From the Desk of Director General

This issue of NARCONTROL covers the events from July to September 2013. The journal is aimed at all stakeholders in the field of Drug Law Administration. NCB through this publication intends to inform the readers of our progress in the areas of enforcement, coordination, capacity building, and efforts made at creating awareness against drug abuse.

This issue contains the numerous operations done by Narcotics Control Bureau and other Drug Law Enforcement Agencies. The special feature is also laid on the land mark judgments given in favor of Narcotics Control Bureau.

The magazine also gives an overview of the drug-awareness drive initiated by Narcotics Control Bureau in the premier schools of Delhi to sensitize the children, teachers and parents of the dangers posed by drugs, tobacco and alcohol by conducting workshops, presentations and discussions in the schools.

The issue contains the analysis of the new NDPS (RCS) Order, 2013 and its new provision as to registration, export, import, and destruction etc. of the Controlled Substances.

As in the past, Narcotics Control Bureau continues its focus on capacity building and training. During the period July to September 2013, Narcotics Control Bureau organized 28 Drug Law Enforcement training programmes wherein different Central/ State agencies were trained. A 4-week basic training of 35 Newly Recruited / Promoted / Deputed Intelligence Officers & Surveillance Assistants of Narcotics Control Bureau was organized during this period.

On the organizational front, 9 Intelligence Officers and 3 other staff joined Narcotics Control Bureau. ‘Hindi Pakhwara’ was organized from 14-28 September during which various competitions were held and prizes given to the winners.

1. OPERATIONSOn 03.07.2013, Officers of the Land Customs, Rail Cargo, Amritsar recovered 9.874 kg of

heroin from 488 bags of cement coming from Pakistan by a goods train. The suspected

source of the drug was South West Asia.

On 06.07.2013, Officers of the Narcotics Control Bureau, Ahmedabad Zonal Unit seized

20.660 kg of hashish from a luxury bus at Ahmedabad. Two persons were arrested in

the case.

On 11.07.2013, Officers of the Border Security Force recovered 8.5 kg of heroin from

the vicinity of the International border with Pakistan. The suspected source of the drug

was South West Asia. The seized drug was handed over to the Narcotics Control Bureau,

Amritsar Sub-Zone for action under the NDPS Act.

On 21.07.2013, Officers of the Narcotics Control Bureau, Delhi Zonal Unit in co-ordination

with the CISF personnel seized 49.650 kg of pseudo-ephedrine at Indira Gandhi

International (IGI) Airport, New Delhi from the checked in luggage of two Gaborone

bound South African nationals. They were arrested.

On 31.07.2013, Officers of the Narcotics Control Bureau, Mumbai Zonal Unit intercepted

a courier parcel containing 14.650 kg of Ketamine. The intended destination of the seized

drug was Mozambique.

On 04.08.2013, Officers of the State Excise, Nagaland intercepted two vehicles and seized

300 kg of cannabis herb which had been compressed to form blocks and kept in the

dickeys of the vehicles. One person was arrested in the case.

On 07.08.2013, Officers of the Directorate of Revenue Intelligence (DRI), Amritsar

intercepted a vehicle and thorough rummaging of the vehicle resulted in recovery of

34.605 kg of heroin from 35 packets concealed in white cloth. One person was arrested

in the case. The suspected source of the drug was South West Asia.

On 17.08.2013, Officers of the Narcotics Control Bureau, Kolkata intercepted a

Johannesburg bound air passenger at Netaji Subhash Chandra Bose International Airport,

Kolkata and seized 22.550 kg of methaqualone from her luggage. She was arrested.

On 18.08.2013, Officers of the Central Bureau of Narcotics, Neemuch intercepted a

four wheeler at Neemuch and search of the vehicle resulted in recovery of two plastic

jerricanes containing 141 kg of Acetic Anhydride. The drug was seized and three persons

were arrested in the case.

