THE EXECUTIVE COMMITTEE RECOMMENDS THAT 0.875 hectares (2.162 acres), more or less, being Part of Lots 14 and 15, Concession 2, From the Bay, formerly Borough of East York and now City of Toronto and labelled 'Lands to be Conveyed Below Top of Bank' and 'Proposed Easement Below Top of Bank' on sketch prepared by Sutcliffe Architects Inc., City of Toronto at 2 O'Connor Drive, be purchased from the Sisters of St. Joseph for the Diocese of Toronto;

THAT the purchase price for the land and conservation easement be $2.00;

THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the land free from encumbrance, subject to existing service easement and subject to the Sisters of St. Joseph for the Diocese of Toronto reserving an easement for the purposes of the installation, construction, repair, maintenance and replacement of a fence, and the carrying out or implementation of the Ravine Stewardship Plan which is subject to the approval of TRCA, together with right of access for such purposes;

THAT the firm of Gardiner Roberts LLP, Barristers & Solicitors, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred incidental to the closing for land transfer tax, legal costs, and disbursements are to be paid;

AND FURTHER THAT the authorized TRCA officials be directed to take whatever action may be required to give effect hereto, including the obtaining of necessary approvals and the signing and execution of any documents.

As a condition of Official Plan Amendment and Rezoning application, the Sisters of St. Joseph for the Diocese of Toronto is required to convey the valleylands to TRCA. Also, as part of the negotiation with the Sisters of St. Joseph for the Diocese of Toronto for the development of this site, TRCA Planning and Development staff agreed to allow the Sisters of St. Joseph for the Diocese of Toronto to construct a fence part way down the slope. The Sisters of St. Joseph for the Diocese of Toronto has requested this location for the fence so that the fence will not be seen from the new development. The Sisters of St. Joseph for the Diocese of Toronto will require an easement to maintain the fence (labelled 'Proposed Easement Below Top of Bank' on sketch). The Sisters of St. Joseph for the Diocese of Toronto is also requesting the easement for access to undertake the Ravine Stewardship Plan which is a condition of development of the site. The Ravine Stewardship Plan will be subject to TRCA approval.

Negotiations have been conducted with the owner’s lawyer, Ruth Horn, Stikeman Elliot LLP.

Attached is a plan showing the location of the subject lands.

RATIONALEThe subject property is valleyland and falls within TRCA’s approved master plan for acquisition for the Don River watershed as outlined in the approved Greenland Acquisition Project for 2006-2010.

TAXES AND MAINTENANCEIt is proposed that the lands be turned over to the City of Toronto for management.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from the City of Toronto to convey certain lands for Street "C" located between Lakeshore Boulevard West and Marine Parade Drive, in the Humber Bay Shores area of the City of Toronto;

AND WHEREAS it is in the opinion of TRCA that it is in the best interest of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act, to cooperate with the City of Toronto in this instance;

THEREFORE LET IT BE RESOLVED THAT a parcel of TRCA-owned land being the ownership rights above 1.5 metres below grade containing 0.023 hectares (0.056 acres), more or less, required for Street "C", said land being Part of the Bed of Lake Ontario in front of Lot 29, Registered Plan 1176, City of Toronto, be conveyed to the City of Toronto;

THAT consideration be the nominal sum of $2.00 and TRCA's expenses and costs are to be paid by either the City of Toronto or South Beach (Lakeshore) Developments Limited;

THAT South Beach provide a release of any obligations of TRCA under any agreement between TRCA and South Beach with respect to the land to be conveyed to the City;

THAT said conveyance be subject to approval of the Minister of Natural Resources in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27, as amended and the release by South Beach of any obligations of TRCA under any agreement with it with respect to the land to be conveyed to the City;

AND FURTHER THAT the authorized TRCA officials be directed to take whatever action may be required to give effect hereto, including the obtaining of necessary approvals and the signing and execution of any documents.

CARRIEDBACKGROUNDAt Authority Meeting #5/09, held on June 26, 2009, Resolution #A94/09 was approved as follows:

WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from South Beach (Lakeshore) Developments Limited to purchase subsurface rights, a parcel of land and grant easements on the parcel of TRCA-owned land located south of 2175 Lakeshore Boulevard West;

AND WHEREAS it is in the best interests of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act to complete a sale of subsurface rights, a parcel of land and grant easements to South Beach (Lakeshore) Developments Limited in this instance;

THEREFORE LET IT BE RESOLVED THAT TRCA finalize a transaction with South Beach (Lakeshore) Developments Limited on the following basis:

(a) TRCA sell subsurface rights for an underground parking structure for parking, utilities, heating and air-conditioning services in TRCA-owned lands containing 0.125 hectares (0.309 acres), more or less, the upper limit of the strata will be at a depth of at least 1.5 metres below grade and the lower limit of the strata is to be approximately 30 metres below grade of the property described Part of the Bed of Lake Ontario in front of Lot 29, Registered Plan 1176, City of Toronto being Part 2 on draft reference plan prepared by J.D. Barnes Limited under their Reference No. 07-22-731-04-A;

(b) TRCA sell a parcel of land for an emergency pedestrian exit stairway containing 0.003 hectares (0.008 acres), more or less, described Part of the Bed of Lake Ontario in front of Lot 29, Registered Plan 1176, City of Toronto being Parts 5 and 6 on draft reference plan prepared by J.D. Barnes Limited under their Reference No. 07-22-731-04-A;

