10. All requests for interpretation, clarification & queries in connection with tender shall be
addressed in writing to issuing Authority e.g. C.M.O. NFL HOSPITAL at least 7 (Seven)
days prior to the closing date of the tender.
11. The Tender shall be submitted duly super scribed “House Keeping of NFL Hospital by
deploying unskilled-safaikaramcharies & Mali "
12. The rate should be quoted lump sum monthly charges in Annexure-G. The rates should be
quoted in words and figures. The rates quoted shall remain valid for 120 days from date of
opening of tenders for acceptance.
13. National Fertilizers Limited reserves the right to issue/ non-issue or reject tender document
of any party. However, where enquiries are made by the bidder, reasons for rejecting a tender
or non-issuing a tender document will be disclosed to the prospective bidder.‟
14. Tender shall be submitted in THREE SEPARATE SEALED Envelops as under :
Envelope No.1
Will be superscribed “EMD” (Earnest Money Deposit) and shall contain earnest money
deposit of Rs.25,000/- and 500/- as Tender Fees in the form of a crossed demand draft
(separate for both amount) issued by any scheduled bank except rural and cooperative bank
in favour of National Fertilizers Limited, Naya Nangal payable at Naya Nangal. In case of
Tender Documents download from NFL website.

Envelope No.2
Will be superscribed “TC” (Terms and Conditions) and shall contain terms and conditions set
for the tender by tenderer for his offer (in duplicate) and which are at variance from the terms
and conditions of the tender documents issued by NFL and the documents as per Para 16,
18alongwith Annexure F.

Will be superscribed “PB” (Price Bid) and shall contain the rates and amount quoted in the
prescribed schedule of rates.
All the three sealed envelopes shall be submitted in a separate sealed envelope superscribed

15. Opening of Tenders
Envelope No.1
Marked “EMD” containing Earnest Money Deposit will be opened first, on the schedule date
of opening of tender in presence of those tenders who wish to be present at the time of
Tender Opening.
Envelope No.2
Marked “TC” will then be opened and discussion will be carried on with the respective
tenderer for clarification, if any.
Envelope No.3
Marked “PB” will be opened subsequently on the same day or at a later date, which will be
intimated to tenderer.
The following documents are to be submitted with the quotation in the envelope no.2, failing
which the tender will be liable for rejection.
16. 1.a) Declaration Forms I & II
b) An Affidavit on Non-Judicial Stamp paper of min. Rs.10/- duly attested by Notary,
stating :-
i) That party/their associates/sister concerns etc. has not been black listed or put on
holiday by any institutional agency/Govt. Dept. /Public Sector Undertaking in the
last two years for participating in the tender.
ii) No other firm/sister concerns/associates belonging to the same group is
participating/submitting tender for the job.
c) Other details are as under :
PAN (Permanent Account No.) issued by Income Tax Dept.
Service Tax No.Code No./Accounting Code if applicable.

17. The contractor shall quote single rate against each item and not the multiple rates in the
Schedule of Rates. Any tender with the multiple rates quoted will be summarily rejected.
Price should be quoted strictly as per the Preforma enclosed for Schedule of Price.
18. This letter shall form part of the contract document and shall be signed and returned along
with the tender documents.

19. All pages shall be initialed at the lower right hand corner and signed wherever required in the
tender papers by the tenderers or by a person holding power of attorney authorizing him to
sign on behalf of the tenderer before submission of tender. All corrections and alteration in
the entries of tender paper will be signed in full by the tenderer with date. No eraser or
overwriting is permissible.
20. No condition or deviation should be mentioned by tenderer in Price Bid. Offers where the
party has mentioned any condition or deviation in Price Bid shall be out rightly rejected.
21. While submitting the offer, bidders may ensure that tender document/offer has been signed
by authorized signatory of the company. Subsequent withdrawal of offer/non-acceptance of
orders placed based on the offer submitted by them will not be entertained on the ground that
the offer was not signed by the authorized person.
22. One person will be allowed to represent only one company during discussion/negotiation
with NFL. If same person is represent different companies with authorization letter from
more than one company, such person will be allowed to represent only the first company
called for negotiation.
23. The Tender shall be addressed to C.M.O. NFL HOSPITAL, National Fertilizers Limited,

