Chair Jung called the meeting to order at 9:00 a.m. in Lansing, Michigan. Michigan Department of Transportation Director’s Report – Kirk Steudle Director Steudle presented information about the transportation revenue package and the ballot proposal that will be decided by voters in May. A complex set of bills break apart funding so that taxes paid at the pump will all go to transportation and schools will get funding from sales tax (schools will gain about $300 million in funding per year). All the proposed changes will take effect only if voters approve the sales tax increase referendum. The 6 percent sales tax from fuel will be removed, then the state gas tax will go from 19 cents to 41 cents per gallon and the state diesel fuel tax will go from 15 cents to 46 cents per gallon; resulting in an increase of about 12 cents per gallon in October 2015. Registration fees for new cars will increase 30 percent starting in 2016, for hybrid and electric vehicles fees will increase $25 to $75 per year, and for trucks larger than 26,000 pounds fees will increase about 30 percent. The State’s earned-income tax credit will increase to from 6 to 20 percent of federal credit. These changes will generate an additional $1.2 billion per year in revenue for roads and bridges; however, the funding distribution will be phased in and will not reach its full effect until 2018. Through the Act 51 formula, which is not changing, funding is distributed 39 percent for county roads, 22 percent for city streets, and 39 percent for state trunkline. To combat inflation each year, revenue will increase with consumer prices but cannot raise more

than 5 cents per year. A firm floor is also built into the revenue calculations, so the fuel taxes will not fall below the initial increase. Steudle reminded commissioners that MDOT cannot advocate how to vote on the proposal. He said MDOT can and will educate people about the facts of the plan when invited to town halls and other meetings. Commissioner Afendoulis asked what the public education campaign might look like. Director Steudle said MDOT would not be leading a campaign so he does not know what is planned, but MDOT is available to be a source of information for any groups that do. Commissioner Boji, asked if the ballot initiate passes, when could MDOT start using the funding? Director Steudle said they are looking at what projects are ready and can be started quickly and if short-term bonds could be taken out to start projects prior to receiving the new funding. Commissioner Hayes asked whether we should address what to do if the funding does not pass in March rather than wait until after the vote. He also asked whether commissioners could speak publically about the proposal. Director Steudle said that in March they can continue the discussion started last July to address reevaluating our goals to meet limited funding resources. The Director also said public employees and commissioners can act personally “off-the-clock” but not in an official capacity. Chair Jung asked about funding that the Regional Transit Authority (RTA) receives and Detroit bussing. Director Steudle said that funding for the Suburban Mobility Authority for Regional Transportation (SMART) and Detroit Department of Transportation (DDOT) goes through the RTA. At this time, the busses are under DDOT and eventually the programs may grow together, but there is not a forced merger right now. No motion required.

II. COMMISSION BUSINESS Minutes of December 4, 2014, Commission Meeting Chair Jung requested a motion regarding approval of the minutes from the State Transportation Commission meeting of December 4, 2014. Commissioner Afendoulis made a motion to approve and Commissioner Boji supported. Chair Jung led a voice vote; all members present voted in favor; motion to approve carried.

III. OVERSIGHT Exhibit A: Contract Agreements – Myron Frierson Mr. Frierson presented information on 29 agreements. Pending any questions, Mr. Frierson asked for approval of Exhibit A. Chair Jung requested a motion regarding approval of Exhibit A. Commissioner Hayes made a motion to approve and Commissioner Afendoulis supported. Supplemental Exhibit A: Contract Agreements – Myron Frierson Mr. Frierson presented information on one agreement. Pending any questions, Mr. Frierson asked for approval of Supplemental Exhibit A. Chair Jung requested a motion regarding approval of Supplemental Exhibit A. Commissioner Hayes made a motion to approve and Commissioner Boji supported. Chair Jung led a voice vote; Commissioner Moser abstained from the vote, all other members present voted in favor; motion to approve carried. Exhibit A-1: Bid Letting Pre-Approvals – Myron Frierson Mr. Frierson presented information about Letting Statistics and Exhibit A-1. Projections for fiscal year 2015 are for 276 state jobs and a total construction cost estimate of $691 billion. At this point in the year, MDOT has let 93.3 percent of jobs anticipated and 141 percent of cost estimates. January lettings were on January 9 and 14. Upcoming February lettings are currently advertising 49 projects. Exhibit A-1 lists 34 projects. Pending any questions, Mr. Frierson asked for approval of Exhibit A-1. Chair Jung requested a motion regarding approval of Exhibit A-1. Commissioner Afendoulis made a motion to approve and Commissioner Moser supported. There were 11 justifications for projects where the low bid exceeded the engineer’s estimate by more than ten percent; OCA has reviewed. Pending any questions, Mr. Van Port Fleet asked for approval of Exhibit A-2. Chair Jung requested a motion regarding approval of Exhibit A-2. Commissioner Moser made a motion to approve and Commissioner Afendoulis supported. Chair Jung led a voice vote; all members present voted in favor; motion to approve carried. Exhibit A-3: Information for the Commission – Myron Frierson Mr. Frierson provided information on three projects with engineer’s estimates under $500,000 and with only one bidder for each project.

