MINUTES OF THE 421st REGISTRATION COMMITTEE MEETING HELD ON

21.08.2020 (10:00 Hrs) THROUGH VIDEO CONFERENCE.

The 421st Meeting of the Registration Committee (RC) was held under the Chairmanship of Dr.

S. K. Malhotra, Agriculture Commissioner & Chairman, Registration Committee on 21.08.2020

at 10:00 Hrs onwards through NIC video conference. Sh. Rajesh Malik, Director (PP) & PPA;

DR C. D Tripathi, Professor Emeritus, Department of Pharmacology, VMMC and S J Hospital,

New Delhi; Dr. Rajan, In charge ADG (PP) ICAR, Krishi Bhawan, New Delhi; Dr. S. P. Sahni,

(Representative of Drug Controller General of India), New Delhi; Dr. K. K. Sharma, Project

Coordinator MPRNL, IARI, New Delhi; Dr. Vishal Chaudhary, Deputy Industrial Advisor,

Ministry of Chemical and Petrochemical and Dr. J. P. Singh, Secretary, CIB&RC attended the

meeting.

Experts/ Officers from the Secretariat of CIB&RC attended the meeting to present their agenda

and volunteered to provide the assistance during the deliberations were Dr. Sushil K. Khurana,

At the outset, Chairman welcomed the members & experts and asked Secretary, CIB&RC to take

up the agenda for deliberations. The decisions taken by the RC are as under:

1.0 Confirmation of minutes of the 420th meeting of the Registration Committee.

RC deliberated the minutes of 420th RC meeting and confirm the minutes with some

modifications :

1) item no. 2.4 : "The Committee noted the reply of the applicant dated 24.07.2020 wherein the applicant has mentioned that the data generation on the required studies

for registration will be completed by early 2021. Hence, it is decided that the

application may be closed. It may be revived when complete data is generated and

submitted by the applicant."

2.0 Presentation

2.1 Presentation of M/s Anu Products, for the registration of Isoprothiolane Technical

97% Min, Difenaconazole Technical 95% Min. and Fenopxaprop-P-ethyl Technical

88% min under section 9(4) TIM

The presentation was made by the representative of M/s Anu Products Ltd. & deliberated.

It was observed that the issue was same as agenda item no 10.28 of this RC which is the

follow –up of presentations of 420th RC. Therefore, the decision would be same as for

agenda item no 10.28.

2.2 Presentation of M/s Syngenta India Ltd., for the registration of Ametryn 73.1% w/w +

Trifloxysulfruon Sodium 1.8% w/w WG.

The representatives of the applicant made a presentation, and intimated the percentage of

a.i. on which the product Trifloxysulfuron Sodium technical was registered in various

countries. On the query regarding application on minimum 90% a.i. and data submission

on higher a.i. with respect to Trifloxysulfuron Sodium technical the applicant informed

that impurity profile was also tested where no alert was obtained. RC advised the applicant

to submit a copy of presentation to the Secretariat of CIB&RC along with their comments

on impurity profile on no alerts observed. The RC deliberated the case in detail and

decided to approve with subject to the fixation of MRL.

The RC also directed the applicant for submitting a duly filled MRL proforma to Sectt. of

CIB&RC for submitting to FSSAI.

2.3 Presentation of M/s NATCO Pharma for the registration of Chlorantraniliprole

Technical 93.00% w/w.

Representative of the applicant made a presentation of the product Chlorantraniliprole

Technical 93.00% w/w. The committee noted request of the applicant and directed to

complete data requirement on shelf life. Applicant also requested for consideration of the

case with minimal shelf life till the complete data is developed. In processing sampling is

also pending and Secretariat was advised for management for this purpose.

2.4 Presentation of M/s Bharat Petroleum for the registration of Petroleum Derived

Spray Oil (Aromatic free paraffinic oil)

Representative of the applicant made the presentation. Committee noted the request of the

applicant in the category of 9(3b) and further agreed that the matter will be reviewed with

other applicants who has applied for registration of Petroleum Derived Spray Oil

(Aromatic free paraffinic oil) in the same category.

