Board Comments
Closed Session Review Following a motion in open session pursuant to KRS 61.810 (1) (c) and (1)(j), it is anticipated that the Board will move into closed session to conduct a character and fitness review and to review potential actions relating to complaints and reports. The Board will also review pending litigation.
Case Decisions Following the closed session review, the Board shall move into open session. All decisions will be made in open session.

On Thursday, December 13, the Education Professional Standards Board and the Office of Educator Licensure and Effectiveness (the administrative office of the EPSB) is moving from 100 Airport Road to the 5th floor of 300 Sower Boulevard, Frankfort, KY 40601. Onsite consultations with office staff will not be available on Tuesday, December 11th–Monday, December 17. The office will begin accepting visitors at 300 Sower Boulevard beginning Tuesday, December 18.

Call to Order
Chair Sarah Burnett called the meeting to order at 9:14 a.m. ET. She read the mission statement
to the Board and audience.
Swearing in of New Board Members
Education and Workforce Development Cabinet Deputy Secretary Mike Nemes and Council on
Postsecondary Education’s Vice President Dr. Aaron Thompson were sworn in by Kentucky
Higher Education Assistance Authority’s Kathleen Ragland.
Roll Call
The following Board members were present during the October 8, 2018, EPSB meeting:
Sarah Burnett, Kim Chevalier, David Graham, Donna Hedgepath, Justin Mitchell, Mike Nemes,
Sherry Powers, Shad Sletto, Steven Thomas, Dr. Aaron Thompson, and Rachel Watson.
Absent: Daniel Morgan, Ellen Murphy, and Dustin Phelps.

Deputy Mike Nemes shared highlights of the Cabinet’s current work with the Board.

Report of the Associate Commissioner of Educator Licensure and Effectiveness
Associate Commissioner Rob Akers presented an overview of the current work of the office
and praised the staff for their outstanding work processing hundreds of educator licenses.

Board Comments
Mr. Sletto noted his concern regarding the lack of a KTIP or mentorship program for alternative
route certification applicants and encouraged alternative route certification applicants to seek out
more classroom management and pedagogical training within their district.

1803151 Tyler Perkins Accept Agreed Order retroactively suspending Certificate
Number 201163830 for a period of three (3) days, from
January 17, 2018 through January 19, 2018.
Perkins is admonished for exercising poor professional
judgment. The Board reminds Perkins of his ethical duty to
take reasonable measures to protect the health, safety and
emotional well-being of his students. The Board will not
tolerate any further incidents of misconduct from Perkins.
On or before March 1, 2019, Perkins shall provide written
proof to the Board that he has completed a course on
educator ethics training with an emphasis on student teacher
boundaries, as approved by the Board. Perkins shall pay any
expense incurred. If Perkins fails to satisfy this condition,
Certificate Number 201163830 shall be administratively
suspended until such condition is satisfied.
Certificate Number 201163830, including any and all
endorsements, is hereby subject to the following
probationary condition for a period of five (5) years:
During the probationary period, Perkins shall not receive any
disciplinary action for breach of student/educator boundaries
from any school district he is employed. “Disciplinary
action” is defined as any termination, suspension, or public
reprimand issued by any school district in the
Commonwealth of Kentucky and upheld, if requested, by
either a tribunal and/or arbitration process. If Perkins fails
to satisfy this condition, Certificate Number 201163830
shall be automatically suspended pending review and
disposition by the Board.
Perkins is aware that should he violate KRS 161.120, either
during or following this five-year probation, the Board shall
initiate new disciplinary action and seek additional
sanctions.

17061178 Rana Brown Accept Agreed Order stating Certificate Number 201197848
has expired. Brown is not currently teaching and has no
plans to return to the profession. Brown shall neither apply
for nor be issued any teaching, administrative, or emergency
certificate in the Commonwealth of Kentucky at any time in

the future. Any future application submitted by Brown, or
on her behalf, shall be denied.

1703587 Jayson Featherston Accept Agreed Order admonishing Featherston for
exercising poor professional judgment, and for using
physical force to move a student. The Board reminds
Featherston of his ethical duty to take reasonable measures
to protect the health, safety and emotional well-being of his
students. The Board will not tolerate any further incidents
of misconduct from Featherston.
Upon acceptance of this agreement by the Board, Certificate
Number 200212788 shall be revoked for a period of five (5)
years. Featherston shall immediately surrender the original
and all copies of his certificate, by personal delivery or first
class mail, to the Education Professional Standards Board,
100 Airport Road, 3rd Floor, Frankfort, Kentucky 40601.
In addition to any testing and/or educational requirements,
prior to reissuance of Certificate Number 200212788,
Featherston shall provide written evidence that he has
complied with the following:
1. Featherston shall provide written proof that he has
completed twelve (12) hours of training on the
Professional Code of Ethics for Kentucky Certified
School Personnel, as approved by the Board. Featherston
shall pay any expense incurred.
2. Featherston shall provide written proof that he has
completed professional development or training on
classroom management/de-escalation techniques, as
approved by the Board. Featherston shall pay any
expense incurred.
3. Featherston shall provide written proof to the Board that
he has completed an anger management assessment, by
a licensed clinical provider, as approved by the Board,
and is compliant with all treatment recommendations.
Featherston shall pay any expense incurred.
4. Featherston shall provide written proof to the Board from
a Kentucky licensed or certified psychiatrist or mental
health professional that he has complied with a
comprehensive evaluation and is fit to return to the

classroom, presents as capable of performing his duties
as an educator, is not a danger to himself or others, and
is compliant with all treatment recommendations. If the
evaluating psychiatrist or mental health professional
recommends ongoing treatment, Featherston shall
provide the Board with written quarterly reports,
beginning three (3) months after reinstatement, that he is
compliant with all treatment recommendations and is not
a danger to himself or others. Featherston shall pay any
expense incurred.
If Featherston fails to satisfy these conditions, Certificate
Number 200212788 shall not be reissued until such
conditions are satisfied in their entirety.
Upon reissuance, Certificate Number 200212788 shall be
subject to the following probationary condition for a period
of ten (10) years.
1. Featherston shall receive no disciplinary action from
any school district in which he is employed during
the probationary period. If Featherston fails to
satisfy this condition, Certificate Number
200212788 shall be administratively suspended
pending Board review and disposition.
“Disciplinary action” is defined as any suspension,
termination, or public reprimand issued by any
school district in the Commonwealth of Kentucky
and upheld, if requested, by either a tribunal and/or
arbitration process. If the tribunal amends the
disciplinary action or if Respondent agrees to amend
the disciplinary action through arbitration, the new
disciplinary action if a termination, suspension or
public reprimand shall be considered a violation of
this condition.
Featherston is aware that should he violate KRS 161.120 in
the future, the Board shall initiate a new disciplinary action
and seek additional sanctions.

1803391 Tia Beltz Accept Agreed Order admonishing Beltz for exercising poor
professional judgment. The Board reminds Beltz of her
ethical duty to take reasonable measures to protect the

Board will not tolerate any further incidents of misconduct
from Beltz.
On or before March 1, 2019, Beltz shall provide written
proof to the Board that she has completed a course on

170611128 Brooke Stansbury Accept Agreed Order revoking Certificate Number
000061548 from April 9, 2018 through April 9, 2020, a
period of two (2) years. Stansbury shall immediately
surrender the original and all copies of her certificate, by
personal delivery or first class mail, to the Education
Professional Standards Board, 100 Airport Road, 3rd Floor,
Frankfort, Kentucky 40601.
In addition to any educational and assessment requirements
necessary for certification at the time, Stansbury shall

at an off-campus site. The institution must submit a written request describing the location and
physical attributes of the off-campus site, resources to be provided, faculty and their
qualifications, and a list of courses or programs to be offered.
Summary: Boyce College is requesting approval to offer ED 210, Computers and Media in
Schools, in the computer lab at Englehard Elementary School in Jefferson County. The faculty
member, Dr. Ryan McCoy, is the current principal at Englehard Elementary. The computer lab is
equipped with 24 computers that already have the needed programs. The current computer lab at
Boyce College is not in an enclosed space and would not provide a conducive teaching and
learning environment for this class.

