1. November 11th is Veterans Day all over the United States. The Official observance designated by Governor Dayton will start

with a free breakfast from 8:30-9:30 AM and 10:00 AM on November 11th at the Veterans Memorial Community Center; 8055 Barbara Ave; Inver Grove Heights, MN 55077. There will be other notable events on November 11th as well.

2. From the STATE QUARTERMASTER: ALL Quarterly Audits submitted MUST be ORIGINAL Audit Forms with ORIGINAL Signatures ONLY. There are many Posts

that have been submitting Audits with photocopied signatures- including officers that are no longer Trustees or Quartermasters. NO Photocopies will be accepted from now on. NO Emailed Audits will be accepted from now on. ORIGINAL Hard Copy Audits, with original Ink Signatures, MUST be MAILED via United States Mail to State Headquarters. Starting in December, ANY Audits not following these guidelines WILL BE REFUSED.

4. BONDING: It is in the Posts best interest to Bond their Quartermaster (and for many, their Commander too) The Quartermaster should be Bonded up to any and all funds they would have access to Checking & Savings. You may

even want to consider Bonding for Investments, CDs and so on. You may think you have sufficient signature requirements to access funds, but you cannot control what an individual Bank Teller may be lenient on during a transaction. Insufficient Bond Amounts can open your Post to losing most or all of the funds you have worked so hard to earn and save. The decision of the Post Bond amount is completely up to your Post membership. But it would be in YOUR best interest to cover your assets to the fullest so that you can continue to follow your mission as a VFW Post. It’s a terrible thing to wish you had complete coverage after an embezzlement already occurred.

5. All Posts that closed their books on June 30, 2018 and had a gross income of $50,000 or more, must file a 990 IRS return

on or before the 15th of November. Posts that have gambling must file a 990T return because this is considered “unrelated business income and taxable”. Failure to file has a penalty of $10.00 per day, with a maximum penalty of $5,000. The Department has a group exemption number of GEN-1068 under Section 501-C-19. Posts should use these numbers on their return. NOTICE: All Posts grossing under $50,000 MUST file an e-postcard (990 N). Posts failing to file a 990 are in danger of losing their Tax Exempt status!!!! (It is recommended that you contact your accountant or the recent IRS instructions for Tax Exempt Organizations.) (Publication 3386)

6. NOTICE of Shipping Charges: The Department Headquarters charges postage for materials ordered from the State Office. When ordering items such as VFW Athletic Patches, Coloring Books, Membership Applications, VFW Stories, etc., please consider the following:

1) Postage fees WILL be charged for any material requests that will NOT FIT in a standard #10 Business Envelope.

2) Postage fees can be avoided by A) Picking up materials at Department Headquarters or B) Requesting delivery to a District Meeting to be picked up.

We will continue to do our best to ship items in the most economical way possible. If you have any questions, please contact the Department Office for details.

7. The Department Midwinter Conference will be held at the Marriott in Minneapolis, Friday, Saturday, AND Sunday January

18-20, 2019. PLEASE NOTE THE CONFERENCE WILL GO INTO SUNDAY MORNING FOR COUNCIL MEETINGS allowing for more seminar opportunities on Saturday. Housing forms for the Marriott and Order forms for the Banquet Tickets are in this mailing, online at: www.mn.gov/vfw , and will be published in the next Gopher Oversea`r. A bulletin for Ads for the Mid-Winter Conference Booklet is also enclosed.

8. The Dues reminder notice for 2019 will be mailed to unpaid members in November/December. Post officers should conduct a Telephone Membership Campaign to follow up on this dues notice. We are now on Subscription Dues. Your Quartermaster should consult the Online Membership System monthly.

9. All requests for present or past Department Officers and Guest Speakers should be coordinated through Department

Headquarters: therefore, such requests should be addressed to the Department Commander at V.F.W. Department Headquarters, Rice St. Station, P.O. Box 17146, St. Paul, MN 55117. It is the responsibility of the Host Post to reimburse the Officer for expense in traveling to Membership Dinners, Speaking Engagements, etc., since traveling expenses are not reimbursed by Department Headquarters.

10. Bantam Hockey rules have been sent to all District Youth Activities Chairmen for distribution to the Posts in their District.

Any Post interested in sponsoring a team should contact their District Youth Chairman immediately.NOTE: Please pay special attention to Roster Submission instructions. (Rules and Rosters are also online at www.mn.gov/vfw)

11. Post Quartermasters are urged to re-check their Post Roster and send in corrected addresses for those members listed as

“Undeliverable”. These members will not receive a dues notice, V.F.W. Magazine or Gopher Oversea’r until the Post provides an address! Furthermore, VFW National Headquarters will eventually drop them from your Post Roster…this includes Life Members!

12. Any Club or Canteen operation that is in violation of established rules of the Veterans of Foreign Wars is reminded that the

Post Commander has the authority to close the bar, club or canteen. Additionally, your Post may have it’s Charter Suspended for at least 30 days by the State Commander.

13. RELIEF FUND: Be it known that under Section 704 of the National By-Laws and Manual of Procedure, (Paragraph B and

C) – A Post or Auxiliary can donate to “National Military Service and Operation Uplink” from their Relief Fund. 14. Please note the “Warning” to Post Commanders, Quartermasters and Trustees enclosed in this General Orders. In the

case of unpaid federal payroll taxes, the Internal Revenue Service (IRS) will go after the “Chief financial officer” (Quartermaster), before going after the “Corporation” (Post).

15. All Post Adjutants MUST maintain the ‘original’ Membership Application for each member of their Post. This application

must show proof of eligibility in the Veterans of Foreign Wars. These records are required by the IRS and the National By-Laws.

Regarding Military Funeral Honors… If your Post or District provides Military Funeral Honors, Please review the message below from the MNDVA.

MN Veterans Organizations, There is somewhat of a recurring issue with your posts/chapters using the old application forms for the MDVA $50 stipend, which they submit when they perform funeral honors. The first couple years of the program, the forms directed the VSO to send them to the National Guard Funeral Honors Coordinator. He would process them for the $50 federal stipend and then send them to MDVA for us to process for the $50 state stipend. The Guard asked that we change that process in 2012, so that they no longer received our forms. Since 2012, the forms have given the address and fax number at MDVA as the proper place to mail or fax the forms. However, some posts/chapters continue to send them to the Guard address/fax; often because they are using old forms with outdated information. When this happens, these forms do not always get routed to MDVA, or they get sent to us long after the fiscal year has ended and we can’t pay them. This leads to some unhappy posts/chapters. They update the application forms each fiscal year (starting July1st) and they are posted on our website in a fillable PDF format: http://mn.gov/mdva/memorials/militaryfuneralhonors.jsp

BUDDY POPPY

Comrades, Order your Buddy Poppies early so that you have them by Veterans Day. Did you know that you can pay for your Buddy Poppies out of your Relief fund? Yes you can! The Manual of Procedure Sec. 219 – Relief Fund paragraph (h) “Necessary expenses to support the relief fund such as the purchase of Buddy Poppies”. The Relief Fund can also help out struggling veterans with their membership dues. Sec. 219 paragraph (g) Remission of dues of sick, needy or disabled members”. Thank you to all of the posts that have ordered Poppies this year. For everyone else now is the time to order. For those of you with auxiliaries please consult with them and submit just one order. Your order will be filled and delivered within 3-4 weeks. Remember that you don’t need to pay for them until next year. November 11th is an extra special Veterans Day. It is the 100th Anniversary of the end of World War 1. Use your Poppies on Veterans Day at your post and during your programs. Recognize the extra special nature of this special day. There is still time to prepare a Buddy Poppy Display for your December District meeting. District 7 currently leads the Department at 92.96% followed closely by the 6th at 92.39%. The Bag A Member Winners for the 1st Quarter are: Small Post: Ely 2717 Medium Post: Cottage Grove 8752 Large Post: Rochester 1215 District: 2 Congratulations to the posts who’ve attained 100%! Continue to be aggressive in recruiting and retaining members. Congratulations also to the 1st quarter winners in the Bag A Member Competition. Remember, the Early Bird contest is cumulative through the second quarter so continue to focus on membership recruiting efforts. Effective July 1, 2018, the subscription dues model postpones expiration of membership to the last day of the 12th month. For example, if a new member joins on November 1, 2018, their dues will expire on November 30, 2019. National is sponsoring a “Return to Vietnam” drawing being held for Vietnam Purple Heart awardees. Trip will be awarded to nine veterans (at least two from each conference) and will take place April 25-May 8, 2018. The entry form is available on the VFW website, I also have hard copies.

November, 2018 MIA Update:

-- Army Staff Sgt. Marshall F. Kipina, 21, of Calumet, Mich., whose remains were previously identified, was buried Oct. 18 in Arlington National Cemetery, near Washington, D.C. Kipina was assigned to the 131st Aviation Company, serving as an observer aboard an OV-1C aircraft, on a night surveillance mission from Phu Bai Airfield over Attapu Province, Laos People’s Democratic Republic. Radar and radio contact were lost with the aircraft which did not return as scheduled. Search efforts were initiated, but no crash site was found. Read about Kipina.

-- Army Lt. Col. Robert G. Nopp, 31, of Salem, Ore., whose remains were previously identified, was buried Oct. 18 in Arlington National Cemetery, near Washington, D.C. Nopp was an OV-1C pilot assigned to the 131st Aviation Company. On July 13, 1966, Nopp flew a night surveillance mission from Phu Bai Airfield over Attapu Province, Laos. Flying through heavy thunderstorms, radar and radio contact were lost with the aircraft, which was not uncommon due to the mountainous terrain in that part of Laos. When the aircraft did not return as scheduled, search efforts were initiated, but no crash site was found. Read about Nopp. -- Army Cpl. James I. Jubb, 21, of Eastport, Md., whose remains were previously identified, was buried Oct. 17 in Arlington National Cemetery, near Washington, D.C. Jubb was a member of Company E, 2nd Battalion, 19th Infantry Regiment, 24th Infantry Division. In August 1950, his unit sustained heavy losses while fighting against Korean forces in the vicinity of the Naktong River, South Korea. Jubb was declared missing in action on Aug. 10, 1950, when he could not be accounted for by his unit. Read about Jubb. -- Army Pfc. Kenneth B. Williams, 38, of Akron, Ohio, whose remains were previously identified, will be buried Oct. 22 in Seville, Ohio. Williams was a member of Heavy Mortar Company, 32nd Infantry Regiment, 7th Infantry Division. In late November 1950, his unit was assembled with South Korean soldiers in the 31st Regimental Combat Team on the east side of the Chosin River, North Korea, when his unit was attacked by Chinese forces. Williams was among more than 1,000 members of the RCT killed or captured in enemy territory and was declared missing Dec. 2, 1950. Read about Williams. -- Army Pfc. Fred W. Ashley, 22, of Emmett, Idaho, whose remains were previously identified, will be buried Oct. 20 in his hometown. Ashley was a member of Troop C,

