Minutes of the Ordinary Monthly Meeting of Lockhart Shire Council held in the Council Chambers,

Green Street, Lockhart on Wednesday, 17 December 2014 at 5:03pm.

PRESENT

Cr P. Yates (Mayor), Cr R. Schirmer (Deputy Mayor), Cr J. Morgan, Cr R. McDonnell, Cr D. Douglas, Cr G. Driscoll, Cr G. Verdon, Cr J. Paterson and Cr M. Day.

Also in attendance were the General Manager, Director of Engineering and Environmental Services and the Director of Corporate and Community Services.

The meeting opened with a prayer.

RESOLVED on the motion of Cr Verdon and Schirmer that the Minutes of the Ordinary Monthly Meeting held on Monday, 17 November 2014 as printed and circulated be taken as read and confirmed.

LEAVE OF ABSENCE

Cr Schirmer sought Leave of Absence for the February 2015 Council Meeting.

RESOLVED on the motion of Crs McDonnell and Paterson that Cr Schirmer be granted Leave of Absence for the February 2015 Council Meeting.

INTERESTS Cr Yates - Pecuniary Interest, Item 12, Development Applications.

PRESENTATIONS The Mayor welcomed Mrs Myra Jenkyn and Mrs Sylvia Mulholland from the Lockhart Progress Association to the meeting, who presented to Council a plaque in relation to the time capsule sunk on Australia Day 2014. The Mayor then welcomed Ms Danielle MacKenzie from Council’s Auditors, Crowe Horwath Auswild, who presented the completed audit of Council’s Financial Statements for year ending 30 June 2014 and responded to questions.

Lockhart Shire Council Ordinary Meeting – 17 December 2014

MAYORAL REPORT

The Mayor, Cr Yates, verbally reported on activities during the past month as follows: Tues, 18 Nov Along with Councillor Schirmer and General Manager Rod Shaw, met with

members of the Greater Hume Shire Council in regards to Fit for the Future.

Fri, 21 Nov Participated in a radio interview with ABC New South Wales Breakfast Show, Sydney in regards to the launching of the new AC/DC album.

Also attended a REROC Executive meeting. Sun, 23 Nov Attended the launch of the new AC/DC album, Rock or Bust, at The Rock.

A number of Lockhart Shire Councillors were also in attendance. Fri, 28 Nov Together with the General Manager Rod Shaw and Councillor Schirmer,

attended a breakfast meeting with representatives from Wagga Wagga City Council.

Sun, 7 Dec Attended Member for Wagga Wagga, Daryl Maguire’s 15 Years in

Parliament celebrations. Tues, 9 Dec Along with General Manager Rod Shaw, attended a REROC meeting and

workshop with the OLG regarding the requirements of a Pilot Joint Organisation. In the evening, together with Councillors Driscoll, Paterson and Verdon attended The Rock Central School presentation evening.

Thurs, 11 Dec Along with General Manager Rod Shaw attended the Mayor of Urana Shire Council’s Christmas drinks.

Sun, 14 Dec Together with Councillors Day, Morgan and Paterson and General

Manager Rod Shaw, discussed the Australia Day Awards for 2015. Mon, 15 Dec Along with Councillor Schirmer and General Manager Rod Shaw, attended

a REROC Board meeting, then together with Lockhart Shire Directors and a number of Councillors, attended an Information Workshop regarding the establishment of a Pilot Joint Organisation.

Along with Councillor Day, attended the Lockhart Central School Presentation evening.

Tues, 16 Dec Attended the CSU Graduation Ceremony for the Faculty of Science Awards on invitation. Also attended on the day our daughter’s graduation.

321/14 RS/CF Section 355 Committee Merger Council endorsed the merger of The Rock Hall Section 355 Committee with The Rock Historical Society to create The Rock Hall and Museum Section 355 Committee.

320/14 RS Fit for the Future Workshop 1. The notes of the workshop held on Thurs, 6 Nov

2014 endorsed 2. Specifically, Council:

a. Have discussions/talks with neighbouring Councils namely Wagga Wagga, Greater Hume, Urana and Narrandera

b. Recognise the financial considerations that will need to be considered with regards to Own Source Revenue and being sustainable into the future

c. Acknowledge that the actions to be taken from the Workshop will be a preamble to wider community consultation

d. Acknowledge that further reports will be presented as information comes to hand with the possible need for an extraordinary meeting to be held in Jan 2015.

319/14 RS Status Report/Précis of Correspondence Issued In reference to Minute No. 172/14, The Rock to Boree Creek Rail Line – The General Manager write to Grain Corp requesting advice about the priority of the branch line in their future plans.

315/14 RS Minutes of the Tourism/Economic Development Steering Committee Meeting - AC/DC Album Launch at The Rock TEDO to be applauded for her efforts in working with Sony Music to secure AC/DC’s worldwide album release at The Rock.

TEDO informed of Cttee’s sentiments. Complete.

312/14 RS Minutes of the Tourism/Economic Development Steering Committee Meeting – The Rock Museum The Rock Hall and Museum Committees merge as a Section 355 Committee.

309/14 RS Notice of Motion – Potential Diesel and Petrol Shortage Council to express its dissatisfaction with this situation by letters to the appropriate Minister and Local Member of Parliament and request advice about how the issue is being addressed at the national level.