Commissioner’s Recommendation:
The Education Professional Standards Board (EPSB) should approve Campbellsville
University’s request.
Rationale:
Campbellsville University has addressed the identified components of the applicable regulation
in the request. These required components include the location and physical attributes,
qualifications of faculty, and identified courses to be offered at the off-site location.
Campbellsville University can provide the necessary resources, advisement, and faculty to
support the additional off-site location. Candidates will have full access to instructional and
technological resources.

Should the EPSB approve Campbellsville University’s request to offer programs at an off-site
location?

History/Background:
Existing Policy: 16 KAR 5:010, Section 28, requires EPSB approval for off-site and online
programs established by educator preparation providers. The regulation requires educator
preparation providers to seek approval from the EPSB before offering courses or whole programs
at an off-campus site. The institution must submit a written request describing the location and
physical attributes of the off-campus site, resources to be provided, faculty and their
qualifications, and a list of courses or programs to be offered.
Summary: Campbellsville University is requesting approval for one off-site campus. The off-site
location in Garrard County is requested in order to offer the School Principal certification
program at the Garrard Education Center (GEC) in Lancaster. The GEC is the former Garrard
Middle School. Resources available at the GEC include a distance learning lab, two computer
labs, a classroom set of chrome books, and online access to Campbellsville University’s main
campus library. The identified classroom is a typical high school classroom with desks, a
projector and interactive screen. Campbellsville University will employ two faculty who will be
co-teaching the campus-based courses, while the online courses will be taught by Campbellsville

University graduate faculty. This request is the result of a partnership with Garrard County Public
Schools to create a “Grow Your Own” effort with the school district.

History/Background:
Existing Policy: The requirements for administrative preparation and certification are
currently divided among five regulations: 16 KAR 3:010, 16 KAR 3:020, 16 KAR 3:030,
16 KAR 3:040, and 16 KAR 3:050. In August 2016, the EPSB became a partner with
Western Kentucky University and the Green River Regional Educational Cooperative
through a Wallace Foundation Grant for improving principal preparation. The University
Principal Preparation Initiative (UPPI) Grant focused on updating state policy and
practice related to effective principal preparation. The UPPI stakeholder group brought
together all related organizations for principal development, preparation, and professional
training to review the regulation on principal preparation, as well as other educational
leadership regulations. At the February 12, 2018 meeting, at the recommendation of the
UPPI stakeholders, the Board approved the adoption of the Professional Standards for
Educational Leaders (PSEL) as the updated standards for all educational leadership
preparation programs in Kentucky. These national standards articulate the knowledge and
skills expected of school leaders.
Summary: The full recommendations from the UPPI stakeholder group were approved
by the Board at the August 20, 2018 meeting. 16 KAR 3:090, incorporates the
recommendations of the UPPI stakeholders into one regulation for Advanced Educational
Leadership. That regulation is before the Board for a second reading. This repealer will
repeal 16 KAR 3:010, 16 KAR 3:020, 16 KAR 3:030, 16 KAR 3:040 and 16 KAR 3:050,
when the new regulation becomes effective.

Summary: At the October 8, 2018 meeting, the Board reviewed the proposed regulation
16 KAR 3:090, Certifications for Advanced Educational Leaders. The proposed
regulation incorporated the recommendations of the UPPI stakeholders into one
regulation for Advanced Educational Leadership. The proposed regulation generated a lot
of discussion around the inclusion of flexibility for educator preparation programs to
admit principal candidates who had not yet received their Rank II. Therefore, staff is
bringing two versions of the proposed regulation for Board review and potential action.
The first regulation requires all candidates for admission to advanced educational leader

programs to possess a Rank II. The second allows flexibility for educator preparation
programs to admit principal candidates who have not received their Rank II. A copy of
the proposed regulations will be provided with the addendum materials.

KENTUCKY DEPARTMENT OF EDUCATION STAFF NOTE Action/Discussion Item: Request for SARA Approval for Liberty University’s School Counselor Programs Commissioner’s Recommendation: The Education Professional Standards Board (EPSB) should approve Liberty University’s submitted programs. Rationale: Liberty University submitted written evidence of compliance with EPSB’s requirements under the State Authorization Reciprocity Agreement for program approval. Action Question: Should the EPSB approve the educator preparation programs submitted by Liberty University?
Applicable Statute or Regulation: KRS 161.028, KRS 161.030, 16 KAR 3:060, 16 KAR 5:020, 16 KAR 8:010, 16 KAR 8:020 History/Background: Existing Policy: Beginning December 1, 2016, Kentucky became a member of the State Authorization Reciprocity Agreement (SARA). This agreement among member states, districts and territories establishes comparable national standards for interstate offering of postsecondary distance education courses and programs. It is intended to make it easier for students to take online courses offered by postsecondary institutions based in another state. SARA is overseen by a National Council and is administered by four regional education compacts (i.e, SREB). In order for the Board to approve educator preparation programs that are NC-SARA members, located out-of-state and offered exclusively online, the educator preparation program has to demonstrate compliance with the applicable Kentucky requirements. To date, the Board has approved three out-of-state universities through the SARA process. Summary: Liberty University is requesting approval for the following programs:
Provisional School Counselor – Master’s for Rank II; Master’s for Rank I Standard School Counselor – Certification only School Counselor – Planned 5th year program for Rank II (rank change only) School Counselor – Planned 6th year program for Rank I (rank change only)
Liberty is currently NCATE and SACS accredited. As evidenced by the application, Liberty University is recognized to grant degrees by the Virginia Board of Education. The M.Ed. in School Counseling program is accredited by the Council for Accreditation of Counseling and Related Educational Programs (CACREP) and requires a 3.0 GPA for admission. The M.Ed. program is a 48-hour degree program that includes 15 hours of advanced education core courses,

24 hours of coursework specific for school counseling, and 9 hours in clinical practice including internship experiences at both the elementary and secondary level. The 21st Century Skills of critical thinking, communication, creativity, and collaboration are assessed at Gate 2 (formal admission into the M.Ed. in School Counseling program). During the internship, candidates seeking Kentucky licensure will review the Professional Code of Ethics for Kentucky School Certified Personnel. Candidates are assessed on the following dispositions: social responsibility, commitment, reflection, integrity, and professionalism. Candidates complete self, site supervisor, and faculty supervisor assessments of dispositions. Budget Impact: There is no budgetary impact. Commissioner’s Recommendation:
The Education Professional Standards Board (EPSB) should approve the guidelines to
assist educator preparation providers (EPPs) in obtaining approval to perform proficiency
evaluations.
Rationale:
16 KAR 5:030, Proficiency Evaluation, identifies the requirements for EPPs to develop a
process by which an EPP may evaluate an educator seeking certification to recognize
competency and proficiency. The guidelines outline the process by which the EPPs
submit and have the Proficiency Evaluation plans approved.

Existing Policy: 16 KAR 5:030, establishes the regulatory requirements for proficiency
evaluations. The regulation was first established in 1975, and was recently revised in
2018. Kentucky Statutes require that educators and other professional school personnel
hold certificates of legal qualifications for their respective positions to be issued upon
completion of programs of preparation. The traditional means of recognizing competency
and proficiency for educator preparation is by earning academic credits. 16 KAR 5:030
provides an alternative means for recognizing competency and proficiency other than
academic credit. The regulation requires that an EPP submit a plan for Board approval
that sets forth the process by which they shall conduct proficiency evaluations.
Summary: The guidelines were drafted by staff to establish a process by which EPPs
submit their documentation for approval. The guidelines are included for Board review
and approval.