On 02.09.2013, Officers of the Narcotics Control Bureau, Lucknow Zonal Unit raided

a godown of a trader in Lucknow and seized 10,700 bottles of phensedyl, 12,70,080

capsules of Spasmoproxyvon, 1,00,800 capsules of Spasmocip and cash amounting to

Rs. 23,550/-. One person was arrested in the case.

On 05.09.2013, Officers of the Air Intelligence Unit, Customs, C.S.I. Airport, Mumbai

intercepted a South African national at Mumbai Airport. The search of her luggage resulted

in recovery of 15.9 kg of methaqualone. The drug was concealed in sports protection gear

and its destination was Lilongwe, Malawi via Nairobi, Kenya. The passenger was arrested.

On 12-13.09.2013, Officers of the Border Security Force, Khemkaran recovered a

consignment of 9.480 kg of heroin,1 pistol (.30 mm), 2 pistol magazines loaded with five

rounds each,40 loose rounds,2 hand grenades from the Indo-Pakistan border. The seized

drug was handed over to Narcotics Control Bureau, Amritsar Sub-Zone for action under

the NDPS Act. The suspected source of the drug was South-West Asia.

On 20.9.2013, Officers of the Narcotics Control Bureau, Thiruvananthapuram Sub-Zone

raided a hotel at Thampanoor and seized 1.515 kg of heroin from the store of a room

occupied by a Maldivian national. On confession of his involvement in drug trafficking, he

was arrested. The intended destination of the seized drug was Maldives. Two of his Indian

accomplices were arrested in the follow up action on 22.09.2013.

Acting on the intelligence input provided by the Drug Enforcement Administration (DEA),

USA that some Nigerian nationals carrying drugs had left from Dubai by emirates flight for

New Delhi. An operation was launched by the Officers of the Narcotics Control Bureau,

Delhi Zonal Unit on 27.09.2013 which resulted in a recovery of a consignment of 8 kg of

a substance purported to be cocaine from the luggage of a Nigerian National. The person

was arrested.

IMPORTANT COURT JUDGEMENTS

TITLE: NCB VS. RAKESH KUMAR & SARVESH BHATIA

• Two persons namely Rakesh Kumar and Sarvesh Bhatia of New Delhi were

arrested on 01.02.2007 in a seizure of 1210 Kgs of Charas and 870 gms of

Charas.

• The Court passed the judgement order on 17.08.2013 that accused Sarvesh

Bhatia stands convicted for the offences punishable under Section 20 (b)

(ii) (C) and Section 29 of the NDPS Act while accused Rakesh Kumar stands

acquitted of the charges framed against him.

TITLE: NCB VS. SANDEEP PRASAD

• One person namely Sandeep Prasad resident of East Champaran, Bihar

was arrested on 04.03.2011 near the entrance gate of Metro Station, New

Delhi on possession of 7 Kg of Charas found in his bag.

• The Court passed the judgement order on 31.08.2013. The Court opined

that the said offence was punishable under section 20 (b) (ii) (C) of NDPS

Act which provides that a person found guilty of having been found in

possession of Commercial Quantity of any cannabis plant shall be

punishable under law. Therefore, the Court imposed a sentence of 10 years

of rigorous imprisonment and a fine of Rs. One lakh upon the convict.

International Conferences/ Training Programs

• An International Workshop on “Financial Flows related to Illegal Drug Production and

Trade” was held on 3rd July, 2013 at Sun-City, South Africa. Shri Prem Anand Sinha,

Zonal Director, Chennai Zonal Unit attended the workshop from Narcotics Control

Bureau.

• Indian delegation led by Joint Secretary (NE), Ministry of Home Affairs participated

in the 13th Joint Working Group Meeting between India and Bangladesh held in New

Delhi on 18th July, 2013. Shri A.K. Jaiswal, Deputy Director General (Hqrs. & Coord.)

participated in the meeting as a member of Indian delegation.