2nd Cavalry Reconnaissance Squadron, 2nd Cavalry Group, on a reconnaissance in the town of Paseka, Czechoslovakia. On May 4, 1945, German soldiers attacked Ashley’s platoon. Ashley’s unit reported him missing in action. Following the war, when Ashley was not among the American prisoners liberated from German captivity, the War Department amended his status to killed in action. Read about Ashley. -- Army Pfc. Leslie E. Shankles, 33, of Arcadia, Kan., whose remains were previously identified, will be buried Oct. 24 in Fort Scott, Kan. Shankles was a member of Company C, 1st Battalion, 60th Infantry Regiment, 9th Infantry Division, when he was killed Oct. 14, 1944, by enemy fire in the Raffelsbrand sector of the Hürtgen Forest in Germany. Shankles’ name is recorded on the Tablets of the Missing at the Netherlands American Cemetery, along with the others missing from World War II. A rosette will now be placed next to his name to indicate he has been accounted for. Read about Shankles. -- Army Pvt. John B. Cummings, 22, of Hartford, Wis., whose remains were previously identified, was buried Oct. 13 in Hazelhurst, Wis. Cummings was a member of Company A, 276th Infantry Regiment, 70th Infantry Division, along the France and Germany border. On Dec. 31, 1944, German troops crossed the Rhine River into France. As darkness fell, two members of Cummings’ company passed him in a foxhole near the riverbank. U.S. troops heard German machine gun fire and maneuvered their way back to the foxhole, but were unable to locate Cummings. Despite extensive recovery efforts, Cummings’ remains were unable to be located. Read about Cummings. -- Navy Fireman 2nd Class George C. Ford, 25, of Lidderdale, Iowa, whose remains were previously identified, will be buried Oct. 20 in Glidden, Iowa. Ford was stationed aboard the USS Oklahoma, which was moored at Ford Island, Pearl Harbor, when the ship was attacked by Japanese aircraft on Dec. 7, 1941. The battleship sustained multiple torpedo hits, which caused it to quickly capsize. The attack on the ship resulted in the deaths of 429 crewmen. Read about Ford. -- Naval Reserve Lt. Richard C. Lannom was the bombardier/navigator aboard an A-6A aircraft on a night strike mission over Quang Ninh Province, North Vietnam on March 1, 1968. The flight path to the target was over islands known to have light anti-aircraft artillery. When the aircraft failed to rendezvous with the carrier, a search and rescue effort was mounted. No evidence of the plane could be found. Lannom and his pilot were subsequently declared missing in action. Interment services are pending. Read about Lannom. -- Marine Corps Pfc. Michael L. Salerno was a member of Company K, 3rd Battalion, 2nd Marine Regiment, 2nd Marine Division, Fleet Marine Force, which landed against stiff Japanese resistance on the small island of Betio in the Tarawa Atoll of the Gilbert Islands. Over several days of intense fighting at Tarawa, approximately 1,000 Marines and Sailors were killed and more than 2,000 were wounded. Salerno died on the first day of the battle, Nov. 20, 1943. District Chairpersons: Make sure all documentation required by the Recognize Teachers Who Care or the Post Teachers Chairman’s Manual is included in the nominee’s packets. IMPORTANT ALERT Post Commander – Post Quartermaster – Post Adjutant

Internal Revenue Service Requirement

Dear Comrades,

Recently in the News, the Internal Revenue Service Audited an American Legion Post. One of their requirements for maintaining a Non-Profit Veterans Organization, was to have a copy of EVERY member’s Proof of Eligibility. ‘Drastic’ you may say… BUT, true!

After consorting with the ‘Wizards’ at our VFW National Headquarters, it has been determined, that ALL of our VFW Posts nationwide must conform to this IRS Requirement. BUT, rather than having a copy of every member’s Discharge or DD-214, it was determined that the member’s application for Membership would suffice.

Therefore, it is requested (for the good of the Organization), that each Post UPDATE their Membership Records for each member of their Post. According to Section 218 (Duties of the Post Adjutant) of the National By-Laws and Manual of Procedure, “A copy of the original application of every member admitted to the Post” shall be maintained by the Post Adjutant. This has always been a requirement under the National By-Laws and each Post Adjutant should be prepared to share those records with the Post Officers, members and (if Audited) the Internal Revenue Service.

NOW, if these applications (records) are not up-to-date, it is recommended that the Post Adjutant send a letter, containing a Membership Application, to each Member. Ask them to complete the application. Especially that information concerning their Military Service and their eligibility for the Veterans of Foreign Wars. Stay on top of this until you have each and every member’s application completed. Please keep this file up-to-date and accessible to your Post Officers and Trustees. In the future, the Post Inspector may be required to view these records.

B. IRC 501(c)(19) What records must be maintained to show the composition of membership? A post must maintain a list of members and the category of membership (veteran, degree of relation or nonveteran or non-relative). If a post receives deductible contributions, it must also maintain a list of members, their dates of service, whether they are war veterans as defined in 170(c)(3), and if not, whether they are spouses, widows, or widowers of war veterans, veterans or cadets.

VFW POSTS FAILING TO FILE IRS FORM 990

Points regarding VFW Posts that have lost (or may lose) their Tax-Exempt status for failure to file Form 990 with the IRS:

• Any Post that has lost its tax-exempt status should regain its tax-exempt status as soon as possible.

• This is accomplished by filing an IRS Form 1023 and paying any applicable fees. • Apply to retroactively reinstate your tax-exempt status to the date that the tax-

exempt status was lost.