Education Professional Standards Board Proficiency Evaluation (16 KAR 5:030) Guidelines
Approved:_______________ Background The traditional means of recognizing competency and proficiency for educator preparation is by earning academic credits. This administrative regulation provides an alternate means for recognizing competency and proficiency within an educator preparation program (EPP) approved by the Education Professional Standards Board (EPSB) for initial certification, another certification area, endorsement, or extension. The EPP may only conduct proficiency evaluations for existing, EPSB-approved EPPs. When conducting a proficiency evaluation, the EPP may assess proficiency by considering any of the following factors: previous education; comparable experience; or proficiency assessment at a level comparable to the usual requirements in the content area in which the educator is seeking certification.
Submitting an Application • An EPP should notify EPSB of the its intent to conduct proficiency evaluations by submitting an email to

evaluation to assess a candidate’s attainment of the applicable educational program standards
Plan Components • Identify the programs for which the EPP plans to conduct proficiency evaluation • Describe the process for evaluating a candidate’s proficiency • Identify the assessment used to measure the performance-based standards (must be comparable to
currently approved program) • Identify the requirements for admission (16 KAR 5:020) and completion; educators holding a valid

Rationale:
In light of the EPSB’s August 20, 2018 waiver of the Rank II requirement, this waiver
will provide Educator Preparation Providers (EPPs) with more flexibility to develop
programs that address the professional development needs of teachers and districts.

Should the EPSB waive the program requirements in 16 KAR 5:010, Section 12 for
master’s degree and 5th year non-degree programs for Rank II?

and program curriculum for any education master’s program or planned fifth-year

Summary: To allow more flexibility in the creation of programs leading to Rank II, a
waiver of 16 KAR 5:010, Section 12, is necessary for EPPs. This waiver will allow EPPs
in Kentucky to develop and earn EPSB approval for innovative programs to address
teachers, schools, and district’s professional development needs.
Budget Impact: This waiver will require resources, including staff, to facilitate the
review process of additional programs.

Existing Policy: 16 KAR 5:060, identifies the International Reading Association
Standards 2010: Middle and High School Content Classroom Teacher, as a requirement
for each middle school, high school, Grades 5-12, and Grades P-12 certification program.
While founded as the International Reading Association (IRA), the association’s name
was changed to the International Literacy Association (ILA) a few years ago. When 16
KAR 5:060 became effective, the standards that existed were the 2010 version. In August
2018, the association released the 2017 version of the Standards for the Preparation of
Literacy Professionals.
Summary: A waiver of the current regulation is necessary for EPPs to begin realigning
their programs with the 2017 version of the ILA standards, while staff revises 16 KAR
5:060 to reflect the new standards.

least three (3) years of teaching experience as a certified educator.
Summary: UK has requested that one of their student teachers be placed in Ms. Bonnie Lewis’
classroom in the Spring 2019. At that time, Ms. Lewis will have two and one half of the required
three years of teaching experience as a certified educator. According to the attached letters of
support, she has proven to be an exceptional teacher and she demonstrates the qualifications that
UK requires for their student teachers. Also, she has demonstrated a high degree of competency
in her practice and the qualities needed for mentoring.

Stephens.
Action Question: Should the Education Professional Standards Board approve the request that the
requirements of 16 KAR 2:120 be waived for a second issuance of an emergency
certification?

History/Background:
Existing Policy: The regulation only allows issuance of a subsequent emergency
certification under two circumstances:
1. The emergency certificate was issued after February 15 of a school year; or
2. The emergency certificate was issued for less than fifty (50) percent of the
person’s class schedule
Summary: Magoffin County Schools has not been able to find a fully certified teacher
for Agriculture. Nicholas Stephens was emergency certified for this area during the
2017-2018 school year. He is currently working with Murray State University through
the Proficiency Evaluation process, but Murray is unable to recommend him for the
certification until he completes coursework that he is enrolled in currently.