(c) TRCA grant permanent easements for maintaining and repairing the parking structure and facilities and constructing, maintaining and repairing an emergency pedestrian exit stairway over the land containing 0.122 hectares (0.301 acres), more or less, described Part of the Bed of Lake Ontario in front of Lot 29, Registered Plan 1176, City of Toronto being Parts 1 and 4 on draft reference plan prepared by J.D. Barnes Limited under their Reference No. 07-22-731-04-A;

(d) TRCA grant a permanent easement for access from the stairway to Marine Parade Drive over the land containing 0.008 hectares (0.019 acres), more or less, described Part of the Bed of Lake Ontario in front of Lot 29, Registered Plan 1176, City of Toronto being Part 4 on draft reference plan prepared by J.D. Barnes Limited under their Reference No. 07-22-731-04-A;

THAT consideration be the sum of $1,280,000 plus TRCA will be paid an addition sum based on 50% of $36.47 per square feet of residential gross floor area (GFA) should the GFA of TRCA property exceed the original GFA of 34,000 square feet used to calculate the consideration;

THAT TRCA will transfer all density rights to South Beach (Lakeshore) Developments Limited attributable to the TRCA-owned lands;

THAT TRCA will grant South Beach a temporary licence for a period of two years commencing within four years of the closing date for construction of the parking structure;

THAT South Beach is to provide a letter of credit in the amount of $400,000 to ensure that the restoration of the property is completed to the satisfaction of TRCA and the City of Toronto;

THAT said conveyance is subject to the necessary Planning Act approvals;

THAT said conveyance is subject to the approval of the Minister of Natural Resources in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27 as amended;

AND FURTHER THAT the appropriate TRCA officials be authorized and directed to take whatever action may be required to give effect thereto, including the obtaining of necessary approvals and the execution of any documents.

The City of Toronto undertook a collaborative review of the west end of the Humber Bay Shores area which resulted in the formulation of new urban design guidelines. The new guidelines were approved by City Council in July 2008. Based on these guidelines a Precinct Plan is being prepared for the area which sets out the internal road patterns and conceptual building envelopes. One of the internal roads in the Precinct Plan is identified as Street "C" which straddles the property line between TRCA land and South Beach land. In the area where this road is proposed, TRCA has an agreement with South Beach to convey to South Beach the subsurface rights for the construction of an underground parking structure. The lands being conveyed to the City of Toronto will be above the parking structure where South Beach has the subsurface rights.

South Beach has submitted an Official Plan Amendment (OPA), Zoning and Site Plan application for their development which includes the parking structure under TRCA land. As a condition of the approval of the OPA, Zoning and Site Plan, the City of Toronto will require conveyance of Street "C".

FINANCIAL DETAILSSouth Beach or City of Toronto will pay all legal, survey and other costs involved in completing this transaction.

RES.#B205/09 - REGION OF PEEL SPILLS RESPONSE DECISION SUPPORT SYSTEMAward of sole source contract to Angus GeoSolutions Inc. (AGSI) for the completion of the Region of Peel Spill Decision Support System.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT a contract for the development of the Region of Peel’s Spill Decision Support System (SDSS) be awarded to the firm of Angus GeoSolutions (AGSI) at a cost not to exceed $208,000 plus applicable taxes;

THAT award of the contract be subject to a partnership agreement between AGSI, Toronto and Region Conservation Authority (TRCA) and the Region of Peel detailing AGSI’s in-kind technical and professional services towards the development of the SDSS and a cash contribution of $340,000;

AND FURTHER THAT the appropriate TRCA officials be authorized and directed to execute all necessary documentation required including signing of documents.

CARRIEDBACKGROUNDAt Executive Committee Meeting #10/07, held on December 7, 2007, Resolution #B161/07, was approved, in part, as follows:

THAT a contract for the development of Spills Response Decisions Support System tool be awarded to the firm of Keigan Systems Inc. at a cost not to exceed $185,000 plus applicable taxes; ...

Since that time Keigan Systems (Keigan), the private sector partner in the development of the Region of Peel SDSS, has gone out of business.

TRCA staff had been working closely with Keigan and the Region of Peel to identify funding opportunities to initiate work on spills prevention and management as a priority recommendation resulting from the Stakeholder's Workshop hosted by TRCA and Toronto and Region Remedial Action Plan (RAP).

The project was to be completed in four phases: Strategic Planning – the development of a strategic vision and partnership for the 1.development and coordinated utilization of a web-based SDSS and database.User Needs Assessment – the identification of the exact data and tool requirements for the 2.SDSS, based on input from the Region of Peel, City of Brampton, City of Mississauga, Town of Caledon, TRCA, Credit Valley Conservation (CVC) and the Ministry of the Environment’s Spills Action Centre (MOE SAC).Publishing Thematic Data Standards –integration of data standards of the ArcHydro data 3.model and the development of standards for accessing and exchanging data with partner municipalities, TRCA and the Ministry of the Environment.

Geospatial Decision Support Systems – the development of the web-based SDSS that will 4.provide a modeling system for spills; access to near-time weather information; background on hazardous chemical materials; and the ability to store historic spill data to assist in targeting outreach and infrastructure investments.