• Indian delegation led by Deputy NSA & Secretary NSCS, participated in the 8th Meeting

of India – Thailand Joint Working Group (JWG) on Security Cooperation held from

18th to 19th July, 2013 in New Delhi. Shri B.B. Mishra, Deputy Director General (Ops)

participated in the meeting from NCB as a member of Indian delegation.

• Home Secretary Level talks between India and Bangladesh held on 19th July, 2013 in

New Delhi. Director General, Narcotics Control Bureau participated in the meeting as a

member of Indian delegation.

2. COORDINATIONINTERNATIONAL

Narcotics Control Bureau has been mandated to implement the obligations under the International and Regional Conventions on drug related matters, as also to render assistance to concerned authorities in foreign countries and international organizations with a view to facilitate coordination and universal action for prevention and suppression of illicit traffic in narcotics drugs and psychotropic substances.

• An Asia Pacific Conference on the subject “Impact of Social Media on Policing” held in

New Delhi from 8th to 10th September, 2013. Shri R. P. Singh, Deputy Director General,

(Northern Region) attended the conference on behalf of Narcotics Control Bureau.

• On 13th September 2013, Hon’ble Deputy Minister, Ministry of Justice and

Counstitutional Affairs of Tanzania, Ms. Angela Jasmine Kairuki paid a visit to NCB Hqrs

New Delhi to familirise with the working of NCB and NDPS Act 1985.

NATIONAL

• An Inter-Agency Coordination Meeting of Wildlife Crime Control Bureau was conducted

under the Chairmanship of Secretary, Environment & Forests on 18th July, 2013 at

Paryavaran Bhawan, Ministry of Environment & Forest, New Delhi to discuss issues

pertaining to the Wildlife Crime Control Bureau and Coordination of Inter-Agency

efforts to control organized wildlife crime. Assistant Director (Admn) Shri U. K. Misra

attended the meeting.

• Director General, Narcotics Control Bureau attended the meeting chaired by Hon’ble

Finance Minister on 31st July, 2013. The subject was NDPS / RCS Order, 2013. The

meeting was also attended by Joint Secretary (Revenue), Deputy Director General

(Hqrs. & Coord.), NCB and Director (Narcotics Commissioner).

• As a follow-up to the meeting chaired by Hon’ble Finance Minister dated 31st July,

2013, a proposal has been sent to Department of Revenue for Amendment to the NDPS

(RCS) Order, 2013 for enacting / framing the provision / notification which may bring

the preparation of Ephedrine & Pseudo-Ephedrine under control to prevent their non-

medical & illicit use and diversion to illicit channels for manufacturing Amphetamine

Type Stimulants.

• Memorandum of Understanding signed on 1st August, 2013 between Narcotics Control

Bureau & Financial Intelligence Unit, Ministry of Finance.

• Director General, Narcotics Control Bureau met with Shri Dilsher Singh Kalha, Secretary,

Department of Pharmaceuticals on 6th August, 2013. The subject of the meeting was

“Abuse & Trafficking of Prescription Pharmaceutical Drugs” especially codeine-based

Drugs and Ephedrine / Pseudo- Ephedrine.

• Deputy Director General (Northern Region), Narcotics Control Bureau attended

a meeting on 6th August, 2013 in the chamber of Shri R. N. Dhoke, Additional

Commissioner of Security (Civil Aviation), New Delhi to discuss the inclusion of NCB

personnel in the Airport Security Committee.

• A meeting of Nodal Officers on “Identification and Destruction of Illicit Poppy

Cultivation” on 5th September, 2013 in Narcotics Control Bureau Headquarters in

New Delhi.

• A meeting with Training Heads of all the CPOs/CAPFs & other Government Departments

regarding Police training in India was conducted by Bureau of Police Research and

Development on 13th September, 2013. Deputy Director (P&C), Shri Manoranjan

Kumar attended the meeting from Narcotics Control Bureau.

