The discussion focused on the 6 sites that were identified in the scope. The time at adjournment was 1:00 p.m.

Item 1: Approve Order of Agenda Member Hayer motioned to approve the Order of Agenda as presented. The motioned was seconded by Member Bailly. The motion was unanimously approved. Item 2: Minutes: Regular Meeting of October 31, 2014 and Special Meeting of November 6, 2014 Member Thorson motioned to approve the Parking Commission meeting minutes of October 31, 2014 and November 6, 2014. The motion was seconded by Member Hayer. The motion was unanimously approved. Item 3: Introduce New Parking Operator – Interstate Parking Company Planner Joe Nigg introduced Andy Renfrew, Fargo Operations Manager; and Paul Schnettler, Minneapolis/St. Paul, MN Operating Partner. Mr. Nigg stated staff felt the transition to the new management has gone very well and thanked Interstate Parking for their efforts. Mr. Schnettler shared a brief overview about Interstate Parking Company, noting he is based out of Minneapolis, MN and oversees the operations in Minneapolis/St. Paul, Fargo and Duluth, MN. He added another partner oversees their customers in Indianapolis, IN, and also in Milwaukee, WI where their corporate office is located. Mr. Schnettler stated Andy Renfrew will manage the Fargo office along with Darcie Unrau, Customer Solutions Coordinator/Office Manager. Joe Nigg stated that additional items will be discussed by Interstate Parking Company under Item 9 on the Agenda.

Parking Commission January 30, 2015 Page No. 2 Item 4: Update on Ordinance to Allow Enforcement within City Off-Street Parking Facilities Joe Nigg presented an update on a proposed Ordinance being drafted by the city attorney’s office to help regulate illegal parking in City-owned parking facilities located downtown. He explained that current City Code allows parking tickets to be issued for on-street parking violations, and this proposed code amendment will also allow the police department and/or Interstate Parking Company the ability to write tickets for off-street parking violations in City-owned parking lots. Mr. Nigg stated the ordinance was not ready in time for this meeting and therefore in an attempt to expedite implementation it may be forwarded to City Commission without additional review by the Parking Commission. The Parking Commission discussed various enforcement issues such as how much flexibility to provide before issuance of a ticket and issues specific to the operations of certain facilities. Mr. Nigg stated this item will be discussed in more detail at the upcoming Parking Commission Roundtable in February. Mr. Nigg suggested that the ordinance would provide the ability to write tickets but it would be critical for the Parking Commission to establish a written enforcement policy to ensure consistent and efficient enforcement procedures. Item 5: Update on Downtown Parking Ramp Feasibility Study Joe Nigg updated the Board regarding the status of this study being conducted by the consulting team of Helenske Design Team, and Carl Walker Inc., contracted by the City in November 2014 per the Board’s recommendation and approval by the City Commission. He stated the five (5) sites included in the study are: the Goodyear/ Warner Site; 2nd Avenue North/2nd Avenue South Lot; St. Mark’s Lutheran Church; half of the City Hall Quadrant; and the Civic Center Ramp. He explained the contract is split into the following three (3) phases: Part A – Multiple Site Evaluation; Part B – Schematic Design; and Part C – Architectural Services. Mr. Nigg stated there will be preliminary analysis presented to the Parking Commission in early March for review. Chairperson Commissioner Williams stated he felt the NP Avenue Lot should be added back into the feasibility study. Member Thorson concurred. Member Walvatne motioned to include the NP Avenue Lot as part of the Downtown Parking Ramp Feasibility Study by Helenske Design Team, and Carl Walker Inc. The motion was seconded by Member Bailly. The motion was unanimously approved. Item 6: Update on City Proposal to Lease Existing Surface Parking at 223 Roberts Street and 229 Roberts Street Joe Nigg updated the Board on the proposal submitted by the City in August 2014, to the Dillard LLP Trustee requesting to lease these two surface parking lots. Mr. Nigg stated staff has been notified that the City’s proposal was not accepted and there have been no counter-offers. Item 7: Update on Civic Center Lot and City Hall Plans

