It will be held at the Arthur Weisberg Family Applied Engineering Complex at Marshall University, which is located at 1676 Third Ave. Tours of the new $56 million complex will be given by current Marshall University Engineering students and CAWV members BBL Carlton and Bastian & Harris, the project’s general contractor and architect. A registration form is attached to this week’s Newsletter. “I hope all members in the area will join their fellow members next Thursday,” said CAWV President Dan Cooperrider. “One of the benefits of CAWV membership is to meet and network with our friends and peers in the industry. Even better is when it’s at a facility that was designed and built by fellow CAWV members. Please come and bring others from your companies,” the president stated. The February 12-17, 2016 meeting will be held at the Grand Floridian Resort and Spa, the site of the very successful 2001 and 2009 meetings. The Program Committee is putting together an excellent mix of business, sporting and social activities to make the 2016 meeting an unforgettable event. In the meantime, everyone wishing to attend must return convention registration forms by October 16 for Early Bird Registration. Rooms reserved after October 30 will be on an availability only basis. WEST VIRGINIA REMAINS TOP IN NATION FOR SHEDDING CONSTRUCTION JOBS Construction employment in West Virginia continues its decline. In August, West Virginia lead the nation in the highest percentage of construction jobs lost in a year’s period, a ranking the state has held for about 18 months. The state dropped 15.1 percent – 5,100 jobs – from August 2014 to August 2015. What is equally depressing is that the closest state, Rhode Island, only dropped 7.9 percent and the next, Mississippi, only dropped 7.4 percent. Of the other 10 states in the negative column for August, the decline ranged from 0.2 percent to 5.7 percent. For West Virginia to be 15.1 percent is indicative of the reduction of funding for highways and other infrastructure projects. Construction employment expanded in 36 states and the District of Columbia between August 2014 and August 2015, according to the monthly analysis of Labor Department data by the Associated General Contractors (AGC) of America. “While half of the states added jobs in August, construction spending data and industry reports suggest demand for projects remain very strong,” said Ken Simonson, AGC’s chief economist. “While construction employment increased in more than two-thirds of the states over the past year, these gains may fade in the near future unless that industry can attract more people to try construction as a career,” said Stephen E. Sandherr, AGC’s chief executive officer. The CAWV has requested information from WorkForce West Virginia on what impact unemployed construction workers are having on the state’s Unemployment Compensation Trust Fund. A 15.1 percent drop in construction employment in a year is bound to create a cash flow issue for the fund. Once the fund drops to a certain level, a surcharge is added to employers to build the balance back up. This is another reason why funding for infrastructure should be a top priority when the West Virginia Legislature convenes in January. HOUSE BEGINS DEBATE ON STREAMLINING BILL The House is set to consider The Responsibility and Professionally Invigorating Development (RAPID) Act, sponsored by Representative Tom Marino (R-Pa.), which would streamline the approval process for federally-funded and federally-permitted infrastructure, energy and other construction projects and deliver faster approvals. The AGC-supported bill builds on the successful environmental streamlining provisions in MAP-21. The RAPID Act seeks to improve the permitting process by requiring greater coordination among multiple federal agencies involved in environmental reviews; providing concurrent reviews, rather than serial reviews; allowing state-level environmental reviews to be used in certain instances; imposing reasonable fixed deadlines for completion of an Environmental Impact Statement (EIS) or an Environmental Assessment (EA); reducing the statute of limitations to challenge a final EIS or EA from six years to 180 days; and establishing a reasonable process for determining the scope of project alternatives. The CAWV Membership and Public Relations joint committee will meet on Tuesday, October 13, at 10:00 a.m. at the CAWV Headquarters. The joint committee meeting is designed to bring ideas forward to promote the CAWV and develop ways to better recruit and retain members. Committee members will evaluate the effectiveness of past strategies and discuss the association’s upcoming promotional efforts. Membership Committee members have been involved with the Public Relations Committee in helping plan and develop these initiatives. All Membership and Public Relations Committee members are encouraged to attend. YCF TO HOST TOYS FOR TOTS GOLF SCRAMBLE - OCTOBER 30 The CAWV Young Contractors Forum will host the third annual Toys For Tots fall golf scramble on Friday, October 30, at 10:00 a.m. at Little Creek Country Club, South Charleston. YCF Chairman Josh Booth would like to invite all members to participate regardless of age. In addition to the registration fee of $50, a box lunch and beverages are included. Members are asked to bring an unwrapped toy to benefit Toys For Tots. A registration form is attached to this week’s Newsletter. CAWV Regional Meeting October 1 and 3, 2015