Keigan was to play a role in the project by assisting TRCA and the Region of Peel in completing these four phases, but also by contributing in-kind technical and professional services towards the development of the SDSS. When notified of Keigan’s inability to complete the project, TRCA staff completed a competitive Request for Quotation (RFQ) process to identify another vendor who could assist with the project. Through the RFQ process AGSI was selected as the successful vendor.

Through this consultation process with the various stakeholders, AGSI completed Phase 2 and identified the tools, data and information required by the various organizations involved in spill response. This information has now provided the partners the foundation of what is required to make the web-based SDSS successful and with the guidance required to complete both Phase 3 and Phase 4.

Value of the Spill Response SystemThrough the completion of the first two phases, the value of the web-based SDSS to the various municipalities has increased. The web-based SDSS has been identified by Region of Peel spill response staff as a way to improve their level of service to the Region, by:

providing a way to predict, respond and manage public safety threats from chemical and oil spills;enabling first responders to trace a spills course through the municipal sewer systems within seconds, as opposed to minutes and hours;identifying the potential sources of unreported spills by tracing the potential spill routes;enhancing communication among the Region of Peel, lower-tier municipalities, conservation authorities and the Ministry of the Environment; and,retrieving information on property owners, chemical storage sites and historical spill information much more quickly, resulting in less time to coordinate information and staff resources.

All of these benefits have an overall positive impact on the natural environment in the Region of Peel by reducing the effects of chemical and oil spills. The proposed system will also have a number of cost benefits for the municipal partners, including:

improved spill response times will enable staff to use more of their time working on prevention; and,the SDSS’s database will enhance staff’s ability to ensure those responsible for spills are held account for the costs of clean-up.

Ancillary Benefits to Municipal PartnersBeyond these benefits, the proposed system also has a number of ancillary benefits for the municipal partners, including:

the development of a data model using the municipal stormsewer systems will also provide municipalities with improved information about their infrastructure networks, providing a tool to assist in prioritizing the maintenance and replacement of stormsewers; and,

the development of a data model using the municipal stormsewer systems will speed up the integration of these data into the various lower-tier municipalities GIS departments and by doing it together will ensure integration among each municipality, but also at a much lower cost to everyone.

The next steps to realizing these benefits are the completion of phases 3 and 4. The third phase will bring all of the municipal data together into an agreed upon data model that will utilize the municipal stormsewer system as its backbone. The fourth phase will take all of this data and integrate it into a web-based system. Both phases will be completed by the end of 2010, allowing the system to be in operation for Region of Peel Spill Response staff by 2011.

RATIONALETRCA and Region of Peel staff have met with and reviewed AGSI's Go360 platform and believe it is a web-based solution that could deliver the SDSS being designed. Given AGSI's experience in the development and implementation of web-based mapping solutions, staff recommends that AGSI be selected to complete this contract. Staff recommend awarding the contract on a sole source basis as per sections 1.14.1 and 1.14.5 of TRCA's Purchasing Policy, as follows:

1.14.1 - Existence of exclusive rights (patent, copyright or license).1.14.5 - The required goods and services are to be supplied by a particular vendor or supplier having special knowledge, skills, expertise or experience that cannot be provided by any other supplier.

AGSI meets both of these requirements, as it holds an exclusive license for Go360 platform for web-based solutions and they have knowledge and expertise in the delivery of web-based solutions with the Go360 platform. AGSI is also well known by staff at the Region of Peel, City of Mississauga and City of Brampton, having worked with all three in the past.

Further to these elements, AGSI has also agreed to enter into a partnership agreement with TRCA and the Region of Peel. Realizing that the project builds on the intellectual property (IP) of AGSI’s Go360 platform, AGSI also realizes that the SDSS provides new IP and new market opportunities for the company. AGSI, Region of Peel staff and TRCA staff have developed a partnership agreement to develop the SDSS that will include:

TRCA and its funding partners contributing all cash costs to complete phase 3 of the project ($208,000 plus applicable taxes);AGSI contributing all cash costs for phase 4 of the project ($340,000); and,A marketing plan that will involve the Region of Peel and TRCA staff speaking at conferences about the SDSS, with all expenses being paid by AGSI.

Given this partnership, the cost for the Region of Peel’s SDSS is reduced by $340,000 by partnering with AGSI. AGSI’s interest in providing these cash costs are that they plan to utilize this experience and the product developed with TRCA and Region of Peel to market the SDSS to other municipalities. AGSI also plans to utilize other third-party funding assistance to cover their costs. Once completed, the SDSS will be showcased in marketing efforts and will highlight the Region of Peel as a leader in this environmental field.

One of the goals of Partners in Project Green is to have 10 per cent of all energy consumed in the Pearson Eco-Business Zone come from renewable energy sources by 2015. A partnership with a renewable energy re-seller will not only assist in helping reach Partners in Project Green’s renewable energy goals, but will also:

push the general market for green electricity;provide a lower cost option for businesses looking to purchase renewable energy; and,develop a revenue source for Partners in Project Green.

To assist in reaching this target, TRCA developed an Expression of Interest (EOI) that was sent out to licensed energy retailers that provided green energy options. Invitations were sent to Bullfrog Power, Direct Energy, Ontario Power Generation and Just Energy. Two respondents – Bullfrog Power and Direct Energy – responded to the EOI. The Green Purchasing Team of Partners and Project Green, along with TRCA staff reviewed the EOI responses.

