Minutes of meeting held on 29.05.2017 at 11.00 A.M in the
conference room of Commissioner Transport/Chairman, STA.
A meeting of the State Transport Authority (STA) chaired by Secretary cum
Commissioner (transport)/Chairman, STA was held on 11.05.2017 at 11.00 AM in the
conference Room of the Transport Department. The following were present.

At the outset, Chairman, STA welcomed all the members, The Chairman STA
desired that minutes of the last meeting of the STA may also be placed before the
STA Board for its approval. Accordingly, the minutes of the meeting held on
04.01.2017 were read out before the members of STA Borad.
The minutes of the meeting dated 04.01.2017 were approved by the STA Board.
Agenda No. 14/2017 :
Sub : Amendment in existing guidelines on Display of Advertisement on Public
Service Vehicles.
1. “Guideline on Display of Advertisement on Public Service Vehicles’’ was
approved on 19.05.2014 (Copy of Guidelines is enclosed as Annexure I) on
19.05.2014. Para 2.7 of the said Guidelines are reproduced as under :
“Affixation of advertisements shall be allowed only on rear side and left side
of the vehicle. The advertising material shall not cover more than 75% of the
area available in each side. While calculating total available area, the area
covered by wind screen shall not be counted”.
2. DTC vide its letter dated 30.03.2016 (Annexure II) had informed that in its
Board meeting held on 30.11.2015, Commissioner (Transport) was directed to
examine the issue of display of advertisements on Fully Body Wrap including
right side (except window glasses & Rear wind glass panel ) on Low Floor Buses.

By allowing the same, DTC may fetch good revenue by displaying the
advertisement on right side of the body panel. DTC informed that the entire
bus body wrap is a common feature in public transport all over the world. All
major STUs in India like BEST, UP Roadways, Haryana, BMTC etc. allow
advertisement display on right side of the buses as well. Even roadways like
Himachal Roadways, whose major operation in hilly areas and the operation of
the buses is on single carriage way, display of advertisements on right side is
allowed. Metro Feeder buses and HoHo buses of Delhi Tourism are also
displaying advertisements on right side of buses, and nowhere any accident
caused due to such advertisement had ever been reported.
3. On the basis of above request of DTC ,STA vide resolution no. 6/2016 in its
meeting held on 16.05.2016 approved the following amendment in Para 2.7 of
the ‘Guidelines on Display of Advertisement on Public Service Vehicle :-
“2.7 Affixation of advertisements be allowed only on rear side, left side and
right side of the vehicle. The advertisement material shall not cover than 75%
of the area available in each side. While calculating total available the area
covered by wind screen shall not be counted ’’.
Copy of the Resolution No 6/2016 dated 16.05.2016 is enclosed as Annexure III.
4. Special Commissioner of Police (Traffic), who is also a member of the STA vide
letter number 6784/TE(D-1), dated 07.10.2016 (Annexure IV) has shown his
concern that if affixation of advertisement on right side of a public service
vehicle is allowed, then it will be a source of distraction for motorists which
may lead to road accidents. Such affixation of advertisement on the right side
of any public service vehicle should not be allowed. It has been requested that
the amendment in para-2.7 of the “Guidelines on Display of Advertisements on
Public Service Vehicle ‘’ may accordingly be carried out and it should be
reverted to the original provision i.e. Allowing advertisement on the rear side
and left side of public service vehicle only.
5. In view of the above, the matter is place before the STA.

RESOLUTION No. 14/2017 :
The agenda was placed before the STA Board on the request of Delhi Traffic Police.
Though, the representative of Delhi Traffic Police was present when the proposal for
inclusion of 3rd side (right side of the vehicle) for advertisements was earlier
approved. However, subsequently, the Delhi Traffic Police raised objections to this
proposal citing serious traffic issues which may lead to increase in accidents on the
road. The matter was deliberated in detail. The STA board decided that a feedback
on the number of accidents, if any, attributable to advertisement on right side shall
be submitted by a Delhi Traffic Police within one month. In the meanwhile, proposal
approved vide agenda No. 1/2017 be kept in abeyance.
Agenda No. 15/2017 :
Sub : Bus service for the voters of Sala Pur village on the Poll Day i.e. 23-04-
2017.
District Election Officer/District Magistrate, South West District requested Dy.
CGM (Traffic), DTC vide letter No. TR/Sch./2/2017/1857 dated 19-04-2017 to provide
Bus service between Sala Pur Khera and MC Primary School, Bijwasan for the whole
day on 23-04-2017 in order to facilitate the electorate of two polling stations (PS No.
111 & 112) situated at MC Primary School, Bijwasan in ward 048-S (Bijwasan) where
the voters of village Sala Pur Khera will cast their votes between 8.00 AM to 5.30 PM
in the elections of Municipal Corporations of Delhi on the day of poll i.e. 23-04-2017
as there is no public transport facility is available .
It is further mentioned in the letter that the Returning officer (046-S to 50-S)
vide letter dated 13-04-2017 has already informed that they are agree with the Terms
and Conditions of Delhi Transport Corporation. However, the office of District
Election Officer (SW) is of the view that the DTC may charge the prescribed fares
from the commuters who avail the bus service on 23-04-2017, the day of polling.
The Dy. CGM (Traffic), DTC vide its letter has sought the approval of STA to
enable them to put one bus as special shuttle service for voters of Salapur Khera
Village on Normal fares as per the request made by DEO/DM (South-West) between

Salapur Khera to MC Primary School, Bijwasan only on poll day i.e. 23-04-2017 as at
present this village is not being served by any bus route of DTC.
Therefore, keeping in view of above urgency and request of DEO/DM (South-
West), the Commissioner-cum-Secretary (Transport)/Chairman (STA) accorded the
approval enabling DTC to put one bus as special shuttle service between Salapur
Khera to MC Primary School, Bijwasan only on poll day i.e. 23-04-2017 for the voters
of Salapur Khera Village.
The matter is placed before STA Board meeting for Ex-post facto approval.
RESOLUTION No. 15/2017 : Approved
Agenda No. 16/2017
Sub : Introduction of Destination Buses in compliance of order of Hon’ble National
Green Tribunal.
Hon’ble National Green Tribunal (NGT) vide order dated 20.04.2017 in O.A.
No. 21/2014 in the matter of “Vardhman Kaushik vs. Union of India & Othrs” inter
alia directed that:
1. “As proposed, the NCT, all other concerning departments and
instrumentalities of the State shall introduce destination buses w.e.f
01.05.2017, as suggested and without default”.
2. “The destination buses would mean the buses which will start from point A
and shall go non-stop to the destination point B”.
3. “The buses initially, on experimental basis, would start from Dwarka, Rohini,
Janakpuri, CGO Complex and Badarpur Border. The destination buses, from
these points, will starts from the main bus stand of the sectors or spots which
are convenient for the public at large, to board these buses. They will start
preferably in the early hours of the day to ensure that persons travelling by
such bus is able to reach their respective offices on time. These buses would
be directed towards Central Secretariat, Shastri Bhawan, Krishi Bhawan,

