Minnesota Rules: Amendments and AdditionsNOTICE:HowtoFollowStateAgencyRulemakingintheStateRegisterTheStateRegisteristheofficialsource,andonlycompletelisting,forallstateagencyrulemakinginitsvariousstages.Stateagenciesare

requiredtopublishnoticeoftheirrulemakingactionintheStateRegister.PublishedeveryMonday,theStateRegistermakesiteasytofollowandparticipateintheimportantrulemakingprocess.Approximately80stateagencieshavetheauthoritytoissuerules.EachagencyisassignedspecificMinnesotaRulechapternumbers.Everyodd-numberedyeartheMinnesotaRulesarepublished.Supplementsarepublishedtoupdatethissetofrules.Generallyspeaking,proposedandadoptedexemptrulesdonotappearinthissetbecauseoftheirshort-termnature,butarepublishedintheStateRegister.

AnagencymustfirstsolicitCommentsonPlannedRulesorCommentsonPlannedRuleAmendmentsfromthepubliconthesubjectmatterofapossiblerulemakingproposalunderactiveconsiderationwithintheagency(MinnesotaStatutes§§14.101).ItdoesthisbypublishinganoticeintheStateRegisteratleast60daysbeforepublicationofanoticetoadoptoranoticeofhearing,orwithin60daysoftheeffectivedateofanynewstatutorygrantofrequiredrulemaking.

Whenrulesarefirstdrafted,stateagenciespublishthemasProposedRules,alongwithanoticeofhearing,oranoticeofintenttoadoptruleswithoutahearinginthecaseofnoncontroversialrules.Thisnoticeasksforcommentontherulesasproposed.Proposedemergencyrules,andwithdrawnproposedrules,arealsopublishedintheStateRegister.Afterproposedruleshavegonethroughthecommentperiod,andhavebeenrewrittenintotheirfinalform,theyagainappearintheStateRegisterasAdoptedRules.Thesefinaladoptedrulesarenotprintedintheirentirety,butonlythechangesmadesincetheirpublicationasProposedRules.Toseethefullrule,asadoptedandineffect,apersonsimplyneedstwoissuesoftheStateRegister,theissuetheruleappearedinasproposed,andlaterasadopted.

Exempt RulesExemptrulesareexcludedfromthenormalrulemakingprocedures(Minnesota Statutes§§14.386and

14.388).Theyaremostoftenoftwokinds.OnekindisspecificallyexemptedbytheLegislaturefromrulemakingprocedures,butapprovedforformbytheRevisorofStatutes,reviewedforlegalitybytheOfficeofAdministrativeHearings,andthenpublishedintheStateRegister.Theseexemptrulesareeffectivefortwoyearsonly.

ThesecondkindofexemptruleisoneadoptedwhereanagencyforgoodcausefindsthattherulemakingprovisionsofMinnesota Statutes,Chapter14areunnecessary,impracticable,orcontrarytothepublicinterest.Thisexemptioncanbeusedonlywheretherules:

(1)addressaseriousandimmediatethreattothepublichealth,safety,orwelfare,or(2)complywithacourtorderorarequirementinfederallawinamannerthatdoesnotallowforcompliance

with Minnesota Statutes Sections14.14-14.28,or(3)incorporatespecificchangessetforthinapplicablestatuteswhennointerpretationoflawisrequired,or(4)makechangesthatdonotalterthesense,meaning,oreffectoftherules.TheseexemptrulesarealsoreviewedforformbytheRevisorofStatutes,forlegalitybytheOfficeof

AdministrativeHearingsandthenpublishedintheState Register.Inaddition,theOfficeofAdministrativeHearingsmustdeterminewhethertheagencyhasprovidedadequatejustificationfortheuseofthisexemption.Rulesadoptedunderclauses(1)or(2)aboveareeffectivefortwoyearsonly.TheLegislaturemayalsoexemptanagencyfromthenormalrulemakingproceduresandestablishotherproceduralandsubstantiverequirementsuniquetothatexemption.

