Learning points include conducting internal investigations, properly assessing/evaluating complaints and allegation and appropriately responding to government contacts of interest. The program will provide guidance on avoiding simple regulatory issues developing into a more serious investigations with penalties.

Case examples are presented demonstrating how documentation, assessment and other clinical and operational areas increase risk in litigation and challenges to the defense. Risk prevention evolution are offered specifically related to clinical documentation and communication amongst healthcare providers. Objectives also include identifying challenges with producing from an Electronic Health Record. Changes in what and how information may become evidence in litigation and dealing with medical records and the changing environment will also be topics covered.

The goal is to spark discussion with the audience regarding current problems in resolving Medicare lien and set aside issues and to provide strategies and solutions that have been successfully employed by others for resolving similar issues. By the end of this session, participants should be able to: Implement strategies for effective lien management in litigation, Analyze the need for Medicare set asides in non-workers’ compensation cases, and Discuss realistic solutions to common challenges faced in resolving Medicare lien and set aside issues.

Horne, Esq., Ebanks Horne Rota Moos, LLP The session will discuss standard of care issues in the long-term care and assisted living facilities and how falling below them, with harmless error, can be presented as abuse and neglect. The lecture will focus on defending these types of allegations and methods to prevent them in the first place. The presentation will also highlight true case studies of abuse in addition to those that were called "abuse", but truly did not fit the description.

2:15 p.m. – 3:00 p.m. Readiness or Not, Here I Come – Avoiding Survey Citations and Penalties Kay Wilkes, RN, LNC, Kay Wilkes Consulting This program will increase understanding about the survey process and CMS guidelines. Compliance with the number of standards is decreasing and deficiencies are rising. Highlights of this program include understanding the mock survey process and staff involvement; common deficiencies in nursing home and assisted living and how to avoid them; evaluating clinical and operational records to insure compliance including chart audits; and understanding the survey process.

3:15 p.m. – 4:00 p.m. Risky Business – Setting the Stage Scott Trigg, Underwriting Manager, CRC Insurance Services, Inc. This session will present an overview of the major risks facing the healthcare industry as a result of financial uncertainty, work culture, reputation risk, medical records management, and staffing challenges. Industry members need to shift insurance and risk strategies and find the operational balance with healthcare reform and insuring all risks are priorities for the industry. Attendees will learn about various approaches to insurance plan design.

4:00 p.m. – 4:45 p.m. Walk the Line – Ethics, Law, and Risk Management Moderator: Rebecca Adelman, PLLC, Esq. Panel: Thomas C. Cowan, Esq., Chastiti N. Horne, Esq. Jonathan D. Rubin, Esq. Chastiti regularly speaks on the subjects of long term care and assisted living facility litigation including administrative/regulatory issues. She is a member of Greater Houston Society of Healthcare Risk Management, Texas Assisted Living Association, Long Term Care Committee and Texas Association of Defense Counsel. Kyonzté Hughes-Toombs currently serves as Assistant General Counsel with the Tennessee Department of Health. She has practiced healthcare and administrative law with the Department for five years, and her primary responsibility is advising the Board for Licensing Health Care Facilities. Prior to working for the Department, Kyonzté owned her own solo firm practicing family and criminal law. Kyonzté has also worked for Howell & Fisher, PLLC in Nashville practicing medical malpractice and general civil litigation as well as the Department of Children’s Services practicing primarily employment law. Kyonzte is very active in the community. She is a member of the 2015 Class of Nashville Emerging Leaders, and she currently serves as the President-Elect of the Napier-Looby Bar Association. Kyonzté obtained both her undergraduate and law degree from Vanderbilt University in 2001 and 2004, respectively.

Rebecca M. Mills is a paralegal with Hagwood Adelman Tipton, residing in the firm’s Memphis, Tennessee, office. LEAH T. THERIO, Associate, Cowan & Lemmon, LLP, Destrehan, Louisiana Ms. Therio is an associate with Cowan & Lemmon and practices in the firms Destrehan, Louisiana office. She is a member of the Louisiana Bar Association, the New Orleans Bar Association and the St. Charles Parish Bar Association. Leah's practice focuses on medical malpractice defense with an emphasis on hospital liability. She has gained considerable experience in hospital emergency preparedness through her representation of several local hospitals in connection with Hurricane Katrina-related claims. Leah’s practice areas further include premises liability, insurance defense and automobile liability. She regularly offers seminars on compliance with Medicare Section 111 reporting and lien resolution strategies for litigation. Leah received her B.A. in 2004 from Tulane University and her J.D. from Loyola University College of Law in 2007.