308/14 DW Notice of Motion – Policy for Keeping of Livestock in Residential Areas a) Council to create a draft policy for the Keeping of

Livestock in Residential Areas, based on the Griffith Shire Council Keeping of Animals Policy, with inclusion of Clause 6.1 from the Forbes Shire Council Keeping of Animals Policy

b) Draft policy to be brought to Council prior to being referred to the public for comment.

307/14 RS Mayoral Report December Council Meeting to be moved from Mon, 15 to Wed, 17 Dec commencing at 5.00pm.

Ordinary Council Meeting held 14 October 2014 301/14 CF Greens Gunyah Museum Redevelopment

Council investigate why additional funds to fix floor cannot be sourced from the Museum’s reserves.

Additional works proceeding. Analysis of funds available to be undertaken. All reserve funds already committed.

290/14 DW Proposed Sewer Extension at The Rock Council to determine the details of the focus group meeting about the proposed sewer extension at The Rock

284/14 JC Minutes of the Tourism/Economic Development Steering Committee Meeting - The Legend of the Fairie Tree TEDO, The Rock Progress Association & Council to organise a community consultation meeting prior to any further action being taken.

280/14 RS Out of School Hours Care (OOSHC) a) A committee to be established to investigate the

feasibility of OOSHC to be established within the shire

b) Committee to visit the Tumbarumba Shire Council centre and question shire personnel on how it is run and if it is a viable entity

c) Committee members to be Cr Driscoll, Cr Paterson, Cr Day and GM, Rod Shaw.

Ordinary Council Meeting held 15 September 2014 266/14 DW Country Passenger Transport Infrastructure Grant

Council endorsed a Country Passenger Transport Infrastructure Grant Scheme application for a bus interchange in The Rock

Grant Application Closed 31 Oct 2014. Application submitted.

255/14 RS Community Strategic Plan Vision, Mission and Values Council to: a) Continue to use its current Vision and Mission

statements embodied in the Community Strategic Plan

b) Adopt the new Values as outlined in the report

Work in progress to establish new values into Council documentation.

252/14 RS Community Strategic Plan/Delivery Program Outcomes Proposed measures of Community Strategic Plan Outcomes endorsed - means of measurement of each outcome and establishment of baseline data for each outcome to be done as soon as practicable.

Lockhart Locks Structure has been constructed. Installation in progress.

Ordinary Council Meeting held 18 August 2014 239/14 DW New Subdivision in The Rock

Following conditions to be placed on a Section 88B Instrument on new subdivision in The Rock: a) Lot sizes to remain as per approved Lot Layout

Plan (13 lots) and no further subdivision be permitted

b) Dwellings must be new construction.

CC has been issued. Expect to commence works shortly on site once eastern boundary fence is replaced.

Council to proceed with property sale. Final maintenance works in progress prior to being marketed Property now being marketed.

200/14 DW Fixing Country Roads - State Government Funding Initiative Council’s priority list of projects to be submitted as an EOI is as follows: 1) The Rock Road - from Ford St to Vincents Rd, 5km

and major culvert upgrade, $1M 2) Grubben Rd - from Shire boundary to Eulensteins

Ln, 1.5km seal and culvert upgrade, $500k 3) Boree Creek Rd - from Narrandera Rd to Boree

Creek, 12km rehab and widening and culvert upgrade, $2M

4) Urana-Boree Creek Rd - from Yuluma to Shire boundary, 12km rehab and widening and culvert upgrade, $2M, and

5) The Rock Road - from East St to Milbrulong, 12km rehab and widening and culvert upgrade, $2M.

EOI’s submitted 4/8/2014. Transport for NSW has advised that all 5 of our submissions have been accepted to proceed to next stage of application. Information session in Wagga 6 Nov 2014. Next stage to be submitted by 5 Dec 2014.

199/14 DW Request from Lockhart Progress Association Council to support Lockhart Progress Association in installing equipment in Walter Day Park (with Progress to meet ongoing maintenance costs) and ensure a future PAMPS program include establishment of a walking track around Lockhart Pondage and extended behind Galore St to meet the Pastoral Shadows track.

Letter sent. Equipment ordered. Equipment has been installed. Complete.

183/14 RS Rural Fire Service Communication Licence Council to execute the licence agreement with NSW Police Force for co-use of communications equipment for RFS under seal of Council. Letter requesting clean copy of agreement to be sent.

172/14 RS The Rock to Boree Creek Rail Line Council to investigate all avenues to have The Rock to Boree Creek Rail Line upgraded to Heavy Weight Rail so grain wagons can be loaded to maximum axle weight.

Letters sent – work in progress. 1st priority in our EOI for State Government $20B Infrastructure Fund.

Ordinary Council Meeting held 17 June 2014 159/14 RS/CF Proposed NBN Facility at Lockhart Recreation

Ground a) Council to accept the proposed agreement with

NBN Co for NBN Co to remove the existing flood light tower at the Lockhart Recreation Ground and replace it with a similar facility in approximately the same location with Council’s floodlights attached

b) NBN Co payment of $20,000 to be placed into reserve for future Lockhart Recreation Ground improvements

Letter sent – DA from NBN to follow. DA received, public exhibition has closed. DA being assessed. DA has been approved.

Ordinary Council Meeting held 19 May 2014 135/14 DW Planning Proposal Amendment No. 1 – Amendment

to the Lockhart Local Environmental Plan 2012 a) Planning Proposal – Amendment No. 1 to the

Lockhart LEP 2012 to be adopted as exhibited b) Amended document to be forwarded to the Dept of

Planning & Infrastructure with a request to draft and finalise the Planning Proposal.

Letter sent to Dept Planning 26/05/2014. Has been some dialogue back and forward with DoP tidying up some details. DoP has been in contact and just finalising new maps. Would appear fairly close to being finalised.

118/14 RS Rural Fire District Service Agreement a) Council advise Coolamon Shire that a further

meeting with the Riverina Zone Manager is required and the points raised by Coolamon be the basis for an agenda at that meeting.

b) The new Zone Agreement not be signed until adequate responses are obtained from the Zone Manager.

114/14 JC Wall/Walk of Fame Selection Criteria TEDSC on completion of review will make presentation to Council.

Ordinary Council Meeting held 17 March 2014 89/14 DW Greens Gunyah Museum Redevelopment

Tender by Stephen Lawrence Constructions Pty Ltd for the redevelopment of Greens Gunyah Museum for the price of $369,148 (excluding GST) be accepted.

Works substantially complete on new building. Works still to be undertaken on old building. Works now close to be completed with minor matters being undertaken.

87/14 RS Report on Council Housing a) Sell the property at 1 Ferrier St, Lockhart, after

vacated by current tenant and minor works & maintenance as recommended by undertaken

b) Sell the property at 13 Rockcliff Crt, Lockhart c) Set a price range and floor price for each property,

and if an offer is received within the set parameters, Mayor & GM be delegated authority to jointly accept such offers.

d) Attach the Common Seal to appropriate documentation.

13 Rockliff Crt being marketed. 1 Ferrier St subject to further report in July CM.

75/14 DW Lockhart Caravan Park A full review to be undertaken as at the end December and reported at Feb 2015 Council meeting.

A new manager has commenced. Report for February 2015 meeting.

74/14 DW Street Trees Policy Council to enhance its Street Tree Policy to include parameters and guidelines on street tree removal, policy to be endorsed by Council and go on public exhibition.

An enhanced policy to be brought to a future meeting.

67/14 CF Section 355 Committees a) Consider funding for those S355 Committees

currently not receiving funding b) Communicates with each S355 Committee

regarding maintenance required now and into the future

c) Review Policy 1.11 Section 355 Committee functions

a) progressing as part of budget process. Budget allocations approved. b) to be communicated when send annual information to committees. c) form part of ongoing Policy review program.

DW Cr Douglas - Request to Revisit Keeping of Livestock in Residential Areas Requested Council again revisit consideration of a policy given situation in Pleasant Hills. Noted Forbes & Griffith Councils have policies. Requested report at November Council meeting on a proposed policy.

DW Cr Driscoll - Damage to edge of bitumen in front of The Rock Preschool The Rock Preschool Operator approached Cr Driscoll re. damage to edge of bitumen from trucks working on the preschool.

Site has been inspected. Works to grade and repair shoulders being arranged to occur shortly.

DW Cr Verdon - Request for Additional Signage, Urana St, The Rock Requested DEES investigate possible additional signage be installed to stop non-local vehicles from entering Urana St service roads in The Rock.

Signs have been ordered.

DW Additional Signage (Chevron to be installed at intersection of Lockhart-The Rock & Vincents Rds) DEES to investigate and take appropriate action.

Sign has been ordered. Sign installed. Complete.

DW Cr Morgan - Linemarking Wagga Road Noted there was no fog line linemarking on section of widened road.

DW to arrange for “sticky stomps” to be replaced prior to line marking anticipated for later this year.

DW Cr Paterson - Level Crossings at The Rock Enquired as to when the level crossings at The Rock will be completed?

DW will monitor and touch up as required until sometime in Oct when temperature is sufficient to seal the pavement. Pavement sealed. Complete.

RS Cr Verdon - Library Grant Asked if recent $16,000 Mobile Library Grant funds allocated to Lockhart Shire Council could be used to install an e-terminal in the Council Administration Building for residents to access Riverina Regional Library services?

Had discussions with State library reps – currently being considered by them Grant approved – e-terminal to be installed.

CF Cr Verdon - Paying Rates Has Council considered offering an incentive to residents who pay Rates in full in one transaction?

CF to investigate if there would be a benefit in Council doing this. Report in progress. Report to Dec-14 CM. Complete

DW Cr Douglas - Recycling Depot Could Council seek funding from property owner to assist with providing all-weather access to site?

DW Cr Paterson - Horse in Yerong Creek Resident in Yerong Creek has approached Cr Yates about the horses in Yerong Creek.

Staff Reports General Manager 1. SHIRE ENTRANCE SIGNS (GM/R40-090)

Executive Summary Request for further consideration of timing of this project. Report Council agreed at its August Council Meeting to allocate $27,000 for shire entrance signs, having discussed this possibility several times previously. To recap, the allocated funds were for signs at 6 locations on regional roads throughout the shire and the Olympic Highway. Some design work has already been carried out, being modelled after various other shire’s signs gathered during research for the project. The timing of the project is now a matter of conjecture with the current boundaries of the shire now in question following the FFF proposals announced by the State Government. It may seem to be unwise expenditure at this point in time until the outcomes of the FFF proposals are completed. This will probably not be for another 12 months. Although the signs project will be an aid for tourism, it is more a ‘nice to have’ rather than ‘necessary expenditure’, and it won’t matter if it is delayed until our shire’s future is more settled. I would propose that the project is put on hold until the FFF proposals in relation to our shire are known and then referred to the following year’s budget for allocation. Integrated Planning and Reporting Reference B5.1.2 - Ensure high quality signage throughout the shire.

The project is currently on hold pending discussion at this council meeting about two issues: 1) A meeting with the consultants has raised some doubts about the veracity of some of the costs

contained in the feasibility study. The consultants have been asked to update their study and also to provide additional options which may be more favourable from a cost perspective. These need to be substantiated and further discussed prior to community consultations being proceeded with. The consultants have indicated this new information will be available by end of January.

2) The current Fit For the Future (FFF) proposals have indicated, among other things, that Council’s Own Source Revenue (OSR) percentage is much lower than the 60% expected by the Office of Local Government (OLG), and that to reach this percentage will require increases to our rate revenue. The prospect of general rate increases as well as additional sewer rates for The Rock community may be a higher cost than the community is willing to bear.

For these reasons, I propose that the project be put on hold until further information is received from our consultants, and we have more clarification of our standing in the FFF proposals. Informal discussion with Urana Council has indicated that their position won’t be known until their December Council Meeting. Director of Corporate Services and myself attended a workshop arranged by Office of Local Government to provide advice as to the completion of the FFF templates that all Councils need to complete and return to OLG by 30 June 2015. These are the submissions required after Councils have decided which FFF option they intend to proceed with. Mayor Yates has attended a REROC Executive Meeting about the formation of the REROC Joint Organisation (JO). A Board meeting of REROC is scheduled for Tuesday 9 December followed by a joint Councillor/senior staff REROC meeting on Monday 15 December 2014. Additional modelling of financial future and own source revenue position has been carried out and will be illustrated at the Council Meeting. Further elaboration on the above points will be made at the Council Meeting. Integrated Planning and Reporting Reference E4.2 - Plan for the long term sustainability of the shire. 5. QUARTERLY BUDGET REVIEW – 30 SEPTEMBER 2014 (DCCS/F10-010)

Executive Summary In accordance with the Local Government Act, 1993, a review of Council’s Budget position as at 30 September 2014 has been undertaken and the following is submitted for Councillors consideration. Report General Fund When Council adopted the 2014-2015 Operational Plan Budget in June 2014 Council budgeted for a surplus of $5,048.00. The Budget Review at 30 September 2014 indicated an estimated surplus of $110,061.00 as at 30 June 2015 after taking into account movements in revenue and expenditure for the quarter. The September 2014 Quarterly Budget Review Statement details are following this report. The significant items to note in the budget for the first quarter are as follows: • Increase expense - NSW Rural Fire Service contribution $16,474 1540-2265-0000 • Grant received Lockhart Recreation Ground $39,500 3990-1425-0000 • Grant received Lockhart Museum $70,000 3540-1400-0000 • Increase in Financial Assistance Grant $96,686 1040-1400-0000. Combined Sewerage Fund A review of Council’s combined Sewerage Fund has been undertaken with items to note in the budget for the first quarter are as follows: • Net decrease of Sewer revenue of $9,621.00 8405-1010-0000 to 8405-1050-0000 • Above decrease in revenue has been partly offset by reduction in transfer to Reserves

6. RATES PAYMENT INCENTIVE (DCCS/R10-030)

Executive Summary Council requested a report on whether Council incentives have been considered for residents to pay their rates in full in one transaction? Report The Local Government Act 1993, S562 states: “Annual rates and charges may be paid in a single instalment or by quarterly instalments”. With regards to incentive to pay in full, S563 states: “A council may discount the amount of a rate or charge to such extent as it determines if the whole of the discounted amount of the rate or charge is paid by a date nominated by the council”. In considering whether to provide ratepayers with an incentive in the form of a discount to pay their rates in full, Council needs to evaluate the potential benefits for Council and for Ratepayers. For Council, the potential benefits would be an increase to its cash flow and potential that the nett result would be revenue positive. Any increase to cash flow would be beneficial if the additional cash flow was required in order for Council to meet its obligations to pay creditors in a timely manner. The other benefit would be more funds to invest. This would only be a benefit if the return on additional funds was more than the total amount of discounts. Council would therefore need to recoup the discount by investing the additional cash funds. Currently the average rate of return on all term deposits held by council is 3.44%. On the scenario provided below:

- A Rates Notice assessment of $1,150.00 at a discount of 3%, discount equates to $34.50 - To generate $34.50 from the discounted amount received would require an interest rate return

over 12 months of 3.1%.

