1. Call to Order

Chairman Corey Ward called the meeting to order at 8:20 am on February 21, 2017.

4. Adoption of Agenda. The agenda posted on the committee website was approved as amended herein. 5. Approval of November 15, 2016 minutes.

The November 15, 2016 minutes posted on the committee website were approved with a correction to the future meeting date (should be February 21, 2017).

6. Personnel.

Members are requested to advise Kevin Brinkman of any corrections that should be made to the roster.

7. Review of Recent OSHA Activities

The committee discussed recent OSHA activities.

8. Review of Recent Serious and Fatal Accidents

The committee discussed recent serious and fatal accidents.

9. Review of Action Items from Last Meeting (Attachment #1)

The committee reviewed the Action Items from the previous meeting (see attachment). Action Items from this meeting are included below.

10. Confined Spaces

(a) NEII® Position Paper on Confined Spaces

Background: The committee previously approved changes to the position paper based on the new OSHA Confined Space in Construction regulations (see website for latest version). This item remains on the agenda to determine if additional changes are needed based on current OSHA activities related to confined space. The committee also discussed other ideas, including an Amicus Brief for industry. Member companies agreed to do some independent testing to confirm that most pits do not have any air quality issues and report their findings.

Discussion: The companies decided not to do Amicus brief at this time. The committee discussed the independent testing of pits for air quality (see Attachment #2). They agreed to a new deadline of June 1. Data will be sent to Kevin Brinkman. He will aggregate and blind the results to remove addresses and any company identifiers. This item will remain on the agenda to determine if additional changes are needed based on current OSHA activities related to confined space.

(b) WA Position on Confined Spaces

Background: At a previous meeting, the committee discussed the WA stance on confined spaces and decided not to take any action pending current OSHA activities related to confined spaces. This item remains on the agenda for further discussion as needed. Discussion: Based on recent changes within the WA Elevator Division the committee agreed no further action is needed as this time. This item will be removed from future agendas.

11. MRL Safety Statistics

Background: The committee agreed to update MRL related safety data to include data through 2016. The committee agreed to complete the update by January 31, 2017. The committee also received a request to determine if we can provide data to compare safety data between MRL and MR elevators. Discussion: The committee discussed the NEII Annual Accident Statistics. Kevin Brinkman reported that not all companies had submitted their data yet. He will resend the form and companies were reminded that the data is due by March 1. The committee also discussed the detailed review of accidents to determine whether any accidents were related to work on MRL machines, governors or controls within the hoistway. Companies previously reviewed data from 2012 through third quarter of 2015. This request is for the fourth quarter of 2015 and all of 2016. Kevin will resend the form used previously and committee members agreed to provide the data by April 1.

12. Review and Update Committee Policies and Position Papers

The following committee position papers are scheduled for review in 2017 (available for

review on committee webpage).

(a) Guidelines for Emergency Preparedness Plan (b) Asbestos Safety (c) OSHA Powered Industrial Truck Operator Regulations

Discussion: Position papers are used to provide more detail than the Handbook, to clarify the NEII position if regulations are not clear, to help to instruct field employees, and to support industry positions when staff is speaking to legislators or reporters. NEII procedures require position papers to be reviewed every three years. Appropriate actions include reaffirming, updating or rescinding a position paper. The committee agreed to review the papers listed above (available on committee webpage) prior to the next meeting and to send any proposed changes or other actions to Kevin Brinkman by June 1. This will remain on the agenda for discussion at the next meeting.

13. Elevator World Safety Videos and Handbook – Ricia Hendrick.

(a) Sales Report (Attachment #3) – Ricia reported that over 20,000 copies of the

latest Hand book have been sold. They have less than 1000 in inventory so they are working on printing additional copies.

(b) Status of Service/Construction Safety Video Update – no update.

(c) Field Employees’ Safety Handbook – The latest printing includes three minor

changes we made since the initial publication of the 2015 edition. Updates will not be sent out for books previously sold.

(d) Electronic field app – Ricia reported that six companies are currently using the

app as part of their safety program.

14. NEII® NOW Safety Corner Articles.

The committee identified the following members to draft articles for the future editions of NEII® Now:

• Issue 1 – Leading Safety Indicators (near misses) – Stephen Berney • Issue 2 – Elevator Industry Field Employee Safety Handbook – Ray Downs • Issue 3 – Safety Behavior – Ray Downs • Issue 4 - Ten Rules of Safety – Results of Safety Summit - TBD

Karen reported that the format for NEII Now is changing to an HTML format and it will

be published six times per year. It will include links to longer articles which will be accessible on the website. The committee agreed that it is important to try to include a safety article in each issue.