SCOTT W. TRIGG, Underwriting Manager, CRC Insurance Services, Inc., Birmingham, Alabama Mr. Scott W. Trigg is a veteran with CRC Insurance Services, Inc., one of the largest wholesale insurance brokerages in the nation, having started with the company in 2000 and again in 2014. Mr. Trigg is currently Underwriting Manager for CRC’s Professional Liability programs where he manages the in-house long term care and miscellaneous medical programs. Mr. Trigg has more than 17 years in the insurance business and is experienced with many aspects of the industry. A few notable responsibilities during his career include the underwriting, marketing, and administration of a CRC, Inc.-Lloyds of London program; the implementation of ImageRight; and the management of “special” accounts with annual premiums ranging from $600,000 to $1.4 million. Prior to joining CRC, Mr. Trigg was Product Manager of Miscellaneous Medical Facilities with Ironshore and Physicians Underwriter with ProAssurance (formerly Medical Assurance). He earned his Bachelor of Science degree from Auburn University in 1993.

Jonathan D. Rubin is a senior partner with Kaufman Borgeest & Ryan LLP in New York City. His practice areas include Medical Malpractice Defense, Long Term Care and Nursing Home Defense, Health Care, Products Liability Defense and General Liability Defense Litigation. Mr. Rubin represents hospitals, nursing homes, physicians and health care professionals in civil litigation matters in state and federal courts. Mr. Rubin also has particular expertise in the defense of mental health providers and has lectured extensively in this area. In addition to the representation of insured’s in medical malpractice and other professional liability claims, he has also represented physicians and other medical professionals in disciplinary actions before the New York State Department of Health (Office of Professional Medical Conduct) and Department of Education (Office of Professional Discipline). Mr. Rubin has given numerous presentations on topics including the litigation of complex medical malpractice matters and a variety of risk management issues for a wide variety of health professionals. Mr. Rubin is admitted to practice in New York; The United States District Court for the Southern and Eastern Districts of New York as well as the District of Columbia. He is the author of several articles related to health care issues. He is a graduate of Vassar College (B.A., Cum Laude) and the George Washington University Law School (J.D.).

Kay Wilkes, RN, LNC brings over 35 years of clinical experience in acute and long-term care. She is the owner and primary consultant for Kay Wilkes Consulting, a healthcare consulting and training company. She received her Associate Degree in Nursing from The University of Tennessee at Martin in 1977. Kay’s area of expertise and consultation is survey compliance, crisis management, customer relations, staff retention and training, and quality assurance and performance improvement. She has provided educational and entertaining presentations to facilities and professional groups including the American College of Health Care Administrators, Assisted Living Federation of America, National Institute for Health & Human Services, National Health Care Quality Initiative, and Baptist Hospital Healthcare System. Kay has developed comprehensive training programs providing clients with the tools and information needed to effectively operate their facilities. Additionally, she has been a featured contributor to Long-Term Care Survey Alert, a monthly publication providing consultation to government, not-for-profit, sole proprietor clients, in addition to large and small nursing home management companies.

Mr. Weiner is a partner with Kaufman Borgeest & Ryan concentrating his practice on the defense of medical professionals in medical malpractice and negligence actions. His focus is in the areas of skilled nursing, assisted living, home care and ancillary services provided to the aging. He is also a licensed pharmacist. He received his Bachelor of Science in Pharmacy from St. John’s University in New York in 1982 and his Juris Doctorate from St. John’s University School of Law in 1985. He has served as both supervisory and monitoring counsel and as trial counsel. In addition, Steven has lectured considerably to the insurance industry, as well as provided numerous in-service lectures to long-term care providers in matters pertaining to the defense of nursing homes. Mr. Weiner has served as national counsel for several prominent insurers in the long-term care industry and has been retained to audit internal files of insurance companies who specialize in this area. He is a frequent speaker at seminars and before facilities and healthcare organizations focused on aging services, including most recently speaking at the ASHRM convention, which draws thousands of risk managers and insurance representatives yearly to its seminars.