NOTICE INVITING TENDER
Sub: - Tender for “House Keeping of NFL Hospital by deploying unskilled-safaikaramcharies & Mali"
ELIGIBILITY CRITERIA
A) The party shall be eligible to participate in the bid only, if /he /they meet the following
eligibility criteria and submit the self-certified documentary evidence in support thereof,
without which price bid shall not be opened.
1. The party shall submit the name and address of the firm/company along with its constitution
giving status of the same, such as sole proprietorship/partnership or limited/private firm etc.
and also provide photocopy of documentary evidence duly attested by Notary.
2. The party shall submit documentary evidence with respect to experience of having
successfully completed similar works, during the last seven years ending last day of
previous month in which NIT has been issued at least one of the following..
a) Three similar completed works each costing not less than Rs. 4.96 lakhs
OR
b) Two similar completed works each costing not less than Rs. 6.20 lakhs
OR
c) One similar completed works costing not less than Rs. 9.92 lakhs
As the total job is with regard to deployment of manpower, definition of “similar work”
means Deployment of manpower, includes all those items of work executed by deployment
of manpower on the basis of mandays, man-months etc. It also includes all those labour
oriented items of works executed on job rate basis, where number of manpower to be
deployed has been so specified in the contract.
3. Average Annual financial turnover of the party during the last 3 years ending 3st March
2014 should be at least Rs.3.72 lakhs for which Party shall submit the documentary
evidence of balance sheet and P&L A/C for the year,2011-2012, 2012-13, 2013-14 in
support thereof.
4. Latest Bank Solvency certificate, amounting to Rs.4.09 Lacs issued by any
nationalized/scheduled Bank of India (Bank solvency issued 12 months prior to the date of
issue of NIT shall also be considered valid unless otherwise expired.)

B) The party shall also be required to submit the following documents, in the absence of
which, the price bid shall be opened, however, the documents shall have to be submitted by
the party before the award of work. Otherwise EMD of the party shall be forfeited.
1. Copy of Labour License.
2. If the party is registered as Micro/Small/Medium Enterprises as per MSMED Act,
2006,the same may be confirmed by the party and submit a photocopy (Self certified)
of the registration certificate in support thereof.(Annexure-3)
EVALUATION CRITERIA
The contract shall be awarded on overall L-1 basis. However, in case, it is found that L-1
tenderer has quoted non-workable rates due to which they become L-1, NFL reserves the
right to reject such tender.

ANNEXURE-D
SCOPE OF WORK UNDER THE CONTRACT
1. Details of the SCOPE OF WORK under the said contract are illustrative only and not
exhaustive, which may also include various other jobs related to housekeeping as may be
assigned from time to time.

2. The following jobs are to be carried out daily:
2.1 Sweeping, cleaning, mopping of main Hospital Building including General Ward,
Female Ward, Special wards, Gynae. ward, and Office building with disinfectants etc.
as per directions of Nursing Supdt./Officer- in-charge.
2.2 Cleaning and dusting of all doors and windows, furniture, fittings, fixtures, equipments
and accessories, glazed panes and doormats, etc., as per directions of Nursing
Supdt./Officer- in-charge.
2.3 Sample collection of Urine from Bedside patients, Emptying of Urine collecting bags,
surgical drains, all types of body fluid aspirations, other discharges. Measurement of
the quantity of the discharge and discard of the same as per the instructions of the
Nsg.Supdt./ Officer-in-Charge.
2.4 Cleaning and disinfecting of toilets and all vitreous fixtures including toilet bowls,
urinals, sinks, toilet seats, containers, kidney trays, bed pans, dust bins, and buckets etc.
Brush thoroughly to include below water level and under rims including areas at hinges
and cistern handles.
2.5 Cleaning and dusting of electrical switchboards, light fixtures, overhead light fixtures,
fans etc.
2.6 Upkeep and cleaning of drains/ sewer.
2.7 Segregation and shifting of Bio-Medical waste collected from different sections of
Hospital to Bio-Medical Waste Treatment room situated outside the NFL Hospital
premises and discard/disposal/treatment of the same as per the instructions of the
Nursing Supdt./ Officer-in-Charge.
2.8 Collection, segregation, shifting and disposal of Biomedical Waste, waste, garbage and
rubbish collected by cleaning the area, drains, sewers, etc. and transportation and
disposal thereof from site to nearest Council bin outside NFL premises as per the
directions of Nursing Supdt./Officer-in-charge. In any case, garbage will not be
dumped within the office premises.

