Builders Association PAC Endorses San Anselmo’s Measure DMeasure D: San Anselmo funding for town infrastructure and services

BACKGROUND:On August 5th 2013, the San Anselmo Town Council voted unanimously to place Measure D on the November 5th ballot. Funds from Measure D will pay for repairs and upgrades to local roads and infrastructure.

MEASURE D:Measure D will enact and one-half cent sales tax for ten years. It is a local transaction tax,

which would be assessed as 5% of purchases, adding 50 cents to a purchase of $100 and $5 on a purchase of $1000. Essential purchases like food and medicine are exempt.

Measure D will allow San Anselmo to address the most urgent needs, including:

• Repairing potholes and repaving roads to improve deteriorating local streets and roads.

• Reducing traffic congestion• Maintaining and improving sidewalks,

drainage and street medians• Preserving public safety

OVERSIGHT:If voters pass Measure D there will be a financial oversight requirements to ensure that funds are spent as voters intended. All funds from Measure D would stay in San Anselmo under local control – nothing could be taken or redirected to the State. There will be annual

independent audits with mandatory expenditure reports. Also there will be required reviews by and independent citizens’ oversight committee.

BALLOT LANGUAGETOWN OF SAN ANSELMO MEASURE DTo repair potholes, repave roads, reduce traffic congestion, maintain and improve sidewalks/drainage/street medians, preserve public safety, and improve other general Town services, facilities, and infrastructure, shall the Town of San Anselmo establish a one-half percent (.5%) sales tax for ten years, with annual independent audits, mandatory public expenditure reports, and an independent citizens’ oversight committee with all funds staying in San Anselmo under local control?

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

About the only thing you can count on is things are going to change! That means one thing often leads to another when qualifying multiple licenses. A couple of contractors discover just what ‘adjustments’ may be required and it’s a lesson we all benefit from learning…

Q: Our company currently has a license that holds a “B” (General Building), “C-10” (Electrical), and the “C-46” (Solar) classifications. The Responsible Managing Employee (RME) for the “B class has left the company and he submitted a Disassociation Notice to the CSLB. We aren’t really worried about it because we don’t do any building work. Our projects all fall under the Solar and Electrical classifications. If we decide not to replace him for the “B” classification, will the CSLB suspend our license? Secondly, we also have a Joint Venture (JV) license with another company, so that “B” classification is attached to that license as well. What will happen to the JV license?

A: As you may already be aware, once your “B” Qualifier disassociates you have 90 days to replace him. Since you also have two other classifications on the license to operate with, the CSLB will not suspend the license. Instead, after the 90-day grace period they will remove the “B” classification from the license.

With regards to the Joint Venture license, it’s

likely that the CSLB won’t automatically remove the classification from the license. I would suggest filing an Application to Remove Classification from License which is available on their website, or you can call our office for assistance.

Q: The Responsible Managing Officer (RMO) on our corporate license also has his own personal license that he uses on the side. He recently informed us that he had an issue with one of his customers that may result in a judgment and possible suspension of his license. Can this impact our corporate license even though they are unrelated licenses?

A: The “relation” between the two licenses is the fact that both licenses have the same qualifying individual, so yes, if your RMO has an unsatisfied/unresolved claim, judgment, or suspension associated with their personal license, it will likely impact all of the licenses that they’re associated with. This goes back to a recent column that detailed the tight interaction of databases among many State agencies, Counties and Cities in CA. When one knows of an issue, they all do.

At the October 21st Contractors State License Board meeting, the Enforcement committee discussed the recent approval of using the CSLB’s website to disclose disciplinary actions taken by partner agencies. To get the program

started, CSLB has identified two partner agencies: the Department of Industrial Relations’ Division of Labor Standards Enforcement (DLSE) and the California Department of Transportation (Caltrans). DLSE issues Civil Wage and Penalty Assessments (CWPAs) for Labor Code violations on public works projects, and Caltrans issues Stop Notices for non-payment of monies due for project issues that include project labor, services, equipment or materials.

As outlined in the Board meeting packet, the “CSLB will only disclose CWPAs that involve significant amounts of money owed to employees and Stop Notices that 1) result in a civil court filing or 2) are issued to contractors with a significant history of Stop Notices”.