Exhibit A-4: Bid Letting Not Pre-Approved – Myron Frierson Mr. Frierson presented 33 projects that were let on January 9, 2015, prior to informing the Commission, so approval is now requested based on the bids. Pending any questions, Mr. Parker asked for approval of Exhibit A-4. Chair Jung requested a motion regarding approval of Exhibit A-4. Supplemental Exhibit A-4: Bid Letting Not Pre-Approved – Myron Frierson Mr. Frierson presented one project that was let on January 22, 2015, prior to informing the Commission, so approval is now requested based on the bids. Exhibit B: Contract Projects Finaled – Brenda O’Brien Ms. O’Brien presented information about Exhibit B, which included cost comparison information about recently finaled contracts. For MDOT projects in November and December, there were 73 projects totaling $93.2

million finaled; six of those were more than 10 percent over original contract amounts. 41 projects came in under original contract amounts. For November and December, final contract costs averaged 3.17 percent over and 1.64 percent under original contract amounts, respectively. So far during fiscal year 2015, closed out MDOT projects have totaled $121.9 million and averaged .7 percent over original contract amounts. For local agency projects in November and December, there were 98 projects totaling

$63.7 million finaled; 9 of those were more than 10 percent over original contract amounts. 54 projects came in under original contract amounts.

Reasons for additional project costs were provided in the meeting materials for 2 MDOT and 3 local agency projects that exceeded their original contract amounts by more than 10 percent.

IV. NOMINATIONS

Local Bridge Advisory Board (LBAB) Term Renewals – Frank Raha Mr. Raha spoke about what the LBAB does and noted that section 247.660 of the State Trunkline Highway System Public Act 145 gives the STC authority to appoint voting members of the board. Six voting board members’ terms expired in December 2014: Wayne Harrall, Doug Mills, Mark Craft, Jim Wonacott, Robert Clegg, and Kevin Maillard. Pending any questions, Mr. Raha requested that their terms be renewed for January 2015 through December 2016.

Chair Jung led a voice vote; all members present voted in favor; motion to approve carried.

V. PRESENTATIONS

Final 2015-2019 Five-Year Transportation Plan – Craig Newell Mr. Newell spoke about changes from the draft plan presented last month, including the addition of a cover letter from Director Steudle that speaks about MDOT efficiencies and provides a high-level overview of the revenue proposal. The draft plan was posted online on December 5 and was available for comment through January 5, twenty comments were received. All comments were directed to appropriate MDOT project areas to be addressed. The plan’s anticipated investment during the five-year period is $8.3 billion, with $5.8 billion for highways; $1.6 billion for bus, rail, and marine; and $850 million for aviation. The majority of the highway investment strategy will be on system preservation, safety, operations, and maintenance. The plan does not reflect any potential revenue increases should the ballot initiative pass in May. The plan illustrates funding challenges in the final four years, showing projected state revenue shortfalls of $120 million to $130 million per year. If the state does not provide matching funds, Michigan would lose $650 million to $750 million per year in federal aid. Regarding public transportation investment, revenues will not be sufficient to maintain current program levels, and reductions are being made to maintain essential services. On the aviation side, the goal is to preserve infrastructure, improve efficiencies, and secure federal funding for 236 public use airports. Pending any questions, Mr. Newell asked for approval of the five-year plan, which will then be submitted to the Legislature by March 1. Chair Jung requested a motion regarding approval of the five-year plan. Commissioner Wyett made a motion to accept and Commissioner Hayes supported. Commission Advisor Raha took a roll call vote, voting in favor were Chair Jung, Vice-Chair Wyett, Commissioners Afendoulis, Boji, Hayes, and Moser, opposed were none; motion to approve carried.

VI. PUBLIC COMMENTS

Paul Palmer, Developmental Disability Council, and Donna Shull Ms. Shaw read a statement written by Mr. Palmer. Mr. Palmer traveled on December 18 using the Michigan Flyer and was dropped-off at the new spot in the ground transportation building. He noted issues with air quality, restroom facilities, and distance. He requested that the Commission vote to end funding to the airport.