2.5 Presentation of M/s Future Crop Science regarding clarifications/representations for

genuineness of consents from technical consent providers

A presentation was made by the applicant. RC directed the concerned expert to put all

facts along with other similar cases in the upcoming RC.

2.6 Presentation of M/s Crop Chemicals India Ltd., regarding

clarifications/representations for genuineness of consents from technical consent

providers.

A presentation was made by the applicant. RC directed the concerned expert to put all

facts along with other similar cases in the upcoming RC.

3.0 Government Business

3.1 Minutes of the meeting in house working group for “Establishment of minimum

purity in India based on the registration of technical active ingredient by the United

States Environmental Protection Agency (US EPA)”.

RC deliberated the comments received from the stake holders on the report of in house

working group and decided to accept the following recommendations of the group

given as below:-

1. The minimum purity of active ingredient in a technical material may be as per the claim for it by the applicant on FORM I or not below the approved lower certified limit in the

US EPA specifications (CSF). Minutes of 417th RC meeting held on 15.06.2020

2. The maximum content of toxicologically significant and/or relevant impurities shall be same as US EPA approved limit.

3. The maximum content of impurities that are toxicologically non relevant shall be set as following:

o Max. Concentration of impurity in India = US EPA nominal content + 3*SD. o for technical material produced using unique technologies, like fermentation etc, the

concentration of toxicologically non-relevant impurities shall be as per US EPA

nominal + 6*SD to accommodate variability.

4. The applicant shall submit a copy of CSF along with FORM I while submitting the application as mandatory document.

5. Any change in CSF in the source country shall be brought into the knowledge of RC by the applicant by submitting copy of revised CSF for endorsing the revised composition

on CR.

6. A condition on the Certificate of Registration shall be incorporated regarding submission of revised CSF immediately for consideration of the RC as and when

undertaken in the source country.

3.2 Strengthening of preliminary scrutiny of various category of 9(3), 9(3b), 9(3) Export),

9(4) TIM and 9(4) FIM category of applications, preparation of checklist based on

guidelines approved by the RC.

As a follow up action of item 3.2 (3) of the 420th RC the matter was deliberated in detail

and the RC approved check lists for preliminary scrutiny of various categories of

application for immediate implementation. Secretariat is directed to upload all the

approved checklists for preliminary scrutiny on the website.

4.0 Export Cases

4.1 List under section 9(3) Export applications.

Committee deliberated the agenda and approved the case as per Annexure 4.1.1, 4.1.2 ,

4.1.3 & 4.1.4, (expect Sr. No. 45,49,53,60 of Annexure 4.1.1). It was reiterated that the

application of import for export category shall be subject to the decision taken by the

committee in its 356th meeting. It was also directed to strictly follow Gazette Notification

SO 3951 (E) dated 08.08.2018 published on 09.08.2018 of Ministry of Agriculture and

Farmers Welfare while issuing approvals.

6.1 Consideration of an application of M/s Dhanuka Agritech Ltd., for grant of

registration for indigenous manufacture of Quizalofop ethyl 10% EC under section

9(3) (FIM vs FIT).

RC deliberated the agenda and approved for grant of registration of Quizalofop ethyl 10%

EC.

6.2 Consideration of application of M/s ATGC Biotech Pvt. Ltd., for grant of registration

for indigenous manufacture of Gossyplure (SCLP PBW) Technical

RC deliberated the agenda and approved the case for grant of registration for indigenous

manufacture of Gossyplure (SCLP PBW) Technical with provisional registration of four

months since study for shelf life as claimed by applicant is undergoing and data shall be

submitted by January, 2022.

6.3 Consideration of an application of M/s Willowood Chemical Pvt. Ltd., for grant of

registration for Technical Import of Acetamiprid Technical 99% w/w min. under

section 9(3) (TI vs TIM).