Failure of Post to get its tax-exempt status reinstated:

• The IRS would view this organization as a For-Profit Organization. • The Post would probably be required to file a Corporate tax return. • Any revenue that the Post receives would potentially be subject to a corporate

tax rate. • This revenue would include:

a. Dues revenue b. Investment Income c. Rental income d. Buddy Poppy revenue e. And any other forms of revenue that are generated

• Failure to file the proper corporate tax return would potentially subject the Post to unpaid tax liabilities.

• The Post could also be assessed large fines and penalties for failure to file a tax return and pay any potential corporate taxes.

• As is the case with unpaid Payroll taxes, the IRS will first go after the Personal Assets of the Post Quartermaster and Commander..

• The Post will also not be eligible to receive tax deductible contributions from donors.

• This could create potential tax issues for any donor who makes a contribution to the Post without knowing the Post has lost its tax-exempt status.

Needless to say, this is NOT a situation that you want to put your Post and Officers in, especially when it is easily avoided. The Veterans of Foreign Wars has been alerting our Posts to the need to file a 990 since 2006. The Internal Revenue gave all Non-Profits at least three (3) years to comply with the new regulations. It wasn’t until 2010 or 2011, when the IRS started revoking the Non-Profit status of our VFW Posts. So very few of us have any excuses. Should your Post have questions or need assistance, please contact Department Headquarters at 651-291-1757 and ask for the State Quartermaster.

COMMANDERS – QUARTERMASTERS – TRUSTEES

WARNING!!! Taxes, Payroll Taxes and Other Post Debts Are YOUR Responsibility!

Comrades,

Recently, one of our Past Post Quartermasters was contacted relative to Unpaid Payroll Taxes. This Quartermaster allowed the Club Manager to handle the Financial transactions of the Club Operation --- and the Payroll Taxes. Over a year and a half, the Club Manager failed to pay the aforementioned Payroll Taxes.

Long story – short, the Internal Revenue Service (IRS) recognizes the (in the VFW) Post Quartermaster as the Chief Financial/Fiduciary Officer of the Post. They therefore started repayment/retribution proceedings against that Post Quartermaster and his personal assets.

It the past, the IRS, other agencies and Vendors have gone after the assets of the Corporation or the Post. Times have changed, especially when Governmental Agencies are concerned! Additionally, they WILL prosecute that Officer in accordance of the Law. This includes jail or prison time and additional fines above the repayment of the debt.

The Department of Minnesota, Veterans of Foreign Wars recommends that ALL Commanders, Quartermasters and Trustees stay on top of ALL Financial obligations of the Post, Club, Gambling or any other Financial commitments of subordinate Units. Additionally, we suggest that you contact your Accountant or a local Accountant to get a better understanding of the IRS and other Governmental Statutes as they apply to your various operations.

To ALL Quartermasters --- YOU MUST BE IN CONTROL OF ALL YOUR ASSETS AND FINANCIAL OBLIGATIONS --- as YOU are the Chief Financial Officer of the Post and the FIRST TARGET of agencies like the Internal Revenue Service.!!!

Ambassador Program One definition of ambassador is “an authorized messenger or representative”. Every member in good 

standing of the Veterans of Foreign Wars is an ambassador of our organization when we take the 

opportunity to represent our post to the public and to potential members. 

Recruiting and retention efforts can be greatly enhanced by taking advantage of opportunities to 

represent the Veterans of Foreign Wars at events like car shows, gun shows, craft fairs, wedding fairs, 

employment fairs, county fairs, etc… … Manned by post members and displaying pride in our 

organization will provide an avenue to recruit new members, reinstate former members and retain 

existing members. Upon request, Department will also dispatch a knowledgeable Past State 

Commander to assist your efforts. 

Resources available to assist your recruiting efforts at these events include banners, table cloths, 

pamphlets and membership applications. Contact department at (651) 291‐1757 or the membership 

chair at (612) 325‐2264 to arrange for the materials desired for your event.  

The Department of Minnesota offers reimbursement up to $150.00 per event to offset the cost of 

booth space or other expenses required by the sponsored event. Additional funds are available from 

National as well – request details from Department. To claim reimbursement, send a copy of the event 

receipt to the Department Quartermaster AND to the Department Membership Chair at the following

SUBJECT: 2019 Calendar Raffle Details.