Connaught Place, Nehru Place and such others centres where large no. of
offices are located. These destination buses would in the evening; coinciding
with the office hours, return from the point of their destination to the
starting point i.e. the places from where they had carried the passengers in
the morning”.
4. “We direct the Director, Transport of NCT Delhi to ensure that all these buses
reach on time without default and to the convenience of the public at large.
The Director of Transport along with the Joint Commissioner of Police, Traffic
would submit a Report in respect of the reduction of individual cars as a result
of introduction of the destination buses. If necessary, they can make enquiry
from the persons of the buses, whether they were earlier travelling by their
own cars. ”
5. “The destinations vehicles would be maintained properly and DTC would
depute special officers from their circle who would be responsible for
cleaning, for maintaining hygiene of the vehicles as well as that they would
operate punctually and the staff would treat the passengers with respect and
decency. The Status Report shall be filed by the Director and Joint
Commissioner of Police to the Tribunal after a period of three weeks of
running of these destination buses. ”
6. “The NCT Delhi and Joint Commissioner of Police, Traffic shall duly advertise,
w.e.f. 25th April, 2017 information daily for the public at large.”
“It is brought to our notice that the Committee has been constituted by NCT
Delhi. The Report of that Committee shall be implemented only subject to
orders of the Tribunal. ”
In compliance of above order, DTC has submitted following 20 routes to be
operated in the morning and 20 routes in the evening. These Destination Buses
will be AC Buses and will start from Originating Point and run Non-Stop till
Destination point as per time schedule given in the table on normal DTC A.C.
Bus fare. A public notice informing general public at large was published in the
leading newspapers after taking approval from State Election Commission as
MCD Elections is invoking in Delhi.

In addition to above, in compliance of order of Hon’ble NGT, a request from
DTC was received to ply similar another following20 routes to be operated in the
morning and 20 routes in the evening.

Keeping in view of urgency, Commissioner cum Secretary Transport/
Chairman, STA accorded the approval enabling DTC to operate 80 buses on the above
routes in compliance of above NGT orders.
The matter is placed before STA Board meeting for Ex-post facto approval.

Sub : Replacement of ECO Friendly Sewa Vehicles-policy guidelines thereof.
The brief history/ Salient features of “ECO Friendly Sewa Vehicles” scheme are
as under :
Brief facts
Vehicles registered under “ECO Friendly Sewa” were initially registered under
“Phat-Phat Sewa” Scheme in year 2002, so far 632 vehicles are registered under this
scheme. Most of the vehicles registered under this scheme are completing its life i.e.
15 yrs. or the vehicles are badly damaged and are not in a position to ply on roads.
Various representations have been received from the owners of these vehicles
for replacement of their existing vehicles against same permit because the vehicles
are completing its life or not in a position to ply on roads.

Recommendations : Owners of ECO Friendly Sewa Vehicles may be allowed to replace
the old registered Vehicles with new vehicles of existing same category and conditions
against the same permit as per section 83 of MV Act, 1988.
The contents of section 83 of MV Act, 1988 are as under :
Replacement of vehicles - The holder of a permit may, with the permission of the authority
by which the permit was granted, replace any vehicle covered by the permit by any other
vehicle of the same nature.
Procedure for replacement and scraping of old “Eco Friendly Sewa Vehicles” will
be as under :
1. The permit holder of “Eco Friendly Sewa Vehicles” shall apply for surrender
of permit and issuance of No Dues Certificate if the vehicle has completed 15
years or Vehicle is not in roadworthy conditions prior to completion of its
prescribed life and shall submit following documents :
a) Application for replacement on prescribed format.
b) Challan Clearance (Traffic + Transport Department)
c) Original registration Certificate, Permit, Fitness Certificate and Insurance.
d) Undertaking regarding no Court case/ Dispute/ Challan and to follow the
guidelines under Motor Vehicles Act, 1988, CMVR, 1989, DMVR, 1993 and
Notifications.
e) Applicant’s residence I.D Proof & three recent passport size photographs.
f) Up to date tax Report.
2. After obtaining required documents and completion of formalities by permit
holder, department shall issue No Dues Certificate, all the documents will be
deposited in the Department at the time of grant of no Dues Certificate (NDC).

3. The permit holder shall submit the chassis number embossed cut portion and
give under taking that the vehicle has been scrapped and request for
deregistration of his existing “Eco Friendly Sewa Vehicles”
4. The department shall issue LOI for purchase of Vehicles.
5. After purchasing the “Eco Friendly Sewa Vehicles” the vehicle owner shall
obtain the certificate of Fitness, registration Certificate (RC) and permit as per
procedure laid down under the Motor vehicles Act, 1988, Rules made
thereunder and the Department orders issued in this regard.
Matter is placed before the STA board for appropriate decision.
RESOLUTION No. 17/2017 : The permit holders of ECO Friendly Sewa Vehicles may
be allowed to replace the old registered Vehicles with new vehicles of same category
against the permit as per section 83 of MV Act, 1988.
Agenda No. 18/2017
Sub : Condition of parking space for Commercial Vehicles
Brief Facts :
There are more than 80,000 Taxis, approximately and thousands of commercial
vehicles, which are being parked on the public streets only. Considering the fact that
the registration was allowed without ensuring availability of space for parking, the
parking arrangement for existing commercial vehicles have to be considered.
The number of Commercial vehicles and Taxies on aggregator platforms has
increased to large extent in recent years without ensuring availability of parking
space for such vehicles. There is a need to link the registration of these vehicles with
proof of availability of parking place. It is proposed that a permit be granted only
upon submission of proof of parking space for taxies and other commercial vehicles.

The quantum of problem can be gauged by the number of total taxies
registered in Delhi and also by looking at new taxies being registered in Delhi each
year. The figures of taxies are as under :

Rules of the Road Regulations, 1989
Parking of the vehicle :
Every driver of a motor vehicle parking on any road shall park in such a way that it
does not cause or is not likely to cause danger, obstruction or undue inconvenience to
other road users and if the manner of parking is indicated by any sign board or
markings on the road side, he shall park his vehicle in such manner.
A driver of a motor vehicle shall not park his vehicle-
at or near a road crossing, a bend, top of a hill or a humpbacked bridge;
on a foot-path;

near a traffic light or pedestrian crossing;
on a main road or one carrying fast traffic;
opposite another parked vehicle or as obstruction to other vehicle;
alongside another parked vehicle;
on places or roads where there is a continuous white line with or without a
broken line;
near a bus stop, school or hospital entrance or blocking a traffic sign or
entrance to a premises or a fire hydrant;
on the wrong side of the road;
where parking is prohibited;
away from the edge of the footpath.
Penalty :
Rs.100 for first offence and Rs.300/- for second or subsequent offence under
section 177 of MV Act 1988.
The number of taxies on aggregator platforms has increased to large extent in
recent years without ensuring availability of parking space for such vehicles. Proof of
parking space may be insisted before grant of permit.
As per City Taxi Scheme, 2015, a taxi service provider including an aggregator
of taxies shall ensure adequate parking facility for the vehicles.
Proposal :
In view of above, there is a need to link the registration of all taxies and other
commercial vehicles with proof of availability of parking place and the permit shall be
granted only upon submission of following proof of parking space for taxies and other
commercial vehicles.
a. The owner of the vehicle must submit copy of agreement with authorized
parking contractor of MCD/NDMC/DDA etc. for a period of minimum one year.
He shall undertake to use the space in any authorized parking till the validity of
taxi or other commercial vehicle permit. The parking space in residential space
or on streets shall not be allowed.
b. If any taxi and other commercial vehicle are found parked in Public Street or
even at residential space, the permit will be liable for suspension/cancellation.