15. NEIEP Activities.

Tim Daly reported that the NEIEP program is changing to a computer format for students. The computers will link to the website for access to classroom work and homework. Students are provided with a link the can access from their computer or phone to show what training each person has had (picture and Q-code). The committee asked whether there is a way to add similar training profile for training provided at companies.

16. NEII® Safety Committee Document Library.

Committee members are encouraged to send Kevin Brinkman documents they wish to share for posting in the library as Ed Donoghue is maintaining the NEII® website. To access the NEII® Safety Committee document library click on the following link: http://www.neii.org/members/committees/22/

17. Old Business.

(a) Safety Absolutes – Ray Downs (Attachment #4)

Background: The committee agreed to develop a Top Ten List of Fundamental Safety Parameters for possible inclusion in the Elevator Industry Field Employees’ Safety Handbook. Members were asked to send their fundamental rules to Kevin to compile into a single top ten list with a few bullet points under each heading. Discussion: The committee reviewed the draft list of top ten safety parameters and bullet points. They agreed to rename the list Safety Absolutes and reduce the number of rules to nine. They also reviewed and updated the bullet points for the remaining rules. Kevin Brinkman will send the updated list to committee members for review and comment by April 1.

(b) NAESA Safety Summit (Attachment #5) and (Attachment #6)

Background: An Elevator Industry Safety Summit hosted by NAESAi is scheduled for May 21-23, 2017 in Phoenix (see attached). The Summit will focus on major

accident/fatality prevention and worker and rider safety, with a goal of trying to develop a guide or standard on safety. NAESAi would like to develop a minimum safety standard (not just a guide like the Handbook).

Bob Shepherd, Executive Director of NAESAi is looking for speakers/participants for presentations and roundtables. A meeting is scheduled for February 20 for discussions between members of this committee and Bob Shepherd and Jack Day of NAESAi to discuss the Summit. Discussion: Corey provided an update on the meeting held Monday afternoon with Bob Shepherd and Jack Day of NAESAi. The committee had a detailed discussion regarding the Safety Summit. The committee drafted a preliminary agenda based on the Monday meeting and the discussion. Topics included an outside speaker on Fatality Prevention/Worker Behavior and breakout sessions on Monday afternoon to cover some of the Safety Absolute topics we are developing. Karen, Corey and Kevin will further refine the draft and then work with Jack Day to help finalize. Once the agenda is finalized, a committee teleconference will be scheduled to discuss assignments.

(c) Overhead Protection (Attachment #7) – Fred Wilt

Background: The committee discussed development of a common practice for overhead protection and screening. Members were asked to submit data (using attached template) to Kevin to be compiled and blinded. Discussion: The committee discussed overhead protection and agreed to a new deadline to provide data. Kevin Brinkman will resend the form and members agreed to submit their completed forms to Kevin by April 1

(d) NIOSH Request for Data – Corey Ward

Background: The IUEC asked NIOSH to request accident data for the last 5 years from member companies. Members provided their 20111-2015 OSHA 300 logs with all names removed to Kevin to compile and blind.

Discussion: The committee discussed the aggregated data based on OSHA 300 logs. They agreed to have Kevin Brinkman do a final review to ensure that all company names have been removed and then send out to the members who provided data for a final review prior to sending to NIOSH. The committee agreed to a one week review period.

(e) OSHA Electronic Recordkeeping Rule

At the previous meeting, Kevin Dix provided an update on OSHA Electronic Recordkeeping rules. OSHA is asking that a Form 300A be submitted electronically by each establishment (all branches with 20 or more people) to OSHA. Discussion: The committee discussed and decided that everyone is now aware of this issue. This item will be removed from future agendas.

(f) Training or education for architects

At the last meeting, Karen Penafiel asked members to provide any ideas they have for sharing information with architects, building owners, etc., so that we can start doing more to promote our organization. Discussion: No report.

(g) JHA Form

At the last meeting, the committee discussed creating a three column JHA form for the website. Companies were asked to send samples. Discussion: Bob Rodriguez will send a sample to me for review at next meeting since all company forms or basically the same.

18. New Business.

(a) OSHA Industry Meeting (Attachment #8)

Kevin Brinkman, Karen Penafiel and Larry Leadingham gave the committee an update on the meeting held on January 26. The meeting was to have some initial discussion only on how OSHA, manufacturers, labor and other interested parties could work together to enhance worker safety. Those present agreed to continue meeting. OSHA will schedule the next meeting in approximately three months. The committee agreed that we should continue to participate at this point.