So, using the rationale in above scenario with current average interest rate return of 3.44%, any discount greater than 3.3% would be revenue negative to Council. Administratively for Council there would be no benefits or efficiencies, unless all rate payers paid in full, as staff would still be required to process quarterly instalment payments. The potential benefit to ratepayers financially would be the discount provided being greater than return in ratepayers bank account. Administratively, the ratepayer would only have to make one payment instead of four. The question is, would a discount of 3.3% or less be a sufficient incentive for ratepayers to pay in full? Albury City Council provide a discount of 2%. For this year the take up was 0.4%, therefore it would be reasonable to conclude that a 2% discount is not a sufficient enough incentive for ratepayers to pay their rates in full. We are seeking information if other councils provide discount and what the take up is. If we receive any further information we will present at next week’s Council meeting. 7. POLICY REVIEW – HARDSHIP – ELIGIBLE PENSIONERS CONCESSION (DCCS/R10-055)

Executive Summary Review of current policy 2.33 titled “Hardship – Eligible Pensioners Concession”. Report Council currently does not have a clear and informative Pensioner Concession Policy detailing the specific requirements, eligibility and processes to claim the statutory pensioner concession from their rates. A Hardship – Eligible Pensioner Concession policy does exist, but focuses on the financial hardship of pensioners beyond a normal pensioner concession. Although the Local Government Act gives the direction for eligibility and processes, having a Council Policy would not only make this information more accessible and transparent to our ratepayers, but would also deal with the specific issue the Local Government Act leaves up to Council, that being accepting late claims. Circular 07/50 from the Office of Local Government confirmed that Council is entitled to adopt a policy of accepting late claims, put simply, backdating a pensioner concession rebate to apply to previous rating years. Failure to adopt a policy dealing with this matter should result in every late pensioner application claim being referred to Council in accordance with section 579(2) of the Local Government Act. This proposed review to policy states that late claims will only be backdated to the financial year prior to the financial year in which the application is made. This would allow ample time to apply as there are numerous listings informing ratepayers of the existence of the pensioner concession, including on Council’s website, Newsletter and on the actual Rates Notice. The 07/50 circular also states:

“Furthermore, the council should take all reasonable steps to ensure that the application is a bonafide one (e.g. insist upon conclusive proof that the person did in fact permanently reside in the subject premises at the relevant time).”

This requires Council be able to obtain proof that the pensioner was at all times during the period of any late claim, eligible for the concession and also that the premises in question was the pensioners principle place of residence. This time frame would also be in line with most other NSW Councils. In creating this policy, information has been sought from various other Councils’ Pensioner Policies as well at the Local Government Act 1993. PRESENTATION OF COUNCIL’S 2013-14 FINANCIAL STATEMENTS (DCCS/A65-010) Council’s Auditors, Crowe Horwath Auswild, has completed the audit of Council’s Financial Statements for year ending 30 June 2014. The Financial Statements and audit reports form part of Council’s Annual Report. In accordance with Section 419 (1) of the Local Government Act 1993 Council must present its Audited Financial Statements, together with the auditor’s reports, at a meeting of the Council. In accordance with Section 418(3) of the Local Government Act 1993 public notice was given in the Eastern Riverina Chronicle that the Audited Financial Statements and Auditor’s Report would be presented at the Council meeting to be held on 17 December 2014. Summary of Financial Statements Operating surplus before capital grants and contributions: $2.03M Surplus (2013 – $1.33M Surplus). Operating Revenues (excl. capital grants & contributions) 13.8% to $9.55M Operating Expenses 6.2% to $7.50M Cash and Investments 30.2% to $7.54M (2013 - $10.81 million). Council’s decrease in cash holdings is due in part to the Federal Government not advancing any Financial Assistance Grants as has been the practice. Revenue from Rates and Annual Charges 4.4% to $2.86M This represents 28.3% of Council’s total Income from Continuing Operations. User Charges and Fees 22.7% to $286,000 Interest on Investments 21.9% to $335,000 Loans $941,000 balance of loan Land Development $152,000 spent on developing Council’s real estate holdings. Infrastructure, Property, Plant & Equipment $6.11M spent on Roads, Culverts & Footpaths. $640,000 spent on Plant & Equipment. Council’s operating results for the 2013/14 financial year have improved on the previous year’s results. Council’s major works focus for 2013/14 was fulfil its expenditure commitments for the Roads to Recovery Program (R2R). R2R is a 5 year roads program ending on 30 June 2014. With Council’s focus in recent years being reinstating flood damaged roads infrastructure, resources were not available for the R2R program. This required Council to expend 3 years of R2R funding in 2013/14.

For the majority of Council’s other operating activities they have remained relatively unchanged from the previous year. This has placed Council in a strong financial position to meet the future challenges of our community. A detailed analysis of Council’s Financial Statements can be found in the Audited Financial Statements, pages 78-85. A representative of Crowe Horwath Auswild will be in attendance at Council’s December meeting to elaborate on their report and to respond to any questions. Recommendation: That Council endorse the 2014 Audited Financial Statements and Auditor’s Report as presented which has been included in Council’s Annual Report.