The Raffle Calendars are now available and we will begin to distribute them to all Districts and Postsas needed. (Some advance Orders have already been placed. Please use the Raffle Calendar Order Form contained in this letter to order Calendars as needed.)

We will be using the District Commanders, the line officers, District Meetings and the Fall Conference to distribute the Calendars to your Post or Auxiliary. Other arrangements can be made on an as needed basis.

This is a fund raiser for not only V.F.W. programs, but also for Camp Ripley outdoors program, Veteran Assistance, and your Posts and the Auxiliaries. The calendars may be sold by all members of your Post, Auxiliary, Pup Tent, or any volunteers that want to help out. They may be sold to members, friends, businesses, relatives, etc. Virtually any- one who wants to buy a calendar can be part of the raffle. For each calendar sold the selling Post or Auxiliary will receive a $5.00 rebate to be used as they wish within their Post

Commanders and Presidents, we will need you to control this within the Post or Auxiliary. You do not have to pre-pay for the calendars and you are financially responsible for only the calendars that your Post or Auxiliary have actually sold. Watch for return deadlines fory any unsold Calendars. Please Note: Failure to meet these deadlines will result in your Post being financially responsible for all the calendars ordered.)

The first of four (3) drawings will take place in January 2019. This drawing will be for January, February and March combined.

DEPARTMENT OF MINNESOTA VETERANS OF FOREIGN WARS

OF THE UNITED STATES For more information on the 2018-2019 Post and District Publications Contest: contact, Department Publications and Public Relations Chair.

The Veterans of Foreign Wars Post and District Publications Contest recognizes excellence in Post and District publications. Entries will be judged on content, design, pictures and graphics (where relevant), and overall quality. Awards will be presented to the winners at the Department Convention.

Any Minnesota VFW Post or District that regularly publishes a newspaper or newsletter for its members may enter. Awards will be presented for first, second, and honorable mention, if judged applicable, to the winners. Entries will be judged by Membership Category - 99 and less; 100-179; and 180 or more. If your Post has a web site, it must be recognized by the Department of Minnesota and listed as such in the Department's list of Posts. The web site should be easy to access, please keep it up to date as well as informative for your members. We will be searching through the web sites from time to time throughout the year.

Please submit your entries early. Deadline is March 1, 2019. Send your two (2) best issues, printed between January 2018 and December 2018. Place your entry in a 9 X 12 envelope and clearly identify it by writing “Publications Contest” on the outside. Include your return address and enclose the completed form below.

POST/DISTRICT PUBLICATIONS PUBLICATIONS SCORING OUTLINE

1. Content: Possible 50 points

A Post/District publication should emphasize local VFW issues. It also should include up-to-date information on local VFW activities and progress regarding each of VFW’s national programs including Voice of Democracy, Citizenship Education, Community Service, Buddy Poppy, Membership, Youth Development, Scholarship and Recognition, and troop support. Articles should answer all pertinent questions and be written in active voice. Liberal use of quotes is recommended.

2. Layout and Graphics: Possible 30 points

Winning publications are attractive and consistent in their appearance. Quality photos and artwork, consistent type in headlines and text, and a clean and readable format are a must. Photographs should be action-oriented and adequately captioned. Artwork and illustrations should be appropriate to the articles and be crisp and well positioned.

3. General Excellence: Possible 20 points

Maximum points can be achieved when all criteria and layout elements come together. Anything that adds to the publication’s readability and attractiveness will be considered.

* * * * * RULES FOR V.F.W. COLOR BOOK CONTEST IN SCHOOLS * * * * * 1. Show sample of the color book to grade school principal for the approval to distribute to 1st, 2nd or 3rd graders for the coloring contest. 2. After determining the number of students in the grades suggested by the principal or teachers, immediately order that number of books from VFW State Headquarters, Rice Street Station - PO Box 17146, St. Paul, MN 55117. The cost is only $.50 per book, plus postage. 3. After the coloring book contest is approved by the principal and teachers, determine if the Post and/or Auxiliary should provide the judges. We should offer to provide the judges so as not to overburden the teachers. 4. When choosing judges, most likely in your Post, Auxiliary or the local neighborhood, you could find two or three judges who have some knowledge of art or education. Be sure to avoid any conflict - don’t choose judges who have students in the grades being judged in the color book contest. 5.