PASSES WRRDA!!!!• Building Code Change Helps Deter

Disability Access Lawsuits

Governor ActsSo, the “ink has dried” on the final actions of the governor and thus “it’s a wraps” on the 2013 legislative session. I am fast and furiously writing my annual “Year-End Legislative Report” which you should be seeing within the next few weeks. As always, I will be writing about the winners and losers in the Capitol and, even more importantly, the bills that were signed into law that affect YOUR business! Stay tuned!

U.S. HOUSE OF REPRESENTATIVES PASSES WRRDA!!!!The U.S. House of Representatives last night passed the Water Resources Reform and Development Act (WRRDA) in an overwhelming display of bi-partisanship bya 417-3 vote! This legislation authorizes funding for water-related capital projects throughout the country for dams, waterway improvements, flood mitigation, and other similar construction.

Overall, the bill provides $10 billion in construction funding over five years andmakes several reforms that will propel projects to approval, funding, and completion much more quickly. H.R. 3080 eliminates unnecessary studies, and ends the practice of sequential

reviews where one governmental agency has to wait for the other to finish its work before it can get started. Environmental reviews under thisproposal will also be streamlined. These changes will result in a review period reduced from fifteen years to three years with hard deadlines in place to hold our government to it. The measure also establishes a Water Infrastructure Public PrivatePartnership Program.

Senate and House staff members will meet in a few weeks to begin the Senate/ House conference negotiations on the bill. In the meantime, the House Transportation and Infrastructure Committee plans to markup its version of the WIFIA bill and pass the measure in November. This action will allow the House conferencenegotiators to use the Committee’s WIFIA bill as the House position concerning this segment of the Senate legislation.

There are still some remaining issues that need to be resolved. These issues includethe removal of the $20 million minimum project size that was required by theSenate WIFIA bill in order for a project to qualify to receive funding, the uncoupling of project financing rates to Treasury prevailing interest rates, and that projectsshould be eligible for 100% federal funding.

I will continue to update you as events occur relative to this legislation.

Building Code Change Helps Deter Disability Access LawsuitsFor a number of years, the business community has been victim to a small but widely destructive, atypical group of plaintiffs and lawyers using the disability laws and court system to seek monetary profits rather than access. The result has been unnecessary, costly litigation for significant numbers of California businesses across the state, and many of them closing their doors for good.

In 2012, we strongly supported legislation to limit frivolous litigation connected with the Americans with Disabilities Act (ADA) that ultimately was signed into law. SB 1186 (Steinberg; D-Sacramento/Dutton; R-Rancho Cucamonga; Chapter 383, Statutes of 2012) also promotes increased compliance with disability accessibility building codes throughout the state.California businesses should be aware of two recent updates regarding ADA compliance:• The California Building Standards Commission has adopted the new 2013 California Building Standards Code, which will go into effect early next year.• In conformity with SB 1186, the California Commission on Disability Access (CCDA) has published a list of “Top 10 Demand Letters & Claims.”

with specified construction-related accessibility standards pursuant to a variable measurement range as compared to a strict measurement standard currently used in the 2010 building code. This change will eliminate many of the ADA lawsuits alleging a barrier violation based on incorrect measurements.

To avoid confusion and unnecessary litigation so that a property owner is not sued for non-compliance with the 2010 building code when the alleged property violation would be in compliance with the variable measurement range set out in the 2013 building code, SB 1186 (Steinberg and Dutton of 2012) enacted special “transitional” provisions to protect property owners from unwarranted liability claims before the new code actually goes into effect next year. This change applies to claims made on and after July 1, 2013 — the publication date of the 2013 California Building Standards Code.

That statute provides that a property’s compliance with property measurement standards for disability access in the 2013 building code is an alternative method of compliance until the 2013 building codes take effect next year.The California Building Standards Commission will have electronic versions of the 2013 code viewable at: http://www.bsc.ca.gov/codes.aspx.The California Commission on Disability Access also provides information and educational materials. The commission’s website is at www.ccda.ca.gov.

New Litigation Tactics Against BusinessSB 1186 also sought to limit abusive litigation tactics used by plaintiff’s attorneys with regard to the laws requiring that places of public accommodation are accessible for persons with a disability.