RC deliberated the agenda and approved for grant of registration for Technical Import of

Acetamiprid Technical 99% w/w min. under section 9(3) (TI vs TIM) for import

manufactured by M/s Hengshui Northern & Chemical Co. Ltd., Xiaozhang Industrial

Zone, Zaoqiang Country, Hebei Province, P. R. China and supplied by M/s Willowood

(Hangzhou) Co. Ltd., Room No. 2003, Golden Plaza, No 118, Quingchun Road, Xiacheng

District, Hangzhou City, Zhejiang Province, China with shelf life of One Year.

6.4 Consideration of an application of M/s Crystal Crop Protection Pvt. Ltd., for grant of

registration for Technical Import (New Source) for Fomesafen Technical 95% w/w

min. under section 9(3)

RC deliberated the agenda and approved for grant for Technical Import (New Source) for

Fomesafen Technical 95% w/w min. under section 9(3) for import manufactured by M/s

Inner Mongolia Join Dream Fine Chemicals Co. Ltd. (Add. Zhiongcheng Road East, Wuda

Economic Development Zone, Wuhai 016000, Inner Mongolia, China) and supplied by

M/s Hebei Bestar Commerce and Trade Co. ltd., (Add. 6-3-203 No. 66 Dianda Street,

Xinhua District, Shijiazhuang, Hebei, China) with shelf life of two years.

RC further directed the Secretariat of CIB&RC to issue the CR only after receipt of

satisfactory report of NMR spectra of the product.

6.5 Consideration of an application of M/s Crystal Crop Protection Pvt. Ltd., for grant of

registration for indigenous manufacture of Fomesafen 12% + Quizalofop ethyl 3% SC

under section 9(3).

RC deliberated the agenda and approved for grant of registration for Indigenous

Manufacturing of Formulation Fomesafen 12% + Quizalofop ethyl 3% SC for use in

Soybean crop to control Echinochloa colona, Eleusine indica, Dactyloctenium aegyptium,

Digitaria and Cyperus rotundus subject to MRL fixation of Fomesafen in Soybean crop.

The MRL of Quizalofop ethyl is already fixed in Soybean crop. The following cautionary

statement may be added in label and leaflets:

1. The product is highly toxic to Bees exposed to direct treatment and thus should be avoided during active foraging period of bees.

2. The product is moderately to highly toxic to fresh water fish and aquatic invertebrates and may be avoided near aquaculture.

RC further directed the Secretariat of CIB&RC to issue the CR only after receipt of

satisfactory report of NMR spectra of the Technical.

8.0 Online filling of application for registration under section 9(4) FIM/FI/TI.

8.1 Consideration of application for grant of registration for Formulation Indigenous

Manufacture (FIM) under section 9(4).

Committee deliberated the agenda and approved as per Annexure – 8.1.1 of the agenda

except the products covered under the Gazette Notification SO 3951 (E) dated 08.08.2018

published on 09.08.2018. RC directed the Secretariat of CIB&RC that all the cases under

section 9(4) must be issued after confirming the fixation of MRL for the product. It was

also directed to re-check the cases and should strictly follow Gazette Notification SO 3951

(E) dated 08.08.2018 and published on 09.08.2018 of Ministry of Agriculture, Cooperation

and Farmers Welfare while issuing approvals and further decided that CRs will not be

issued till consent letters on original affidavits (hard copy) /Undertaking requirement of

Public Notice dated 23.04.2019 are received in respect of applications where original

consent letters from the technical providers are awaited. If no consent letter on original

affidavit (hard copy) / Undertaking requirement of Public Notice dated 23.04.2019 is

received within 30 days from the uploading of the minutes same will be apprised to RC for

closure of the case. RC further directed the applicants for providing original consent

letters on affidavits (hard copy), where were possible, in lieu of the undertaking

requirement of public notice 23.04.2019 as due to implementation of nationwide unlock.

8.2 Consideration of an application of M/s Phyto Chem (India) Ltd., for grant of

registration of Paraquat dichloride Technical 42% min. for import u/s 9(4).