3. The following jobs are to be carried out bi-monthly (On alternate Saturdays or on any other
days as directed by the Nsg.Supdt. / Officer-in-charge):
Upkeep of –
Thorough cleaning/washing of Hospital premises, complex, ceiling including glass panes on
top, coffered beams of entire area including open area, removing cob-webs, soot, dust
accumulation with vacuum cleaner, brushes. The above jobs are not exhaustive but
indicative only. The deployed manpower shall be required to undertake additional jobs if
any, as assigned by the Nsg.Supdt./ Officer-in-Charge.
4. Maintenance of lawns and flower beds at NFL Hospital: Cutting and removing wild
growth, bushes &shrubs, maintenance of flower beds, lawn mowing, maintenance of
hedges& parks.
5. Deployment of Manpower:
For execution of above jobs as per scope of work and proper House Keeping of the Hospital
on round the clock basis and to take care of Female/Male/General Ward/Private Ward/Gyne
Ward, Operation Theater extend proper service to the patients and to keep entire Hospital
Building in hygienic condition, the contractor will be required to deploy the staff as under:-
Four Female Unskilled- SafaiKaramcharies and Six Male Unskilled – SafaiKaramcharies,
and one Unskilled-Mali, for deployment in shifts for general House Keeping as mentioned
in the scope of work.
This document shall form part of the Contract and shall be signed and stamped by the
Tenderer on each page and submitted in Envelope No.1.

Annexure-E
SPECIAL TERMS & CONDITIONS
1. QUANTUMOF JOB:
The quantum of job/shifts mentioned in the scope of work is tentative and can beincreased or
decreased at the sole discretion of NFL, depending upon the emergency and volume of job.
2. PERIOD OF CONTRACT:
Initially, the contract will be for a period of one year from the date of issue of Work Order/LOI
and can be extended for another period of three months on the same terms & conditions, at the
sole discretion of N.F.L.
3. MINIMUM WAGES:
A. It shall be ensured by the contractor that minimum wages as notified by Appropriate Govt.
(presently Central Govt. or State Govt.) are made by him to the deployed manpower on or
before 7th of the following month.
B. In case the rates notified by the Central Govt. for any scheduled employment are less than
the rates notified by the State Govt. in that case the Contractor shall be required to make the
payment to the workmen at the rates notified by the State Govt.
4. SECURITY DEPOSIT: -
i) Initial Security Deposit (ISD) @ 2.5% of contract value shall be deposited by the
contractor within 10 days of issue of letter of intent & balance 7.5% shall be deducted
from monthly bills to make total security deposit @ 10% of contract value.
ii) Security Deposit will be released after 3 months of completion of contract period.
iii) Earnest Money shall be adjusted towards initial security deposit.
iv) No interest will be paid on Security Deposit/EMD.
v) Income Tax : Income Tax as applicable shall be deducted at source from the running
bills of the contractor.
vi) Submission of Monthly Bill : The Contractor shall submit his monthly bill within the
first week of the following month to the Executive Department for verification and
recommendations. In case the contractor fails to submit the bill by the last day of the
following month, a penalty of 1% of the billed amount for every month of delay or part
there of subject minimum of Rs.1,000/- shall be recovered from the bill.
vii) NFL Nangal Unit is having its Cash Credit Account with State Bank of India Naya
Nangal who is having Electronic Fund Transfer Facility/RTGS at its branch at Naya
Nangal and some other important branches. The contractor who are maintaining their
bank account, having EFT /RTGS facility may submit the bank particulars i.e. Bank
Account No. Name of place of branch, Branch Code No. etc. so that their payment can
be released through e-transfer of funds to their account.
viii) Escalation/De-escalation in the minimum wages for manpower deployed.
The rates quoted by the tenderer shall remain firm during the currency of the contract
including extended period also, except increase/decrease in the minimum wages of the
labour by The appropriate Govt. (presently Central Govt./State Govt.).

