III. Board Reports
A. Board Chair – Dr. Newman Dr Newman mentioned that a discussion would take place during the Long Range Planning Meeting regarding the roles and responsibilities of Board members.
B. Board Members
Ms. Johnson attended the NCSBN NCLEX item-writing Committee in April in Chicago and is going back in June to co-chair the NCLEX item writing with Ms. Forst. Ms. Johnson also completed the leadership board initiative through the steering committee.
Dr. Hubbard also attended the NCSBN NCLEX item-writing Committee in April. She will be attending again in September.
Ms. Whitson discussed an article she found by the American Academy of Pediatrics regarding the role of school nursing. She stated they are recommending a full-time school nurse in every school and foresees Florida needing an influx of nurses due to this recommendation.
Ms. Forst also attended the NCSBN NCLEX item-writing Committee in April. She will be attending again in June. Appoint 2 BON Members to discuss wrong-site surgery issues with 2 BOM Members
Mr. Baker informed the Board that 2 members were needed to join 2 Board of Medicine members to discuss wrong-site surgery issues. The meeting will be scheduled in the near future and will also include counsels from both boards. Dr. Newman appointed Forst and Desmond to go to the meeting and Whitson and Johnson as back-ups. Mr. Baker indicated he would give more information as soon as he receives it.
NCSBN Annual Meeting in August
Mr. Baker informed the Board that two voting delegates were needed to attend the NCSBN Annual August Meeting in Chicago. Dr. Newman appointed Ms. Forst and Ms. Whitson as voting delegates and Ms. Johnson as an attendee.

Ms. Gustafson gave a brief review of the May Rules Report. Ms. Gustafson stated they have begun notices of rule development due to legislative changes to eliminate medical errors continuing education for initial licensure and to include the negative formulary rule. Ms. Guillemette stated that 64B9-5.002 has language regarding medical errors licensure that needs to be amended to state that 2 hours is needed each biennium for renewal. A motion was made by Newman to open rule 64B9-5.002 for development. Motion passed unanimously.
3. Litigation Update
Ms. Guillemette informed the board about a petition filed in the Judicial Leon County Circuit from the Florida Academy of Nursing for injunctive relief so the Board will be unable to put the school on probation. Ms. Guillemette said that Florida Academy of Nursing is arguing that their test scores have not been considered for two full calendar year and that the board staff is using partial time within the year. The Circuit Judge stated that the Board should not be considering partial quarters when a school begins submitting test scores, but only the following two calendar years. A motion was made by Newman to accept that the board recognizes a calendar year as January 1st to December 31st and will not recognize a particle calendar year for the first testing cohort from a program. Motion passed unanimously.

Mr. Baker informed the board that the 6 applications listed were being updated to remove the requirement for prevention of medical errors at initial licensure and any cleanup staff noted. A motion was made by Newman to approve this. Motion passed unanimously. Ms. Gustafson asked the board to approve the amendment of the rules in which those forms are incorporated to change the effective/revision date of the forms.

A motion was made by Newman to indicate the board does not believe that changing the revision date on the form will have an adverse impact on small businesses or be likely to directly or indirectly increase regulatory cost to any entity by over $200,000 in FL within one year after implementation of the rule or with the amendment require legislative ratification. Motion passed unanimously.
Mr. Baker took time to give a big thank you to the board staff due to the current influx of workload and the staff working overtime to accommodate the extra work. Mr. Baker also updated the Board on recent implementation discussions at the Department from the result of legislation this year. The implementation for most of Nursing’s bills with the exception of the Compact bill have been finalized. Mr. Baker talked about his presentation at the Florida Hospital Association with Martha DeCastro regarding the changes happening now in Nursing and in the future with the compact bill. Mr. Baker stated that Sherri Sutton-Johnson spoke at a CNA graduation in Quincy, FL and thanked her for that. Mr. Baker gave updates on the new formulary committee and that their first meeting is scheduled in Orlando on June 29th and Mr. Baker is working with the Chair of that committee to finalize the agenda. Mr. Baker informed the Board that a workgroup was formed at the Department to assist with iViewer enhancement ideas, which the Board should see by the August meeting. Staff are currently working with Prometric to fix issues with CNA exam information being sent to the board office. Mr. Baker thanked the staff for working hard on that. Mr. Baker lastly informed the Board that the August meeting will be held at the Rosen Centre in Orlando.

I. Discussion
A. Probable Cause Panel- Participation 1. S. 456.073, FS - Disciplinary Proceedings.
Dr. Newman asked board members to state their concerns on why it is difficult for
everyone to serve on panels. Ms. Forst expressed difficulty in signing up for
panels during certain times of the year. Ms. Gustafson suggested changing the
day and time of the panel and reminded the board that the panel must have at
least one licensed member and one current member. Mr. Baker expressed the
importance of participating on a panel once agreeing to join. Ms. Gustafson
added to this by discussing possible quorum issues when board members back
out of participating in panels.
2. Point of contact
Mr. Baker expressed that if board members are on a panel and are unable to
participate, they need to contact the board staff as soon as possible and not PSU
so it is known and can be dealt with accordingly.
B. Possible 2017 Legislation: 1. S. 464.012, FS – ARNP certification; possible elimination of obsolete route
Mr. Baker and Ms. Gustafson explained to the Board that according to
464.012(1)(c), FS; The statute does not specify that one must have a Master’s
Degree, but only that they have graduated from a program leading to one.
Florida can accept applicants by endorsement from other states who don’t have
a Master’s Degree who want to be licensed as an ARNP in Florida. A motion was
made by Newman to have this language addressed if it moves forward in the
2017 package. Motion passed unanimously.
2. S. 464.019, FS – Proposed Revisions
Under 464.019(1)(c), FS; the Board agreed to adding “per subject area”.
Discussion then ensued regarding the possibility of Florida nursing schools
having clinical facilities in U.S. territories. Mr. Baker suggested limiting clinical
training to the United States and the District of Columbia. The board agreed with
Mr. Baker’s suggestion. Under 464.019(1)(f), FS; the board agreed to add “as
specified by the board in rule, shall…”. Under 464.019(2)(e), FS; the Board
agreed to add “An applicant for program approval shall permit the board to
conduct an on-site evaluation.” Under 464.019(5)(a), FS; Mr. Baker expressed to
the Board that obtaining reports based only on first time test takers who
graduated within the first 6 months is cumbersome and shows unrealistic data.
This also causes schools to make students wait until after the 6 months. The
board agreed to strike this from the law. In the same section, the board also
agreed to add “the program shall present a documented plan for remediation