Action Question: Should the Education Professional Standards Board approve the request that the
requirements of 16 KAR 2:120 be waived for a second issuance of an emergency
certification?
Applicable Statute or Regulation: KRS 161.010, KRS 161.028, KRS 161.030, 16 KAR 2:120
History/Background:
Existing Policy: The regulation only allows issuance of a subsequent emergency
certification under two circumstances:
1. The emergency certificate was issued after February 15 of a school year; or
2. The emergency certificate was issued for less than fifty (50) percent of the
person’s class schedule
Summary: Woodford County Schools has not been able to find a fully certified teacher
for Agriculture at the middle school. They have had six teachers in eight years. Katlynn
Brown was emergency certified for this area during the 2017-2018 school year. She has
completed the required certification program through the University of Kentucky, but is
lacking the passing test scores to be certified.

Summary: Bridgett Duke is currently enrolled in the University of Kentucky’s (UK)
Visually Impaired certification program, but has not completed the required 9 hours from
the program to qualify for a Probationary Certificate. Kentucky School for the Blind
(KSB) is requesting that she be allowed a second emergency certification for the current
school year while she continues her program at UK. KSB will apply for the Probationary
Certificate following this school year. Ms. Duke was previously emergency certified in
Art during the 2015-2016 school year in another district.

Action/Discussion Item: 16 KAR 2:010. Request to Waive Grade Level Restrictions for three Bell County Middle
School Teachers: Sarah Napier, Clifton Caldwell, and Lisa Hall.
Action Question: Should the Education Professional Standards Board approve Bell County’s request that
the grade restriction requirements of 16 KAR 2:010 be waived and allow these three
teachers to teach their content area to 4th grade students?

History/Background:
Existing Policy: 16 KAR 2:010, restricts middle school teachers with Grades 5-9
Certification to teaching the content area to students in the 5th- 9th grades.
Summary: Bell County has a K-3 primary and 4-8 middle school structure within their
K-8 configured schools. Due to the scheduling of the periods, the district needs the
middle school teachers to be able to teach their content to 4th grade students for one
period a day. Bell County has made this request for the past several years as their K-8
elementary teachers have reached retirement. The small enrollment at these schools
prevent the schools from hiring additional elementary certified teachers. The middle
schools are on a seven period day, and without this waiver, Bell County is only able to
utilize these middle school teachers for four periods of their instructional day. If these
teachers are able to teach their content to 4th grade students, it allows for an additional
period of content instruction.

Action/Discussion Item: 16 KAR 3:010. Request to Allow Other Administrative Experience to Meet
Requirements for Issuance of Superintendent Certification for Joshua Hatfield.
Action Question: Should the Education Professional Standards Board approve the applicant’s request to
allow previous “other” administrative experience to meet the requirements for issuance of
the superintendent certification?
Applicable Statute or Regulation: 16 KAR 3:010
History/Background:
Existing Policy: 16 KAR 3:010(1)(c) requires applicants for superintendent certification
to have two (2) or more years of certified administrator experience in a position of school
principal, supervisor of instruction, guidance counselor, director of pupil personnel,
director of special education, school business administrator, local district coordinator of
vocational education, or a coordinator, administrator, or supervisor of district-wide
services, prior to issuance of the superintendent certification. Other administrative
experience may be substituted for this requirement with the approval of the Board.
Summary: Joshua Hatfield completed an Education Specialist degree at Lincoln
Memorial University in 2014, which resulted in superintendent certification in Tennessee.
He has since completed a Doctorate in Educational Leadership at the University of the
Cumberlands. During his time at the University of the Cumberlands, Mr. Hatfield served
in a director role for three years. Mr. Hatfield also provided verification of six months
experience as a grant director at Hazard Community and Technical College, and one year
as special education department head at Somerset Independent Schools.
