Minnesota Rules: Amendments and AdditionsNOTICE:HowtoFollowStateAgencyRulemakingintheStateRegisterTheStateRegisteristheofficialsource,andonlycompletelisting,forallstateagencyrulemakinginitsvariousstages.Stateagenciesare
requiredtopublishnoticeoftheirrulemakingactionintheStateRegister.PublishedeveryMonday,theStateRegistermakesiteasytofollowandparticipateintheimportantrulemakingprocess.Approximately80stateagencieshavetheauthoritytoissuerules.EachagencyisassignedspecificMinnesotaRulechapternumbers.Everyodd-numberedyeartheMinnesotaRulesarepublished.Supplementsarepublishedtoupdatethissetofrules.Generallyspeaking,proposedandadoptedexemptrulesdonotappearinthissetbecauseoftheirshort-termnature,butarepublishedintheStateRegister.
AnagencymustfirstsolicitCommentsonPlannedRulesorCommentsonPlannedRuleAmendmentsfromthepubliconthesubjectmatterofapossiblerulemakingproposalunderactiveconsiderationwithintheagency(MinnesotaStatutes§§14.101).ItdoesthisbypublishinganoticeintheStateRegisteratleast60daysbeforepublicationofanoticetoadoptoranoticeofhearing,orwithin60daysoftheeffectivedateofanynewstatutorygrantofrequiredrulemaking.
Whenrulesarefirstdrafted,stateagenciespublishthemasProposedRules,alongwithanoticeofhearing,oranoticeofintenttoadoptruleswithoutahearinginthecaseofnoncontroversialrules.Thisnoticeasksforcommentontherulesasproposed.Proposedemergencyrules,andwithdrawnproposedrules,arealsopublishedintheStateRegister.Afterproposedruleshavegonethroughthecommentperiod,andhavebeenrewrittenintotheirfinalform,theyagainappearintheStateRegisterasAdoptedRules.Thesefinaladoptedrulesarenotprintedintheirentirety,butonlythechangesmadesincetheirpublicationasProposedRules.Toseethefullrule,asadoptedandineffect,apersonsimplyneedstwoissuesoftheStateRegister,theissuetheruleappearedinasproposed,andlaterasadopted.

conditionsexistthatdonotallowtheCommissionertocomplywiththerequirementsforemergencyrules.TheCommissionermustsubmittheruletotheattorneygeneralforreviewandmustpublishanoticeofadoptionthatincludesacopyoftheruleandtheemergencyconditions.ExpeditedemergencyrulesareeffectiveuponpublicationintheState Register,andmaybeeffectiveuptosevendaysbeforepublicationundercertainemergencyconditions.

TheconditionsthatdonotallowcompliancewithMinnesota Statutes,Sections97A.0451to97A.0459,areasfollows:Eachyear,Minnesotajoinsotherstatesalongthelightgoosemigrationrouteinallowingaspringharvestforpopulationreduction.Thisactionisintendedtomitigatetheimpactoflightgeeseonfragilearcticnestinghabitat,asprescribedbytheU.S.FishandWildlifeService(“USFWS”).ThisactionhasbeenauthorizedbytheUSFWSandhasbeenheldannuallyinMinnesotasince2000.TheMinnesotaDepartmentofNaturalResourcesusescurrentbiologicalandharvestdatatoadjusttheseasonvariablesassociatedwiththisaction.

Forpurposesofthispart,“lightgoose”meansalessersnowgooseincludingabluephaselessersnowgoose(Anserc.caerulescens)oraRoss’sgoose(Anserrossii). Subp.2. Permit required. Apersonmaynottakealightgooseduringtheperiodprescribedinsubpart3exceptwithavalidpermitandinfullcompliancewiththispartandtheconditionsinthepermit.Residentsandnonresidentsmayapplyforpermits.Nohuntinglicenseorstampsarerequired.Apermitholdermusthaveapermitinpossessionatalltimeswhentakingortransportinglightgeesetakenunderthispartandmustretainthepermitforaslongasthepermitholderpossesseslightgeesetakenunderthispart. TheconditionsthatdonotallowcompliancewithMinnesotaStatutes,sections97A.0451to97A.0459,areasfollows:thatdistributionoflicensesfortheturkeyseasonaresubjecttomodificationonanannualbasisastheDepartmentofNaturalResourcesrefinesthemannerbywhichtheseasonisconductedtoprovidehigh-qualityhuntingopportunitiesandassureequitabledistributionofharvest.Turkeypopulationandharvestdatausedforselectinghuntersandsettingquotasandareasisgatheredannuallyandanalyzedinlatesummer.Adjustmentstopermitareaboundariesandlicensequotasarebasedonannualandlong-termpopulationdataaswellasinputfromthepublic.
TheSt.MichaelsMeadowsWildlifeManagementAreaisanintegralpartofawetlandrestorationprojectbut
cannotsustainfirearmshuntingduetoitsproximitytoalargeresidentialhousingdevelopment.ChangestotheCarlosAveryWildlifeManagementUnitSanctuaryimproveopportunitiesforyouthordisabledhunterswhoareparticipatinginspecialhunts.ChangestoCrossLakeandCampRipleyGameRefugesinCrowWingandMorrisoncounties,respectively,provideadditionalhuntingopportunityonrefugeswherethereisaharvestablesurplusofwildturkey.

Rulemaking authority and procedure.MinnesotaStatutes,section62J.61,establishesarulemakingprocedureforadoptingrulestoimplementtheMinnesotaHealthCareAdministrativeSimplificationAct,MinnesotaStatutes,sections62J.50to62J.61.Theprocedureprovidesthat:
