RESOLVED: To approve the purchase of two (2) 2012 regular cab 3/4 ton 4 x 4 work trucks with 9’ Boss super-duty trip edge plows be awarded to Bill Snethkamp Dodge, 6131 S; Pennsylvania Ave., Lansing, MI 48911 at a cost of $27,277.15 each for a total of $54,554.30.

9a. Public Hearing/Motion – Approval of Industrial Development District – Katcon Properties

Mayor McDonald opened the public hearing at 7:34 p.m.

Economic Development Director Johnson introduced Jose DeNigris, President of Katcon USA. Mr. DeNigris stated the company is located at 2965 Lapeer Road, is a provider of automotive supplies and the project presented will include catalytic converters and exhaust systems.

Mayor McDonald closed the public hearing at 7:37 p.m.

Moved by Mr. Newkirk; Seconded by Ms. Doyle. RESOLVED: To approve the request for establishment of an IDD for Katcon Properties with the adoption of the attached resolution (Attachment B).

9b. Public Hearing/Motion – Approval of Industrial Facility Exemption Certificate – Katcon USA, Inc.

Mayor McDonald opened the public hearing at 7:40 pm.

President of Katcon USA, Jose DeNigris stated new jobs at the facility will include line operators, skilled welders, warehouse fork truck drivers, plus quality, manufacturing and process engineers. Noting globally the company employs 500 with revenue roughly 450 million.

Mr. Bennett clarified that the abatement is for 50% of personal property investment.

Mayor McDonald closed the public hearing at 7:42 p.m.

Moved by Ms. Doyle; Seconded by Mr. Newkirk. RESOLVED: To approve the request for a 5 year IFEC for Katcon USA, Inc. for a total personal property investment of $2,675,217 by adopting the attached resolution (Attachment C).

9c. Motion – Approval of Special Land Use Permit and Site Plan / New Covenant Church – Building Addition

10. COMMENTS AND MOTIONS FROM COUNCIL

Mr. Newkirk

Asked for an update on the City Clerk.

Mr. Kittle:

Announced that he has moved to Heritage in the Hills.

Asked that residents be kept well informed and updated on the Squirrel Road improvements.

Mr. Knight:

Asked if keeping the pathway clean, from Oakland University to the downtown area could be considered.

Suggested leasing part of the county site to centralize DPW.

Would like to set policy on 100% abatements for personal property, with the thought of giving four years at 100% ~ recognizing that the biggest depreciation is during the first 4 to 5 years.

Ms. Doyle

Was happy that the Chief followed up on the Tienken Road truck traffic and hopes there is conversation with Rochester Hills regarding signage.

Met with Heritage in the Hills Board and will be meeting with Bloomfield Orchards Board regarding the single trash hauler. The object is to meet with major neighborhood associations that already have a contractor in place.

Stated the Beautification Commission has been asked by the Southeast Regional Beautification Organization to host their meeting in September 2012.

Stated Summerfest went extremely well commenting on how clean the area was kept.

It was moved by Council Member Newkirk and supported by Council Member Doyle.

WHEREAS, Act 198 of the Public Acts of 1974, as amended, authorizes the City Council of Auburn Hills to establish

RESOLUTION APPROVING AN INDUSTRIAL FACILITIES EXEMPTION CERTIFICATE

FOR KATCON USA, INC.

At a regular meeting of the City Council of the City of Auburn Hills, Oakland County, Michigan, held in the Council Chambers at 1827 N. Squirrel Road, Auburn Hills MI 48326 on the 11th day of July, 2011.

The following resolution was offered by Councilperson Doyle and supported by Councilperson Newkirk.

WHEREAS, pursuant to P.A. 198, 1974, M.C.L. 207.551 et seq., after a duly noticed public hearing held on the 11th day of July, 2011, the City of Auburn Hills, established an Industrial Development District, commonly referred to as the Katcon Properties, LLC Industrial Development District; and

WHEREAS, Katcon USA, Inc. has filed an application for an Industrial Facility Exemption Certificate with the Clerk of the City of Auburn Hills with respect to proposed new personal property within the Katcon Properties, LLC Industrial Development District; and

WHEREAS, before acting on said application, the City Council of Auburn Hills held a hearing on the 11th day of July, 2011 at a regularly scheduled meeting, at which time the applicant, the assessor, and a representative of the affected taxing units were given written notice and were afforded an opportunity to be heard on said application; and

WHEREAS, construction and installation of the facility has not begun earlier than six (6) months before May 9, 2011, the date of the acceptance of the application for the Industrial Facility Exemption Certificate; and

WHEREAS, completion of the personal property is calculated to and will at the time of issuance of the certificate have the reasonable likelihood to retain, create or prevent the loss of employment in Auburn Hills; and

WHEREAS, the aggregate SEV of real and personal property exempt from ad valorem taxes within the City of Auburn Hills after granting this certificate will exceed 5% of an amount equal to the sum of the SEV of the unit, plus the SEV of personal and real property thus exempted.

INTRODUCTION AND HISTORY

As Council may recall, in 2008/2009 the DPS managed a log cabin replacement project at Hawkwoods Nature Center where Oakland Schools provided a no cost student-based labor force to build the first of six replacement log cabins. The Oakland Schools program provides instructors and students to construct the cabin and high school age students learn valuable carpentry skills as part of their education curriculum. In September 2010, a second replacement cabin project was started and again Oakland Schools students and instructors supported the project with a volunteer labor group. The current cabin replacement project is also partially funded by a $ 10,000.00 merchandise Grant provided by Home Depot to reduce the City’s cost for materials. Unfortunately, procurement of cedar logs for the project delayed construction until this past May and Oakland Schools students were no longer available due to summer vacation. The DPS is presently constructing the second log cabin with a volunteer labor group of DPS employees and their families. This was done to comply with the construction dead line of the Home Depot Grant and the second replacement cabin is expected to be completed in September.

A third replacement cabin has been budgeted for 2011 and Home Depot has verbally committed to another $ 10,000.00 Grant to assist with the project. However, Home Depot cannot officially commit to a second Grant until the current cabin is completed and the current Grant is closed out. Oakland Schools has again committed to the project and they will be available in September when school resumes. The third component, cedar logs for the project, was specified and sent out to bid via MITN where twenty five vendors were notified of the City’s invitation to bid. On July 6, 2011, four bids were received by the City Clerk’s Office. Bid tabulations are as follows: Log-N-Iron, Inc. Vassar, Michigan $ 14,500.00 Lowes Wilesboro, North Carolina $ 15,688.69 Cedar Log and Lumber Millersburg, Michigan $ 16,676.92 Wood Haven Log & Lumber Mio, Michigan $ 21,450.00 Cedar Log and Lumber is the vendor who provided material for the first two cabin replacement projects. Low bidder, Log-N-Iron’s log material does differ slightly in appearance compared to the materials purchased for the first two cabins. The Recreation Director has inspected a sample log provided by Log-N-Iron and agrees with the DPS that the difference in material appearance is acceptable and well worth the $ 2,177.00 cost savings. Log-N-Iron harvests their cedar material from the Michigan thumb area with some of the larger log material harvested from Michigan’s Upper Peninsula. STAFF RECOMMENDATION Coordinating a volunteer labor force, the Grant from Home Depot, and the purchase of cedar log material for the last cabin has proven to be a difficult timing issue. The DPS is requesting Council approve the purchase of the log materials now so that these three components will come together in September and construction can be timed to match Oakland School’s September to May student availability. The 2011 Park Improvement Fund has budgeted $ 24,000.00 to fund a third replacement cabin. The City’s cost for log materials, plus other materials not available from Home Depot is estimated at $ 20,000.00. If Home Depot did not fulfill their verbal commitment to a second Grant, the Park Improvement Budget would be short $ 6,000.00 to cover material costs for the replacement cabin. The DPS is confident Home Depot will honor their verbal commitment and therefore recommend Council approve the purchase of the log materials.

INTRODUCTION AND HISTORY The Department of Public Services is returning with the construction services for the Primary/Grey Water

Main Improvement Project. The project proposes replacing the 6-inch water main with a new 12-inch main along Primary Road (Squirrel to Grey) and Grey Road (Primary to Auburn). This will be necessary to support more expected development coming on line and to also address the need for greater water pressure for building fire suppression systems.