One of the key provisions in SB 1186 prevents the stacking of claims. Before SB 1186, unscrupulous attorneys would have their clients repeatedly visit

the same business establishment to encounter the same alleged construction-related accessibility violation in order to drive up the value of the case, as under the California Unruh Civil Rights Act, each violation triggered a minimum $4,000 statutory penalty. In one notorious example, the lawsuit claimed that the plaintiff had been denied access to the same business, on the same basis, on 30 occasions and asked for $120,000 in damages.

SB 1186 sought to cure this abuse by mandating a court to review the reasonableness of a plaintiff’s actions in repeatedly returning to the same establishment where the individual had experienced a construction-related accessibility violation in light of the plaintiff’s obligation under the law to mitigate (reduce) damages.

Thus, if the plaintiff’s complaint alleges that he/she went to the same fast food restaurant 20 times and each time the plaintiff encountered the same barrier violation (such as a non-compliant countertop or parking space), SB 1186 allows the judge to question the validity and reasonableness of each of the repeated visits and whether the plaintiff had a reasonable basis for not mitigating his damages. (SB 1186 also reduced the minimum statutory penalty to either $1,000 or $2,000 for certain defendants who met specified criteria and corrected the violation within 30 to 60 days. However, for intentional violations and defendants who did not qualify for reduced damages liability, the minimum statutory penalty remains at $4,000 per violation.)

Unfortunately, those same unscrupulous attorneys are trying to manipulate the anti-stacking restrictions. Instead of suing based on the same plaintiff’s multiple visits to the same business for the same violation, now restricted by SB 1186’s anti-stacking provision, some lawyers are using different plaintiffs to sue the same business for the same violation. By filing separate lawsuits by different plaintiffs, the lawyer is not “stacking” his/her claims in the same case, and is therefore

able to avoid the mandatory review by the judge as to the reasonableness of the claims alleged.

This new litigation tactic is a good reminder to businesses that although there have been legislative efforts such as SB 1186 to try to deter frivolous litigation, the best way to protect a business against such litigation is to have the property inspected by a Certified Access Specialist to identify and remedy any potential construction-related accessibility issues.

Top 10 ADA Claims Against Businesses in CaliforniaThe California Commission on Disability Access recently released a report that identifies the top 10 construction-related accessibility violations alleged in settlement demand letters and claims: http://www.ccda.ca.gov/Reports.htm. All business and property owners should review this report to not only educate and protect them from being the target of costly litigation, but to make their businesses accessible to all patrons by removing such accessibility barriers.The best way to avoid such a lawsuit is to know the law, the building code, and assure your property complies.

The CCDA is authorized by California Government Code Sections 8299–8299.11 to act as an information resource; to research and prepare advisory reports of findings to the Legislature on issues related to disability access, compliance inspections and continuing education; to increase coordination between stakeholders; to make recommendations to promote compliance with federal and state laws and regulations; and to provide uniform information about programmatic and architectural disability access requirements to the stakeholders.

SMALL EMPLOYERS: HEALTHCARE REFORM UPDATE

The health insurance marketplaces created by the Affordable Care Act will open on Oct. 1. Most small employers—those with 50 or fewer full-time employees—are not required to offer health insurance coverage under the Affordable Care Act. Even businesses with more than 50 full-time employees have received a one-year reprieve from penalties if they don’t offer insurance. But all companies, regardless of size, are required to notify their employees about the Obamacare marketplaces.There’s also another feature of the law that was supposed to help small businesses: a tax credit to help the smallest ones buy health insurance. It has been around since 2010 on a smaller scale, but starting in 2014, they’ll be able to get a credit for up to 50 percent of their health care premium costs if they buy insurance through one of the SHOP exchanges.It’s only for really small businesses, though — those that have fewer than 25 employees (or their “equivalents,” again), pay less than $50,000 a year in average wages and pay for at least half of the premiums themselves. And they only get the full credit if they have 10 or fewer full-time workers and their average wages are less than $25,000 a year.Smaller companies with fewer than 50

employees, while not required to provide health insurance, need to inform employees about the law and make sure new healthcare plans (if they offer them) comply with Obamacare.

Make sure you’ve addressed the requirements that went into effect in 2012 or earlier:• Provide your employees with a Summary

of Benefits and Coverage from your insurer, clearly explaining what their plan covers and what it costs.

• Make sure any health accounts you have set up for your employees, such as flexible spending accounts (FSAs), health reimbursement accounts (HRAs) or health savings accounts (HSAs), comply with new rules:

1. They can no longer be used to buy over-the-counter drugs (except insulin) without a prescription.

2. ◦Employees are limited to contributing no more than $2,500 to FSAs.