RC deliberated the agenda and approved the case for grant of registration of Paraquat

dichloride Technical 42% min. for import u/s 9(4) with validity upto 25.01.2021 subject to

submission of original documents such as registration certificate/ certificate of DNA &

consent letter from the source and original affidavit that the applicant does not possess any

certificate of registration for Technical Indigenous Manufacture (TIM). Applicant has to

submit an Affidavit in respect of enhanced purity of the product, latest manufacturing

process, quality specifications, chemical profiling of active ingredient and impurities.

8.3 Consideration of an application of M/s Crystal Crop Protection Ltd., for grant of

registration of Carbofuran Technical 90% w/w min. for import u/s 9(4).

RC deliberated the agenda and asked the Sectt. of CIB&RC to examine veracity of the

approved source as mentioned by applicant in consent letter and put up the facts to

upcoming RC.

8.4 Consideration of an application of M/s Sign Chemical Industries Pvt. Ltd., for grant

of registration of Cartap hydrochloride Technical 98% w/w min. for import only u/s

9(4).

RC deliberated the agenda and asked the Sectt. of CIB&RC to examine veracity of the

approved source as mentioned by applicant in consent letter and put up the facts to

upcoming RC.

RC deliberated the agenda and observed that the applicant has tendered an apology for

including the banned products in the endorsement application. In terms of the apology by

the applicant RC decided to approve the same. However, RC sternly warns the applicant

10.0 MISCELLANEOUS ITEMS

10.1 Report of the sub-committee for approval of laboratory/institution testing facilities

for generating and accepting data for the purpose of registration of pesticides.

RC deliberated the subcommittee report and approved the following recommendations:-

1. Inspection and approval of GLP/NABL accredited laboratories, henceforth, is not required by CIB&RC.

2. Chemistry, residue, persistence and packaging data generated by the GLP/NABL

accredited laboratories/Institutions may be considered for registration of pesticides

subject to approval of testing parameters in the scope of accreditation certificate.

3. While applying for the grant of registration, the applicant should enclose copy of

GLP/NABL certificate of the lab from where chemistry, residue, persistence and

packaging lab data has been generated.

4. For development of better quality of pesticides and making them acceptable

globally, regulatory system should steadily advance towards adopting GLP

practices.

RC further directed the Sectt. of CIB&RC to prepare a updated list of NABL/GLP

accredited labs with their scope and validity and data should only be accepted from those

labs have requisite scope and validity .

10.2 Request for import of sample quantity of product A23213A by M/s Syngenta

Biosciences Pvt. Ltd.

RC deliberated the agenda and closed the application on applicant’s request.

10.3 File received after 413th RC (Agenda Item No. 3.2) decision.

RC deliberated the agenda and decided to close the applications.

10.4 Consideration of application for import permits for boric acid for non-insecticidal

use.

RC deliberated the agenda and approved as per Annexure 10.4.1.

10.5 Consideration of application for import permits multiuse insecticides (other than

boric acid) for non insecticidal use.


10.6 Request received for revival of application.

RC deliberated the agenda and allowed to revive the following applications of label

expansion.

1. 9914-END/2018 2. 9920-END/2018

10.7 Report of expert group for grant of registration for Tricontanol.

RC approved the recommendations of the report submitted by expert group. RC decided

that there is no requirement of consent letter for technical of Tricontanol as the same is not

registered since Tricontanol formulations are directly manufactured from the plant extracts.

RC further decided to form a following expert group to look into the issues related to

agenda no. 9.21 of 399th RC and directed to submit its report within one month.

Committee deliberated the agenda and agreed to consider 0.01 mg/kg as default MRL for

below mentioned case. The default MRL value will be applicable for six months as per

minutes of (item 10.10) 417th RC meeting from the date of uploading the minutes.

Annexure-10.10.1

10.11 Application for import of sample quantity of 26 Liters of IKF-5411 400SC

formulation coded herbicide for RTT purpose of M/s ISK Biosciences India Pvt.

