One of my greatest pleasures is hearing from readers who often respond to a particular column they’ve read. Here’s some feedback from readers like you… In a recent column your answer to the question on the HAZ CERTIFICATION is not complete. For instance, a General Building (B) contractor could bring a qualifier for the “C-36” on board whom also holds/obtains the HAZ MAT for the purpose of installing/removing underground tanks. I appreciate your clarification. The question I was asked was, “could someone come on board with the Hazard-ous Certification only”? They did not want to withdraw as RMO, but also, did not want to take the Haz. exam. Nonetheless, your point is well taken since the above example would certainly be a workable alternative. Thanks for taking time to help us all better understand State law and it’s ongoing interpretation. As my space is limited, I ‘m often only able to provide answers focused on the exact question the contractor asked.
Q. I understand that our RMO must own 20% of the company. We are starting a new business and this person will have less than 5% ownership. I do not know if it matters, but he has been licensed in the past. I came across one of your columns that contradicts what I was told. What do you suggest? A. What you may have heard through the sometimes unreliable “grapevine’ is considered by many to be the law. In reality, there is no rule or regulation that requires the Responsible Managing Officer (RMO) to own any stock in the company. The “20%” rule applies if your RMO is presently a qualifier for another company and wants to qualify BOTH licenses. Your qualifier appears to have been the RMO for his previous employer but this license expired last year. There should no problem with him being your RMO regardless of his ownership percentage.
Q: My Responsible Managing Employee, or RME. is not working out. I would like to fire him but cannot because he has said he'll take the license when he leaves. He dangles this over me and I feel like I'm being held hostage. Do have any suggestions on what I can do to resolve this situation?
A: I am sorry your Qualifier is a. . . problem. However, be assured that when a RME is fired, or leaves your company for any reason, he cannot "take the license". This license belongs to your corporation, NOT the RME.
You should start by completing a Notice of Disassociation informing the CSLB that your Qualifier is no longer employed by the firm. The corporation will then have 90 days to replace him. During this time, the license remains in good standing as if the RME were still listed. Part of the reason this law exists is to insure that a company cannot be "held hostage" and has adequate time to find a new qualifying individual. If it appears it will take longer than 90 days to replace your Qualifier, I suggest petitioning the CSLB for additional time.
For those in this situation, you may want file an application to replace the Qualifier, since the Board is sponsoring legislation to amend this “90 day extension” rule.

SAFETY TOPIC: Give Jacks, Lifts, and Hoists the High Safety Priority They Deserve
Each year serious injuries and deaths occur in the workplace as a result of unsafe jack, stands, lifts, and hoist use. Although safety responsibility for these devices must be shared between employer and employee, the ultimate responsibility for safety lies with the individual worker. Even where there is close supervision, the worker makes the final decision on how to do the job.
JACKSWorkers must select a jack with the rated lifting capacity that equals or exceeds the load it will support. Jacks must be placed on a firm, level surface perpendicular to the load in order to work efficientially. If the jack slips out from under a load, workers may not have enough time to get out of the way, so adjustable stands or other substantial support should also be placed underneath the load so that it will not fall if the jack slips or fails. It should be clear to workers, that they should never enter beneath or work under a load that is supported only by jacks. If a jack is bent or defectiveit should be tagged and removed from service.
HOISTSOnly workers who have been trained in the proper use of hoists should be allowed to operate them. The lifting capacity of the hoist must be clearly marked and visible to the operator and cage-controlled hoists must be equipped with an effective warning devices. Before operation, operators should check that the hoist chains or ropes are of sufficient strength and length to safely lift or otherwise handle the load. On a chain hoist, they should make sure the hook has a safety clip so that if the chain is given slack the hook won’t come loose. The oil level on hydrau-lic hoists should also be periodically checked. Operators should understand that they are pro-hibited from carrying loads over people and any hoist malfunction should be reported to their supervisor immediately.
LIFTSLifts should be marked with the name of the manufacturer, the approval number issued by the Division of Industrial Safety or statement of compliance with ANSI B153.1-1974 (or if manufac-tured after 8/17/94, compliance with ANSI B153.1-1990), and date of installation. No one should be inside a vehicle that will be lifted and for their safety, workers should stand to one side as the lift operates, making sure the doors, hood, and trunk of the vehicle are closed before the lift. The load should rest squarely on the lift and not overload the lift’s capacity. The floor under the lift should be free of oil or grease to prevent slipping hazards. Oil levels on hydraulic lifts should be checked periodically and lifts removed from service if there are any indications of malfunctioning.