The escalation on account of increase in the minimum wages shall be compensated to
the contractor as per the formula indicated below:-
=Billed Amount x65/100x (Escalated minimum wages-Present minimum wages)
Present minimum wages
The appropriate Govt. notifies minimum wages of labour from time to time. The above
formula for escalation will be used for minimum wages prevailing at the time of opening
of tender.
“Escalation/De-escalation shall be calculated on the minimum wages declared in the
notification issued by Central Govt. as applicable on the date of opening of tender. Even
if the notification is issued at a later date, it shall be considered from retrospective effect
and the same shall be the basis of calculations.”
However, if change in minimum wages is notified after validity/currency of contract, the
same shall not be considered for escalation/de-escalation.
5. PAYMENT OF TAXES & DUTIES :-
OTHER THAN SERVICE TAX :
The tenderer shall quote their rates inclusive of all taxes & duties excluding Service Tax.
No request for increase / decrease or inclusion of any tax shall be entertained afterwards
6. PAYMENT OF SERVICE TAX :
A. Service Tax
The tenderer shall separately indicate the portion (amount) of taxable services on which
Service Tax is claimed by him, in the price bid. The tenderer shall also indicate the Service
Tax rate and the amount of Service Tax in the price bid. However, in case of services
notified for liability of payment of Service Tax on the part of service receiver, the
Company (NFL) shall pay the Service Tax to the extent, the liability is so provided for
service receiver. The tenderer shall quote / claim Service Tax only to the extent of his
portion of Service Tax to which he is liable.
i) In case of tenders called under dual bid system, the tenderer shall confirm that all the
columns in the price bid relating to lump sum monthly rates and Service Tax
alongwith totals have been filled up. This confirmation may be provided in prescribed
Performa (Annexure-F) and submitted along with technical bid in Envelop- II.
B. Evaluation of Bids
The amount of Service Tax as indicated in the price bid (service receiver & service
providers) shall be considered for evaluation of bids for arriving at L-1 status.
i) If nothing is mentioned in the columns relating to Service Tax, it shall be construed
that the quoted rates are inclusive of Service Tax and tenderer is not claiming anything
extra on this account from NFL.
ii) If in the Service Tax columns, tenderer fills up the remarks such as, as applicable /
Service Tax extra / as per Govt. Rules etc. then it shall be construed that Service Tax
at prevailing rats is applicable on all the items i.e. on total quoted value of the contract,
which shall be loaded for evaluation purposes for arriving at the status of L-1.
C. Payment on account of Service Tax shall be made based on invoice / bill raised by the
tenderer separately indicating the amount of Service Tax, restricted to the quoted
proportion / rate of Service Tax. The tenderer must provide copy of service tax registration