Partnership DecisionThrough a series of discussions with TRCA staff and each vendor, the Green Purchasing Team selected Bullfrog Power as the preferred partner vendor. The rationale for this selection included:

Bullfrog Power provides Type III Eco-logo power, while Direct Energy provides Type I and II;Bullfrog Power is best in class in the renewable energy market, and it is essential that TRCA and Partners in Project Green is associated with best in class environmental solutions; and,The marketing plan outlined by Bullfrog Power was determined to be more effective than the plan provided by Direct Energy.

It is understood that due to the price point offered by Bullfrog, Partners in Project Green may not receive as large a profit share as is possible with Direct Energy. However, due to the broad client base that Bullfrog Power has already established in the Pearson Eco-Business Zone, it is believed that many partner companies will elect to pay the premium for the higher quality product.

Partnership TermsAs part of Bullfrog Power’s proposal, the following partnership benefits were proposed:

Bullfrog Power in partnership with TRCA will develop and execute a marketing and communications plan for the program in the Pearson Eco-Business Zone;Bullfrog Power will donate $1.00 from each mWh consumed as a result of this partnership to TRCA to assist in the funding of Partners in Project Green; and,Bullfrog Power will provide the following product discounts to companies in the Pearson Eco-Business Zone (price breaks work on aggregate with discounts being realized as company’s sign up):

CONCLUSIONThe proposed partnership with Bullfrog Power provides a win-win opportunity for TRCA and Partners in Project Green to promote the use of renewable energy in the Pearson Eco-Business Zone, increase the amount of renewable energy generated in the Province of Ontario, increase the brand recognition of Partners in Project Green, while generating a new revenue opportunity for TRCA to fund its operations in the Pearson Eco-Business Zone.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The applicant seeks permission to undertake site grading, permanently place fill material and interfere with a wetland in order construct an industrial development. The site is located south of Highway 401 and the CN railway, east of Brock Road within the Brock Industrial neighbourhood of the City of Pickering. The site is also located immediately to the east of a large portion of the Duffins Marsh Provincially Significant Wetland Complex and has been zoned and designated in the City of Pickering and Region of Durham Official Plans for industrial uses since the 1970’s.

The proposed industrial development includes the expansion of an existing liquid waste processing plant operated by the applicant. The expansion provides for truck parking, soil treatment and storage areas, granular stone driveways, earth berms for screening and a stormwater management facility. The expansion will make use of an existing railway spur on the subject lands for the transferring of liquid waste materials.

The subject permit application follows a Zoning By-law amendment application made in 2005 and approved by the City of Pickering, and a Site Plan application, which was reviewed concurrently with this permit application. During review of the Zoning By-law amendment application, TRCA staff requested the preparation of an Environmental Impact Statement (EIS) for the subject lands. The EIS identified the presence of locally significant wetlands on the lands subject to the zoning application (and now this permit application).

Despite the presence of wetlands on the subject lands, the City of Pickering Official Plan and zoning by-law designated the subject lands for industrial uses. In the absence of municipal Official Plan polices, only ‘Provincially Significant’ wetlands are protected from development pursuant to the Provincial Policy Statement. The wetlands on the subject lands were locally significant and were not subject to the Provincial Policy Statement protections. There were no policy tools in either the City of Pickering Official Plan or Region of Durham Official Plan to prohibit development in the wetlands on the subject lands. Despite the lack of protection under the Planning Act, the wetlands were within a Regulated Area pursuant to Ontario Regulation 166/06. Regardless of the existing or proposed zoning, removal of the wetlands required a TRCA permit.

Through a lengthily review and negotiation process, TRCA staff worked with the Owner and City of Pickering staff using the leverage provided by Ontario Regulation 166/06 requirements to arrive at a solution whereby the owner would provide $80,000 in compensation funding to re-create and/or enhancements to wetland communities off-site within the Duffins Creek watershed. It is staff’s opinion that this approach balanced the lack of Planning Act protections for the wetlands with the ecological impact associated with removal of the wetlands on-site by allowing for compensatory ecological enhancements to wetland communities on publicly held lands in the local watershed.

Permit After the Fact:In summer of 2009, subsequent to the passage of the Zoning By-law amendment application and an agreement by the Owner to provide the compensation funding, fill materials were placed on the site, including the wetlands, in the absence of an approved permit. The Owner was advised of the violation and subsequently made a permit application, as required under the Regulation. Since that time, the Owner has been working cooperatively with TRCA staff to design a site plan to address TRCA requirements for the construction of the permanent facilities including appropriate stormwater management. These requirements have now been satisfied and the applicant has paid the application fee and an additional fee of 100% of the application fee associated with a violation of the regulation.

Control of Flooding:The subject lands are not located within the Regional Storm Flood Plain.

Pollution:A Site Sediment Control Plan has been submitted by the applicant in order to manage construction generated sediment. This plan meets TRCA staff requirements and should prevent sedimentation of the adjacent wetland complex during the construction phase.

Dynamic Beaches:Not applicable.

Erosion:There are no slope stability or geotechnical concerns with the proposal.

Conservation of Land:The proposal involves (involved) the removal of 0.8369 of a hectare (2.07 acres) of locally significant wetlands. In order to justify the removal of the existing wetlands, the owner has provided TRCA with $80,000 of compensation funding to allow the creation or enhancements to wetland communities within the Duffins Creek watershed. This funding has flowed to the Restoration Services Division, which is implementing wetland creation/enhancement plans in the lower Duffins Creek. In addition, the site plan includes a landscape plan, which will provide for the planting of trees and shrubs along the perimeter of the site. Stormwater from the site, which was previously untreated, will now pass through a bio-retention stormwater management system before discharge into the local drainage system and on to the adjacent Provincially Significant Wetlands.

Proposal:The proposal is to temporarily fill in order to pre-load underlying soils in preparation for construction of the City of Toronto's new Port Lands Regional Sports Centre. The subject property is owned by the Toronto Port Lands Company (formerly TEDCO) and is located on the south west corner of Commissioners Street and The Don Roadway in the Port Lands. The property has been chosen as the location of the new Sports Centre and will house between two and four ice rinks to serve a regional market. The property is underlain by soft, organic soils given that the Port Lands were created many years ago from fill over the lake bed, and these soils need to be pre-loaded (compressed) through filling in order to prepare the site for future slab-on-grade construction. This temporary filling using locally sourced fill is the subject of this permit. The filling was started on January 25, 2010 with permission from TRCA's CAO. The permission was granted in this unique situation as the development of the facility is being fast-tracked due to timing restrictions imposed by recently announced federal infrastructure funding. The filling and pre-loading will take some time and the site needs to be ready for development by the summer of 2010 in order to meet critical funding deadlines.

The north west corner of the property is targeted for future use as a portion of the new mouth of the Don River identified in the draft preferred alternative in the Don Mouth Naturalization and Port Lands Flood Protection EA. This north west corner must be reserved for this purpose in any future development proposal. Toronto Port Lands Company is working closely with Waterfront Toronto and TRCA to ensure that the proposed Sports Centre development is fully compatible with the new mouth of the Don River. A second TRCA permit will be required for the final grading and full buildout of the project and the locational constraints for the building and servicing will be considered at that time.

Control of Flooding:The subject property is entirely within the Regional Storm Floodplain of the Don River. The north part of the site is located within the Lower Don River Special Policy Area. The south part of the site includes an existing large industrial building that will be demolished. As such, the overall proposed Sports Centre development meets Provincial and TRCA Natural Hazards policies subject to appropriate flood proofing. In order to implement the draft preferred alternative in the Don Mouth Naturalization and Port Lands Flood Protection EA, the property will need to be filled consistent with a freeboard design elevation of the top of the bank of the proposed new mouth of the Don River, and be consistent with said filling that was permitted for the adjacent FilmPort site to the east. The temporary filling subject to this permit will be at a grade higher than this elevation, and final grades and floodproofing will be addressed at a later date through further approvals. As such, the temporary filling will have no impact on the control of flooding.

Pollution:The proposed sports facility will be built to achieve LEED Gold status and all sediment controls must meet the highest standards from the beginning of the fill exercise through to completion. The site is isolated from Lake Ontario. As such, the proposed temporary filling will have no impact on the control of pollution.

Proposal:The purpose of this application is to acknowledge the construction of an approximately 30' x 25' terrace at the rear of the existing single family detached dwelling at 110 Park Road in the City of Toronto (Toronto and East York Community Council Area). This terrace was constructed without the benefit of a TRCA permit. The subject site is located within the Avondale Ravine, west of Mount Pleasant Road, north of Bloor Street East within a TRCA Regulated Area of the Don River watershed. Avondale Ravine is a highly developed valley corridor. The rear lots and manicured rear yards of 110 Park Road and all of the neighbouring properties extend down to the valley floor. Most of the houses are built over the original top of bank and a number of them include terraces, patios and decks on the valley floor. The watercourse was filled a number of years ago and a storm sewer was installed in the rear yards of some of the properties in the 1990's to alleviate localized drainage issues.

A number of the owners of neighbouring properties have raised concerns with the terrace. It is our understanding that the neighbors' concerns pertain to aesthetics (size and scale) and its impact on localized drainage.

Criteria under Ontario Regulation 166/06 do not include aesthetic or urban design considerations. This is typically a municipal responsibility. The City of Toronto has confirmed that the proposed terrace is consistent with the Zoning By-law and is exempt from the necessity of Site Plan review and a municipal building permit. As such, the aesthetics and height of the terrace are not subject to TRCA's review and/or comment, and there is no control of such under municipal planning or regulation.

We also understand that several of the owners of the neighbouring properties contributed towards the installation of a storm sewer and easement at their rear of some of their lots. Based on information received from City of Toronto, the terrace is not located in an area subject to the drainage easement and the design of the storm sewer does not limit the construction of the terrace.

TRCA's review of the subject permit application is limited to a review of issues pertaining to natural hazards and natural heritage, while ensuring that the tests of the Regulation are met. There are no such issues related to this proposal and the proposal has no impact on the five tests of the Regulation.

TRCA has conducted numerous meetings/discussions with neighbors in consultation with City of Toronto Buildings and Urban Forestry Ravine Protection staff.

Control of Flooding:The site is not located within a regional storm flood plain and the terrace will have no impact on the storage and/or conveyance of floodwaters.

Proposal:The proposal is to conduct site grading works, in order to facilitate the development and construction of a residential subdivision on the subject lands. The subject site is located on the west side of Highway No. 27, and north of Nashville Road, in the City of Vaughan. The property is partially located within a Regulated Area and within the Regional Storm Flood Plain of the Humber River. A tributary of the Humber River and a valley slope are located on the west side of the property.

It is noted that there is an approved Master Environmental Servicing Plan (MESP) for the subject site. The limits of the natural features including the valley slope and significant vegetation were previously identified and delineated during the MESP and associated draft plan of subdivision process. A 10 metre buffer has been provided from the dripline of the significant vegetation and the stable top of bank line.

The subject works will be completed in two phases. The initial phase involves the stockpiling of topsoil and fill material in the southern portion of the property. This stockpiling will take place entirely on the tableland portion of the site and is far removed from the valleylands and its associated buffer. The second phase will consist of the topsoil stripping of the lands and final grading, in order to facilitate the development of the residential subdivision. The applicant will be submitting technical plans for TRCA review for this phase of works. A revised permit will be required for this additional work.

Proposal:The applicant seeks permission to undertake a cut-and-fill alteration to the Regional Storm Flood Plain boundaries within a tributary of the Little Rouge River. The Little Rouge tributary corridor where the works are proposed is located in the northwest quadrant of the Community of Stouffville (North of Main Street, east of Highway 48) within an employment/residential subdivision owned by Stouf Con Eight Developments Ltd. (File No. 19T(W)-03.005B).

The owner is proposing to shift the boundary of the Regional Storm Flood Plain to the west from its current location, which will result in centering the flood plain at the location of the watercourse. This will create additional natural areas to the west of the tributary that will be included within the protected valleyland block than would have otherwise been the case under the planning framework of the Community of Stouffville Secondary Plan. The area to the east of the tributary, which is to be filled in order to remove the flood plain is currently a cultivated agricultural field. Given this context, it is the opinion of staff that the proposed cut and fill will improve the long-term protection of this reach of the Little Rouge tributary while permitting the owner to propose a more efficient use of the adjacent table lands through the draft plan of subdivision.

Control of Flooding:The proposal will maintain the storage and conveyance of the Regional Storm Flood Plain along this reach of the watercourse. The proposed grading plans have met TRCA's engineering requirements for flood plain management.

The works are associated with a master planned community referred to as Rosedale Village. The subject property, approximately 16 hectares (40 acres) in size, is located at the southwest intersection of Dixie Road and Countryside Drive, in the City of Brampton. This permit application is one of several TRCA permit applications in support of the above noted draft approved plan of subdivision. The overall project will comprise residential dwellings, open spaces, neighbourhood commercial development, municipal services and roads inclusive of sewer and watermain. The western boundary of the subject property is abutting a stream corridor of the Etobicoke Creek Watershed that has been recently realigned. The proposed watercourse realignment was based on natural channel design principles and provided for improved ecological functions, as well as improved channel form. The watercourse realignment project (Permit No. C-09851R) was approved by the TRCA Executive Committee at the August 10, 2007 TRCA Executive Committee meeting. An adequate buffer has been incorporated into the design of this subdivision. An erosion and sediment control plan has been prepared and submitted with this application to provide on-site erosion and sediment control for the topsoil stripping and pre-grading activities. The plan includes the use of sediment control fencing, cut-off swales, rock check dams, erosion control blankets, construction access mud mats, and a sediment control pond. Stormwater from the subject lands will drain to the existing Dixie-Bovaird Pond located south of the subject property, which is consistent with the approved Functional Servicing Report (FSR) for this area. Please note that the proposed stormwater management plan will not remove all contributions to the adjacent Etobicoke Creek tributary, which is necessary for the maintenance of baseflow contributions in a post-development scenario. The 1500 mm diameter outfall will convey storm runoff from approximately 10.6 hectares of the northern portion of the site. The outfall will direct stormwater runoff to a vegetated scour pool that was designed as per the Ministry of Transportation (MTO) Drainage Manual to dissipate the tractive forces and velocity of the flow. With the scour pool, the proposed 100 mm diameter river run stone will provide adequate shear stress capacity. The proposed outfall will continue to provide stormwater contributions to the nearby Etobicoke Creek tributary in order to maintain flow contributions and recharge the creek. The creek continues downstream and eventually discharges to Dixie Road and the Dixie-Bovaird Pond. The proposed outfall has been designed in accordance with TRCA's guidelines and design criteria. Additionally, an extensive enhancement planting plan has been provided for the outlet location.

Being a warm water fisheries watercourse, the proposed watermain crossing construction work will be completed during the warmwater construction timing window between July 1 and March 31. Vegetated rip-rap will be installed over new backfill and around the structural improvements. Site 13 involves the removal and re-stacking of several loose armour stones along the river bank and installation of vegetated rip-rap. Site 14 located near the easterly limits of the golf course will include the re-construction of the stream bed and banks for a length of approximately 175 metres to prevent further mass wastage of a large valley scarp. When completed the proposed works at Site 14 will improve the channel capacity and function. Proposal:The purpose of this application is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of an outfall structure related to the construction of a new 6,492 square metre (69,879 sq. ft.) elementary school, parking lot, and playing fields on the subject property associated with a municipal site plan application (Town File No. SPA 09-94). The subject property is located on the east side of Bramalea Road, north of Mayfield Road, in the Town of Caledon. The subject property is currently zoned Agricultural (A1), which permits a school use within Agricultural zoned areas. A headwater tributary of the Campbell's Cross Creek, which is part of the Humber River Watershed, traverses the southern property boundary before flowing south at the rear of the Caledon Recreation Complex. Based on our review, the proposed works are located on the tableland portion of the property and are sufficiently setback from the headwater feature. In addition, the outfall structure is sufficiently setback from the headwater tributary to provide for additional filtration and dissipation of flows from the site development. As such, no impacts are anticipated as a result of the placement of the outfall. Appropriate stormwater management techniques are proposed on-site to achieve Level 1 quality control and quantity controls. Water balance is to be achieved through infiltrating clean and treated stormwater on-site utilizing a pervious pipe system prior to outletting in the creek. As such, there are no flooding, geotechnical, or ecology related concerns with this application. Plantings are adjacent to the headwater tributary and between the proposed outfall and the tributary in order to provide a net ecological gain for this area.