Fred Wurtzel, National Federation of the Blind of Michigan Mr. Wurtzel noted that David Robinson will be handing out a resolution that calls for the return of the pick-up spot to in front of the McNamara Terminal. He noted that persons with

disabilities travel a lot for business. He felt that the issues with the new spot send a poor message about Michigan to people who are new to the state.

David Robinson, National Federation of the Blind of Michigan Mr. Robinson feels that people with disabilities are suffering physically with the use of the new drop-off/pick-up spot. He also feels that the American Disabilities Act is not being followed; people with disabilities are not being given equal access to what the general public has at the airport.

Walter Sorg, Mid-Michigan Environmental Action Council Mr. Sorg recently used the Michigan Flyer at the new drop-off spot; he noted issues with distance, weather, and space for coach parking. He urged the Commission to use funding to influence the Metropolitan Airport Authority to fully accommodate the needs of passengers who use the Michigan Flyer.

Director Steudle noted that the Department does not provide any funding to the Metropolitan Airport Authority and federal funding goes directly to the airport because they are a large airport. Chair Jung stated that the Commission is sympathetic to the issue and he will speak with the airport director personally.

10. PASSENGER TRANSPORTATION - Section 5309 Program

Project Authorization (10) Revision (4) under Master Agreement (2007-0205) between MDOT and the Eaton County Transportation Authority (EATRAN) will add parking lot renovation to the facility line item, will adjust the funding between line items, and will extend the authorization term by six months to provide sufficient time for EATRAN to complete the facility renovations. The removal of the underground storage tank and the repaving of the parking lot have been delayed because of the winter weather. The original authorization provides state matching funds for EATRAN’s FY 2010 Federal Section 5309 Capital Discretionary Program grant for the purchase of vehicles and for facility construction. The revised authorization term will be April 15, 2011, through September 24, 2015. The authorization amount remains unchanged at $1,250,000. The term of the master agreement is from October 1, 2006, until the last obligation between the parties has been fulfilled. The master agreement includes authorizations for program years FY 2007 through FY 2011. Source of Funds: Federal Transit Administration Funds - $1,000,000; FY 2002, FY 2010, and FY 2014 State Restricted Comprehensive Transportation Funds - $250,000.

11. PASSENGER TRANSPORTATION - Section 5311 Capital Program Project Authorization (7) Revision (1) under Master Agreement (2012-0176) between MDOT and the Van Buren County Board of Commissioners will reduce the amount of federal funds by $60,059 and of state funds by $15,015 for the purchase of buses. To avoid allowing FY 2010 Section 5311 Nonurbanized Area Formula Capital Program/American Recovery and Reinvestment Act of 2009 (ARRA) funds to lapse, funds from the ARRA grants will be used to supplement the costs of the buses under two new authorizations (2012-0176/P11 and 2012-0176/P12). The original authorization provides state matching funds for the FY 2013 Federal Section 5311 Nonurbanized Area Formula Capital Program, Surface Transportation Program, and the Congestion Mitigation and Air Quality Improvement Program grant for the purchase of buses. The authorization term remains unchanged, September 23, 2013, through September 22, 2016. The revised authorization amount will be $183,610. The term of the master agreement is from October 1, 2011, until the last obligation between the parties has been fulfilled. The master agreement includes authorizations for program years FY 2012 through FY 2016. Source of Funds: Federal Transit Administration Funds - $143,879; FY 2013 State Restricted Comprehensive Transportation Funds - $35,970; Van Buren County Funds - $3,761.

12. PASSENGER TRANSPORTATION - Service Initiatives Project Authorization (2) under Master Agreement (2015-0139) between MDOT and the Regional Transit Authority of Southeast Michigan (RTA), in Wayne County, will provide state funding for the Authority's administrative costs. The authorization will be in effect from the date of award through three years. The authorization amount will be $1,100,000. The term of the master agreement is from October 1, 2014, until the last obligation between the parties has been fulfilled. The master agreement includes authorizations for program years FY 2015 through FY 2016. Source of Funds: FY 2015 State Transportation Funds - $1,100,000.

13. *RAIL - Reduce Loan Amount Amendatory Contract (2014-0893/A2) between MDOT and Quality Liquid Feeds, Inc. (QLF), will reduce the loan amount by $4,550 to reflect the actual costs of the project. The original contract provides financial assistance in the form of a loan from MDOT to QLF for the construction of a rail spur at an industrial park in Comstock Park, Michigan. The contract term remains unchanged, from August 26, 2014, until the last obligation between the parties has been fulfilled, until the contract is terminated, or until the loan has been fully repaid. The revised project cost will be $559,835. The revised loan amount will be $279,917.50, 50 percent of the project cost. Source of Funds: FY 2014 State Restricted Comprehensive Transportation Funds - $279,917.50; QLF Funds - $279,917.50.