• Assistant Director (Ops.) Shri Praveen Kumar attended a meeting with major

Pseudoephedrine, Ephedrine and Acetic Anhydride manufactures and their major

user companies at Central Bureau of Narcotics, Gwalior, Madhya Pradesh on 16th

September, 2013.

• Director General, Narcotics Control Bureau, Shri Rajiv Mehta attended the 16th National

Integration Council Meeting on 23rd September, 2013 at Vigyan Bhawan, New Delhi.

3. CAPACITY BUILDING Assistance to States & Union Territories

20 states & UTs have sent proposal of 2013-14 for grant of central assistance under the scheme “Assistance to State & UTs” to strengthen enforcement capabilities for combating trafficking of Narcotics Drugs and Psychotropic Substance. Under scrutiny of the proposals received, it has been found that some of the states have not submitted their Utilization Certificate and Audit Certificate of the grants utilized earlier. Letters have been issued to such state to submit their Utilization and Audit Certificate in order to get their proposal considered. A letter has been written to MHA for convening the meeting of Empowered Committee for consideration of the proposals received from states and UTs. As soon as the date of the meeting of Empowered Committee will be given by MHA, the proposals scrutinized will be finalized in the said meeting.

Drugs Detection Kits

Narcotics Control Bureau placed the suppiy order on 21st May 2013 to Hindustan Antibiotics Limited (HAL), Pune for procuring the following numbers of Drug Detection Kits: -a) Standard size Narcotics Drug Detection Kits- 1104b) Precursors Chemical Detection kit– 430c) Ketamine Detection Kits – 214

The above numbers of Drug Detection Kits have been despatched to NCB Zones and Sub-Zone for further distribution to drug law enforcement agencies in their jurisdictions.

Training

NCB has been regularly organizing training programs to enhance and sharpen the specialized skills required top improve performance and effectiveness of the personnel involved in drug law enforcement. During July to September, 2013, NCB organized 28 training courses and a total of 659 personnel working in various Central / State agencies were trained. 04 weeks Basic Training of 35 Newly Recruited/ Promoted / Deputed Inteligence Officer & Surveillance Assistants of NCB at RTI NACEN, New Delhi, 60 Newly Recruited Sepoys ( Ist & IInd Batch) of NCB were trained at RPTC, Jodhpur (Raj.), NCB Zonal Units Jodhpur / Delhi during this period.

Computer based training module

NCB is organizing CBTs in capacity building for combating illicit trafficking of narcotics

drugs and psychotropic substances at CBT estabilbhsed at NCB Headquarters and three

metro Zones i.e. Kolkata, Mumbai and Chennai in the year 2012. The software module

is based on International best practices as part of a project of UNODC to strengthen the

Drug Law Enforcement capacities in South Asia. It is a self-evaluation programme utilized

for enhancing the skills and knowledge of personnel on specific modules of drug law

enforcement. With the approval of the MHA, CBT Centres have also been opened in other

zones namely Lucknow, Jodhpur, Ahmedabad, Chandigarh, Jammu, Indore, Guwahati,

Patna and Bangalore. The bar diagram below shows the number of personnel attended the

CBT training from different organizations.

THE CBT MODULE HAS THE FOLLOWING FEATURES:• The modules cover all aspects of drug law enforcement including intelligence,

investigation, precursor trafficking and anti money laundering.• It is possible to design a variety of courses ranging from few hours to a few days,

weeks or months. The course content can thus be made specific to the target groups.

• The interactive nature of the modules facilitates enhancement in retention capacity of the learners.

• This module has pre and post test facilities which enables the administrator to assess the impact of learning process.

DRUG DEMAND REDUCTION

One of the core duties of Narcotics Control Bureau is to create public awareness regarding

the ill-effects of drug abuse which is corroding the modern society and to promote the

concept of living healthy life free of drugs. This is done through various platforms including

awareness campaigns, rallies, print and visual media etc.