Committee deliberated the agenda and approved for import of 26 Liters of coded molecule

IKF-5411 400SC for RTT purpose.

10.12 Request for permission to do locust control trials with CIB&RC approved chemicals.

RC deliberated the agenda and deferred for further clarification on technical issues.

10.13 Agenda for import of coded molecule A23373A of M/s Syngenta Biosciences Pvt. Ltd.

Committee deliberated the agenda and approved import of 116 L of coded molecule

A23373A for RTT purpose.

10.14 Proposal for assigning of label claim of Chlorantraniliprole 18.3% SC, Fipronil 0.3%

G and Chlorpyriphos 20% EC in Wheat against pink stem borer (Sesamia inferens)

and Army Worm (Mythimna separata) as a special case.

Committee deliberated the agenda and suggested pesticide industry to come forward for

data generation and application according to approved guideline.

10.15 RTT ex-post-facto status on 14.08.2020.


10.16 Consideration of an application of M/s Pioneer Pesticides Pvt. Ltd., for withdrawal of

certificate for manufacturing of pesticides by CIB&RC u/s 9(4).

RC deliberated the agenda and decided to call back the Certificate of Registration issued to

the applicant. RC decided to inform the applicant to immediately surrender the original

Certificate of Registration issued by Secretariat, CIB & RC within 15 days from date of

hoisting of the minutes on CIB & RC website.

10.17 Legal action against applicants for submitting fake affidavit for technical consent.

RC noted the progress made in the matter so for and further directed the concerned expert

to examine the other similar applications and bring facts to the RC.

10.18 Follow up action of decision of 413th RC vide agenda no. 10.49.

RC noted and directed Secretariat to hoist the list of authorized persons provided by the

Company for issuing affidavit of consent for supplying technical grade material on the

website.

10.19 Consideration for closure of applications for registration for which deficiency reply

has not been submitted within the prescribed timelines.

RC deliberated the agenda and decided to give 30 days additional time for responding to

the applicants.

10.20 Request of M/s BASF India Ltd., to re-open the closed file for registration of

Dinotefuran 0.5% RB (gel) formulation for import u/s 9(3).

The Committee noted that study on honey bees as per guidelines has not been submitted by

the applicant and they have requested for waiver. Hence, the Committee decided that the

application may be reopened only when complete data is submitted by the applicant as per

guidelines of the RC.

10.21 Correction in agenda item no. 9.31 of 416th RC meeting in respect of endorsement of

alternate packing for change in primary packing, secondary and transport packing

for Transfluthrin 1% FU application of M/s Godrej Consumer Products Ltd.

RC noted the correction in the agenda item and approved the same.

10.22 Application for grant of validity extension for registered bio-pesticides strain under

9(3b).

RC deliberated the agenda and agreed for closure of the files.

10.23 Technical consent verification of Formulation Certificate issued to 10 companies that

have been identified Fake Case under section 9(4) FIM.

RC noted the status and directed the concerned expert to examine and bring facts to the

RC.

10.24 Revisit current guidelines for registration of pesticides u/s 9(3) and 9(4).

RC deliberated the Agenda and approved revised sub-committee with new composition.

Dr. Archana Sinha, JD (Chem) will continue to remain as a member. RC further decided

that the sub-committee will submit report before 30th September, 2020.

10.25 Status of NMR of 9(3)/9(4) TIM cases.

RC noted the status and deliberated the agenda and decided that in case of the product

samples shelf life is expired, the applicant will make sure to re-submit the sample to CIL

within 10 days from uploading the minutes on the website for early NMR analysis.

10.26 List of free sale certificate application.

RC deliberated the agenda and approved as per Annexure-10.26.1

10.27 List of 9(3)/9(3b) FI/TIM files where deficiencies reply has not been submitted by the

applicant within the prescribed timeline as decided by the RC in its 400th meeting.

RC decided to close the file 4790-FI/9(3)/2014 as the applicant has not responded within

the stipulated time period.

10.28 Follow up action on the agendas of 420th RC meeting and on other agendas in various

RC meetings.