Parking Commission January 30, 2015 Page No. 3 Joe Nigg referred to a memo regarding the upcoming construction of the new City Hall, and the loss of parking spaces once the Civic Center Lot is completely closed. He reiterated the effect this will have regarding parking for City staff, and added it will also affect parking for Board Members and the public when attending meeting hearings. Mr. Nigg stated staff has proposed some options which will be further discussed at the upcoming Parking Commission Roundtable in February. Item 8: Review Parking Services (John Rogne) December Monthly Report Joe Nigg presented the December 2014 report. Mr. Nigg stated there is a need for a more robust data management tracking system to provide an accurate picture of the City’s downtown parking activity both on-street and in City-owned lots. Item 9: Interstate Parking Company – Operator Report Fargo Parking Operations Manager Andy Renfrew reviewed some of the changes they have put in place over the last month. Mr. Renfrew highlighted they have started the process of placing new signage in the lots for the public’s convenience and awareness, and the recent implementation of credit card processing at all parking booths. Item 10: Other Issues or Public Comments a. February Parking Commission Roundtable – Tuesday, February 17, 2015 from 9:30 a.m. to Noon, City Commission Chambers. Joe Nigg noted the upcoming Parking Commission Roundtable will be an effort to bring together city staff, Interstate Parking Company, and the Parking Commission to discuss and explore various topics and items relating to downtown parking. Mr. Nigg referred to a packet he gave to the Board containing written complaints staff has received regarding the increasing issues with downtown parking. The Board further discussed the importance of addressing these issues, educating the public, and being more accessible for questions concerning parking. The time at adjournment was 9:08 a.m.

MEMORANDUM

TO: Parking Commission FROM: Joe Nigg, Planner DATE: February 20, 2015 RE: Discuss Implementation Plan for Phase II, On-Street Time Zone Concept Background. At the October (2013) retreat the Parking Commission spent a significant amount of time discussing and exploring a range of issues and priorities. The highest priority identified (at that time) focused on the development of an on-street parking strategy that would simplify the system and make better use of underutilized on-street capacity in ‘fringe’ blocks. The 2012 Parking Evaluation Study and 1999 Downtown Parking Study strongly indicate that there is a need to simplify on-street parking in the downtown area. In 2014 the Parking Commission worked to develop the on-street concept and it was discussed at the January, March and September meetings. In general, the concept transitions a majority of the on-street parking to 4-hour time zones other than Broadway and Roberts Street which would remain 90 minute zones. There would also be a few pockets of 2 hour time zones in a couple specific areas. With this concept, the re-park ordinance would continue to apply and in regards to the 4-hour time zones a vehicle would still need to move at minimum once per day. In September (2014) the Parking Commission initiated implementation of “Phase I” which included the area from 5th Street to the Red River and from the railroad tracks to 2nd Street S. Phase I was identified as more of a trial, since limited public input and outreach had been completed. The trial period allowed the city the ability to monitor the change and look for any unforeseen issues – before pursuing implementation of the entire concept within the downtown core. Phase I was completed in December (2014) and by all accounts it appears the change is working as anticipated. As a reminder, the rationale for these rather aggressive changes included the following considerations:

- A majority of the ‘fringe’ blocks have an on-street utilization number at or well below 50%. - A majority of city owned parking facilities are at or over capacity. In addition, some of the hourly

parking that is currently handled off-street in city lots (civic, GTC, 2nd Ave S) will be reduced or removed to accommodate additional renters in the near future.

- Complexity of the existing time zone system (see attached map). - Consistency and efficiency from an enforcement perspective. - Ability to reduce or supplement hourly parking needs within the Civic Center Ramp. - Supplemental ‘longer term’ parking that is proximal to the downtown core.

Next Steps. At this time, the Planning Department would like to start working through a process to complete the vetting of Phase II which encompasses the remainder of the downtown core (see attached exhibit). City staff would like to pursue a formal public input opportunity and presentation within the next month or so, in cooperation with the Downtown Community Partnership (DCP). The Parking Commission utilized a task force to assist in the development of this concept which included representation from the business community, police department and DCP. Staff would like to additionally re-engage this group as part of this process.

TO: Parking Commission FROM: Joe Nigg, Planner DATE: February 20, 2015 RE: Review draft Ordinances to Allow Enforcement within City Off-Street Parking Facilities Background. The City owns and operates eight (8) surface parking lots and three (3) structured parking facilities which equates to approximately 2,000 off-street spaces. Six (6) of these eleven (11) facilities are gate controlled; however, only the Island Park Ramp and GTC garage have access control 24/7. Over the years, parking enforcement within city lots has been handled with a ‘warning’ citation that was issued by Parking Services and placed on the offending vehicle’s windshield; although this approach rarely served its purpose as illegal parkers quickly learned that there was no resulting penalty even after numerous warnings. On a rare occasion, the City and Parking Services would tow a vehicle and in the last two years I can think of only one such example. Although always an issue in certain facilities (specifically the 2nd Ave N, 2nd Ave S and NP Avenue lots) the issue of addressing illegal parking within city off-street lots has more recently become extremely problematic in particular as facility occupancy rates have reached or exceeded 100%. City Code allows parking ticket issuance for on-street violations; however, a code amendment will need to be completed in order to allow enforcement within off-street facilities. At the February 17th meeting the City Commission authorized the city attorney to draft the applicable ordinance amendments. Attached are the two (2) ordinances as prepared by the city attorney. Together, these ordinances will allow the city the ability to write tickets for illegally parked vehicles in city parking lots. To summarize: Ordinance Amending §8.1006 – This ordinance would effectively amend Section 8.1006 of the

Municipal Code and would allow the city the ability to write parking tickets in off-street parking facilities where time-limit parking is posted. Examples would be the Library surface lot or future City Hall surface lots.

Ordinance Enacting §8.1006.2 - This ordinance would enact a new sub-section within Section 8

of the Municipal Code which would allow the city the ability to write tickets in off-street parking facilities where a “permit” would be required – or in other terms, city facilities that accommodate contract and hourly parking.

The ability to write tickets in off-street city lots will be a significant system improvement and will increase the efficiency and effectiveness in terms of facility management. The city has periodically received complaints about illegal parking in certain lots; however, within the last year these complaints have been much more prevalent. Recommendation. To recommend approval to the City Commission the attached ordinances.

AN ORDINANCE AMENDING SECTION 8-1006 OF ARTICLE 8-10 OF CHAPTER 8 OF THE FARGO MUNICIPAL CODE

RELATING TO TIME-LIMITED PARKING ZONES

WHEREAS, the electorate of the city of Fargo has adopted a home rule charter in accordance with Chapter 40-05.1 of the North Dakota Code; and,

WHEREAS, Section 40-05.1-06 of the North Dakota Century Code provides that the City

shall have the right to implement home rule powers by ordinance; and, WHEREAS, Section 40-05.1-05 of the North Dakota Century Code provides that said

home rule charter and any ordinances made pursuant thereto shall supersede state laws in conflict therewith and shall be liberally construed for such purposes; and,

WHEREAS, the Board of City Commissioners deems it necessary and appropriate to

implement such authority by the adoption of this ordinance; and, WHEREAS, the city of Fargo seeks to regulate parking in publicly owned or operated

parking lots and ramps. NOW. THEREFORE,

Be It Ordained by the Board of City Commissioners of the City of Fargo: Section 1. Amendment. Section 8-1006 of Article 8-10 of Chapter 8 of the Fargo Municipal Code is hereby amended to read as follows:

Ten-minute, fifteen-minute, thirty-minute, sixty-minute, ninety-minute, one hundred twenty-minute, or other time-limited parking zones Time-limited parking zones. Except as otherwise allowed by a permit issued by the Department of Planning and Development for the Downtown Residential Parking Zone as authorized below, the owner or driver of any motor vehicle of any kind whatsoever shall not cause, permit, or allow such vehicle to be parked or to be re-parked within the same block, or within the same off-street parking lot or parking ramp owned or operated by the city of Fargo, for a period longer than the time limit restrictions posted for such area.¶ For purposes of determining a violation of this ordinance, a vehicle shall be considered to have remained parked or to have been re-parked within the same block, lot, or ramp when it is established to by a preponderance of the evidence that the same vehicle has been found parked along either side of the same street or road between two intersecting roads, or has been parked within the same lot or ramp at any time within a four hour period, regardless of any evidence that the vehicle was moved between the time it was initially parked and later re-parked. Each 10-, 15-, 30-, 60-, 90-, 120-minute or other time-limited period during which the vehicle is parked shall constitute a separate and additional violation of this section.