RESOLUTION No. 18/2017
The STA Board agreed in principle that a comprehensive policy for parking of
commercial vehicles should be formulated. Since, the local bodies i.e., MCD’s, NDMC,
DDA and also DMRC are responsible for providing the parking space in Delhi, these
agencies should also be taken on board for proper formulation of the policy.
The following issues may be addressed by the local bodies :
1. They should inform about the capacity to provide parking space for commercial
vehicles; whether sufficient space is available to accommodate these vehicle ?
2. They will intimate whether they can provide the parking space on subsidised
rates. They should come out with reasonable parking charges for these
vehicles.
3. They will intimate whether any guaranteed parking space for commercial
vehicles may be provided by them and also whether they can provide the day
and night parking space.
4. The MCDs should chalk out a plan so that parking space can be made available
within every 5 to 10 sq km of Delhi. The other agencies should also make
efforts to increase parking space in the areas under their jurisdiction.
5. These agencies shall also examine whether separate parking space for fleet
owners can be provided.
6. It was observed by Board that a large number of taxis and other commercial
vehicles registered in the neighbouring states park their vehicles in Delhi.
While formulating the policy, this issue needs to be addressed so that the
available parking space is best utilised by the Delhi registered vehicles.
Besides above, the issue of parking of vehicles on roads by second hand car
dealers and the authorised car dealers was also discussed. It was desired by members
of STA that the Transport department shall examine the possibility of amending the
DMVR to grant license to second hand car dealers to regulate the trade.

On similar lines, the conditions of trade certificate granted to vehicle
dealers shall also be amended to check on-road parking.
Agenda No. 19/2017 :
Sub : Request of operators for change / modification / alteration of routes
allotted to Gramin Sewa vehicles.
ISSUE RAISED :
Various representations have been received from the operators of Gramin Sewa
vehicles for change/modification/alteration of routes allotted to gramin sewa
vehicles on following grounds.
i. The routes are economically unviable.
ii. The routes allotted are far away from their residence which is causing
unnecessary dead mileage.
iii. Some of the roads of the gramin sewa vehicle routes are under
construction/renovation or have been closed causing inconvenience to ply on
those routes.
iv. The via of routes and maps of such routes are in need of clarification.
v. Some of the routes are very short and required extension.
Background regarding allocation of routes for Gramin Sewa vehicles
1. The total number of 6153 Gramin Sewa vehicles have been registered till date,
the vehicles registered under Gramin Sewa scheme were issued Contract
Carriage permits under section 74 of the Motor Vehicles Act and initially they
were allowed to ply only in rural areas, unauthorized resettlement colonies and
J.J. Colonies and will not in any case cross the boundary of the ring road.
2. The Transport Department received complaints that the Gramin Sewa Vehicles
are causing traffic nuisance by concentrating at particular points/places only.
To regulate the movement of these Gramin Sewa vehicles, it was decided that
the vehicles under Gramin Sewa scheme should be allotted routes and the

study to know the flow/quantum of commuters in a particular area and
rationalization of routes thereof was conducted by DIMTS Limited.
3. As per the study report submitted by DIMTS Ltd., the transport department
vide public notice dated 09.06.2011 and 17.06.2011 issued a list of 166 routes
to be allotted to the gramin sewa vehicles.
4. The routes of gramin sewa vehicles were allotted by draw of lots by the
computer branch on 24.06.2011.
5. Considering the various requests for change of routes by “Gramin Sewa
Vehicles” permit holders who have found their allotted routes unviable, the
transport department gave final chance to opt anyone of the 72 routes, on
dated 24.01.2012 vide no. F.No.DCB(VIU)/TU/TPT/2012/37, where less no. of
routes have been allotted earlier.
6. The routes granted under gramin sewa vehicles scheme were again changed
three to four times. These unsigned lists are available on department website
and updated in the DIMTS software with change of routes. However, no
authenticate noting are found in the main file, request/applications for change
of route, the same is also not available in the registration files as well as main
files. Some of the permit holders have sold their vehicles and found that new
route had been allotted during the issue of permit and claiming old one as
stated that they have not applied for route change. The department has no
solution to resolve their problems.
7. Various representations have been received from the operators of graminsewa
vehicles through the Hon’ble Minister of Transport for change of route or
extension of routes on following grounds (copies placed opposite in a file).
a. The routes are economically unviable.
b. The routes allotted are far away from their residence which is causing
unnecessary dead mileage.

c. Some of the roads of the gramin sewa vehicle routes are under
construction/renovation or have been closed causing inconvenience to ply on
those routes.
d. The via of routes and maps of such routes are in need of clarification.
e. Some of the routes are very short and required extension.
8. The operators of Maxi Cab and gramin sewa vehicles had submitted their
requests for change/modification/alteration of routes before the STA board
vide agenda no. 06/2017 on 04.01.2017, it was decided that
comprehensive/scientific study in this regard may be carried out through a
professional agency in a time bound manner.
Proposal :
The routes of gramin sewa vehicles have been changed, two or three times but
no authenticated official record is found available on any file, so a decision may be
taken by the STA board after calling objections from the gramin sewa vehicle permit
holders for change/modification/alteration of routes allotted to the operators of
gramin sewa vehicles.

RESOLUTION No. 19/2017 :
The STA Board resolved that :

should be published on website of the Transport Department for soliciting
objections / suggestions.
3. These applications should also be forwarded to the Delhi Traffic Police for
seeking their concurrence.
Agenda No. 20/2017 :
Sub : Regarding allotment of routes for the vehicles operating under phat-phat
sewa scheme.
Issue raised :
A representation dated 28.04.2017 is received from the General Secretary of
Delhi Pradesh Phat-Phat Sewa Owners Union, for allotment of route permit to the
vehicles registered under phat-phat sewa scheme.
The representative of Union informed that phat-phat sewa vehicles are mostly
plying on following routes so, a permanent route permit may be allotted to phat-phat
sewa vehicles on these routes.

The representative of union further informed that the route permits have been
allotted to eco-friendly sewa vehicles, gramin sewa vehicles and maxi cabs but no
route permit has been granted to the phat-phat sewa vehicles.
The brief facts of the case are as under : 1. The phat-phat sewa scheme was launched during the year 1998. Before 1998
the old MCRs/Harley Davison phat-phatis vehicles were replaced by the
vehicles complying with prescribed mass emission standards.
2. The vehicles registered under phat-phat sewa schemes are plying with DL 1Q,
vehicle registration numbers.
3. The vehicles are operating as ordinary transport vehicles on “Contract
Carriage” permits (without fare meter).
The contents of the section 2(7) of the Motor Vehicles Act, 1988 are as under :
“contract carriage” means a motor vehicle which carries a passenger or passengers
for hire or reward and is engaged under a contract, whether expressed or implied,
for the use of such vehicle as a whole for the carriage of passengers mentioned
therein and entered into by a person with a holder of a permit in relation to such
vehicle or any person authorised by him in this behalf on a fixed or an agreed rate or
sum –
a) on a time basis, whether or not with reference to any route or distance; or
b) from one point to another, and in either case, without stopping to pick up or
set down passengers not included in the contract anywhere during the journey,
and includes –

i) a maxicab; and
ii) a motorcab notwithstanding that separate fares are charged for its
passengers
4. The vehicles registered as “phat-phat sewa” are allowed to ply in Delhi state
only.
5. No route permits have been allotted to the phat-phat sewa vehicles.
Proposal :
No route permits have been allotted to the phat-phat sewa vehicles in the
original scheme of phat-phat sewa vehicles, so the original scheme should not be
changed and no route permit should be allotted to the phat-phat sewa vehicles.
The proposal has been approved by the Chairman of the STA board.
Matter is placed before the STA board for appropriate decision.
RESOLUTION No. 20/2017 :
The STA Board resolved that conditions of the original scheme should not be
changed.
Agenda No. 21 /2017 :
Sub : Cancellation of old records of the Auto Rickshaws, which have completed 15
years of prescribed life but the details are still borne on the computer data
base and in some cases where record of the other TSR is in the owner’s
name in the computer data base which has not completed 15 years.
The above mentioned agenda was placed before the STA board on 04/01/2017
vide No. 11/2017. The matter of resolution no. 11/2017 was deferred with direction
that the matter should be examined again with sample cases and mechanism to
disposed off the cases.

