List of participants in the meeting is annexed. Shri Sanajy Bisariya, Joint Development Commissioner, Member-Secretary welcomed the Chairperson and other members of the committee. The member Secretary deliberated that as it is first meeting of the newly constituted Committee after its re-constitution, therefore a brief presentation on the identified defined activities under the scheme and over all progress of the scheme was presented by the scheme officer Shri O.P.Singh, Dy. Director. During the presentation the Project Implementation Committee (PIC) members expressed their concern regarding the improvement under the scheme guidelines for better and effective implementation of the scheme. The Chairperson and members agreed upon the following:- Internal guidelines can be prepared to evaluate the proposals received from the implementing agencies including NGOs. A core team comprising the four members Prof. (Dr.) S.K.Verma, Shri Avinash Kumar, Additional Director (EP & IPR) Shri Yaswant Dev Panwar, Head, PFC, TIFAC, New Delhi and Shri S.S.Singh, Dy. Controller of Patent , Design & Trademark, New Delhi may suggest for further improvement in the existing scheme, so that the objectives envisage under the scheme can be achieved. Minutes of the 17th Meeting of Project Implementation Committee (PIC) for Implementation of

Scheme "Building Awareness on Intellectual Property Rights" for MSMEs under NMCP

The 17th meeting of Project Implementation Committee (PIC) for implementation of Scheme "Building Awareness on Intellectual Property Rights" for MSMEs under NMCP was held on 20-01-2016, under the Chairmanship of Dr. Manisha Shridhar, Regional Advisor, IPR and Trade and Health, Health systems and Development, WHO, Regional office for south –East Asia, World Health House, Indraprastha Marg, New Delhi.

List of participants in the meeting is annexed.

Shri Sanajy Bisariya, Joint Development Commissioner, Member-Secretary welcomed the

Chairperson and other members of the committee. The member Secretary deliberated that as it is first

meeting of the newly constituted Committee after its re-constitution, therefore a brief presentation on

the identified defined activities under the scheme and over all progress of the scheme was presented by

the scheme officer Shri O.P.Singh, Dy. Director. During the presentation the Project Implementation

Committee (PIC) members expressed their concern regarding the improvement under the scheme

guidelines for better and effective implementation of the scheme. The Chairperson and members

agreed upon the following:-

Internal guidelines can be prepared to evaluate the proposals received from the implementing

agencies including NGOs.

A core team comprising the four members Prof. (Dr.) S.K.Verma, Shri Avinash Kumar, Additional

Director (EP & IPR) Shri Yaswant Dev Panwar, Head, PFC, TIFAC, New Delhi and Shri S.S.Singh, Dy.

Controller of Patent , Design & Trademark, New Delhi may suggest for further improvement in the

existing scheme, so that the objectives envisage under the scheme can be achieved. In this regard

Chairperson suggested that the team may refer the following:

o Various schemes implemented for the SMEs by the various countries globally,

o WIPO assistance /Schemes for the MSMEs .

o Indo-US trade Policy, Schemes of Other Patent Office on IPRs.

o A National Study Intellectual Property and Micro and Medium Enterprises India

prepared by Shri R. Saha, in 2012 under the WIPO Development Agenda. (IPR-cell of

O/o DC-MSME, will circulate the same to all members through e-mail.)

On the basis of the above suggested study, a paper may be prepared by above members,

The members discussed on the slow progress under the component “ reimbursement of patent

and GI” of the scheme. It is observed that SMEs, holder usually files their Patent individually rather than

in the name of the Firm / company. Under the provision of the scheme it can’t be reimbursed. The

Committee Members also focused on the monitoring and re-view of the physical and overall progress

of the existing and forthcoming IPFCs. Further, the members appreciated the overall efforts of IPR-Cell .

However, Chairperson and other members recommended that the IPR-Cell of O/o DC-MSME may be

strengthened with adequate staff for effective implementation and monitoring of the IPR Scheme.

further, with the help of the adequate staff IPR-Cell will be able to monitor IPFCs effectively.

Agenda Item No.1

The minutes of the 15th & 16th meeting of the PIC as approved by Chairman had been circulated

to all members of Project Implementation Committee (PIC) with the approval of the competent

Authority.

Agenda Item No. 02

(a) The Committee noted the action taken by the IPR-Cell on the recommendations of the last

meetings i.e. 15th & 16th .

(b) The Committee reviewed the progress and current status of the Intellectual property Facilitation

Centers (IPFCs) setup under the scheme. After extensive discussion on the various issues

pertains to IPFCs , Chairperson suggested to review the IPFCs and visit the critical IPFC

personally by the PIC members as per their availability. As discussed and decided the following

IPFCs may be visited by the following members:

Shri Yashwant Dev Panwar, Head PFC,TIFAC, New Delhi ---IPFC- NIESBUD, Noida &

IDEMI, Mumbai.