3. ◦Employees will pay higher penalties (20%) for withdrawing HSA funds for nonmedical expenses.

Prepare to comply with these requirements in 2013 and beyond:• If you have not been providing insurance,

investigate your options now. If you have fewer than the full-time equivalent (FTE) of 50 employees, you don’t have to provide coverage. But you may want to see if you can afford it. Beginning in 2014, you can buy coverage through insurance marketplaces

(exchanges). If you have fewer than 25 employees, you also may be eligible for tax credits.

• If you do provide insurance, make sure your health plan meets these new requirements:

• ◦Is adequate and affordable: Insurance is considered “inadequate” if it pays less than 60% of health care expenses for a typical population and “unaffordable” if employees have to pay more than 9.5% of their family income to buy it.*

1. Does not exclude people with pre-existing medical conditions.

2. Does not put annual or lifetime limits on coverage.

3. Does not allow coverage to be canceled solely because of an honest mistake an employee made on the insurance application.

4. Does not make new employees wait more than 60 days for coverage.

In addition, small group plans must cap deductibles at $2,000 for individual coverage and $4,000 for family coverage.*

11. Provides required preventive care with no copay.*

• By Oct. 1, notify your employees about the availability of health insurance marketplace (exchange) plans and that they may be eligible for subsidies to help pay for coverage. Here is the template of information required for employers who offer coverage. Further guidance, and templates for

employers who will not be offering coverage, are available from the Department of Labor.

• Inform your high-wage employees ($200,000 for individuals; $250,000 for joint filers) of new Medicare payroll and investment income taxes — effective in 2013 — and adjust your payroll system accordingly.

• Report to the federal government on whether you offer health coverage, the total number and names of those receiving coverage, and the cost of the plan. The first report is due in 2015 for the year 2014.

• Decide whether you want to offer expanded wellness incentives. Starting in 2014, businesses can offer discounts of up to 30% off insurance premiums to employees who take part in employer-sponsored wellness programs. This is an increase from the 20% discount previously allowed.

*Requirements don’t apply to grandfathered plans — those that were in effect on March 23, 2010, and that have not changed substantially. Ladders - Construction

Ladders present one of the major hazards in construction work, and their use is the cause of many serious accidents.

Construction Wood - Stock ladders should be solidly constructed of straight grain materials and free from defects. Side rails should be of spruce, maple cypress or similar species of woods, perfectly smooth and free from slivers. Rungs should be oak, hickory or ash.

Metal - Side rails of metal ladders should be of sufficient cross section to prevent extreme deflection when in use. Rungs should be corrugated, coated with skid resistant materials or otherwise treated to minimize slipping.

Inspection and Testing Wood - Wood ladders should be periodically treated with a clear preservative such as varnish, shellac, or linseed oil. Painting is not advisable as defects and deterioration may be covered up.

Metal - Rungs should be cleaned to prevent accumulation of materials that might destroy non-slipping properties and all metal fittings should be carefully checked.

All types of ladders - When not in use, all types of ladders should be stored under suitable cover for protection from the weather. Ladders stored horizontally should be supported at both ends as well as the intermediate points to prevent sagging which will loosen the rungs and warp the rails.

Construcción Madera - escaleras de manos de Acciones se deben construir sólidamente de materias rectas de grano y libertar de defectos. Las barandas del lado deben ser de picea, ciprés de arce o especie semejante de bosque, suavizar perfectamente y libertar de astillas. Rungs debe ser roble, el nogal americano o la ceniza.

Metal - barandas de Lado de escaleras de manos de metal deben ser de sección transversal suficiente para prevenir desvío extremo cuando en el uso. Rungs se debe ondular, debe ser revestido con patina las materias resistentes o de otro modo trató para aminorar resbalar.

Inspección y Probar Madera - escaleras de manos de Wood se deben tratar periódicamente con un claro conservativo tal como barniz, la goma laca, o el petróleo de linaza. La pintura no es conveniente como defectos y empeoramiento pueden ser encobridos.

Metal - Rungs se debe limpiar para prevenir la acumulación de las materias que quizás destruyan las propiedades de no-resbalando y todos accesorios de metal se debe verificar con cuidado.