AWARENESS PROGRAMES

Narcotics control Bureau organizes awareness programmes so as to curtail the spreading

menace of drug abuse engulfing all sections of the society especially young students. Drug

abuse along with the abuse of alcohol coupled with smoking of tobacco products is taking

a heavy toll on the health of the youth. It entails not only health costs but also economic

and social costs. To summarize, the spread of drug abuse among the youth has started

damaging the foundation of our society. NCB is spreading awareness against drug abuse

directly by addressing the students, their parents, teachers and counsellors. One such Drug

Awareness Programme was conducted on 6th September, 2013 at Vasant Valley School at

Vasant Vihar, New Delhi.

4. ORGANIZATIONDeputation

Following deputation orders were issued during the period:-

1. Direct recruitment

a) Dossiers of 11 Surveillance Assistants were received from Staff Selection Commission

subsequently appointment letters were issued to 08 candidates on 02.07.2013. All

the candidates joined on 05.08.2013.

b) Offer of appointment for the post of Sepoy issued to 45 candidates on 29.07.2013

and to 12 candidates on 02.08.2013. 49 candidates joined on 05.09.2013 and the

remaining joined on 16.09.2013.

c) 11 dossiers of Steno. Gd. III received from Staff Selection Commission. Offer of

appointment was issued to 07 candidates on 19.07.2013. All the candidates joined

on 19.08.2013.

d) Staff Selection Commission was requested for directs recruitment for 07 Lower

Divisional Clerks in NCB. 04 dossiers have been received so far.

Commission. 05 officers have been selected.

LogisticsLand and Building

Jodhpur: The construction of office bldg. has been completed by CPWD and subsequently handed over to NCB Zonal Unit Jodhpur. There is provision of lift facility in the building. Installation of fire extinguisher has also been completed but yet to be handed over to Jodhpur Zonal Unit. The office has been shifted to the new office building and started functioning w.e.f. 30.04.2012.

Jammu: Acquisition of land for Jammu Zonal Unit for construction of office-cum-residential complex is in progress.

Chandigarh: The proposal of allotment of land measuring 2010 sq, mtrs (0.5 acre) out of the identified land measuring 3682.6 Sq. mtr. (0.91 acres) at Sector-38, Chandigarh sent to JS (Estate) Chandigarh for construction of office building for Chandigarh Zonal Unit of NCB. The matter is in progress.

Indore: Land measuring 3490.91 Sq. mtr. @ Rs. 26000/- per Sq. mtr. at the cost of Rs. 9,08,73,624/-including lease rent purchased from Indore Development Authority. Payment made to Indore Development Authority on 20.9.13.

Ahmedabad: Proposal for purchase of land measuring 6478 Sq. mtrs. (1.60 acre) for costing Rs. 14, 57, 55,000/- sent to Ministry of Home Affairs on 30.09.2013 for administrative approval and financial sanction.

Chennai: 1.64 acres of Land purchased for office.70% work of road construction in the complex is completed. Flooring of car shed work under progress. Work for green park to be started by Horticulture CPWD. Laying of pipes for electrical and BSNL lines are being carried out.

Kolkata: 2 acres of Land purchased for office. About 98% of works of office building and 97% works of residential building have been completed.

Lucknow: 1.005 acres of Land purchased for office. Preliminary estimate amounting to Rs. 30, 25, 51,264/- alongwith drawing of construction of office-cum-residential complex sent to MHA on 25.9.2013 for administrative approval and financial sanction.

Analysis of the NDPS (RCS) order 2013Pramod Kumar Mahtha, Intelligence Officer

Looking to the present day growing menace of Drug and Psychotropic Substance in India, the Government of India has come forward with the NDPS (RCS) Order 2013 for better regulation and control of Controlled Substance within India which plays very important role in manufacture and production of drugs and psychotropic substance.