FEBRUARY 2015

STATE PROJECTS OVERVIEW

The February 6, 11, 12, and 18, 2015, Bid Lettings, included 26 State trunkline projects with $112.5 million in

engineer estimates. The low bids received totaled $112.8 million. The average low bid was $4.3 million and the

median of $1.8 million. In comparing State projects of the February 2014, Bid Lettings, 28 State projects were

let with $44.4 million in engineer estimates and a low bid total of $44.8 million.

Of the 26 State projects let in February of 2015, 11 included warranties with $82.7 million as the low bid total.

The 26 State projects received a total of 89 bids.

For fiscal year to date, 121 State projects have been let with the low bid total of $549.5 million. Compared to the

same period last year, 121 State projects were let with a low bid total of $424.2 million.

PROJECTS BID SUMMARY

The total number of bids received for the 58 projects let in February was 278 for an average of 4.79 bids per

project.

There was one project postponed from the February 6, bid letting and currently one (State) project for which all

bids have been rejected.

Of the 116 contracting companies eligible to bid for the February lettings, 103 submitted at least one bid.

JOB PROJECTIONS

Anticipated to be let during FY 2015 are 276 State jobs with a construction cost estimate total of

$691.2 million.

For fiscal year to date, 90.8% of State jobs anticipated for this period have been let using 115.6% of the projected

cost estimates. For this same period last year, 90.1% of State jobs were let using 80.7% of the projected

construction costs.

UPCOMING LETTING STATS

The March 6, 2015, Bid letting is currently advertising 40 State trunkline projects with a total engineer estimate

of $179.4 million. Of the 40 State projects, 19 include warranties with engineers’ estimates of $154.6 million. In

addition, 41 Local area projects are advertised with a total engineer estimate of $27.1 million.

The special letting scheduled for March 11, 2015 is currently advertising five fixed-price variable scope State

projects with a total estimated price of $3.3 million. Of the five State projects, four include warranties with a total

estimated price of $1.7 million. One Local area project is advertised for this special letting with a contract price

of $333.3 thousand.

MARCH 6, 2015 and CMGC

STATE PROJECTS OVERVIEW

The March 6, 2015, Bid Letting, and including the CMGC project for March, comprised a total of 40 State

trunkline projects with $186.0 million in engineer estimates. The low bids received totaled $184.2 million. The

average low bid was $4.7 million and the median of $1.4 million. In comparing State projects of the March 2014,

Bid Lettings, 37 State projects were let with $77.5 million in engineer estimates and a low bid total of

$83.6 million.

Of the 40 State projects let through March 6, 19 included warranties with $153.3 million as the low bid total. The

40 State projects received a total of 111 bids.

For fiscal year to date, 161 State projects have been let with the low bid total of $733.7 million. Compared to the

same period last year, 158 State projects were let with a low bid total of $507.8 million.

PROJECTS BID SUMMARY

The total number of bids received for the 79 projects let through March 6 and including the CMGC project was

249 for an average of 3.15 bids per project.

Three projects were withdrawn from the March 6, bid letting and one project received no bids. Currently, there

are no projects for which all bids have been rejected.

Of the 119 contracting companies eligible to bid for the March 6 letting, 93 submitted at least one bid.

Anticipated to be let during FY 2015 are 276 State jobs with a construction cost estimate total of

$691.2 million.

For fiscal year to date, 94.5% of State jobs anticipated for this period have been let using 117.7% of the projected

cost estimates. For this same period last year, 88.8% of State jobs were let using 78.6% of the projected

This increase was needed to address the saturated condition of the subbase and allow removal of moisture moving up through the subgrade to help stabilize the condition of the subbase. As reported in the attached Schedule of Auditor’s Reports Outstanding, the processing of some auditor’s reports did not occur within the timeline provided for in the guidance document. The project included in this report was funded by the American Reinvestment andRecovery Act (ARRA) and included costs paid by the city to the contractor forliquidated damages. However, the original ARRA funding amount was not sufficientfor the department to reimburse the city for the liquidated damages. The department isseeking increased funding from the Federal Highway Administration to address theshortfall.

The Office of Commission Audits recommended on January 11, 2012, to the Office ofRail that the corporation's concerns, regarding the audit report results, be discussed bythe Disputed Audit Review Team (DART). DART met on April 13, 2013, andrequested that the Office of Rail seek a contract amendment to eliminate the auditadjustment. Because of complications in the negotiation process, the amendment hasbeen delayed. The Office of Rail anticipates that it will include the amendment on aState Transportation Commission agenda in April 2015.