Brief facts/Issue Raised are as under :
i. There are a large numbers of TSRs which have completed 15 years of
prescribed tenure, but the details are still borne on record and in many cases
such TSRs were procured without consent of the person in whose name the TSR
stands, as alleged. In view of this position, due to the existence of their names
on record, due to conditions stipulated in permit conditions dated 08.08.2012,
they are not being considered for allocation of new TSR;
Recommendations of the committee :
Where the other TSRs have completed more than 15 years - The driver be
directed to register a FIR regarding the fact that he never possessed the other TSRs
and he be also directed to file an indemnity bond stating therein that in case his
statement is found to be false/incorrect at any later stage, he shall be liable to
prosecution, realization of penalty, if any, as well as the permit of the new TSR to be
allowed as replacement shall stand forfeited.
Legal issue involved :
There was no bar on owning more than one Auto Rickshaw prior to 08.08.2012.
The registered owners of the Auto Rickshaws provided photocopies of his commercial
licences, PSV badge and address proof to the financers to take loan against his
vehicle, these documents were used illegitimately to register numerous other Auto
Rickshaws which are in the name of the person, although he is un aware of the same.
The ownership of the multiple Auto Rickshaws was obtained fraudulently by the
financers using the document of the persons i.e. his driving licences, PSV Badge and
Address Proof etc.
When the applicant approaches to the Registering Authorities to surrender the
permit and to replace his genuinely registered vehicle, the Registering Authority is
not in position to allow the replacement of his registered Auto Rickshaw as the
computer data base is showing various other Auto Rickshaws and permits in his name
As per permit condition of Auto Rickshaws dated 08.08.2012, there is a
provision in clause 3, that the applicant should not possess any other Auto Rickshaw

or transport vehicle with permit. So the replacement of genuinely registered vehicle
and surrender of its permit has been denied by the Registering Authority as many
other Auto Rickshaws are reflecting in the data base of the computer in the name of
the same registered owner.
In this situation the genuinely registered owners of the vehicles/ permit
holders are in serious trouble and cannot legally replace their registered vehicles.
As per legal provision in Motor Vehicle Act and rules framed there under, the
registered owner may apply for cancellation of fraudulently registered vehicle and
permit which is reflecting in his name in the data base of the computer.
The legal provisions for cancellation of registration and permit are as under:
Section 55(5) of Motor Vehicles Act, 1988 (Cancellation of registration)
If a registering authority is satisfied that the registration of a motor vehicle
has been obtained on the basis of documents which were, or by representation of
facts which was, false in any material particular, or the engine number or the chassis
number embossed thereon are different from such number entered in the certificate
of registration, the registering authority shall after giving the owner an opportunity
to make such representation as he may wish to make (by sending to the owner a
notice by registered post acknowledgement due at his address entered in the
certificate of registration), and for reasons to be recorded in writing, cancel the
registration.
Section 86 (d) of Motor Vehicles Act, 1988 (Cancellation and suspension of
permits) - The Transport Authority which granted a permit may cancel the permit.
(d) If the holder of the permit has obtained the permit by fraud or
misrepresentation.
GPS Status : These Auto Rickshaws have completed their life span of 15 years, GPS is
not installed.

After detailed deliberation, the STA board approved the proposal.
Agenda No. 22/2017 : Sub : Request for change of Routes of Gramin Sewa vehicles. Brief facts :
The government of NCT of Delhi had decided to launch a new para transit
scheme wherein high capacity three wheelers and similar other vehicles with seating
capacity of 6+1 (six passengers excluding driver) was to be given permits to ply in the
rural areas, unauthorized, resettlement colonies and J.J. Clusters of Delhi. It was
named as “Gramin Sewa”. A total of 6153 vehicles were registered as ‘Gramin Sewa’
till date.
Initially, no routes were allotted to these vehicles. The vehicle owners were
granted a permit (commonly known as ZERO PERMIT), under which the vehicle could
ply all over Delhi on any route; area etc on their own choice beyond the boundary of
inner Ring Road. However, later on, it was found that the said ZERO PERMIT was
creating problems and conflicts between different operators which increased day by
day due to large number of operators on the same route/ roads. In fact, the purpose
of launching this scheme was apparently found defeating the very purpose for which
they were deployed, as many operators were not interested to ply their vehicles in
particular area.
To streamline the routes of Gramin Sewa the whole of Delhi was divided into
seven zones and further 66 temporary routes were identified/ decided and duly

published in leading newspapers dated 26.12.2010. The route code slip of these 66
zonal routes had been allotted randomly to the permit holders in their respective
zones according to their residential addresses.
A contract was granted to the DIMTS for route designing. The DIMTS had
designed 166 routes as uploaded at the department website. The Transport
Department had invited owners of Gramin Sewa vehicles to apply five route
preferences out of 166 routes. The registration of any fresh Gramin Sewa was stopped
on 16.05.2011. The department had granted the permanent route to all registered
permit holders through Draw of Lot on 166 routes.
Later on the routes granted were again changed three to four times. These
unsigned lists are available on department website and updated in the vahan system
with change of routes. However, no authenticate noting are found in the main file,
request/ applications for change of route, the same is also not available in the
registration files as well as main files. Some of the permit holders have sold their
vehicles and found that new route had been allotted during the issue of permit and
claiming old one as stated that they have not applied for route change. The taxi unit
has no solution to resolve their problems. The Taxi unit is allotting routes in
accordance with the data base record of DIMTS or as per original route permit allotted
to the owner of the Gramin Sewa vehicle.
The routes of Gramin Sewa vehicles have been changed from two to three
times. These lists are available on Transport website but no signed and authenticated
by any official of the Transport Department.
The observations of Secretary-Cum-Commissioner Transport dated 07.09.2015
from file no. MLO (TU)/TPT/15/102, Gramin Sewa Scheme. (copy of note sheet is
enclosed) is as under :
Hon’ble Chief Minister has also desired conducting comprehensive route
rationalization of all modes public transport in the city. Therefore, the routes of
Gramin Sewa vehicles need to be rationalized along with other services.

The requests for change/ modification/ alteration of routes of Maxi Cab and
Gramin Sewa vehicles was placed before the STA board vide agenda no. 6/2017 for
taking appropriate decision. The decision of the STA board is as under :
The matter was deliberated in detail and decided that the requests for
change/modification/ alteration of Maxi Cab/ Gramin Sewa cannot be entertained in
piece meal manner. Any route change without proper study and justification may
lead to cascading effect, resulting in resentment amongst affected parties. It was
decided that comprehensive/ scientific study in this regard may be carried out
through a professional agency in a time bound manner.
Sh. Sanjay Bathla is repeatedly questioning since 2011 on procedure of
allotment of routes to Gramin Sewa vehicles and he is stating that the routes for his
vehicles have never been allotted as per his choice and that those routes have been
allotted to his vehicles which he never applied.