Four construction bids were received for the referenced project on Tuesday, June 28th, 2011. The bids are

OHM has provided their Scope of Construction Services, in the amount of $36,000.00, that shall include construction engineering, contract administration, surveying, and completion of as-built drawings. Not included in the engineers scope is materials testing provided by Schleede Hampton & Associates, Inc. at an additional estimated cost of $5,000. STAFF RECOMMENDATION This specific project was not anticipated in the 2011; however, it has become apparent that the current water main will not support future development plans of the Downtown area if it is not upsized. The Department of Public Services, along with the TIFA Board of Directors (7/12/2011) recommends proceeding with Superior Excavating, Inc. and the Primary/Grey Water Main Improvement Project. Funding is available in TIFA-A [27350/70970]. MOTION Move to approve the construction services for the Primary/Grey water main improvement project to Superior Excavating, Inc., P.O. Subject: Motion - Approve the Construction Cost for the Forester Square at Auburn Village Road Improvement SAD INTRODUCTION AND HISTORY City Council has taken the necessary steps thus far to consider a Special Assessment District (SAD) for improvements to the roadway system within the Forester Square Development. The next step in the process is to consider and approve the cost of construction, which will aid in establishment of the SAD Roll. On July 12, 2011, sealed bids were opened for construction services. Attached is OHM’s recommendation letter to award the contract to the low bidder, Pro-Line Asphalt Paving Company. The engineer’s estimate for the construction cost is $1,024,000 which was found to be in the middle of the range of bids received. Also, the company’s references review were satisfactory from an experience and ability to complete the work perspective. Therefore, we have confidence that the low bid of $954,238.32 is a sound qualifying bid. Additional costs will include OHM’s Engineering Services in an amount not-to-exceed $139,000 for the range of services provided for in the attached Scope of Engineering Services document. Also, the materials testing services to be provided by Soil and Materials Engineering, Inc. (SME) is estimated at $24,000. Attached is the scope of work summarizing SME’s role in the project. STAFF RECOMMENDATION Approve the construction costs submitted to establish the SAD Roll, including the Pro-Line Asphalt Paving Company bid of $954,238.32, OHM’s Scope of Engineering Services quote of $139,000, and the soil and materials testing quote from SME at $24,000. The total construction estimate is $1,117,238.32. This project is being administered as a City project funded through a special assessment district (S.A.D.). PROJECT UNDERSTANDING It is our understanding that the City of Auburn Hills plans to move forward with the construction phase of the Forester Square Road Improvement SAD upon approval of the appropriate SAD resolutions. The project involves road improvements that consist of full reconstruction, patching, and a mill and overlay. SCOPE OF SERVICE Construction Staking This task will involve performing construction staking for the proposed improvements. Specific work efforts include:

• Establish on-site survey control to be utilized during the construction of the project. • Provide required construction staking for line and elevation of contract items such as storm

sewer, curb and gutter, and pavement. • Staking shall included two sets of off- set stakes.

Construction Observation Under this task the project team will observe the construction efforts on the project and assist with any necessary field changes to successfully complete the work. Specific work efforts include:

• Provide daily observation of the project when significant construction work is occurring to verify that materials, installation, and construction methods used are in conformance with the project plans and specifications as well as applicable standards.

• Produce daily field reports to document the work and record quantities of contract pay items.

Construction Engineering This task will consist of providing part-time project engineering services required to address and resolve construction issue when they arise as well as providing project oversight. Specific work efforts include:

• Arrange and attend one (1) pre-construction meeting prior to the start of the project. • Prepare and provide the Contractor with a list of required submittals and review shop

drawings, construction schedules, materials certifications, and other submittals.

• Coordinate with the materials testing consultant on materials related items. • Coordinate with the residents of the subdivision for the duration of the project. • Prepare and deliver “As-Built” plans that include the constructed location of all installed

underground utilities. Contract Administration Under this task, the project team will complete services necessary to administer the contract. Specific work efforts include:

• Review Contractor’s construction progress for compliance with the approved project schedule.