Control of Flooding:The proposed works are located outside of the Regional Storm Floodplain. As such, no impacts to the storage and/or conveyance of flood waters are anticipated.

Pollution:Appropriate sediment and erosion controls will be installed and maintained on the subject property during all phases of construction.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The works proposed under this permit are associated with initial site preparation and servicing works associated with a new residential plan of subdivision located west of Yonge Street, north of Elgin Mills Road in the Town of Richmond Hill. The property is partially located within a Regulated Area associated with a tributary of the Rouge River which traverses the property.

This is the first permit that is being brought forward for works associated with this plan of subdivision. The permit application is to allow for site grading and preparation works on the Regulated tableland portions of the subject property. The applicant is also proposing to construct one of two permanent stormwater management ponds, which will be utilized as a temporary sediment and erosion control pond while site preparation works are being completed. As the Rouge Tributary that traverses this site is home to sensitive aquatic species, near water works will be phased to minimize any potential impacts associated with the site preparation works.

Additional permits will be brought forward for works associated with other phases of this development, including an additional future stormwater management pond, site preparation on future phases of this subdivision, as well as valleyland enhancement works.

Control of Flooding:The proposed work area is located outside of the Regional Storm Flood Plain of the Humber River. As such, no impacts to the storage and/or conveyance of flood waters are anticipated.

Pollution:Erosion and sediment control measures, in accordance with TRCA's guidelines, will be implemented and maintained for the duration of the project.

Dynamic Beaches:Not applicable

Erosion:Erosion will be minimized through the implementation of the aforementioned erosion and sediment control measures.

Other works associated with the urbanization include a new curb and gutter, storm sewers, and storm outfalls.

The Rouge 'C' crossing is identified as a “hydrologically sensitive feature” on the Oak Ridges Moraine. Section 41 of the Oak Ridges Moraine Conservation Plan indicates in Subsection 5 that transportation and infrastructure may be permitted to cross hydrologically sensitive features (i.e. watercourses) subject to the tests and best management practices described in section 41(5)(a to e). This project has been reviewed under the Environmental Assessment Act, Ontario Regulation 166 and under the Fisheries Act for the tests and best management practices.

Control of Flooding:The proposed culverts at Rouge 'C' will greatly improve the flood flow conveyance.

Pollution:Standard erosion and sediment controls (silt fence, rock check dams) will be in place for the duration of construction and until the site is restored to prevent construction generated sediment from entering the watercourse. Oil Grit Seperators (OGS) will be installed to provide water quality treatment of the storm water flows.

Dynamic Beaches:Not applicable

Erosion:There are no geotechnical/slope stability issues associated with the proposal.

Conservation of Land:The watercourse will be altered "temporarily" in order to work in the dry to remove the existing culvert and to replace with the twin culverts. A portion of the watercourse at the north and south ends of the existing culvert will be altered "permanently" in order to tie into the new location of the twin culverts. With the erosion and sediment controls in effect, the potential for a Harmful Alterations, Disturbance or Destruction (HADD) of fish habitat will be mitigated and a Letter of Advice (LOA) will be written by TRCA staff on behalf of Fisheries and Oceans Canada (DFO). In-water and near-water works will be subject to the cold water timing window.

PlantingsThere will be a net gain of vegetation at a ratio of 3:1 with plantings of native/non-invasive species within the limits of this project between Yonge Street and Linda Margaret Crescent on 19th Avenue, and within the limits of the Gamble Road Widening project between Bathurst Street and Yonge Street (CFN 42367)

Proposal:The widening of Gamble Road was approved under a Schedule C Municipal Class Environmental Assessment filed in June 2001. Phase one was constructed in 2004 and 2005, and widened Gamble Road from 2 lanes to 4 lanes with turning lanes as required and a combination of urban and rural cross sections. The current proposal is to urbanize the remaining rural sections. These works include: concrete curbs and gutters, concrete sidewalks, storm sewers, resurfacing, and a bus pad structure. No alterations are proposed to the existing culverts at approximately stations 10+200, 11+500 and 12+000. Only the crossing of German Mills Creek at station 10+200 has a Regional Storm Floodplain; however the current centreline of road is being maintained. A section of ditch on the north side of Gamble Road, east of Bathurst Street which drains into German Mills creek will be re-graded to increase its capacity to handle flows during the spring thaw. These works are proposed on TRCA's land and will require a temporary construction easement. There are no archaeological resources anticipated in this section. TRCA will issue the temporary construction easement when the permit has been issued. The proposal is not affecting any "hydrologically sensitive features" on the Oak Ridges Moraine.