number which should also be mentioned in invoices / receipts along with Service Tax Code
and Accounting Code.
D. Contractor must submit documentary evidence of deposit of Service Tax immediately after
its deposit with Service Tax Department. The documentary evidence must be submitted
latest by the date for submission of invoice / bill of subsequent month, failing which NFL
can withhold the payment of subsequent Service Tax due to non- compliance of Service
Tax Rules. The Service Tax of the final bill shall be reimbursed on production of
documentary evidence. The liability of NFL shall be restricted to the amount of Service
Tax only as per terms & conditions of the contract and any interest / penalty etc. shall be to
the contractor‟s account.
E. Any subsequent change in the rate of Service Tax shall be to NFL‟s account during
contractual period only.
F. It is a case of manpower deployment and as per Service Tax Law, the contractor‟s liability
is to pay Service Tax of 25% of the quoted value of the contract and NFL is to pay 75% of
service tax of the quoted value. The contractor as well as NFL have to deposit the Service
Tax in the ratio 25 : 75 unless and until the same is changed by the Govt.
7. CONTRACTOR’S OBLIGATIONS:-
a) The contractor shall deploy unskilled-safaikaramcharies and malias mentioned in the
scope of workas mentioned at S.No. 5, for execution of the jobs in the scope of work as
mentioned from point No. 2 to 4.
b) Contractor should have his own PF Account and PAN and indicate the same in the tender
at the time of submission of quotation.
c) Contractor will have to pay the minimum wages fixed by the Central Government or State
Govt. from time to time for unskilled worker which are presently Rs.256.03 per day
respectively w.e.f. 01.09.2014 by Punjab State Govt.
d) Contractor is required to deploy 11 nos.ofUnskilled worker (10 no. SafaiKaramcharies
and 1 Mali) as per the requirement of Hospital and in case of failure to deploy the
required manpower as per requirement, NFL reserves the right to get the above stated
manpower from any other source/ agency at the risk and costs of the contractor.
e) Contractor will have to make the payment to the manpower engaged/ deployed by him in
the Hospital in a particular month before the 7th day of the subsequent month to which
payments to them relates. In case of delay penalty @ 500/- (Rs. Five hundred only) per
day beyond 7th day as specified above shall be recoverable from any dues or payment due
to the Contractor.
f) Contractor will be required to maintain a wage register in the prescribed Proforma.
Payment to the labour shall be made by contractor in the presence of the representative of
the C.M.O./Sr. Manager (P&A) who will give a certificate to the effect that payment has
been made in his presence. A duplicate copy of the payment of wages sheet duly signed
by the staff engaged by him for execution of the job and certified by the representative of
the Medical Department shall be submitted with every bill by contractor failing which bill
will not be processed for issue of COC required for release of payment.
g) Contractor will maintain all records and registers as per the statutory requirement and will
comply with the provisions of labour laws.
h) The contractor will ensure compliance of all statutory provisions for the manpower
deployed by him.
i) Contractor shall be responsible for any damage to NFL property by his workman.
j) Contractor shall be responsible for the supervision of the manpower deployed by him to
ensure proper execution of job as per the instructions and satisfaction of Officer-in-Charge.

8 PAYMENT TERMS :
a) Payment of monthly bill submitted by the contractor complete in all respect shall be
released within 30 days from the date of submission of the bill after deducting statutory
levies & other recoveries etc.
b) In case of increase in payment of minimum wages by the Central Govt./State Govt. as
applicable to unskilled the same will be allowed as per formula of 65 : 35 as defined in
clause no.4(viii).
9 PF ACCOUNT No. & APPLICABILITY OF THE ACT :- Contractor will have to furnish their PF account No. and will ensure compliance with all the
requirements of PF & Misc. Provision Act, 1952 for contract labour.
OTHER STATUTORY REQUIREMENTS:
a) Every contractor should have his own PF Account Number and shall be responsible to
deposit the PF contribution in respect of workmen engaged by him.
b) The contractor shall indicate PF Account Number allotted to each worker engaged by him
in the monthly wage bill and will ensure its accuracy and correctness.
c) The contractor shall submit Annual Return in respect of all the workmen engaged by them
with concerned RPF authorities with copy to P&A Deptt.
d) After submission of the return, the contractor shall arrange and distribute PF slips in
respect of PF Contribution, issued by the RPF Authorities and will distribute to the
concerned workers after intimation to the Executing Deptt and P&A Deptt.
e) After closure of the contract or in case of change of the employer (contractor), the
outgoing contractor and present contractor shall ensure submission of Form-13A, for
transfer of PF contribution from old account to the new account.
10 COVERAGE UNDER ESI ACT :
As the ESI Scheme has been made applicable w.e.f. 01.05.2011, as per notification dated
18.04.2011, issued by Ministry of Labour& Employment, Govt. of India, the provisions as per
following may be complied with.
i) The Contractor should have his own ESI Account Code Number from the ESI Authorities.
It shall be the responsibility of the contractor to deposit the ESI contribution every month @
6.5% of the monthly wage bill (Employers contribution @ 4.75% & Employee‟s
contribution @1.75%), under intimation to P&A Deptt.
ii) It shall be the responsibility of the Contractor to ensure Registration and issue of ESI cards
to the manpowerengaged by them for availing medical facilities by the beneficiaries.
iii) It shall be the responsibility of the Contractor to submit ESI Return to the statutory
authorities under intimation to P&A Deptt.
11 TERMINATION OFCONTRACT IN FULL OR IN PART:
Notwithstanding anything elsewhere herein provided and in addition to any other right or
remedy of NFL under the Contract or otherwise including right or NFL for compensation for
delay the Officer-in-charge may prejudice to his right against Contractor in respect of any delay,
bad workmanship or otherwise or to any claims for damage in respect of any breaches of the
Contract and without prejudice to any rights or remedies under any of the provisions of this
Contract or otherwise and whether the date for completion has or has not elapsed by intimation
in writing, absolutely, determine the Contract.
Default or failure by Contract of any of his obligations under the Contract including but not
limited to the following, the Contract is liable to be terminated, if the Contractorbecomes
bankrupt or insolvent or goes into liquidation or is ordered to be would up or has a receiver
appointed on its assets or execution or distress is levied upon all or substantially all of its assets.