Controlled substances are chemicals whose manufacture, possession, or use is regulated by government through legislation over it. As per the definition under the NDPS Act 1985, Section 2 (viia) “controlled substance” means any substance which the Central Government may, having regard to the available information as to its possible use in the production or manufacture of narcotic drugs or psychotropic substances or to the provisions of any International Convention, by notification in the official Gazette, declare to be a controlled substance. They are not drug in itself but used in production of drugs as precursors.

Control over control substance is one of the important strategies for supply reduction of Narcotics Drug and Psychotropic Substances by preventing diversion of the controlled substance to illicit channels of manufacture. In the U.S., the Drug Enforcement Administration is responsible for suppressing it by enforcing the Controlled Substances Act where as in India; it is regulated by the NDPS (RCS) Order 2013. The present Order of 2013 has repealed the earlier NDPS (RCS) Order 1993. The present NDPS (RCS) Order 2013 has three Schedules A, B & C.

Schedule A contains five controlled substances whose manufacture, distribution, sale, purchase, possession, storage and consumption is to be done by getting Unique Registration Number issued from the Zonal Director of NCB as per the area of jurisdiction in appendix. The registration number has to be taken within 180 days from 26th March 2013 following the procedure of Clause 4 of the Order. The holder of registration number can also surrender the same under Clause 5. Provision regarding transportation and Sell of Controlled Substance under this schedule has been elaborated in Clause 7 and Clause 8 respectively. The Destruction of Controlled Substance in this Schedule is to be conducted as per the provision of Clause 9.

Schedule B & Schedule C contains seventeen controlled substances whose export and import from India is subject to getting No Objection Certificate (NOC) issued by the Narcotics Commissioner, CBN following the procedure of Clause 10 and Clause 11 respectively. Clause 12 gives provision of labeling of consignment for export and import of Controlled Substance.

The NDPS (RCS) Order 2013 nowhere gives provision as to punishment in case of its disobedience. But the Section 25A and Section 26 of the NDPS Act will apply if the provisions of the NDPS (RCS) Order 2013 are not followed by the people dealing in Controlled Substance. The maximum punishment in case of violation of the Order shall be rigorous imprisonment for the term which may extend to 10 years and shall also be liable to fine which may extend to one lakh rupees.

That was enough to shake up the other 4 backies from various stages of their sleep and to place them in their favourite spot in the eucalyptus yard at the far end of the college ground. Money comes thick and fast when the matter is to quench your thirst. Neither the college fees nor the money to buy groceries on your way back stands a chance before it. Peter was as ready as always with his Yamaha RX 100. Rohit jumped in as the pillion with all their ‘hardenend’ money. Friends waited for them with and their eyes directed towards the steps descending to the grounds. Nervous jokes were cracked, but the response was lukewarm for pre occupied minds. And then, the joy was momentous when Rohit appeared on the top of the steps with a wide smile and a visibly heavy college bag. May be it was his friends’ response that urged him to run down the steps. Vikram waiting below shouted him to take it slow, but only too late. The appendix of the present Order is enclosed with Form-A to Form-K which can be used by the persons dealing with Controlled Substance for registration, quarterly return, destruction, export, import, etc. Presently, the registration is done manually by the Zonal Units of NCB but very soon the online registration system will come into existence. The project for installation of Online Registration System of Controlled Substance is under development phase at the NCB Headquarter, New Delhi.

The present Order of 2013 contains better provision for regulation and control of controlled Substance than the earlier Order of 1993. The growing abuse of Controlled Substance in production of drugs led to the development of present Order 2013 for efficient control and management of control substance within the country. The present Order contains user friendly provisions which will neither prohibit the licit user from using the Controlled Substance for benefit of society nor will it allow the bad elements of society to misuse it. The present Order contains provision of tracking the controlled substance from the source of origin to the end user.

Through this Order, Government of India has placed greater responsibility on NCB and CBN Officers for effective control, regulation, management and tracking of Controlled Substance with in the country. It is the duty and responsibility of NCB and CBN Officers to ensure that the mandate & objective of the Order is achieved in real sense for drug free society and welfare of the country.