Executive Summary Monthly report on Engineering Matters. Background Information (a) Works Report: All three grader crews are working on construction projects, being Alma Park

Road, Urana-Boree Creek Road and MR543 heavy patching and shoulder widening. Grader crews will then proceed with next projects on programme being Halliday Street sealing and gravel various resheets. Osborne-Yerong Creek Road has been sealed and works completed. A marked up programme for the next 12 months will be presented at the meeting. Concrete crew is undertaken footpath works in Green Street West and various pram ramp/footpath improvements throughout the Shire. The old public toilet block in Urana Street, The Rock is set for replacement in March/April 2015. A Development Application has been lodged and the building will be a similar structure however of increased capacity as well as disabled access.

(b) Flood Mitigation: A meeting with LLS and NSW Fisheries to discuss creek vegetation was held

26 November 2014. Refer to attached minutes. (c) Road Safety Officer: Nil to report. (d) Traffic Committee: Nil to report. (e) Lockhart Local Emergency Management Committee: RFS community consultation with

Pleasant Hills community regarding bushfire management was held 5 December 2014. (f) Fleet: Orders have been raised for all fleet replacement programme for 2014/15 as per

Operational Plan. Most new fleet replacement has been delivered with last item due March 2015. Replaced items have been sold via Rundles Auctions with sound results.

10. NOXIOUS WEEDS (DEES/N10-025)

Executive Summary Monthly report on Noxious Weeds. Report Property Inspections Inspections were concentrated on ensuring that follow-up control was completed by property owners whom had initiated control but not completely eliminated the weeds. Other properties were targeted based on past history, particularly if known for the presence of St. Johns Wort, Green Cestrum and Coolatai Grass. The weeds most commonly found were Horehound (Marrumbium vulgare), Bridal Creeper (Asparagus asparagoides), Privet (Ligustrum sp.), Prickly Pear (Cylindropuntia sp.), Wild Radish (Raphanus raphanistrum), Green Cestrum (Cestrum parqui), and St. Johns Wort (Hypericum perforatum).

The dry spring has resulted in a late onset of St. John’s Wort this season, but the recent rain will increase its presence, as well as enhancing the germination of Bathurst Burrs (Xanthium spinosum). 11. PARKS AND GARDENS REPORT (DEES/P10-005)

Executive Summary Monthly report on Parks and Gardens. Report General maintenance Regular duties include inspections of parks and public facilities to remove litter, clean BBQ’s, check for damage or vandalism, clear footpaths and empty public and roadside bins. Most areas undergo inspections twice per week, including Galore Hill, where crews also clean and check the toilet facilities. Contract cleaners attend to the public toilet facilities in Lockhart, The Rock and Yerong Creek.

Playgrounds in the shire are being inspected regularly as per Australian Standards, with any maintenance being noted and completed as necessary. Exercise Equipment The exercise equipment purchased by Lockhart Progress Association has been installed in an agreed upon position at Walter Day Park. The equipment is easily accessible, but has been situated to blend with an existing garden bed so as not to detract from other features of the park. Softfall was installed for the safety of users. Remembrance Day The Cenotaph sites in the shire received a little extra attention in the lead up Remembrance Day, including scheduling of mowing, removal of weeds and debris and the cleaning of gutters. After the flagpoles were refurbished as part of the Cenotaph upgrade at The Rock last year it was agreed to also refurbish the flagpoles at the Lockhart site this year - they were sent away to be powder coated and were reinstalled prior to the ceremony. BBQ’s New electric BBQs have been ordered for Wal Alexander and Walter Day Parks in Lockhart and Stan Galvin Park in Yerong Creek. A single has been ordered for Wal Alexander and double for the other two parks, as per existing facilities. The BBQs will be installed in stainless steel cabinets, the old brick and tile structures will be demolished. Requests to quote on the erection of a new shelter at Stan Galvin Park have been sent out; quotes should be received early in the New Year and construction scheduled soon after. Pools Both pools were handed over to the contractors, Sophie Driscoll and Megan McKenzie, Monday 17 November and opened for business on Tuesday 18 November. Council staff conducted regular vacuuming and water testing and attended to the amenities buildings, gardens and lawns to prepare for handover. Council staff will continue to assist the contractors where necessary to ensure the smooth operation of the facilities. Sculpture Trail The approved position in Cowan Garden is being prepared for the installation of Raeleen Pfiffer’s sculpture, ‘My Waratah’. The growing sculpture trail walk in Lockhart, aims to create a natural walking trail through the town, the existing circular garden bed at the end of Cowan Gardens will showcase ‘My Waratah’. Cowan Gardens is already the home of Keith Simpson’s work, ‘The Good Old Days’ which encourages many people to stop at this site, and the placement of Raeleen’s sculpture will create a link to ‘The 9 Martyrs’ at Walter Day Park. There are currently only two plum trees toward the back of the garden bed at the proposed site, the sculpture will take centre stage, with further landscaping designed around the piece. The Sculpture Trail now extends from Walter Day Park and the Caravan Park at the western end of town and The Pastoral Shadows of Brookong at the eastern end. Green Street, Lockhart The planter boxes have been replanted with Petunia for the summer months. A red and white striped variety was chosen for its festive appearance. Lockhart Recreation Ground After consultation with a member of the Recreation Ground Committee, two large peppercorns have been removed on the western side of the oval. The Rec Ground Committee has plans for this area, but the trees were removed as they had many hollows and were at risk of dropping limbs. The peppercorn in the playground area has also been earmarked for removal for similar reasons. EE Heckendorf Aviary The aviary has been removed; the site was tidied up for use during the Spirit of the Land Festival. A garden commemorating EE Heckendorf will be designed and installed on the site at a later date.

