Dangers Impacting the Future of Real EstateA Letter from the President | By Scott Avery

Looking ahead to the future, whether as part of your own business strategy or as our collective Avery-Hess team requires that we all assess the Realtor business environment we live in and the potential challenges down the road. This is a wise and prudent thing for each of us to do. Every day, each of us sees evidence of changes in our industry and business that can be both exciting and unsettling. In the last two weeks, I have been poring through a report commissioned by NAR that assesses threats that “could” emerge and affect various facets of our industry. My hope is we can use this information as a “discussion starter” to help all of us prepare for the future.

My commentary focuses on the first section of the report; Dangers impacting Agents. For the last year, I have been engaging in dialog at your sales meetings about the commission structure and ways to empower yourself to combat the danger of commissions trending downward (which by the way, is listed as Danger #2). Awareness, education, training and thinking “outside the box” are key building blocks in developing the “informative dialog” necessary to handle this with consumers increasing pressure to reduce rates. But more important, and there is no easy way to say this, the #1 danger facing agents today is that “Masses of Marginal Agents are Destroying our Reputation” and when you couple that with the threat talking about The Decline in the Relevancy of Agents it begins to get your attention. If we fail to properly assess and respond to consumer demands and expectations, will our role and perceived value deteriorate? Is the branding of the agent more important than the house being sold? Is focusing on the consumer more important than focusing on the transaction? It is the reports commentary that “the real estate industry is saddled with a large number of part-time, untrained, unethical, and/or incompetent agents. This knowledge gap threatens the credibility of the industry. I know many of our Avery-Hess agents blanch at the thought of working with certain agents or companies. Why? There are too many agents simply not qualified to the level they should be. Professional hardworking agents understand this “brings the industry down”.

So where do we go and what do we begin to do about this? As I said, this should form the basis for discussions within your office much as we are doing at corporate with the leadership team. But I’d like us all to think for a minute about the “safe harbor” that I believe exists within Avery-Hess. We have a culture that works to create a collaborative environment between agent and company with a singular focus to service the consumer and deliver “WOW” service. At our leadership workshop last week I heard a great term for us. We have a “knowledge” based culture. We work hard to be selective in those we bring on board. We train, develop, mentor and support agents committed to sharing our vision of consumer service. Our environment of high standards, quality service and consumer focus will help you stand out and raise both your knowledge base and relevancy within the industry. If we continue to attract better more professional agents, we will stand out as a company consumers will turn to. And this is precisely what you should truly care about. You can help by attending training and raising your knowledge level, by asking the better agents in the marketplace to come and talk with us. You can talk about creating an office filled with great agents who want to work with, and around, other great agents. By accomplishing this we will raise the reputation and relevancy of Avery-Hess, Realtors®, rise above these dangers and be a company whose agents are quite simply THE BEST! And that my friends is your best path to future successes.

George Mason UpdatesWhat the heck is TRID?

You are probably seeing emails from title companies and mortgage companies offering TRID seminars. Here is what you need to know in a nutshell. New regulatory changes referred to as the TILA-RESPA Integrated Disclosure (TRID) rule will kick in on August 1st (pending a proposal to delay until October 3rd).

What is the impact of the new rule?TRID will create two new documents, referred to as the Loan Estimate and the Closing Disclosure. The Loan Estimate (LE) will replace the current Good Faith Estimate and the Initial Truth in Lending disclosure. The Closing Disclosure (CD) will replace the HUD-1 Settlement Statement and the Final Truth in Lending disclosure. The new forms are easier to read and provide more information.

What is the big deal?Along with these new forms there is a new timing requirement. The Closing Disclosure (CD) must be received by the buyer at least 3 days prior to closing. The days that count exclude Sundays and Federal Holidays. If the buyer has not received the Closing Disclosure at least 3 days before closing the transaction cannot close.

What should realtors do about it?To help keep your transactions on track (especially if the financing is not being done by GMM) - It might be a good idea to check with the lenders on your transactions three days before closing to make sure that they have provided the Closing Disclosure to the buyer.