The CAWV is hosting a regional meeting of members on Thursday, October 1 in Huntington. It will be held at the new Applied Engineering Building at Marshall at 3100 Third Avenue in Huntington. The meeting will begin at 3:00 p.m. with a meeting of the CAWV Board of Directors. From 5:00 p.m. to 7:00 p.m., there will be on open reception for all members in the local area. Tours of the new $56 million complex will be given by current Marshall University Engineering students and CAWV members BBL Carlton and Bastian & Harris, the project’s general contractor and architect. “I would like to invite all members to attend the Board meeting and reception,” said CAWV President Dan Cooperrider. “This is a great opportunity for members to meet and greet one another, plus it’s a chance to see Marshall’s new state-of-the-art engineering facility.” On Saturday, October 3, come and join fellow CAWV members and Marshall fans for the 10th Annual CAWV Marshall Tailgate. The CAWV will be hosting this event on the West Lot before Marshall takes on Old Dominion on October 3. The tailgate will begin at 1:30 p.m. and will be open until kickoff at 3:30 p.m. Below is a schedule of events. CLAY CENTER ANNOUNCES MUSEUM RENEWAL PLANS The Clay Center Board of Directors voted to approve a new $14 million fund that will be used to upgrade, add and expand a host of features to the Avampato Discovery Museum, including a multi-story, climbable statue in the museum’s main lobby. The changes will come by way of a new “Discovery Museum Renewal Fund,” a new fund that will be added to the center’s Permanent Fund. The Clay Foundation has already committed $8 million to the fund, which leaves $6 million to be raised for a project intended to reinvigorate the Clay Center’s arts and science presentations, outreach and sustainability. Visitors will see changes in fairly short order, said Clay Center President and CEO Al Najjar. “This is not a five- or ten-year project. We’re talking about two, two-and-a-half years. It’s all about the integration of the arts and sciences.” Phase One of the project, targeted for completion by Thanksgiving 2016, includes two notable additions to the heart of the Clay Center. One of the signature pieces of the renewal project is an original interactive sculpture referred to during the meeting as “the Climber.” The vertical sculpture, which will be created by Spencer Luckey, will be commissioned and built in the lobby, starting at the lower level where the museum cafe is located and climbing two stories up to the Avampato art museum. Children will be able to climb through it to get to different levels of the building. The center will also add a simulated city, temporarily dubbed “My Town,” where children will take part and be in charge of civic life, an interactive exhibit along the lines of the lines of “Kidtropolis” at the Children’s Museum of Houston. The same designers of “Kidtropolis” will design the Clay Center’s version, which will include Charleston and West Virginia references such as the state Capitol gold dome. FIRE PROTECTION AND BURN PERMITS The Fall fire season starts October 1 and runs through December 31 in West Virginia. Between 7:00 a.m. and 5:00 p.m. no outdoor burning is permitted throughout the Mountain State and is also designated as Forest Fire Season. No person shall during the fire season, except between the hours of 5:00 p.m. and 7:00 a.m., set on fire or cause to be set on fire any forest land, or any grass, grain, stubble, slash, debris, or other inflammable materials. Any fire set during this time shall be extinguished prior to 7:00 a.m. Even during the permitted burning times all inflammable material must be removed from the burning area for a distance of not less than 10 feet. If fire escapes beyond the safety strip, the person responsible shall be guilty of a misdemeanor with fines ranging from $100 to $1000 dollars plus civil penalties.

HERE ARE SOME TIPS FOR FALL BURNING

Before leaving ANY fire for ANY period of time, it must be totally extinguished.

Commercial permits to burn during the prohibited periods may be issued by the Division of Forestry and cost $125 each. A permit is required for each site burning is to take place.

All sawmills, power shovels, engine or machine capable of throwing sparks must be provided with an adequate spark arrestor if operating on land subject to fire by any cause.

All inflammable waste disposal areas on ANY land must annually have removed all grass, brush, debris and other inflammable material adjacent to such disposal areas to provide adequate protection to prevent the escape of fire to adjacent lands.

The State shall recover from the person or persons, firms or corporations whose negligence or whose violations of any provisions of this article cause ANY fire at ANY time on any grass or forest land the amount expended by the State.

A landowner must take all practicable means to suppress ANY fire on his property. If he fails to do so, the State shall collect from him the amounts expended by the State for such purposes.