The Parking Commission, subject to the review and confirmation of the board of city commissioners shall post the time-limited parking zones on city streets, except for time-zones located on the campus of North Dakota State University in which case the University shall post the time-limited parking zones. The Parking Commission is hereby authorized to establish and post hourly rates for parking in publicly owned or operated parking lots or ramps. Hourly parking rates in publicly operated lots and ramps shall be approved by resolution by the board of commissioners. The police department or its designee shall enforce such time zone restrictions in areas which are so posted.

The Parking Commission may, if in their its judgment traffic conditions so warrant it and subject to review by the board of city commissioners, may extend, change, or adjust the parking zones designated herein, provided said extension, changes, or adjustments are posted or marked.

The Department of Planning and Development shall be authorized to issue a permit to residents of the Downtown Residential Parking Zone in accordance with an approved program as adopted by resolution of the board of city commissioners.

Decisions of the Parking Commission are subject to review and confirmation or approval by the board of city commissioners by request of any interested person submitted in writing to the director of planning and development within ten days of such decision.

Section 2. Effective Date.

The Parking Commission is hereby authorized to establish permit-only parking zones located in off-street parking lots or ramps owned or operated by the city of Fargo. The fees for such a parking permit shall be approved by resolution by the board of commissioners.

Section 2. Effective Date.

TO: Parking Commission FROM: Joe Nigg, Planner DATE: February 20, 2015 RE: Discuss Implementation of Digital Pay Stations at NP Avenue and 2nd Avenue Lots As part of the process to secure a new parking management company and as part of contract negotiations all parties were operating under a certain set of assumptions in regards to how long the system would need to be run “as-is” and when transitions to automation at certain facilities would be pursued. The contract with Interstate Parking Company (IPC) is written with a defined management fee for 2015 with a condition that requires the removal of the civic surface lot by June 1st. If the civic lot is removed, the management fee for the preceding years (2016 and 2017) is reduced. In addition, the contract includes a commitment by IPC to fund up to $33,897 in automation improvements – which were specifically contemplated for the NP Ave and 2nd Ave lots. The 33K basically covers the placement of 3 Luke II digital pay stations. The overarching assumptions were such that the system would continue to operate “as-is” for the first few months and eventually the city (with IPC’s guidance) would remove the attendant booths at both NP and 2nd Avenue and a booth would only be retained at the Civic Center Ramp. As discussed at the roundtable meeting on February 17th there are a number of issues and details that need to be addressed before digital pay stations could be implemented at these locations. To identify a few:

1. Off-street enforcement needs to be available and the applicable policies need to be formulated; 2. Validations; 3. Coordination with adjacent property owner (NP Ave); 4. Education and Outreach; 5. Need to ensure that the investment aligns with an overarching vision or with system guiding

principles. It is evident to city staff that establishing the ability to implement technology at these locations is going to take some time and will probably be a multiple-month effort. Attached is the analysis that was reviewed by the Public Works Project Evaluation Committee (PWPEC) in early February. Note that only the exhibits for 5th Street are included in the packets as the 4th Avenue modifications are not being pursued any further by the Engineering Department. The city’s traffic engineer, Jeremy Gorden, will be present to review this analysis with the Parking Commission.

Joe Nigg, Planner DATE: February 20, 2015 RE: Discuss Proposed Downtown Shuttle / Circulator Route With the pending closure of the civic lot and given the limited off-street parking to accommodate the needs of city hall and other businesses in this sub-area; the city has been discussing a circulator route concept with the City of Moorhead and the Moorhead Center Mall. Attached is an exhibit which depicts the possible route alignment and the associated designated stops. The route would operate under a fifteen (15) minute headway and the concept would make use of existing parking within the Moorhead Center Mall ramp. The City of Fargo would provide the bus and operate the route and parking would be free at the Moorhead Center Mall ramp. The concept remains preliminary and there are no formal agreements in place at this time. City staff would be looking for any feedback on this concept from the Parking Commission.
