MINUTES OF THE MEETING FINANCE AND CLAIMS COMMITTEE MONTANA STATE SENATE April 3, 1979 The 26th meeting of the Senate Finance and Claims committee met in room 108 of the State Capitol Building on the above date. Roll call was taken and the Chairman, Senator Himsl called the meeting-to order at 8:04 a.m. ROLL CALL: All members present. CONSIDERATION OF HOUSE BILL 811: This bill was explained by Representative Porter as the school bus bill. It was heard in the Education committee in the House and in the Senate. I will let Bob Stockton, office of the Superintendent of Public In- struction explain this bill. Bob Stockton, OSPI: This bill funds the school transportation both for bus and for individual transportation, in which the state shares. The funding is 1/3 state, 1/3 county, and 1/3 district. In the Highschool districts the state paid 1/3 and the counties 2/3. This bill increases the bus rates per mile by 5C and the individual is raised from 12C to 18C.. We pay for only one round trip a day. We are actually paying 9C a mile since we pay only one way and only what is over and above the 1 three mile limit on a school. (There is no transportation pro- vided below 3 miles, and this equalizes that part.) If they live 20 miles out we pay for the one trip even though they make two in a day. Senator Himsl: This explains where the money comes from and then says general fund. Senator Story: Part of the money is paid in from the county. Senator Nelson: Do they have to pay core for the contracted busses? Nr. Stockton: It appears on paper that the contract busses are getting a little more than the district busses. The districts depreciate their busses in another fund. I support this bill. There were no further proponents, no opponents, and the hearing was closed following the above questions from the committee. CONSIDERATION OF HOUSE BILL 906: Speaker of the House, Repres- entative Gerke explained the bill. He said this is t h e home- stead tax relief bill. This bill is very popular, I have been told, from all the districts. It is a bill that obviously should be funded fully. The polls indicated people wanted this type of tax relief, the initiative in '76 proved the people do want it. The appropriation is for a little more than $10 million 1 a year.

Bous l iman: The Depa r tmen t o f Revenue r e p o r t s t o u s t h e a d m i n i s t r a t i v e c o s t s f o r 1977 w e r e $196 ,000 and i n 1978 t h e y w e r e $149 ,990 .

S e n a t o r Smi th : What a b o u t t h e costs t o t h e c o u n t i e s ? M r . BousPiman: W e had no way o f g e t t i n g t h o s e f i g u r e s .

S e n a t o r S t o r y : I n t h e s u r v e y t h a t was made a l l t h e c o u n t y t r e a s u r e s combined t h e c o s t was be tween $45,000 and $ 5 0 , 0 0 0 .

S e n a t o r T h i e s s e n : D i d n ' t w e a p p r o p r i a t e a s e t amount f o r t h e a d m i n i s t r a t i o n ? M r . Bous l iman: T h e r e i s a l o t more b e i n g re- v e r t e d t h a n t h e $350,000 r e c e i v e d a n d t h e $750,000 a p p r o p r i a t e d . T h e r e was $15 m i l - l i o n a p p r o p r i a t e d i n 1977 which i n c l u d e d t h e a d m i n i s t r a t i v e c o s t s . The d i f f e r e n c e i n t h e a d m i n i s t r a t i v e c o s t s p l u s t h e r e m a i n d e r n o t s p e n t w i l l b e r e v e r t e d .

CONSIDERATION O F HOUSE B I L L 116: S e n a t o r F a s b e n d e r s a i d h e would c a r r y t h e b i l l f o r R e p r e s e n t a t i v e S o u t h , t h e s p o n s o r . H e s a i d t h a t i n t h e l a s t s e s s i o n w e p r e t t y w e l l o p e n e n d e d s p e c i a l e d . The a c t u a l c o s t s e x c e e d e d t h e amoun t s - - I t was i n - d i c a t e d t h a t some o f t h e t h i n g s t h a t were bad f o r s p e c i a l e d was t h e i n c e n t i v e a n d some of t h e c o s t s s h o u l d b e b o r n by t h e l o c a l s c h o o l d i s t r i c t s . The subcommi t t ee worked on t h i s p r o b l e m and came up w i t h some s p e c i a l b i l l s . The main o n e , HB 116 i s h e r e . Many of t h e s e b i l l s have p a s s e d . T h i s w i l l t a k e v a r i a b l e a l l o w - a b l e costs a n d remove them f rom t h e a l l o w a b l e c o s t s c h e d u l e . M e l i s t e d some o f t h e c o s t s - - s u p p l i e s , c l e r i c a l , e tc . H e s a i d it worked c l o s e l y w i t h S e n a t e b i l l 2 . The c o s t i s i n e x c e s s o f $ 3 m i l l i o n t o p u t back on t h e l o c a l s c h o o l d i s t r i c t s . I n o r d e r t o make t h i s up on t h e a d d i t i o n a l b u r d e n on t h e d i s t r i c t s t h e money w i l l g o t o a l l d i s t r i c t s i n Montana. I t a l l o w s some o f t h e c o s t s t o go back i n t o t h e d i s t r i c t and p u t s t h e r e s p o n s i b i l i t y on t h e d i s t r i c t t o c o n t a i n t h e costs o f t h e s e s e r v i c e s .

S e n a t o r H i m s l : Have you i d e n t i f i e d more h a n d i c a p p e d ? S e n a t o r S t o r y : T h e r e i s no i n c r e a s e , j u s t t h e i r l o c a t i o n . S e n a t o r H i m s l : What i s t h e p e r c e n t a g e o f s t u d e n t s r e q u i r e d t o l i v e o u t o f t h e i r d i s t r i c t s f o r t h i s t y p e of e d u c a t i o n ? Ans. 27%

M r . Branson: T h e r e i s a b o u t 7 % o f t h e p o p u l a t i o n b e i n g s e r v e d . The F e d e r a l Government i s . g i v i n g est imates o f 1 2 % . P u b l i c Law 142 s o l d c o n g r e s s on a 1 2 % f i g u r e . The f e d s a r e saying--we a r e l o o k i n g f o r 1 2 % . Doug Booker, Governor ' s O f f i c e : W e c u t a d m i n i s t r a t i v e s t a f f by approximately 3 8 % . Out o f 459.1 which was recommended by t h e House, we have 29.1 s t a f f and a d m i n i s t r a t i o n . I f it was a 1-1 w e should have 12 .

Sena to r Smith: I am wondering whether t h e f e d e r a l requ i rements are be ing met. Doug Booker: W e a r e meeting t h o s e medicaid s t a n d a r d s f o r reimbursement.

Sena to r Akles tad: I have a l o t of problems wi th t h i s program. How many people a c t u a l l y admin i s t e r ing s e r v i c e t o t h e people were t aken o u t ? Western Montana College needs at least a current level budget to meet the challenge of the Legislature to increase

our enrollment over the next

two

years,

We know that unless we can increase enrollment, w

e will be exposed to the damaging threat of closure aqpfn during

the 1981 legislative session. Unless we have the above general funds in addition to what is included in HB 483, our

chances of increasing enrollment are practically nill.

Because of fixed operating cost increases, serious cuts in

instructional budgets are imminent.