SAFETY TOPIC:Dé a los Gatos Hidráulicos, a los Elevadores y a los Guinches la Alta Prioridad de Seguridad que Ellos se MerecenCada año, ocurren lesiones graves y muertes en los lugares de trabajo como resultado del uso inseguro de gatos hidráulicos, pedestales, elevadores y guinches. No obstante que la responsabilidad de seguridad por estos dispositivos debe compartirse entre el empleador y el empleado, la respon-sabilidad final por la seguridad radica en el trabajador individual. Incluso donde exista supervisión estrecha, el trabajador es quien tiene la última palabra sobre cómo ejecutar el trabajo.
GATOS HIDRÁULICOSLos trabajadores deben seleccionar un gato hidráulico con una capacidad nominal de elevación que equivalga o exceda la carga que soportará. A fin de funcionar eficientemente, los gatos hidráulicos deben colocarse sobre una superficie firme, a nivel y perpendicular a la carga. Si el gato hidráulico se desliza bajo la acción de una carga, los trabajadores quizá no tengan suficiente tiempo para apartarse, por esa razón es necesario colocar pedestales ajustables u otro tipo de soportes sustanciales debajo de la carga para que ésta no caiga si el gato hidráulico se desliza o falla. Los trabajadores deben entender con claridad que nunca de-ben colocarse o trabajar debajo de una carga que esté soportada solamente por gatos hidráulicos. Si el gato hidráulico está doblado o defectuoso, deberá etiquetarse y ponerse fuera de servicio.
GUINCHESSólo los trabajadores con capacitación en el uso apropiado de guinches deben estar autorizados para operarlos. La capacidad de izado del guinche debe estar claramente marcada y ser visible para el operador y los guinches controlados desde la jaula deben estar equipados con dispositivos eficaces de advertencia. Antes de accionar el guinche, los operadores deben verificar que las cadenas o los cables del guinche tengan la suficiente longitud y resistencia para izar o de otra manera manejar la carga de manera segura. En un guinche de cadena, es necesario asegurarse que el gancho tenga un dispositivo de seguridad de manera que si se le da holgura a la cadena el gancho no se soltará. También debe inspeccionarse periódicamente el nivel de aceite en los guinches hidráulicos. Los operadores deben entender que les está prohibido transportar cargas sobre las personas y que deben informar a su supervisor la presencia de cualquier desperfecto del guinche.
ELEVADORESLos elevadores deben estar marcados con el nombre del fabricante, el número de aprobación emit-ido por la División de Seguridad Industrial o la declaración de cumplimiento con las normas ANSI B153.1-1974 (o si hubiera sido fabricado después del 8/17/94, el cumplimiento con la norma ANSI B153.1-1990), y la fecha de instalación. Nadie debe estar en el interior de un vehículo que se elevará y para su propia seguridad, los trabajadores deben pararse a un lado del elevador mientras esté fun-cionando, y deberán asegurarse que las puertas, el capó y el baúl del vehículo estén cerrados antes de elevarlo. La carga debe estar apoyada uniformemente en el elevador y no deberá sobrecargarse la capacidad del elevador. El piso debajo del elevador debe estar exento de aceite o grasa para prevenir peligros de resbaladuras. Es necesario verificar periódicamente los niveles de aceite en los elevadores hidráulicos y deberá ponerse fuera de servicio a los elevadores si existe alguna indicación de desper-fectos.

Mary A. Larsen, is a California General Permit Trainer of Record (TOR), and is offering two courses to meet the requirements of the California State Water Resource Control Board approved training
course as defined by the California Stormwater Quality Association (CASQA) for individuals intending to become Qualified SWPPP
Practitioners (QSP), or Qualified SWPPP Developers (QSD).
This 2 and 3 day course is intended for anyone dealing with Stormwater whether or not they intend to take the exam and become a State Certified QSP or QSD. The QSP course is intended for inspectors
and is focused more on the field application of the General Permit, while the QSD course is intended for those wishing to write and
implement SWPPP's and is also a great source of information for those reviewing and certifying SWPPP's.