• Prepare construction pay estimates. • Request and review material submittals for conformance with the contract documents. • Prepare contract modifications (change orders) should the need arise. • Review construction claims and coordinate claim resolution with the City and the

Contractor. PROJECT SCHEDULE As outlined in the contract documents, we expect that work on this project will start in early September 2011. The construction is anticipated to be completed in May 2012. FEE SCHEDULE The services outlined above will be performed on an hourly basis for the not-to-exceed amount of one hundred and thirty-nine thousand dollars ($139,000). This amount is based on the assumptions listed below. The City will be invoiced on a monthly basis for these services. The tasks outlined above are estimated as follows:

Letter of Recommendation Dear Mr. Auger: On July 12, 2011 at 10:00 am, a total of seven bids were received for the above referenced project. The three lowest bidders list are as follows:

Bids for this project ranged from the low of $954,238.32 to the high bid of $1,122,824.70. Our final engineer’s estimate of the construction cost was $1,024,000.00

The project scope consists of alleyway reconstruction with asphalt paving, concrete curb, concrete driveways, and storm drainage improvements, as well as pavement patching, curb and gutter spot repairs, and an asphalt overlay on the main streets within the subdivision. We have reviewed the references of the low bidder Pro-Line Asphalt Paving Co. out of Washington Twp, Michigan. They have been operating under their present name for eleven years; their officers have thirty years of experience. They have satisfactorily completed work in the City of Rochester Hills, City of Troy, and the City of Plymouth, among others, of a similar size and scope as this project. Based on our findings and experience, we recommend award of this contract to Pro-Line Asphalt Paving Co. in the amount of $954,238.32, per the unit prices bid for the project. Based on our review of the project drawings and previous experience withthe project, we understand that the pavement rehabilitation programconsists of the removal of the existing asphalt concrete leveling course ofthe 15 existing alley streets and the construction of new concrete drivewaysand gutters, selective patching of existing leveling course, repairs to theexisting curb and gutter of the main roads, and a new asphalt concretewearing course for the alley streets and main roads. As part of the alleyrepairs, Street C will be constructed of Portland Cement Concrete (pCC)and downspout connectors tied to the existing sewer system are planned.

Scope of Services and Professional Fees

We have developed a fee estimate for the CMS based on our understanding of the project scopeand our understanding of the proposed construction schedule. We understand the project will beconstructed in two phases as detailed on Sheet I of the project drawings. V/e further understandthat OHM anticipates substantial completion by November 15, 20ll and final completion byMay 15, 2012. Start of construction is anticipated to be around the first week of September. V/eanticipate our seryices during construction of the referenced project will consist of providingCMS related to subgrade preparation, storm sewer and downspout tie-in construction, aggregatebase placement, concrete and asphalt concrete pavement procedures. A breakdown of ouranticipated scope of services for each phase is provided below.

Phase II Estimated Fee: $ 13,000

We have assumed the majority of construction will occur Monday through Friday duringnormal workíng hours, except Íor two hours of overtime allotted for each paving day and twoweekend paving vßìts. Please note that the above lee estimøtes reflect our assessment of theproject schedule and sequencing based on our previous experience, and that invoices will beprepared according to the attached fee schedules (FS:O & FS:4). Invoices will be based upon theactual amount of time expended, tests performed, and materials used. This is determined by yourstaff s request of our services during construction based on the duration, progress and schedulingof the above items.

V/here possible, we will coordinate with the contractor and OHM Project Engineer to combinework items into the least amount of site visits possible. Additional fees beyond the aboveestimate would be required for services or for site visits and time spent beyond the amountindicated above. Our budget estimates also include a limited amount of project management forscheduling, coordination, technical support, material submittal review, report review, and reportpreparation and transmittal.

SME GENERAL CONDITIONSl. In this Agreement, the party agreeing to have the services performed is

the "Client." The Client's client shall be refened to as the "Owner."Unless expressly st¿ted otherwise, Soil and Materials Engineers, Inc., itsemployees, agents, subconsultants and subcontractors, are collectivelyrefened to as "SME."

2. SME will submit invoices to Client monthly and a final bill uponcompletion ofservices. Payment is due upon presentation ofinvoice tothe Client and is past due 30 days from date ofthe invoice. Client agreesto pay a service charge of L-l/2Vo per month, or tle maximum rateallowed by law, whichever is greater, on past due accounts.