Agenda No. 23/2017 :
Sub : Transfer of Permit : Mini Stage Carriage/Maxi Cab.
The representative of Association held a meeting with Commissioner
(Transport) on 15-03-2017 alongwith their grievances wherein inter alia discussed to
remove three year ban invoke by STA vide Resolution No. 06/2014. A meeting was
also held with the Special Commissioner (Transport)/Secretary (STA) on 24-03-2017
wherein it was proposed an Agenda note in this regard may be put up before the STA.
Brief facts :
The then Secretary (STA) while issuing consolidated instructions vide order No.
F.21/Secy/STA/2002/RTV/14 dated 10-02-2012 regarding routes change,
replacement, transfer of permit, waiver of certain charges/fees/penalty and renewal
of expire permit had taken into consideration the direction vide order dt. 18-08-2011
of Hon’ble High Court of Delhi that :
“in future no passenger stage carriage permits be granted/allotted whether
under scheme or otherwise, without advertising the same, so as to let out all the
desirous of applying therefore, know of availability thereof and without giving equal
opportunity to all concerned”.
Secretary (STA) in its order stated that court direction gave a set back to the
activities of touts/financers/mafias. It was transpired that such elements were eying
to grab permits of local stage carriage through another route i.e. transfer of permit.
It was gathered that such elements use to purchase old RTVs/Mini Feeder Buses with
its permits at throw away prices expecting replacement in near future to get the
permit transferred in their name. Though, permit can be transferred with the
permission of STA yet it was considered necessary to keep precautions that such
transfer did not resort to trading of permit especially when Stage Carriage permit is a
scares commodity being no open ended.
Hon’ble Supreme Court of India in the matter of “M.C. Mehta Vs. U.O.I &ors”
has also directed not to renew permits in case of its trading. In view of court orders,
to protect the interest of small operators and also to check illegal activities of

touts/financers/mafia, department had issued following consolidated instruction vide
odder no. F.21/Secy/ STA/ 2002/ RTV/14 dated 10-02-2012 (Annexure-‘A’).
(i) Route Change : Route change will not be allowed because as per Section 80 of
Motor Vehicle Act, 1988, any variation/extension or curtailment of the route or
routes or the area specified in the permit shall be treated as an application for
the grant of new permit.
(ii) Transfer of permit : Permission to allow transfer of local stage carriage permit
of RTV/Mini Bus has been restricted to the cases of death of permit holders
that too in the name of legal heir/successor of deceased permit holder.
(iii) Replacement of Vehicle : The owner of RTV/Mini Buses plying on stage
carriage permit can replace the old vehicle at the expiry of 10 years of life of
the vehicle from the date of its registration or earlier against the same permit
subject to the vehicle should be of six wheel confirming BS-IV emission norms
with CNG fuel and must have type approved by ARAI/VRDE and Transport
Department. The seating capacity of vehicle should not be less than 18 and not
more than 24 excluding driver. There should not be any approved standing
capacity. The vehicle should be installed with GPS and replacement will be
allowed only in the name of permit holder.
(iv) Renewal of expired permit : the competent authority has decided to allow
renewal of local stage carriage permit in those cases where validity of permit
expired after 01-01-2011 with the specific conditions of not allowing its
transfer except in case of death. The competent Authority has further decided
that in those cases where permit validity expired prior to 01-01-2011, renewal
will not be allowed and to treat these slots as vacant because the non-renewal
in time for considerable longer period is clear indication that permit holder is
not interested to operate the vehicle and renewal at belated stage would
relate to speculation/trading. Such vacant slot of local stage carriage permit
will be filled in due course with the approval of competent authority.
Later on the representations from the Transport Associations have been
received requesting to allow transfer of Stage Carriage Mini Buses/RTVs. The similar
requests were also received by the Taxi Unit Burari regarding transfer of permit of
Gramin Seva. The matter was put up before STA Board vide Agenda No. 6/2014. Shri
Sanjeev Jha, MLA, member of STA Board informed many associations of Maxi Cab have

also represented for transfer of Maxi Cab permit which was stopped during the year
2012. Another Member Shri Madan Lal, MLA pointed out that in case of an accident,
the claimant and insurance company find it difficult to settle the claims as the old
owner have no interest or liability and the present owner do not come forward to take
the responsibility of accident. Therefore, transfer of ownership and permit may be
allowed so that the legal owner/permit holder runs the vehicle. The view of Shri
Madan Lal, MLA was also supported by Special Commissioner of Police (Traffic) as the
enforcement of law would be efficient and challan would be delivered at correct
addresses of the permit holder. Accordingly, STA vide Resolution No. 6/2014 resolved
to approve the agenda of transfer of permit of mini buses/RTV/Maxi Cab subject to
the following conditions (Annexure-‘B’) :
i. The transfer shall be allowed only in case of valid permits. Further, no permit
shall be renewed which had expired on or before 31-12-2013. This shall ensure
that dead permits are not revived for the purpose of transfers.
ii. The vehicle on permit should be of six wheels conforming to Bharat Stage-IV
emission norms with CNG Fuel and type approved by the Transport
Department, Delhi in view of Mini Buses/RTVs.
iii. The antecedents of the purchaser shall be verified by the Delhi Police before
registration by Registering Authority i.e. MLO (HQ) as per practice in vogue.
iv. Transfer shall also be done in the same category of permit in which it was
allotted for example SC/ST, Ex-serviceman etc.
v. Affidavit of the Transferor on a judicial Stamp paper in prescribed format
shall be submitted.
vi. Transfer permit fee of Rs. 5000/- per vehicle and up to date of stand fee
should be paid.
vii. Permit once transferred in favour of prospective transferee after completion
of requisite formalities, will not be further transferable for a minimum period
of three year except in the case of death or disability/insanity of the permit
holder.
viii. Transfers shall be approved at the level of officers of the rank of Deputy
Secretary/Deputy Commissioner of STA/ARU/TU or above.

The representative of Association held a meeting with Commissioner
(Transport) on 15-03-2017 along with their grievances wherein inter alia discussed to
remove three year ban invoke by STA vide Resolution No. 06/2014.
The request of various Unions is placed before STA Board for taking appropriate
decision regarding removal of following condition invoked by STA Resolution No.
6/2014 :
“Permit once transferred in favour of prospective transferee after completion
of requisite formalities, will not be further transferable for a minimum period of
three year except in the case of death or disability/insanity of the permit holder”.
RESOLUTION No. 23/2017 :
The STA Board deliberated the issue in detail and considering the hardships
faced by the permit holders in genuine cases, it was resolved that :
The limitation period of three years for transfer from the date of change of
ownership is modified as under :
I The request for transfer during the first year of change of ownership shall not
be entertained.
II Request of transfers from more than one year and upto three years from the
date of change of ownership shall be approved by Secretary (STA) on case to
case basis.
III These shall not apply in cases of transfers due to death, disability/insanity of
permit holder and these will be continued to be considered as per existing
policy.
Agenda No.24/2017 :
Ex-Post facto approval of the Routes where STA and Traffic has accorded its
approval but could not incorporated in the Minutes of Meeting held on
15.09.2014.
STA Board during the meeting held on 15.09.2014 at agenda no. 11/2014 had
considered modification/extension/change mini stage carriage routes subject to

approval of Delhi Traffic Police with respect to Traffic Congestion point of view. Dy.
Commissioner of Police (Traffic), HQ vide letter dated 20.10.2014 informed that out
of 86 routes, 46 routes are basically extension of existing routes and hence, they had
the objection. Further on 25 routes, STA had not sought any clarification, therefore,
there is no objection on the same. Traffic Police had sought certain clarification on
remaining 17 routes.
The minutes of STA Board meeting held on 15.09.2014 was issued on
28.11.2014 after receiving the reply of Traffic Police vide letter dated 20.10.2014.
Further, in response to query of Traffic Police, Department vide letter dated
31.10.2014 furnished the requisite clarification to Traffic Police. Traffic Police vide
letter dated 14.01.2015 accepted the clarification of the Department except on route
no. F. 253A and F303A for which the Traffic Police had earlier conveyed their
approval were not recommended.
The President, Transport Operators, Labor Welfare Association (TOLWA) in his
complaint inter alia pointed out that STA and Traffic Police has accorded its approval
on the following routes but these were not incorporated in the minutes of meeting :-

Via : GokulPuri, Bhajan Pura, Khajoori, Pushta, Shastri Park.
4. Route No. F 702 : Uttam Nagar to Safdar Jung Terminal
Via : same as earlier.
5. Route No. 709A : Najafgarh to Mahipal Pur
Via : Nagli Sakrawati, Kakrola Bridge, NS Institute, Madhu Vihar, Dwarka Sector
1, 2, 3, Palam Village, Palam Airport, Shankar Vihar.

Commissioner, Transport has approved the above mentioned modification
subject to post facto approval by the STA Board. Accordingly, order dated
19.04.2016 was issued and many of operators have obtained the revised route permit.
The matter was placed before the STA Board meeting held on 16.05.2016.
The Board vide his resolution No. 4/2016 resolved that a committee of 3
officers consisting Dy. Secretary STA; Dy. Commissioner (Plg.) and Sh. Sanjay Dewan,
AS, STA may re-examine each and every route and agenda may be resubmit to
authority by Circulation.
Accordingly, the Committee deliberated upon the minutes of the STA board,
meeting held on 15th Sep. 2014, report of Delhi Traffic Police and representation/
request of operator /TOLWA. Delhi Traffic Police had approved all the existing routes
where buses are already plying informing that Delhi Traffic Police had no objection on
the proposed extension / modification from Traffic Point of Law on such existing
routes.
The observations of the Committee in respect of each route is enclosed as
Annexure A. The committee after examine the each and every route mentioned in the
agenda concluded that :
i) Route Rationalisation Committee in its report dt. 05-08-2014 did not
recommend any modifications in the above mentioned routes.
ii) Minutes of the STA board meeting dt. 15-09-2014 was issued after considering
the partial report of Delhi Traffic Police.
iii) There are variations in the minutes of STA board meeting, report of Delhi
Traffic Police and the representation of Operators / TOLWA.

The route of F-709A was originally from Najafgarh to Palam Village. The
operators requested for extension up to Mahipalpur which was allowed both by both
STA Board and Delhi Traffic Police. The via of the extension as approved by the STA
Board was Dwarka Sector 6-10, Bagdola, Dwarka Sector 21 under Pass, Pushpanjali,
Samlkha crossing, Rangpur to Mahipalpur. However the operators have demanded via
from Palam Gaon to Palam airport, Shankar Vihar and Mahipalpur, so that the
Comuters from Najafgarh get straight service up to Mahipalpur. Vide order dated 19-
04-2016 the via has been allowed as demanded by the operators subject to post facto
approved of the STA board.

Due to change in via the route overlap the route No. F-711A. Earlier number of
request had been received from the operators of route No. F-711A to not to allow any
other route buses on their route. After this change nos. of objections have been
received from operator of route No. F-711A that due to change in via of route No. F-
709A their route have become unviable.
In view of above since, the revised permits have already been issued on many
of the routes and there are no objections from the operators except for route no.
709A, the following proposal is submitted for consideration for STA Board :
1) F107A the merging of route No. F107A with route no. 913A may be allowed.
2) F208A the extension of route upto ISBT Ring road may be allowed as the STA
board has earlier allow the same on route no. F107, F114, F302, F806, F 808,
F902.
3) F248 the extension of route upto ISBT may be allowed as the STA board has
earlier allow the same on route no. F107, F114, F302, F806, F808, F902.
4) F702A upto Safderjung terminal may be allowed as recommended by traffic
police.
5) F832A - though the STA board in its meeting dated 15.09.2014 is approved
extension upto Pitampura Metro Station subject to approval of traffic police.
The Traffic Police has consented extension of route upto JJ colony Nangloi as
demanded by the operators. The Board may re-consider and may allow
extension upto JJ Colony Nangloi.
6) F709A - Since there are no. of objections from the operators of route No. F711A
due to overlapping of their routes, the amendments allowed in route No. F709A
may be reconsidered by STA board.
STA resolved that proposal contained in agenda was approved except Route No.
709A. Representatives of route no. 709A and 711A may be called for personal hearing
in the next meeting.
The representatives of both the routes were personally heard on 26-05-2017.
The representative of Route No. 711A stated that there are already 21 buses plying in

this route and another 17 buses of route No.709A has been added which causes undue
competition. It has requested that their route may change. Copy of representation is
placed as Annexure-‘A’.
The representatives of Route No. 709A stated that they are plying their buses
since last one year and there was no dispute with the route No. 711A. It is further
stated that at present there is no bus or any means of public transport from Najaf
Garh to Mahipal Pur. The department has rightly changed the route keeping in view of
public interest. Copy of representation is placed as Annexure-‘B’.
The matter is placed before the STA for taking appropriate decision.
RESOLUTION No. 24/2017 :
The STA Board after considering the representations of operators of route No.
F709A and F711A resolved not to grant ex-post facto approval for change of via of
route No. F709A from Shankar Vihar and they (F709A) will continue to operate on
their original route via through Rangpuri, Samalkha and Dwarka underpass. It was
further resolved that in future no route modifications should be allowed without
calling objections from affected parties.
Agenda No. 25/2017 :
Sub : Transfer of permit of vehicle No. DL-1VC-3081
Shri Nafe Singh son of Shri Banwari resident of 8 Q, Auchandi Road, village
Bawana, Delhi is registered owner of stage carriage RTV No. DL-1VA-7328 covered by
Permit No. SC/LPV/HQ/00368/2006 valid upto 25-03-2017, plying on route No. F826A
from Rithala Metro Station to Bawana Industrial Area.
Shri Nafe Singh out of bonafide needs and requirements intended to sell the
said vehicle to Shri Purshottam s/o Shri Jai Bhagwan and as mandatory both transferor

and transferee appeared before STA in person on 19-02-2015 to record personal
appearance in respect of transfer of permit of said vehicle.
Accordingly, the then Dy. Secretary (STA) granted approval for transfer of
permit on 09-03-2015 but the transfer of permit could not be taken place as per
policy in vogue of department.
Both transferor and transferee agreed to the policy and submitted a joint
application/representation thereby withdrawing the earlier request of transfer of
permit and requested for replacement of vehicle by inducting new six-wheeled
vehicle. Permission was granted for the same on 29-02-2016.
The owner of the vehicle deposited the permit in replacement mode on 01-03-
2016 and inducted new vehicle No. DL-1VC-3081 on 14-03-2016.
Further, both transferor and transferee re-appeared before the then AS (STA)
on 21-03-2016 with the purpose of transfer of permit/vehicle and DS (STA) approved
the same on 03-06-2016. Accordingly, the transferee got the new six wheeled vehicle
No. DK-1VC-3081 transferred in his name by depositing mandatory transfer fee
including up-to-date stand fee etc.
Resolution No. 11/2014 stipulates that where routes are modified shall not be
transferred for 3 years and such modifications in routes are temporary and may be
reviewed dependency on future traffic conditions. Permit was not issued in favour of
the transferee due to decision taken vide above resolution. He is pressing hard to
renew the permit as the permit expired on 25-03-2017. If department renews this
permit then it will come in the name of transferee.
The applicant further vide letter dated 24-04-2017 has requested to renew the
permit and he will abide by the decision taken by the STA Board in this regard.
Since, the ownership has been changed by the registering authority [MLO (HQ)].
The renewal of permit will be issued in the name of transferee only. The restriction
of three year will be completed on 14-09-2017. Decision taken during the STA Board
may be sought for one time relaxation in pursuance of condition of non-transfer of
permit for three year after change/modification of route as approved by STA vide
resolution No. 11/2014.

