government of India Secretariat andattached offices.- This is intended to be an intensive and detailed testin methods and procedure of work in the Government of IndiaSecretariat and attached offices. The subject wil! cover (1) Manual ofOffice Procedure (2) Notes on Office Procedure issued by the Instituteof Secretariat Training and Management (3) Hand book of ordersregarding use of Hindi for Official purposes of the Union issued by theMinistry of Personnel and Training, Administrative Reforms andPublic Grievances and Pension and (4) Practices and Procedures inMinistry of Information Technology and its attached and subordinateoffices.

3. The candidate arc allowed to answer paper (ii) or paper (iii) or paper (v)or all of the said papers either in Hindi (Dcvanagari) or in Fngli~h. Paper(i ] and paper (iv) must he answered in English by all the candidates.

Note I _. The option for paper (ii) or paper (iii) or paper (v) or all of the saidpaper shall be for a complete paper and not for different questions in the samepaper.

Note 2 -- Candidates desirous of exercising the option to answer the aforesaidpapers in Hindi (Devnagari) shall indicate their intention to do so in theapplication form. otherwise it shall he presumed that they would answer allthe papers in English .

4. Credit shall be given for neat and methodical expression of ideas with dueeconomy of words, in the written answers. :'.

5. It will be open to Secretary, Ministry' of Information Technology,Government of India to prescribe minimum qualifying marks in Part I andin each of the 5 subjects therein and disqualify the candidature of thosewho secure less than qualifying marks which will not be more than 50 percent. He may direct the Departmental Promotion Committee to fixminimum qualifying marks in Part 11 of the examination also in whichqualifying marks will not be more than 40 per cent.
