Yvette Harrell informed the Board that as a result of the denial notice they added a d/b/a to the name of Supreme Demotion Inc. Further, Ms. Harrell stated they submitted a bid and was attempting to secure a contract through the small business program for a County demolition job. A motion was made by Robert Baer to APPROVE. NOVA CABINET DESIGN CORP Note: Formal Hearing Held in Absentia April 23, 2008 Mr. Espinosa explained to the Board that he had sold his business and was unaware of this complaint, which resulted in a Formal Hearing held in his absence. Mr. Espinosa further indicated that in an attempt to re-establish himself as a Contractor he became aware of this Board Order. The Licensing Section informed Mr. Espinosa that he was required to place his license on inactive status if he no longer wished to contract. At this time he was requesting a pardon from the Board Order. The Chairman recommended that Mr. Espinosa contact the homeowner and attempt to clear up this matter. A motion that the Board Order remains in place was made by Julie Coffey and seconded by Phil Stamatyades. The motion carried unanimously. GABRIEL SPINA BOARD ORDER STATUS FINISH CARPENTRY

Mr. Spina appeared with his wife. Ms. Spina indicated that they had to go out of town for medical reasons and now, upon their return, wanted to resolve this matter. Further she stated that, due to tough times and the need to work to comply with the imposed fees on the Board Order, they be granted a payment plan. After some discussion, it was agreed that the fee to the homeowner and the fee to the County be made within three (3) months in equal monthly payments commencing with February. The motion approving a payment plan was made by Robert Baer, seconded and carried unanimously.

JOHN REYES BOARD ORDER – 4/28/2010 PAINTING & WATERPROOFING CONTRACTOR REYES PAINTING CO., INC. Mr. Reyes explained to the Board, as to this matter, that he went to give an estimate and he asked for a deposit of $100.00. Several months later the homeowner called to change contract for less work. Subsequently the homeowner cancelled. He recalls sometime ago getting a call from the department regarding an investigation resulting from a complaint but never received notification of the hearing. Mr. Reyes stated he did not return the deposit due to the time and his effort that was extended prior to cancellation. Recently he came into the Contractor License Section as he had moved, faxed an address change but had not received his renewal. He was then informed his license had been suspended resulting from non-compliance of a Board Order due to a hearing held in his absence on April 28, 2010. Mr. Reyes requested reconsideration of penalty imposed indicating that the $5,000.00 fine is difficult for him to pay during these times. Jose Lezcano, Supervisor of Contractor Enforcement Section stated staff would want the administrative cost incurred and restitution to the homeowner. II. Assistant County Attorney, Joni Mosely, informed the Board that her review of

Chapter 10 Code of Miami-Dade County Section 10-6(B)(6) revealed that the Board has to set standards of financial stability – credit worthiness to be used by the Board in their review of applications for a Contractor’s Business Certificate. Further, she indicated consistency of application of these standards would be used going forward.