Shri Avinash Kumar , Addll. Director (EP& IPR)—IPFC- CST-UP, Lucknow & TSCST,

Shri Anil Kumar, Ex Director O/o DC-MSME, New Delhi—IPFC- RAJCOST, Jaipur,

SCST&E,Shimla and HSCST, Panchkula,

Dr. S.S.Singh, Dy. Controller of Patent, design & trademark, New Delhi pleases may be

decided later

Shri Devki Nandan, Under Secretary IFW, Ministry of MSME- IPFC- Bhopal, and another

may be decided later on.

(c ) The Committee members have suggested that Shri Anil Kumar, may coordinate with

RAJCOST & CUTS Institute for revival of the IPFC as the funds have been surrendered by the

RAJCOST earlier. Further, it was also advised to involve one officer from O/o DC (MSME) shall

accompani the above mentioned members during their visit in the respective IPFCs as cited

above.

(d) The Committee member were of the view that a meeting of all IPFC may arranged and

AS & DC along with all PIC members may review the progress and current status and future course

of action on the functioning of the Intellectual property Facilitation Centers (IPFCs) may be decided.

2. On the basis of following criteria’s committee recommended the following proposals for organizing Awareness /Sensitization programme on IPR for MSMEs:-

The proposal from the organizations, who have already taken up the activities prescribed under IPR Scheme may be considered preferably.

The proposals from Government (Central /State) / Autonomous organization may be considered on priority basis.

The Academic Institution, those implementing incubation scheme of this office may be considered for organizing Awareness/ Sensitization programme on IPR for MSMEs.

If there is any pendency with implementing agency including UCs etc. the proposal will not be considered, till the settlement of old issues. Further, in case of the approved /recommended proposals the funds may be release only to the implementing agencies, who have settled the earlier proposal in all aspects. On the basis of the above criteria’s the recommendations are as under:-

Not approved, as they do not have exposure in the field of IPR and not Comply the Scheme Guidelines as they do not having relevant experience / track record in assisting MSMEs.

The Committee also recommended that the following points shall be incorporated in the

sanction order:

Every implementing agency including MSME-DIs shall communicate to the O/o DC (MSME) for

the involvement of PIC members and officers concerned from the Hqrs., New Delhi in each &

every programme.

MSME-DI should organize the programme with the active cluster / Associations / technical

Institutions / state government organizations of the region.

The regional IPFC and MSME-DI must actively be involved in each programme by the

Implementing agency.

In all cases including MSME-DI, Programme organizers should ensure that there should be at

least 30 participants in each programme, at least one representative from the each units of the

specific cluster should participate in programme.

The topics (Patent, Trademark, Industrial Design, copyright etc.) may be selected keeping the

requirements of target groups in view and issues of local importance should also be included

wherever appropriate regarding IPR.

If the implementing agency is Technical Institution in that case the Implementing agency has to

involve other nearby technical Institutions, regional IPFC and MSME-DI invariably.

Implementing agency.

In all cases including MSME-DI, Programme organizers should ensure that there should be at

least 40 participants in each programme, at least one representative from the each units of the

specific cluster should participate in programme.

The topics (Patent, Trademark, Industrial Design, copyright etc.) may be selected keeping the

requirements of target groups in view and issues of local importance should also be included

wherever appropriate regarding IPR.

If the implementing agency is Technical Institution in that case the Implementing agency has to

involve other nearby technical Institutions, regional IPFC and MSME-DI invariably.

Proposals for S.T. Training / L.T. Training by Maharashtra Centre for Entrepreneurship Development (MCED), Aurangabad (Maharashtra), International Institute of Management Sciences (IIMS), Kolkata, IICA, Gurgaon, National Institute of Technology (NIT) Rourkela, Sanshadow Consultant Pvt. Ltd(SSCPL), New Delhi.

- The MCED, Aurangabad is not directly engaged in IPR related activities, The proposal of

training programmes will be considered after assessing the performance of the approved

programmes. Therefore, initially awareness Programme / workshop have been approved

by Committee to MCED, Aurangabad.

- IIMS, Kolkata has organized workshops under the same scheme in 2011. In view of the

same Committee recommends one Short terms training programme on IPR Management

to be organized by International Institute of Management Sciences (IIMS), Kolkata. As per

the schemes guidelines the short term training programme should be 2-3 weeks duration

with maximum GoI assistance of Rs.6.00 Lakhs. As per scheme guidelines IIMS, Kolkata has

to contribute 10% of the total project cost i.e. Rs.64,600/- and GOI assistance will be

limited to be Rs.5,81,400/- Also, earlier proposals of IIMS, Kolkata if any will not be

consider for financial assistance.