which shall include specific benchmarks to identify progress towards a graduate
passage rate goal.”, strike “the board shall place the program on probationary
status pursuant to chapter 120”, add “approval of the remediation plan, the board
shall place the program on probationary status pursuant to chapter 120.” And
strike “for remediation, which shall include specific benchmarks to”. Under
464.019(5)(b), FS; the board agreed to add “the program director fails to appear
and”. Under 464.019(7)(d), FS; the board agreed to add “cannot be licensed
until” and “from the date of termination or closing has passed” and strike “prior to
filing a new application approval”. Under 464.019(8)(3), FS; the board agreed to
add this to the law. Under 464.019(11)(e), FS; the board agreed to add “A
nursing education program which fails to meet the requirement for accreditation
shall be terminated and ineligible for re-approval for a period of 3 years”.
3. Change ARNP Title to APRN
The board is in agreement with changing the ARNP title to APRN.
4. Other
Mr. Baker asked the board if there are any other possible changes they would
like to see. Ms. Forst wanted to know if people who were educated out of the US
could indicate to the board what they have been doing since their education. Ms.
Guillemette explained that because they are required to take the NCLEX, this is
not needed.
C. 2016 Legislation: 1. HB 423
a) Rule 64B9-4.010 ARNP Standards for Protocols
Protocols currently require every supervising physician sign an ARNP’s protocol.
The board discussed the potential of having a Medical Director sign off on the
protocol instead of every doctor. Ms. Whitson brought up there could be
physicians who may not want an ARNP doing particular things but have no say
because the medical director signed off instead of them. A health care attorney
from the audience stated that in our frequently asked questions, we already allow
this. Ms. Gustafson suggested adding the DEA number of the ARNP if
applicable. Ms. Gustafson also proposed having a rule workshop for this so that
people with interest in this rule may come and give their ideas. The board agreed
with doing this for the August 2016 board meeting.
b) Approved Organizations to Offer Required ARNP Controlled Substance
CE
Mr. Baker told the board that the new CE requirement will begin on August 1st
since there is a renewal ending on July 31st. Mr. Baker then asked for guidance
on whether or not the board deemed “offered” to include courses accredited or

approved by AANA, AANP, and ANCE. The board agreed those would be
acceptable CEs.
2. HB 977
a) Rule 64B9-4.002(3) – adding language related to new Psych Nurse
certification
Mr. Baker asked the board to identify certifying bodies within this rule. The board
agreed to let the board staff and counsel draft language for the rule amendment
for the August board meeting.
3. HB 1061- Nurse Licensure Compact
Mr. Baker let the board know that there are ten states which have now joined.
Ms. Johnson asked what the difference was between the old and new compact.
Mr. Baker explained that the new compact requires a criminal background check
from every participating state and someone with a felony conviction may not
have a compact license. Participants in IPN or a similar program would also be
ineligible for a multi-state license.
D. Rule 64B9- 8.006- Disciplinary guidelines (Review of current guidelines
in addition to new requirements under HB 423 & HB 977) Ms. Gustafson asked the board to consider upping the maximum penalty for criminal violation.
Ms. Gustafson specifically requested for the maximum penalty for the first offense be
revocation. A motion was made by Newman to make the changes as proposed. Motion passed
unanimously. Ms. Gustafson will bring the revised copy to show the board in August after she
makes the changes.
E. S. 464.018(1)(d)2, FS - 1st Time Retail Theft Ms. Guillemette noted she saw inconsistency on board motions and would like board guidance
to make it more consistent. Current matrix shows 1st time theft for applicants to be approved
without going to the board but when they are licensed, they are being treated differently. Ms.
Gustafson explained the difference between a letter of guidance and a letter of concern. The
board agreed they will begin recommending a letter of guidance instead of an administrative
complaint in future probable cause panels.
F. Rule Clean-up 1. Rule 64B9-4.004(3)(a) – deleting “notarized true and correct”
Deleting this would allow board staff to accept copies of board certifications. A
motion was made by Newman to delete the language. Motion passed
unanimously. A motion was made by Newman to accept that this would not have
adverse monetary effect. Motion passed unanimously.
2. Rule 64B9-3.0025 Remedial Courses for Reexamination.
a) Offerings by programs on probationary status.

Ms. Guillemette and Dr. Hubbard will work on language to present to the board at
the August meeting.
G. Division of Work Load: Dr. Newman expressed concern with committee workload being imbalanced due to committees
adjourning at different times. Mr. Baker stated the difference in workload depends on the time of
year (graduation, etc.) and suggested we could switch certain items between committees
depending on the time of the year to keep it balanced.

H. Potential 2017 Board Meeting Dates Discussion was opened to proposing meeting locations for 2017. The board expressed
interest in Tampa, Naples, Gainesville, and Tallahassee. The board agreed to the