The matter is place before STA for decision.
RESOLUTION No. 25/2017 :
The matter contained in the agenda was deliberated in detail and resolved that
matter may again be examined in detail and the reasons leading to such kind of
situation may be carefully brought out. The matter may be put up in the next STA
meeting.
Agenda Note No. 26/2017 :
Sub : Replacement of Mini Stage Carriages.
Shri Ram Ji Lal requested to grant permission to replace vehicle No. DL-1VA-
2073 bearing Stage Carriage Permit No.SC/LPV/HQ/00202/2006 plying on route No. F-
838A (Mohan Garden to Uttam Nagar East Metro Station). The permit of the said
vehicle was valid upto 11-06-2011 and vehicle completed its lifetime of 10 years on
14-07-2012. Accordingly, permit holder applied for replacement of said vehicle and
recorded his personal appearance on 30-04-2014 as it is mandatory for replacement.
Transport Department vide order No. F.21/Secy/STA/2002/RTV/14 dated 10-
02-2012 permitted the replacement of Mini Stage Carriage for those vehicles
where life of vehicle and validity of permit expire after 01-01-2011. Further, STA
vide resolution No. 6/2014 during the meeting held on 16-06-2014 resolved that
permits of Mini Stage Carriage would not be renewed which expired on or before
31-12-2013. An order in this regard was issued on 01-08-2014.
The request of applicant was put up before the competent authority to grant
permission for replacement and renewal of permit. The competent authority
rejected the request due to change in policy. The applicant again requested to put
up his case before the STA Board. The STA during the meeting held on 16-05-2016
rejected the request due to change in policy. The applicant again requested to place
his case before the STA Board for reconsideration. The matter was put up and Special

Commissioner/Secretary (STA) enquired as how many similar cases are received by
STA.
In this regard it is submitted that there are 5 similar cases (including above
case) which were placed before the STA Board and Board rejected the request for
replacement of vehicle. The brief synopsis is as under :

due to policy change, applicant became in eligible for renewal of permit. Hence,
request was rejected.

STA Board vide resolution no. 17/2016 dated 16-05-2016 resolved that
due to policy change, applicant became in eligible for renewal of permit. Hence,
request was rejected.
i. Vehicle No. DL-1VA- 3908 :
Permit No. SC/LPV/HQ/00232/2006
Life of vehicle expired on 03-03-2013
Permit renewed upto 13-12-2011
The transfer of permit was approved by the then Dy. Commissioner (STA) on
25-10-2010. In the meantime, a complaint dated 14-10-2011 had been received. It
was requested to stop transfer of permit as there was civil court case was pending
against the permit holder. The matter was disposed of on 15-04-2014 vide order
passed by ACJ cum ARC, North West District, Rohini Court. The Court Passed the
following order :
“The matter has been settled in the Mediation Cell and now he does not wish
to pursue further within the present matter and same be disposed of as compromised.

Further it is jointly prayed by the parties that interim order passed vide order dated
16-08-2013 be vacated. In view of above, present matter is disposed off as
compromised. The interim order dated 16-08-2013 stands vacated. Both the parties
shall remain bound with their respective statements”.
The Commissioner Transport in the respective file has accorded permission to
place the matter before the STA Board for replacement and renewal of permit of said
vehicle.
Further, Sh. Laxmi Kant vide letter dated 13-04-2016 has made a request to
stay the proceeding of replacement/renewal of permit and also keep the file in safe
custody as the permit holder has not fulfilled the condition of settlement.
STA Board vide resolution no.22/2016 resolved that the request of
applicant for transfer of permit did not attain finality due to dispute among the
parties. Now due to policy change the applicant became in eligible for renewal of
permit. Hence, cannot be considered”.
Matter was placed before STA Board meeting held on 04-01-2017 and the STA
deferred the matter as it was desired to know the back ground of the policy change
which leads to rejection of these cases.
In this regard, it is submitted that during the meeting held on 16-06-2014,
while resolving Agenda No. 06/2014 (Annexure-‘B’) the STA inter alia resolved to
approve the agenda of transfer of permit of Mini Bus/RTV/Maxi Cab subject to
condition that :
“The transfer shall be allowed in case of valid permit. Further, no permit shall be
renewed which had expired on or before 31-12-2013. This shall ensure that dead
permits are not revived for the purpose of transfer.
Matter is placed before STA Board.
RESOLUTION No. 26/2017 :
Matter contained in the agenda was deliberated in detail. The Board wanted
to know how many other such cases are pending for decision. It was informed to the

Board that there might be a few more cases affected by this order. After
consideration, the STA Board approved the proposal contained in the agenda.
Agenda No. 27/2017 :
Sub : Issues related to Route Rationalisation
1) A Committee consisting of following officers was constituted vide order dt.
12.07.2016 (Annexure I) in pursuance of decision of STA Board vide Resolution
No. 21/2016 to examine rationalisation of routes of Mini Stage Carriages.

2) The Committee through the representations received from the Mini Stage
Carriages operators. A copy of the Report of the Committee is at Annexure II.
The demand can be categorised mainly in following categories:
I. Extension of existing routes as the present route has become unviable due to
gramin sewa / e-rickshaws / metro connectivity.
II. Transfer / merging to another route due to economic un-viability of present
route.
III. Demand of new route due to economic un-viability of present route.
IV. Change of via.
3) The Committee examined all the 73 routes on which 798 numbers of buses are
being operated.
a. Out of these on 29 routes four or less number of buses are being operated. The
Committee feels that any route on which such a low number of buses are being
operated fails to serve the purpose of connectivity. Being a very low frequency
route there is no convenience to the commuters.

b. It is also found that on 17 routes, 20 or more buses are being operated. There
are demands from operators to allot / merge with these routes. Being already
sufficiently filled route, any further transfer/ merging with these routes may
cause resentment amongst the existing operators
c. The Committee also observed that there are many routes whose via overlaps
for considerable distance.
4) The representative of DIMTS informed that the GPS installed on the mini buses
are being maintained by the DIMTS. A route mapping can, therefore, easily be
done at the level of DIMTS. The Committee also feels that the route
rationalisation, being a technical issue, cannot be done on the basis of request
of operators only. A larger perspective involving all the available mode of
transportation like Metro, DTC, Cluster, Gramin Sewa and also availability of E-
rickshaws in the areas are to be taken into account. The route rationalisation
should be done in a more scientific way using the GPS mapping and other data
about the number of passengers and number of options available to
Commuters.
5) The Route rationalisation Committee vide its report dated 07.10.2016 has
proposed that :
i) As an interim measure, the 24 routes on which there are 4 or less number of
buses, can be offered as a first alternative for transfer of routes by draw of
lots. For this the applications can be invited from all interested operators who
want their routes to be shifted / transferred / extended due to non-economic
viability of their present routes. The Committee has prepared the list of such
routes, on the basis of inputs from DIMTS, containing the tentative number of
buses that can be operated on these routes alongwith a time schedule.
ii) No extension / change of via / transfer may be allowed at present.
iii) All the routes should be rationalised through a scientific study which may be
got done through any professional agency.
iv) As a special case, the request of Route No. F812A from Bakarwala to Dwarka
may be considered for change of route as certain part of their routes which
passes through Najafgarh area has been made one-way due to construction of