- IICA, Gurgaon - The proposal of training programmes will be considered after assessing the

performance of the approved programmes. therefore, initially awareness Programme /

workshop have been approved by Committee to IICA, Gurgaon. However, as requested by

IICA they may organize short term training programme on IPR of three weeks duration

without financial assistance.

- The Committee recommends one Short term training programmes to be organized by

National Institute of Technology (NIT) Rourkela. The committee members were of the

view that initially they should start with awareness programs on IPR for MSMEs. Hence not

recommended. IPR-Cell of O/o DC (MSME) may communicate NIT Raurkela in this regards.

- In view of the past performance in organizing awareness programmes on IPR Committee

recommends one short term training programme to Sanshadow Consultant Pvt.

Ltd(SSCPL), New Delhi. As the proposal of awareness and workshop have been considered

in agenda no. 3 & 4. Therefore the committee members suggested to defer the proposal

for the next meeting.

1. On the proposal of Setting up of IPFC for MSMEs by TANSIA FNF Service Centre, Chennai

, the Committee members were on the view that TANSIA FNF Service Centre, Chennai may be

deferred for its consideration in next meeting of PIC. However, office of DC (MSME) may

request to TANSIA FNF Service Centre, Chennai for location and revised budget proposal of IPFC

and the same may be placed before the PIC for further necessary action. Further, TANSIA FNF

Service Centre, Chennai stated that they are already serving to the MSMEs in IPR related issues.

Hence, TANSIA FNF Service Centre, Chennai may submit the documents regarding the

handholding support to MSMEs including filing of various IPRs of MSMEs.

2. The proposal for setting up of IPFC at KIIT-TBI, by KIIT University Bhubaneswar for

MSMEs is not approved in view of that the IPFC sanctioned to CTTC, Bhubaneswar that may be

given a chance to grow. As of now the proposal of IPFC submitted by KIIT-TBI, by KIIT University

Bhubaneswar may be deferred. However, committee member were of the view that through

presentation presented by the representative of KIIT-TBI, by KIIT University Bhubaneswar, it

appears university good infrastructure and other programmes like workshop, Pilot Study etc,

may be given. In view of the same O/o DC (MSME) may asked for other proposal from KIIT-TBI,

by KIIT University Bhubaneswar.

3. As a recommended by PIC in the minutes of the 16th meeting, committee recommended

to awareness programme on IPR to be organized by ESTC, Ramnagar. The progress of the IPFCs

sanctioned to IDEMI, Mumbai and CTTC, Bhubaneswar can be asses by the O/o DC (MSME).

Meanwhile, the proposal for Setting up of IPFC for MSMEs by Electronics Service & Training

Centre, (ESTC), Ramnagar (Uttarakhand) at Ramnagar Campus deferred for the next meeting

after review of the progress / performance of the awareness / sensitization programmes.

4. The proposal of IPFC submitted by Coir Board, Kochi Kerala for setting up of IPFC at

Kochi for MSMEs be deferred as the broader objectives have not been exercised and

mentioned in the proposal. In the proposal sustainability of the IPFC have also not been worked

out. In view of the same committee deferred the proposal with a view that Coir Board re-

submit the fresh proposal. The revised proposal should have the budget estimate as per revised

scheme guideline and the Coir Board shall also indicate their contribution towards proposed

IPFC. Further, while preparing the proposal the following must be include :-

Name of the nodal officer.

Mechanism to generate revenue for the Sustainability of the IPFC.

5. The proposals of Chamber of Industrial & Commercial Undertakings, Ludhiana and Auto

Parts Manufacturers Association (India), Ludhiana were discussed by the committee members,

during the discussion the representative of above mentioned Implementing agencies were

present. After, discussion on the both proposals, committee members were of the view that

both proposals may be deferred. The Committee suggested that both implementing agencies

may exercise for joint proposal of IPFC for Ludhiana so that the centre may be made sustainable

after gestation period. O/o DC (MSME) may communicate for submitting for joint proposal as

per scheme guideline. Further, the comments / views of the Director, MSME-DI, Ludhiana shall

be obtained in the matter and may be placed before the PIC in its next meeting.

6. As the representatives from Engineering Staff College of India (ESCI), Hyderabad was

not able to attend the meeting and present the proposal. Hence, the proposal was not taken

up for consideration.