RC directed Secretariat to bring cases with complete facts and presentation may be made in

next RC.

10.29 Consideration of application for import permits for Boric Acid for non-insecticidal

use.

This agenda shifted to agenda item no. 10.4.

10.30 Consideration of application of M/s BASF India Ltd. For registration of

Alphacypermethrin 30g/l + Flufenoxuron 30g/l SC formulation for import u/s 9(3) of

Insecticides Act 1968

The Committee deliberated the agenda in detail and noted the status of registration of the

product in other countries. The Committee noted that Flufenoxuron is banned in EU

countries and Flufenoxuron containing products are not registered in USEPA. Further, this

product is approved for use through Professional Operators in countries where registered

and the applicant inspite of communicating many a times have not submitted intention to

use the product through Pest Control Operators. The Committee was appraised that the

product is not approved under WHO prequalified scheme and that the applicant has not

submitted data as per the decision in 416th RC meeting and instead has again requested for

waiver of studies. Hence, the Committee decided to close the application.

10.31 Follow up status of appeal No.12 of 2019 filed by M/s Spectrum Ethers Ltd. Against

CIB&RC for file No.29-TIM/9(4)/2011-CIR-I.

RC deliberated the agenda and decided to give the last opportunity and applicant may be

asked to submit the deficiency reply within 30 days or else the file will be closed.

10.32 List of closure of files in Toxicology {Consultant (Path)} which are deficient as per

400th RC meeting regarding.

RC deliberated the matter and directed the concerned expert to bring status with complete

facts in the next RC.

10.33 Consideration of application for import permits for multiuse insecticides (other than

Boric Acid) for non-insecticidal use.

This agenda shifted to item no. 10.5.

10.34 Online applications of FIM 9(4) were deliberated in 414th, 415th, 417th & 418th RC

agenda.

RC noted for the list of 414th, 415th, 416th, 417th & 418th RC agenda regarding details of

technical consent providers at Annexure 10.34.1, 10.34.2, 10.34.3, 10.34.4, 10.34.5

10.35 Follow up action of 420th RC agenda item No.3.3 report of the in-house committee on

objections/suggestion received from the stack holders on draft Gazette Notification

SO 531(E) dated 31.01.2020 regarding banning of Tricyclazole and Buprofezin

The RC perused the report of the sub-committee, and deliberated it in detail and accepted

the recommendations for onward transmission to DAC&FW.

11.0 Any Other item

11.1 Amendments of labels and leaflets as per Insecticides Rules 1971 vide notifications

GSR 782 (E) dt 14.10.2020 and GSR 355(E) dt 05.06.2020.

RC deliberated the issue and observed that in view of the Central Government had

published gazette notification GSR 782 dt 14.10.2019 for amendments in label and leaflets

of pesticides as per the provisions of Insecticides Rules 1971. Various representations were

received from various pesticides industries and associations regarding the practical

difficulties faced in the implementation of the above said rules and to extend the timeline

given for implementation.

Central Government after considering all the objections and suggestions has published

another notification GSR 355 dt 05.06.2020 with the intention of resolving the issues of

practical difficulties in printing the label and timeline extended for 3 months.

However, the above notifications GSR 782 and GSR 355 have been challenged by few

pesticide associations in the Hon'ble High Court of Delhi vide writ petition WP 4136/2020

and 4137/2020.

On the directions of the Hon'ble High court to resolve few remaining issues, a meeting was

held under the chairmanship of JS (PP) on 22.07.2020 with all stake holders including the

petitioners.

The issues raised by the stakeholders in the meeting were deliberated one by one and

clarifications were provided to the stake holders during the meeting on each issue. The

minutes of meeting held on 22.07.2020 are attached at Annexure 11.1.1.

RC deliberated the issues raised in the meeting and agrees to the clarifications provided by

the central government in toto. Further, RC emphasized that the amendments in label and

leaflet shall be carried out as per the decision taken in 417th RC meeting with in the

specified time line.