Metro. But first they may be given option to shift to any of the 24 routes as
mentioned above.
6) Matter was placed before the STA Board meeting held on 04-01-2017 for
consideration.
7) The STA deliberated the issue in detail and it was observed that similar
requests were also received form Gramin Sewa and Maxi Cab operators vide
agenda No. 06/2017. The major reason for request of Change/ Alteration/
Modification of route is non-economic viability due to extension/opening of
new metro lines, increase in E-rickshaws and parallel operation of such
services. It was therefore decided that the requests for change / modification
/ alteration of Mini Stage Carriage buses cannot be entertained in piece meal
manner. Any route change without proper study and justification may lead to
cascading effect resulting in resentment amongst affected parties. It was
decided that a comprehensive / scientific study in this regard may be carried
out through a professional agency in a time bound manner.
8) DIMTS was requested to submit their proposal for carrying out scientific study
in this regard. Meeting was also held with DIMTS. DIMTS has submitted its
proposal and informed that study will require four months time from the date
of award of proposal.
9) Department has compiled the request of the operators and put it on the public
domain through department website and pasting the same on the notice board
of the department for soliciting the objections and suggestions on the
suggested change on the routes.
10) Department has also requested Delhi Traffic Police to offer their comments on
the request of operators for traffic circulation point of view. Response to the
reminder of the Department from the Traffic Police is still awaited.
11) In the mean while department also considered route allotment/rationalization
by constitution of committee of the departmental experts i.e. DTC & DIMTS till
such study is completed.

12) DTC and DIMTS were requested to nominate their experts. DIMTS has suggested
in order to carry out any re working of routes of Mini Stage Carriages/Gramin
Sewa etc. a proper study based on scientific data would be desirable. The
committee of experts would not be able to give any recommendation without
going in field and examining the request of route modification etc. However,
Senior Manager (Road Transport) has been nominated by DIMTS in this regard.
Nomination from DTC is still awaited.
13) In response to the putting up the list of request of operators on public domain,
department has received objections from the general public/fellow operators.
The list of objection has been compiled and annexed as Annexure-‘A’.
Matter is placed before STA Board for taking appropriate decision.
RESOLUTION No. 27/2017 :
The matter contained in the agenda was deliberated in detail. The STA Board
was of the view that routes where four or less than four Mini Stage Carriage buses are
plying on a route may be allowed to shift / merge with other routes as these routes
may not be providing any effective services to the commuters. The representative of
Delhi Traffic Police informed that they would provide their comments on the requests
of route modifications in a time bound manner after taking inputs from their zonal
offices. The STA Board resolved that the next meeting of STA Board should be
convened at the earliest and this issue should be taken up during next meeting.
Agenda No. 28/2017 :
Sub : Replacement of vehicle plying under Mini Stage carriage Permit.
A meeting was held on 30-07-2015 at 3.00 PM in the conference room of the
Hon’ble Minister of Transport on the issues raised by the Transport Operators &
Labour Welfare Association. (Annex-‘A’). In the minutes inter alia decided that STA
would look into the request of operator to allow replacement of vehicle with upper

model in respect of Mini Buses covered under Stage Carriage permit as existing policy
permit only new bus for replacement.
Section 83 of the Motor Vehicle Act, 1988, stipulates that (Annex. ‘B’)
Replacement of vehicles - The holder of a permit may, with the permission of the
authority by which the permit was granted, replace any vehicle covered by the
permit by any other vehicle of the same nature.
Further, STA during the meeting held on 22-12-2008 vide resolution No.
80/2008 resolved that replacement of vehicle where permit holder wants to replace
the bus on expiry of its prescribed life on Stage Carriage Permit, the practice of
allowing old/another buses on replacement shall be discontinued forthwith in order to
ensure parity. Henceforth, only new bus model (current year) registered in the name
of permit holder as owner Serial No. 1 will be permitted. (Annex-‘C’).
Vide order dated F.21/5/secy/STA/2002/ RTV/2011/4 dated 10-02-2012
replacement of the old stage carriage vehicle at the expiry of 10 years of life of
vehicle from the date of its first registration or earlier against the same permit was
allowed subject to the following conditions (Annex.-‘D’) :
i. The vehicle should have six wheels conforming to Bharat Stage IV emission
Norms with CNG fuel mode and must have type approved by ARAI/VRDE and
the Transport Department, Delhi.
ii. The approved seating capacity of the vehicle should not be less than 18 and
not more than 24 excluding the driver. There shall not be any approved
standing capacity.
iii. The vehicle should have body build by manufacturer (OEM) as per approved
specifications of the ARAI/VRDE.
iv. Six seats for ladies and two seats for senior citizens/handicapped persons
should be kept reserved on left side of the bus.
v. The vehicle should be installed with GPS device under the terms and
conditions mentioned in order No. AS/STA/Tpt/2010/267-274 dated 26-04-
2010.
vi. Replacement will be allowed only in the name of the permit holder and
transfer of permit (other than in favour of heir/successor in death case) shall
not be allowed.

Further, STA vide resolution No. 10/2016 in its meeting held on 16-05-2016
resolved that sub para (iii) of para 2 of the order dated 10-02-2012 of the Secretary
(STA), be amended to include private bus body builder accredited by the testing
agency along with the OEM (Annex.-‘E’).
It is pertinent to mention here that the Clause ‘b’ of sub Rule 2 of Rule 82 of
Central Motor Vehicle Rules, 1989, stipulates that (Annex.-‘F’) :
“Where a vehicle covered by a tourist permit is proposed to be replaced by
another, the latter vehicle shall not be more than two years old on the date of such
replacement”.
During the meeting of the Association with the Commissioner (Transport) on 15-
03-2017 and with the Special Commissioner/Secretary (STA) on 24-03-2017, the
matter of replacement of vehicle was discussed and it was proposed for inducting
upper model against replacement subject to following conditions that :
(i) Conditions for replacement of vehicle stipulated in the consolidated
instructions issued vide order No. F.21/Secy/ STA/ 2002/ RTV/14 dated 10-02-
2012 and its amendment vide order dated 31-05-2016 shall prevail.
(ii) After completion of 10 year life of existing Mini Stage Carriage, a new Mini
Stage Carriage (with owner Serial No. 1) as per above order may be replaced.
(iii) During the 10 year life of existing Mini Stage Carriage, in place of new vehicle,
an upper model (model higher than existing Mini Stage Carriage) may be
allowed to induct against replacement subject to the vehicle comply with the
emission norms prevailing at the time of replacement.
(iv) In case, upper model is inducted as per point (iii) above, the new vehicle is
compulsorily be inducted after completing 10 year life of old Mini Stage
Carriage vehicle.
(v) New vehicle complying with the current emission norms will be replaced if
emission norms revised.
Keeping in view of above, the matter is placed before STA Board for taking
appropriate decision regarding model of replacement of vehicle plying under Mini
Stage carriage Permit.

RESOLUTION No. 28/2017 :
Matter contained in the agenda was deliberated in detail. The STA board was
of the view that quality of service shall deteriorate in case old vehicles are replaced
in lieu of existing vehicle. It will not be in overall public interest. Only new vehicles
shall be brought as replacement. Hence proposal contained in the agenda is not
approved.