(b) OSHA Data Request

As part of the OSHA Industry Meeting, OSHA asked in NEII would be willing to share our accident data and other safety information with the group. They committee discussed this request and agreed that we should only share the Handbook and position papers, but not individual company information at this time. They also agreed to hold on safety data until we have more time to review and discuss internally. They already have the NIOSH data because companies send in the OSHA 300 logs. The committee discussed evaluating the NIOSH data based on the ten most common injuries. Kevin Dix agreed to send ten categories to subdivide. The committee will review at next meeting.

(c) Addition of IUEC member on Committee

The committee briefly discussed whether we should consider adding an IUEC member (possibly Mike Langer) to the committee or possibly inviting someone to a meeting and then make a decision. Members agreed to discuss within their companies and provide feedback to Kevin Brinkman within two weeks.

(d) Managers and Sales Staff Safety Training

The committee discussed best practices for safety training of managers and sales staff who may visit job sites.

19. Future Meetings.

Note: Hazards should be identified in advance to determine the appropriate methods and equipment to be used in various emergency retrieval or rescue scenarios.

Controlling Contractor. Both the General Industry and new Construction standards require thatemployers provide certain identification, assessment and information-exchange / coordination,including pre-entry information, to anyone physically entering a permit space. The Construction standard final rule requires that the Controlling Contractor (often called the GC) lead this informationexchange, adding a layer to prevent untrained or unqualified persons from entering the space. Inaddition to coordinating multiple entities when appropriate, the Controlling Contractor, uponcompletion of confined space work, will debrief entry personnel and apprise the Host Employer of anyfindings.

Competent Person. With regard to multi-employer worksites, the new Construction standardrequires each employer to ensure that a competent person identify all confined spaces in which itsemployees may work via a two-step evaluation, necessitating a certain degree of expertise.Those two steps:a) determine if a space meets the definition of confined space, andb) if so, the competent person must identify through testing any confined spaces that are PRCSs.A competent person must be capable of and have authority to identify permit space hazards, so as toprevent both unauthorized entry and to ensure adequate protection for authorized entrants.The General Industry standard requires the employer to bear this responsibility.

Safety Absolutes Car Top Access

• Maintain control of the car at all times.• Send the car down, open the door (Door-Lock), verify car is present, and install the door stopper.• Verify door safety, stop switches and inspection switch independently.• Ensure stop switches are activated when exiting car top.• Secure working area

Pit Access • Maintain control of the car at all times • Send the car up, open the door (Door-Lock) and install door stopper.• Activate and verify pit stop switch and use ladder safely. Turn on pit light.• Deactivate stop switch after exiting. • Secure working area

Mechanical Stored Energy • Bring equipment to a zero energy state (i.e hydraulic, gravitational, pneumatic, etc).• Avoid pinch points of materials and tools.• Avoid loose clothing and be careful when wearing gloves near moving machinery.• Ensure all loads are stable and secure.• Do not put yourself in the line of fire (leaning over to adjacent shaft etc.)

Fall Protection • Always wear proper fall protection PPE. • Always tie off when a fall hazard exists.• Inspect your fall protection system before each use.• Always be aware of your surroundings (potential fall hazards)• Ensure proper guardrails are used.

False Cars & Running Platforms • Perform daily inspection of equipment prior to use.• Operate with a minimum two means of safety.• Always assemble/disassemble false cars/running platforms at the lowest landing.• Do not overload false cars or running platforms.• Install protective barrier between cars if performing work while a car is operating at contract speed in an adjacent hoist way.

Hoisting and Rigging • Ensure hoisting and rigging plan is in place• Know the weight of the load and ensure equipment is rated for the load.• Do not stand or walk under load being hoisted.• Use certified equipment and inspect before each use.• Ensure load will clear all obstructions.

Jumpers • Jumpers may not be installed on the safety circuit when the elevator is on automatic operation.• Only use company approved jumpers and inspect jumpers for damage prior to use.• Make sure all jumpers are accounted for.at all times.• Always notify co-workers when jumpers are being used; use a jumper tag to identify.• Understand what effect using or removing a jumper will have on the entire system.

Electrical Safe Work Practices

• Lock out and tag out if power is not required (never open main line disconnect). • Test meter on known source before use. • Probe with one hand to verify circuits. • Use certified tools, inspect before each use, and prevent incidental contact with live electrical circuits. • Always protect high voltage exposed live circuits.

LOTO • Ensure there are no passengers in the cab and all doors are closed and secured. • Lock out and tag out if power is not required (never open main line disconnect). • Follow company Lock Out/Tag Out procedures. • Verify that the correct system has been de-energized. • Follow Electrical Safe Work Practices.