Mowing and Slashing Irrigated areas are being mowed and edged at least fortnightly. Christmas and the hot, dry weather are the main influences on the scheduling of slashing at this time of year. Slashing has already been completed at Pleasant Hills, Munderwadery Cemetery, Milbrulong, Yerong Creek H/way and Lockhart Airstrip. The Rock H/way was completed in the lead up to the AC/DC launch, intersections on Lockhart/Collingullie Road and Narrandera Road have also been completed along with most streets and town approaches. All slashing is scheduled to be completed shortly to avoid the risk of fire. Parks and Gardens The roses in Walter Day Park have been fertilized and mulch with Lucerne hay, dead heading will be scheduled regularly to keep them at their best. Routine irrigation checks and maintenance will continue throughout the irrigation season. Walter Day Park finally has water back on after a lengthy delivery delay of an essential valve. Thankfully the recent rains have already greened the lawns up giving them the head start they need to get back to top condition before the worst of the high temperatures set in. Routine maintenance is being conducted including regular weeding, spraying, pruning, watering, planting of replacement shrubs and mulching. Weed Control Regular weed control is being conducted on Council property including hand spraying and weeding of gardens. Khaki and cathead are coming into season, known problem areas are being monitored and treated. Integrated Planning and Reporting Reference D1 – Infrastructure that facilitates an active community. Executive Summary Under Council’s arrangements with the Museum and Galleries Foundation of NSW, Council’s Museum Advisor, Ms Kim Biggs has presented her 2014 Annual Report. Background Information Council’s Museum Advisor, Ms Kim Biggs, has provided an Annual Report of activities carried out in the year ending 2014. The report completes a busy year for Ms Biggs, who has worked with the Lockhart and District Historical Society Museum Committee and The Rock Hall and Museum Committee to develop and expand their operations. Particular emphasis for the Lockhart committee has been the redevelopment and expansion of the Greens Gunyah Museum, which has been a huge achievement for the Council, the Committee and all of those who volunteered. Another significant achievement has been the formation of The Rock Hall and Museum Committee, who have confirmed a location for a proposed new museum at The Rock, along with a policies to identify core themes and strategic planning activities. 354/14 RESOLVED on the motion of Crs Day and Paterson that the information be noted. 14. POLICY FOR KEEPING OF LIVESTOCK IN RESIDENTIAL AREAS (MES/H10-035)

Executive Summary At its meeting November 2014 Council resolved for staff to draft a new Keeping of Animals Policy in line with Griffith and Forbes Council’s to be brought to Council prior to being referred to the public for comment. Background Information The larger allotment size and rural setting of the Shire and its residential areas is generally encouraging for property owners to house animals on their land for companionship or as a hobby. Occasionally, Council staff receives notification from concerned residents about the health of these animals, or the environment on which they are kept. Dust, odour and escapees are the most common issues raised. In light of these issues, Council staff was requested to present a draft Policy on the keeping of livestock in residential areas. The policy was aimed to provide guidance to property owners and occupiers on keeping on livestock, while maintaining the amenity of the area for other residents. The draft policy, which when displayed for public consultation in 2012, was not well received, and Council thus resolved to not adopt the policy. In an attempt to kerb frequenting issues from repeat offenders, Council requested at its October 2014 meeting to revisit the Policy. Policies referenced during the October meeting from Griffith City and Forbes Shire Councils have been attached to this report, and while they do provide detailed information to residents, Lockhart Shire Council is still faced with the dilemma of having no compliance/ranger staff available to enforce such extensive regulations. Meanwhile, previous requests for Wagga Wagga City Ranger services to extend their current contract beyond companion animals have been declined. At its meeting November 2014 Council resolved for staff to draft a new Keeping of Animals Policy in line with Griffith and Forbes Council’s to be brought to Council prior to being referred to the public for comment. The new draft Keeping of Animals Policy presented is based on Griffith City Council policy as well as Forbes Shire Council and the draft Cootamundra Shire Council policy. Cootamundra’s policy was formulated after extensive community consultation/workshops in its development and at its time of formal Public Exhibition no comments were received. The draft policy has provision for variation of the policy to allow residents to apply to carry animals outside the policy. This allows some flexibility on a case by case basis. In revisiting the Policy, Council must consider its relevance to the Lockhart Shire – the larger block sizes, anticipated level of compliance, the level of service staff employed by Council – these factors play a significant role in determining its success. While stocking rates should be a matter of common sense, with land availability being the determining factor, the proposed new draft policy is predestined to target those who already choose to heavily stock small portions of land. If the policy is to become enforceable, the major issue will be forcing those who already have animals in their possession to de-stock, in order to meet policy requirements. Council remains severely restricted with regards to resources required to adequately enforce and/or prosecute those deemed non-compliant. To provide such a service, Council would have to commit substantial funding towards training, personal protective and handling equipment, legal authorisation, handling/impounding facilities (yards, loading ramps, transport), and in severe cases, measures to permit euthanising of animals.