Control of Flooding:There will be no impact to the control of flooding since the proposed centre line of road will be maintained at the Regional Storm Floodplain of German Mills Creek. Minor regrading is proposed in the floodplain to increase the capacity of the ditch draining into German Mills Creek.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The proposed works include construction of a new storm sewer and outfall, plunge pool, and low-flow channel at the 17th fairway. Construction of a new section of cartpath and tee deck is also proposed. The works are designed to mitigate erosion along the adjacent slope, which will be revegetated post-construction, and prevent sediment from entering the watercourse.

Control of Flooding:The proposed works will not have negative impacts to storage or conveyance of flood waters up or downstream.

Pollution:A silt fence will be secured around all construction areas to prevent the migration of construction generated sediment into the watercourse.

Dynamic Beaches:Not applicable

Erosion:Installation of the proposed storm sewer will prevent further erosion on the adjacent slope caused by surficial erosion due to overland flow of stormwater.

The purpose is to allow development within a Regulated Area of the Humber River Watershed in order to facilitate the construction of a swimming pool, cabana, private septic system, geothermal heating/cooling system, and associated landscaping features at 8065 16th Sideroad in the Township of King. A new two-storey single-family dwelling with walkout basement, attached five-car garage and detached carport are also being constructed on the site, but beyond the TRCA's Regulated Area.

The permit will be issued for the period of February 12, 2010 to May 30, 2011 in accordance with the following documents and plans which form part of this permit:

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The purpose is to allow development within a Regulated Area of the Humber River Watershed in order to facilitate the construction of a swimming pool, cabana, private septic system, geothermal heating/cooling system, and associated landscaping features at 8065 16th Sideroad in the Township of King. A permit for these works was previously approved by the Executive Committee on June 1, 2007 (Permit No. C-07300). Works began after the issuance of the first permit and ceased after the permit expired on May 31, 2009. The applicant was asked to forward a new permit application to TRCA staff in order to continue with the works.

There have been changes to the proposed development since the works were first approved by the Executive Committee, including the inclusion of the geothermal heating/cooling system, minor adjustments to the locations of the amenity uses, reduced slope gradients, and enhanced erosion and sediment control measures to address deficiencies noted by TRCA staff on the site.

Resculpting of the site was permitted under the original permit issued by the TRCA in consultation with the Township of King. All site grading and filling associated with the proposed works continues to be set back at least 30 metres from the natural features, the most notable being the watercourse that traverses the central portion of the site.

Conditional Approval:Issues relating to lacking and poorly maintained erosion and sediment control measures were identified on the site under the previous permit. While the applicant has been working with the TRCA to address these concerns, TRCA staff recommends that this permit be approved with the following conditions to ensure compliance with the approved plans and the proper restoration of the site:

That upon completion of the works, the landowner's geotechnical consultant provide written certification that the project has been executed in compliance with the approved plans;That a Letter of Credit be secured by the TRCA to ensure completion of the restoration/stabilization works on the slope.

Furthermore, the timeframe for this permit has been shortened to fifteen months as the majority of the works within the Regulated Area have already been completed.

Control of Flooding:The development is not located within the Regional Storm flood plain. There has and will be no impact on the storage or conveyance of floodwaters.

Pollution:Sediment and erosion control measures were installed after the issuance of the first permit. However, based on site visits conducted by TRCA staff, the sediment and erosion control measures on-site were lacking or poorly maintained, which allowed the release of sediment to the adjacent natural features. The applicant is working with TRCA staff to enhance and maintain the erosion and sediment control measures on the site until the work area is stabilized. The applicant has also been asked to remove the sediment from the bottom of the slope and the impacted vegetated areas.

Dynamic Beaches:Not applicable.

Erosion:Based on site visits conducted by TRCA staff, erosion was noted on the newly placed fill and there was evidence of sediment transport to the natural features due to lacking or poorly maintained erosion and sediment control measures. With the expected enhancements to the erosion and sediment control measures on the site, as requested by TRCA staff, it is expected that there will be no further geotechnical, slope stability or erosion issues associated with the development. Site grading plans and geotechnical reports have been submitted to the satisfaction of TRCA staff.

Conservation of Land:The stabilization and restoration of the site is intended to reduce the impacts to the conservation of land.

PlantingsAll disturbed areas will be restored with seed upon completion of the works. Additional plantings of native, non-invasive species will occur adjacent to the watercourse, on the slope and to the rear of the lot. A detailed landscape plan has been submitted to the satisfaction of TRCA staff.

Policy Guidelines:This proposal is consistent with Section 4.2 - Existing Development - of the Authority’s Valley and Stream Corridor Management Program.

The subject site is located east of the Don Valley Parkway, south of York Mills Road in the City of Toronto (North York Community Council Area).

Conditional Permit:This permit will not be issued until TRCA staff has reviewed and accepted the geotechnical report received by TRCA February 9, 2010. Any minor revisions resulting from the geotechnical review will be addressed through redline revisions.

Control of Flooding:The site is not located within a regional storm flood plain and the proposal will have no impact on the storage and/or conveyance of floodwaters.

Pollution:Appropriate erosion and sediment controls will be installed and maintained throughout all phases of construction.

Dynamic Beaches:Not applicable

Erosion:A geotechnical slope stability report will be reviewed and approved by TRCA geotechnical engineering staff and the proposal will be constructed in accordance with the recommendations of the report.

Conservation of Land:No significant vegetation will be removed as a result of construction. The proposed works are adequately set back from the long-term-stable top-of-bank.