7. The proposal of IPFC submitted by Indian Institute of Corporate Affairs (IICA), Gurgaon

deferred. The Committee members were of the view that the performance of the Workshop

/Interactive seminar and training programmes recommended by PIC may be monitor first.

Further, in organizing Workshop /Interactive seminar and training programme IICA, Gurgaon

may contact Prof.Dr. S.K.Verma for participation and the programme shall be organized in

collaboration with MSME-DI Karnal.

8. The proposal for setting up of IPFC for MSMEs by Indo German Tool Room (IGTR) Aurangabad approved subject to the following terms and conditions:-

Indo German Tool Room (IGTR) Aurangabad may submit the revised proposal, as per scheme guideline.

Mention the name of the nodal officer to look after the IPFC.

Mention the linkage with MSMEs and associations.

Shall work out on revenue generation mechanism for sustainability of the IPFC and specify the activities to be adopted for sustainability.

Nodal officer shall be trained on IPR related issues at NIIPM, Nagpur.

9. In view of the two existing IPFC functioning at Hyderabad (NI-MSME and FISME ), the proposal for setting up of IPFCs by CITD, Hyderabad was deferred. The committee member suggested that revised proposal for setting up of IPFC at Vishakhapatnam or Vijayawada may be sought from CITD, Hyderabad. O/o DC (MSME) may communicate for submission of revised proposal, the revised proposal shall contain the following information :-

CITD, Hyderabad may submit the revised proposal, as per scheme guideline.

Mention the name of the nodal officer to look after the IPFC.

Mention the linkage with MSMEs and associations.

Shall work out on revenue generation mechanism for sustainability of the IPFC and specify the activities to be adopted for sustainability.

10. Committee approved the proposal of National Research Development Corporation, New Delhi for setting up of IPFC for MSMEs at Andhra University, Visakhapatnam. The NRDC, New Delhi has associated with Industrial association and Academia to support the Intellectual Property Facilities Centre at Andhra University College of Engineering at Vishakhapatnam. The Total Project Cost will be Rs.100.00 Lakh with GoI assistance of Rs.65.00 Lakh and the Share of NRDC, New Delhi will be Rs. 35.00 Lakh during the five years period. The proposed IPFC will cater their services preliminary to MSMEs and to individuals, students, research scholars’ and academia in IPR related issues.

11. Committee deferred the following proposal for the next meeting and advised to O/o DC (MSME) to asked for the revised proposals as per scheme guideline and following conditions :-

a) Malaviya Centre for Innovation, Incubation & Entrepreneurship (MCIIE), Indian Institute of Technology, (Banaras Hindu University), Varanasi

b) Centre for Science & Technology Entrepreneurship Development (Under Science & Technology Department) (C-STED) Government of Kerala.

Mention the name of the nodal officer to look after the IPFC.

Mention the linkage with MSMEs and associations.

12. PHD Chamber of Commerce and Industry, New Delhi has already been sanctioned one

IPFC at Lucknow, which has started functioning in September 2015. The committee member

were of the view that the present proposal may be deferred for the next meeting to view and

monitor asses the performance of IPFC Lucknow recently established by PHD Chamber of

Commerce and industry. Further, the performance / report of the various programme

organized by the PHD Chamber of Commerce and industry may also be submit before the

committee to review of the over all performance of the PHD Chamber of Commerce and

industry under the IPR Scheme.

13. Committee approved the proposal of ICAR- Central Research Institute for jute & Allied

Fibers (Indian Council of Agriculture Research), West Bengal for setting up of IPFCs at Kolkata

for MSMEs with the following conditions :-

Revised budget estimate for the proposed IPFC and indicate the value in terms of Rupees of their contribution to be made by the CRIJAF in setting up IPFC.

Mention the name of the nodal officer to look after the IPFC.

Mention the linkage with MSMEs and associations.

Shall work out on revenue generation mechanism for sustainability of the IPFC and specify the activities to be adopted for sustainability.

14. In view of the IPR related work ZTM-BPD UNIT of IARI, New Delhi and coverage of

geographical location in 14 cities of Haryana, MP, Rajasthan, Jharkhand, UP, Delhi, Chhattisgarh

and Uttarakhand by having ICAR Zonal institution under ZTM-BPD Unit of IARI, New Delhi,

Committee approved the proposal of Zonal Technology Management & Business Planning and

Development Unit, Indian Agriculture Research Institute, New Delhi with a condition that final

approval of IPFC will be decided by the AS & DC (MSME). The proposed budget for the IPFC

will be Rs. 71.50 Lakh, wherein Goi assistance will be Rs.65.00 Lakh and the contribution of ZTM

& BPD, IARI New Delhi will be Rs. 6.50 Lakh towards IPFC.