Previously, in some significant cases, Lockhart Shire Council staff has been required to issue infringement notices to some landholders for improperly keeping stock, or for roaming stock - and often with mixed results. Staff have acknowledged the issuing of notices have had little effect in preventing recurring events, and landholders rarely demonstrated a change in behaviour towards keeping of their animals. Recently, and as an alternative to prosecution, Council staff has operated on the premise that, rather than paying an infringement notice, the offender was better off using that sum of money to apply measures for ensuring future compliance, including purchase of fencing materials. Such an approach has been graciously received, and positive results have been documented. Currently, in instances where high stocking rates or animal are already a cause for concern, neighbouring landholders are swift in notifying Council, Police or the RSPCA of any issues, and these are addressed accordingly on a case by case basis. Council staff currently take a proactive approach and work with the offender(s) to ensure the issues are rectified, and only in specific cases where no reasonable action is undertaken, do Council issue orders under the Local Government Act 1993. Integrated Planning and Reporting Reference D3.2.1 - Clearly define land use requirements and developments in line with State Government Regulations. Legislative Policy and Planning Implications Compliance with noise and odour from keeping animals may be regulated under the Local Government Act 1993. (i) Report, TUMBOOSH Visit, Tues 16 Dec 2014 – Cr Driscoll gave a brief report on the visit to Tumbarumba Council’s TUMBOOSH (Out of School Hours Care facility).

(i) Driveway Repairs to Lions Recycling, Lockhart - Cr Morgan enquired as to status of repairs?

Response - Director of Engineering and Environmental Services DEES advised as it is private access, Council is not responsible and does not undertake these works. DEES has written to John Holland Rail to see if they will take some action, with no word back as yet.

(ii) Status of drainage outside Dulcie McKenzie’s Residence on Spanish Ave?

Response - Director of Engineering and Environmental Services DEES advised he will investigate and take appropriate action.

(iii) Could a 40 km/hr Speed Limit be placed on Green Street, Lockhart CBD Area?

Response – Director of Engineering and Environmental Services DEES advised that all speed zones are set by RMS and that a speed reduction would not be likely. DEES advised he will bring up again with Police at the next Police and Community Consultation Committee meeting.

(iv) Green Street Clock – Cr Morgan advised that the clock in Green St is not working again.

Response – Director of Engineering and Environmental Services DEES advised staff are aware of this and are looking at what can be done as it has been repaired once, but most likely will now need to be replaced. Staff are looking at options.

Cr McDonnell (i) Winning and Crushing of Gravel Status? - Cr McDonnell enquired as to status?

Response - Director of Engineering and Environmental Services DEES advised that four out of five pits have been completed and expects Galore Pit to be undertaken in the New Year.

(i) Rubbish in Backyard of Council House in Ferrier Street – Cr Schirmer advised that Mrs Haberecht believes the rubbish in the backyard of the Council house in Ferrier Street hasn’t been cleaned up and stated she is worried about snakes.

Response - Director of Engineering and Environmental Services DEES advised that as far as he knows it has been cleaned up and a letter was written to Mrs Haberecht.

Post Meeting Note: DEES inspected house on 18 Dec 2014 and confirms all rubbish has been removed, backyard is clean and tidy.

(ii) Flood Marker at Ed Schirmer’s crossing on Hollies Road – Cr Schirmer advised that the

flood marker has blown over.

Response – Director of Engineering and Environmental Services DEES advised he will investigate and take appropriate action.

(iii) Statement – Cr Schirmer stated it is good to be a Councillor, Council works well as a team,

debate is constructive and he congratulated the Mayor on his efforts over the past year.

Cr Douglas (i) Statement – Wished everyone a Merry Christmas and Happy New Year. Stated it was an

honour to serve on Council and he is proud of our Council/Shire.

Cr Yates (i) Statement – Cr Yates stated that he was advised that there could be possible retrenchments

(up to 1,500 people) across the State at Essential Energy in the near future and this could impact on Lockhart EE Depot. If this proves to be true, Cr Yates requested that Council advocate for keeping Lockhart Depot fully staffed.

OPEN COUNCIL The following resolutions of Council, while the meeting was closed to the public, were read to the meeting by the Mayor. 1. AUSTRALIA DAY 2015 (GM/C15-005)

357/14 RESOLVED on the motion of Crs Schirmer and Paterson that Council endorse the recommendations of the Australia Day Committee for the Awards for 2015 and associated matters.

2. RATES REDUCTION FOR RESIDENTS AFFECTED BY FLOOD EVENTS (DCCS/F20-030)

358/14 RESOLVED on the motion of Crs Paterson and Verdon that Council advise the owners of the three properties with assessments numbers 1565-01, 1364-0 and 298-0 that the service charges will revert back to service charges applicable to land occupied with a residence as of 1 July 2015.

3. OUTSTANDING DEBTOR – RE. DIVIDING FENCE (DCCS/A15-010)

359/14 RESOLVED on the motion of Crs Driscoll and Morgan that Council write off the outstanding balance of $600 relating to debtor account.