Adoption of Permanent Exempt Rules Referencing Property Tax Data Submissions: Amending Minnesota Rules, parts 8106.0700 and 8106.0800; Revisor’s ID Number R-04629.

WHEREAS:1. TherulemakingprovisionsofMinnesota Statutes,Chapter14,areunnecessaryandimpracticablewhen,as

inthiscase,amendmentsaremadetoarulethatincorporatesspecificchangessetforthinapplicablestatuteswhennointerpretationoflawisrequired.Minnesota Statutes,section14.388.

2. TheattachedFindings&StatementofSupportingReasonsjustifiesthegoodcauseexemptionfromrule-makingprovidedbyMinnesota Statutes,section14.388,andisherebyincorporatedbyreference.

3. Therulemakingcomplieswithallapplicablelaw,including:a)theproceduralrequirementsinMinnesota Statutes,section14.388,andMinnesota Rules,part1400.2400;andb)thenoticerequirementsinMinnesota Statutes,sections14.22,subdivision1,and14.388,subdivision2.TheDepartmentprovidednoticeinvariousways,including:providingnoticeontheDepartmentwebsiteandintheStateRegister;sendingnoticetopersonswhoregisteredtheirnamewiththeDepartmentunderMinnesota Statutes,section14.14,subdivision1a;andsendingnoticetoallcountyassessors,auditors,andtreasurerswhosubmitpropertytaxdatatotheDepartment.

4. TheattachedcertifiedcopyoftheruledemonstratesthattheOfficeoftheRevisorhasapproveditsform,asrequired by Minnesota Statutes,section14.386,paragraph(a)(1),andMinnesota Rules,part1400.2400.

FINDINGS & STATEMENT OF SUPPORTING REASONSI. BackgroundThe2019taxbill(2019Minnesota Laws,1stSpecialSession,chapter6)amendedMinnesota Statutes,section

270C.85,subdivision2,toclarifythatthecommissionerofrevenuemaycollectpropertytaxdataattheparcellevelorhigherinthetime,form,andmannerasthecommissionermayprescribe.ThismethodofcollectionisconsistentwithpropertytaxdatacollectionunderthePropertyRecordInformationSystemofMinnesota(PRISM).Sectionsofstatutethatreferencedabstract-levelpropertytaxdatawerealsoamendedtocross-referenceMinnesota Statutes,section270C.85,subdivision2.

TheproposedamendmentstoMinnesota Rules,Chapter8106,bringtheChapter8106rulesintoconformitywiththesestatutorychanges.

II. Amendments Exempt Because They Reflect Statutory ChangeMinnesota Statutes,section14.388,subdivision1,clause(3),providesagoodcauseexemptiontotheregular

rulemakingprocessforamendmentsthat“incorporatespecificchangessetforthinapplicablestatuteswhennointerpretationoflawisrequired.”

ThefollowingproposedamendmentsqualifyforthegoodcauseexemptionbecausetheybringChapter8106intoconformitywithstatutorychange:

• Minnesota Rules,part8106.0700,subpart3,isbeingamendedtoreflectstatutorychangeconsistentwiththecross-referencechangestopropertytaxdatasubmissionsthatoccurredinthe2019taxbill.Theproposedamendmentsremovereferencestotheabstractsofassessment,whicharenolongerfiledbythecountiestothecommissionerunderPRISM.LanguageisinsertedwhichreferstopropertytaxinformationreportedtothecommissionerofrevenueunderMinnesota Statutes,section270C.85,subdivision2,clause(4).

• Minnesota Rules,part8106.0800,subpart2,isbeingamendedtoreflectstatutorychangeconsistentwiththecross-referencechangestopropertytaxdatasubmissionsthatoccurredinthe2019taxbill.TheproposedamendmentsremovereferencestotheStateBoardofEqualizationabstractofmarketvalue,whichisnolongerfiledbythecountiestothecommissionerunderthePRISM.LanguageisinsertedwhichreferstopropertytaxinformationreportedtothecommissionerofrevenueunderMinnesota Statutes,section270C.85,subdivision2,clause(4).