Abandons the work
Persistently disregards the instructions of the OWNER in contravention of any provision of the
CONTRACT.
Or
Persistently fails to adhere to the agreed program of work.
Or
Sublets the work in whole or in part thereof without OWNER‟s consent in writing.
Or
Performance is not satisfactory or work is abnormally delayed.
Defaults in the performance of any material undertaking under this CONTRACT and fails to
correct such default to the reasonable satisfaction of the OWNER within fifteen days after
written notice of such default is provided to the Contractor.
a) Owner may terminate the Contract due to any reason including reasons due to force
majeure, regulations or ordinance of any Government or any other reasons beyond the
reasonable control of the Owner.
b) Such termination will be 15 (fifteen) daysnotice in writing and no claim/compensation
shall be payable by the OWNER as a result of such termination, excepting the fees and
costs for the meaningful services rendered by the CONTRACTOR and acceptable to
OWNER, up to the date of termination.
12 SAFETY:
It is obligatory on part of the contractor to abide by the terms and references as contained in the
Safety Code the violation of which will tantamount to disqualification of the Contractor for any
type of work in NFL as well as security deposit will also be forfeited.
13 COMPLIANCE OF STATUTORY OBLIGATIONS:
The contractor shall comply with all statutory Acts & rules including the following :
i) Contract Labour (Regulation & Abolition Act), 1970,
ii) Minimum Wages Act, 1948,
iii) EPF & Misc. Provisions Act, 1952,
iv) Factory Act, 1948,
v) Employees State Insurance Act, 1948 if applicable,
vi) The Payment of Wages Act, 1936
vii) Employee‟s Liability Act, 1938,
viii) Industrial Dispute Act, 1947.
Any other Act framed by Central or State Govt. from time to time and relevant to the contract.
14 PAYMENT OFMINIMUM WAGES: -
a) It shall be the responsibility of the contractor to make payment of Minimum Wages to the
workmen engaged by him on or before 7th of the following month, as fixed / revised and
notified by the Appropriate Govt.(presently Central Govt./State Govt.) which are on higher
side.
b) In case the rates notified by the Central Govt. for any scheduled employment are less than
the rates notified by the State Govt. in that case the Contractor shall be required to make the
payment to the workmen at the rates notified by the State Govt.
c) The Contractor will pay all statutory payments including Bonus.
Presently the minimum wages w.e.f.01.09.2014 payable to unskilled worker
(SafaiKaramcharies& Mali)is Rs.256.03 per day as per rate of Central/State Govt.

15 PENALTY
15.1 Whenever and wherever it is found that the cleanliness is not up to the mark, it will be
brought to the notice of the supervisory staff of the Contractor by NFL, who will get the
same attended to immediately and submit the work done report to the Officer-in-charge
and if no action is taken, penalty @ Rs. 500/- for each default will be imposed and the
same shall not be subject to dispute or arbitration.
15.2 In case of non-attendance / execution of housekeeping jobs at a particular location on
any day(s), recovery on pro-rata basis will be made from the bill(s) of the Contractor.
15.3 In case of deficiency of services, due to deployment of lesser no.of persons than
required/suggested, penalty @1.5 times of minimum wages subject to max.10% of the
work order value shall be imposed and the same shall not be subject to dispute or
arbitration.
16 RISK & COST
If at any stage, the performance of the contractor is found un-satisfactory, the awarded
job will be terminated and will be awarded to the other agency at the risk and cost of the
contractor and extra 25% departmental cost shall also be recovered from the contractor.
17 ARBITRATION CLAUSE:
The contract shall be governed by and construed in accordance with the laws of India.
i. “Except where otherwise provided in the contract all matters, question or differences whatsoever,
which shall at any time arise between the parties hereto, touching the construction, meaning,
operation or effect of the contract or out of matter relating to the contract or the breach thereof or
the respective rights or liabilities of the parties during or after completion of the works or whether
before or after termination, shall after written notice by either party to the contract be referred to
the arbitration of the Unit Head, National Fertilizers Ltd, Nangal Unit or his/her nominee.
The arbitration & Conciliation Act, 1996 or any statutory modification or re-enactment thereof and
the rules made there under shall govern the Arbitration proceedings.
The contractor hereby agrees that he shall have no objection if the arbitrator so appointed is an
employee of NFL and he had to deal with the matter to which contract relates and that in the
course of his duties as such he has expressed his views on all or any of the matter in dispute of
differences”.
It is agreed by and between the parties that in case a reference is made to the Arbitrator or the
Arbitral Tribunal for the purpose of resolving the disputes/differences arising out of contract by
and between the parties hereto, the Arbitrator or the Arbitral Tribunal shall not award interest on
the awarded amount more than the rate of SBI PLR/Base rate as applicable to NFL on date of
award of contract.”
ii. Applicable where contract is awarded to Public Sector Enterprises/Government:
In the event of any dispute or difference relating to the interpretation and application of the
provisions of the contract, such dispute or difference shall be referred by either party for
Arbitration to the sole Arbitrator in the Department of Public Enterprises to be nominated by the
Secretary to the Government of India In-charge of the Department of Public Enterprises. The
Arbitration and Conciliation Act, 1996 shall not be applicable to arbitration under this clause. The
award of the Arbitrator shall be binding upon the parties to the dispute, provided, however, any
party aggrieved by such award may make a further reference for setting aside or revision of the
award to the Law Secretary, Department of Legal Affairs, Ministry of Law & Justice, Government
of India. Upon such reference the dispute shall be decided by the Law Secretary or the Special
Secretary/Additional Secretary, when so authorized by the Law Secretary, whose decision shall

bind the parties finally and conclusively. The parties will share equally the cost of arbitration as
intimated by the Arbitrator.
18 Whether any ex-employee(s) of NFL is/are employed with the tenderer. If so,Name,
Designation, Department and E. No. of such ex-employee(s) be indicated in Annexure-
F(3).
19 Whether any relative (s) of the tender is/are working in NFL, if so, the Name, Designation
and Department & E. No. of such employee (s) be indicated in the quotation as per
Annexure- F
20 Contractor will be required to execute an agreement as per NFL Proforma on non-judicial
stamp paper of Rs.15/- for satisfactory execution of the contract. Agreement duly signed
an Notarized on the date of signing/execution by both the parties.
21 Contractor will have to send his acceptance for the work order along with
agreement as mentioned above. The Work Order shall be issued to the contractor in
duplicate, the duplicate copy may be returned to us duly signed and stamped as token of
acceptance of the WO by the contractor.
22 The rates quoted by tenderer shall remain firm till the completion of job/contract period
and also during the extended period, if any.