CHARLESTON CIVIC CENTER PROJECT TO INCLUDE SEWER MAIN BORE AND JACK PROJECT The $82 million expansion of the Charleston Civic Center will require the relocation of a sanitary sewer main along the Elk River. The project is being designed by GAI Consultants, Inc., Charleston, and should be ready to bid in a couple of months. The project consists of placing two lines, one on top of the other, because once the civic center is completed, there will be no access to the pipe. Constructing two lines allows the sewer main to operate by switching flow to one line while the other line is being repaired. The project will consist of boring and jacking two sewer lines totaling 1,000 feet of 42” steel casing pipe and 30” HCPE pipe. The project will have to be coordinated with BBL Carlton, the design-builder of the civic center project. The bids will be advertised through the City of Charleston. Charleston City Council Monday approved money for the project, which is estimated around $3.5 million. Information will be in future Municipal/Utility bulletins.

COMMISSION TO REVIEW MOUNTAINEER XPRESS PIPELINE

A plan to build a 36-inch pipeline that would carry natural gas from Marshall County to Cabell County has been submitted to the Federal Energy Regulatory Commission, the federal agency responsible for the oversight of interstate pipelines, for review. On Aug. 26, Columbia Pipeline Group and its partners submitted the preliminary filing for the 165-mile Mountaineer Xpress pipeline that would help transport gas from the Marcellus and Utica shales south into Kentucky and on to the Gulf Coast.

Columbia Pipeline Group announced Wednesday that the preliminary filing for the $2 billion project had been accepted by FERC, and that the company plans to file its final project plan in the spring of 2016. In total, the $2 billion project would require the construction of pipeline in at least 12 counties, including Marshall, Wetzel, Doddridge, Wirt, Jackson and Putnam counties. According to the federal filing, the company will hold public meetings in Proctor, Jacksonburg, West Union, Smithville, Ripley and Winfield between Sept. 28 to Oct. 6. The Mountaineer Xpress is only one of several gas pipelines planned for West Virginia that are making their way through the federal review process.

TWO WV LOCALITIES TO SHARE $1.1M FOR WATER PROJECTS

Two West Virginia localities will share more than $1.1 million in funding for water infrastructure products. U.S. Sens. Joe Manchin and Shelley Moore Capito announced the Appalachian Regional Commission grants Wednesday. A waterline extension project that will serve 134 households and two organizations in an isolated part of Clay County will receive $760,000. An additional $386,000 is going to the Gary Wastewater System Inspection and Evaluation project, which will make repairs to improve services for 442 customers in McDowell County.

STATE TRANSPORTATION FUNDING UPDATE During the September legislative interim meetings, members on the Joint Committee on Finance and the Tax Reform Committee heard presentations from representatives of the Blue Ribbon Commission on Highways and the CAWV. One of the main presentations was on what other states are doing to provide revenue for their highway construction and maintenance programs. Below is recent information from ARTBA’s Transportation Investment Advocacy Center: An updated report by the Transportation Investment Advocacy Center™ shows 18 states have passed legislation to support transportation investment in 2015. Coming up, three states have fall ballot measures pending voter approval, and at least two states are continuing to search for a transportation funding solution before the end of the year. Nearly 170 state measures were introduced in 2015 to increase or support transportation funding. To-date, 28 of those bills have passed. Some of the approved measures include: Recurring transportation funding in Washington, Nebraska, Georgia, Idaho, Utah, South Dakota, Iowa, North Carolina, and Delaware; Stabilization of variable-rate gas tax formulas in order to prevent loss of revenue in Kentucky, North Carolina and Vermont; One-time transportation funding legislation in Connecticut, Georgia, Massachusetts, North Dakota, New York, Minnesota, Mississippi and New Mexico; and Ballot measures for fall 2016 in Maine, Texas and Louisiana. North Carolina lawmakers gave final approval Sept. 18 to a state budget that provides an increase of $440 million in transportation funding by eliminating Highway Fund transfers to the General Fund, raising Division of Motor Vehicle fees (with quadrennial adjustments for inflation on certain fees), increasing the state Highway Use Tax on out-of-state motor vehicle purchases, eradicating the ‘noncommercial leaking petroleum- UST cleanup fund’, and permitting municipalities to increase their vehicle sales tax. The bill passed after months of dispute between both parties of the General Assembly, with three continuing resolutions issued as the debate extended beyond the beginning of the fiscal year on June 30. HB 97 now goes to the desk of Gov. Pat McCrory (R), who stated Sept. 17 his intention to approve the state budget compromise.
